Something has intrigued me about the timing of the SA's announcement that they were going for DP. I choose to believe (hope, really) that they have a semi-smoking gun, say a smoldering gun. Here's my question and hope it makes sense: If there were a smoldering gun, is it possible both parties know what it is but is sealed for trial? Is it possible prosecution is still "analyzing" it?

I don't read here every day so sorry if this has been brought up, and also sorry if it shows my ineptitude. lol

I think it is absolutely possible; although the defense may not know what it is, at least not yet. There is a good reason the state put the DP back on the table.

RH with great repect for a trial attorney, please apply the following to KC.. TIA
"I think most people charged with a crime are guilty; however, they are usually overcharged or the state is being unreasonable it its prosecution. In such a case my goal is to obtain the best resolution possible. "

Could something still be being tested at this point and can't be released because the state themselves have not gotten it back?

Please don't take offense as I didn't mean it to be. I am a database manager and don't work for free either. I certainly wasn't asking about KC or her family, but the friends of KC that seem to be college students. I wouldn't expect you or any defense attorney to always work for free. Emotions are involved in my job though, and I was just wondering because of your dollars and cents comment if you ever took cases because you were emotionally involved in the outcome?

O/T...You watching the Gator game?
Okay let me rephrase, the only value of taking on a witness as a client would be media exposure. However the value of the time that would have to be given to representing the witness would far outweigh any tangential media exposure it would bring.

Yes, Touchdown Aaron Hernandez - GO GATORS!:croc:

I heard she was offered 8 years for everything before they found the body; I would have applied my recommendation that she jump all over that...

OMG...8 years?, with the charges though at the time...understandable..
Lets just say she would have took it, then months later they found the body..
What would have happened next? Would double jeopardy come into play?

BBM

And would like to add, Mr. Hornsby, what are your feelings of a defendant, with no remorse, someone who is just void of any feelings for the crime of which they are accused?
If they are found guilty or admit their guilt - the same as you. I just believe every person is entitled to their due process before I pass judgment.

Why do you think Nejame resign from representing the Anthony's?

I think beyond big mouths there was more which involved KC.

I also think Baez made statements that are not privledge in front of them (Opinion only).

What is your take on this, including the fact that conway's office is down the hall from najame....

I understand that you cannot document that in any way and we do take it in the spirit it is being given. But I am wondering how accurate you think that is?

It's a heard, attorneys talk, it can't be documented..Attorneys do talk...

But you either apply it, discount it, throw it away or take it with a grain of salt.

I heard it from three different sources. But none of my sources was directly with the State or Defense. So to be clear, what I heard was hearsay.

In my employment, I was referred to as the breaker. You make it, I break it.

I never intended to be parallel to you, but it seems I have been.

So now, cuz you aren't in court, what breaks you?

ps I know you can't answer that....

Scary thought, Caylee's killer could have walked with only 8 years..

WOW! Eight years! That just blows me away!
Mr. Hornsby, do you think Caylee will ever get the justice SHE deserves?
