Ray says Misty wouldn't qualify for youthful offender status.

here is the Florida Law: Qualification

Pursuant to section 958.04, F.S., the court may sentence as a YO any person:

(a) Who is at least 18 years of age or who has been transferred for prosecution to the criminal division of the circuit court pursuant to chapter 985;

(b) Who is found guilty of or who has tendered, and the court has accepted, a plea of nolo contendere or guilty to a crime that is, under the laws of this state, a felony if the offender is younger than 21 years of age at the time sentence is imposed; and

(c) Who has not previously been classified as a youthful offender under the provisions of chapter 985; however, a person who has been found guilty of a capital or life felony may not be sentenced as a YO under the Youthful Offender Act.

Inaproppriate sexual behavior...sounds like someone in the Kyron Horman case.

So does she qualify ?

It appears as thought Misty meets all the requirements for Youthful Offender in Florida. However, I have been unable to find information about eligibility for a person charged with EIGHT felony counts. That right there might disqualify her, but it is not stated one way or the other in the guidelines. I do believe Fields is going to try for Youthful Offender anyway. It would be a good move on his part--the judge just might allow it given Misty has no priors.

All JMO so take this with a grain of salt.

I'm thinking it's because she has eight felony charges which include drug trafficking, some are mandatory 25 yrs minimum. Hope *could* have been eligible for Youthful Offender *IF* the judge would have been extremely lenient, except for her attitude and those pesky mandatory minimum rules. Misty also has an attitude problem and they have similar proof of that, as they had with Hope - those infamous jailhouse tapes. Let's not forget Misty hasn't been an angel while in jail, she's even contacted the governor with her childish complaints!

I guess it just depends on how they handle it, how she handles herself, plus those danged drug bust videos with Misty riding shotgun, giving orders to the undercover, RC, and anyone who would listen. "BAYBEEEEEE, he says he doesn't want to do it here." What were her instructions about exchanging the drugs in the bathroom? Not her first time.

The prosecution will find lots of reasons for her NOT to be considered as a youthful offender. Many youthful offenders just go along for the ride. Misty was trying to be head honcho. I think this is what Ray is talking about. :cow: :cow: :cow:

after watching Ron work these mandatory minimums down from about a thousand years to a few, I have a hard time believing in the words 'not qualify'. so much for the words 'mandatory minimum'.

That Bathroom plan should prove these people are missing dots on their dominoes. WTH was that all about? The UC must have been laughing to himself...are these people for real? Misty was certainly not any near close to being a drug dealer/runner. That was the stupidest exchange I ever heard to obtain drugs.

I don't think trafficking drugs can qualify anyone for a youth offender program. They take trafficking VERY seriously. I think misty has many 3 yr term charges. I have to go look it up.

On Aug 6 or so WBG is going to be sentenced. It will be interesting to see which charges they knock off for him.

Whisp, you are right...Misty has two charges that are 3 year minimums. One charge is a 15 year minimum and another one looks like it might also be 15. The rest are 25 including the one in St. Johns.

But she would still go to prison for 25 years minimum.

Fields will try for Youthful Offender, though. He would be a fool not to try.

ETA: And on that note, I am going to delete my post about Misty's eight 25-year counts since I didn't do my homework prior to posting it. Good catch, and thanks.

3 = 3yr
2 = 15yr
3 = 25yr.

IMHO.. Alot of similarities when you think about it..... I highly suspect Ron C and TH are cut from the same cloth....JMO
