Self-Defense

And the Defenses "GOAL" is to raise reasonable doubt in the mind of the jurors. Her lawyers are using an affirmative defense to excuse or justify Jodi's criminal actions. This is what scares me a little bit. There is always a slight chance that at least "one juror" might feel some sympathy for JA and hold out for a 1st degree murder as opposed to the death penalty that is authorized by law in a Capital case. Just sayin

The burden of proof is MUCH LOWER for the defense because any affirmative defense that is raised by the defendant has to be proven by the weight of the evidence. Where as the burden of the prosecution is MUCH HIGHER. The State has to prove beyond any reasonable doubt that Jodi committed premeditated first degree murder and that her self defense theory is all bullchit LIES.

I just hope the jury can see beyond all the sex, lies and audiotapes. We all know this whack job planned this entire murder. She was obsessed by TA. She wanted everything he had. She wanted to be his wife, and live his life. If she couldn't have him she was going to make damn sure nobody else had him.

I was concerned about that ONE question but one question in a sea of hundreds that support the State doesn't bother me. I could see a question like that coming in to cross the T's and dot the i's.

I was talking about more what I see visually in the courtroom. NONE of them are looking at her. There is some cheeky footage I've seen shown where it looks like she and Wilmott are watching a juror and having some kind of connection and smiling. I can guarantee you (as I was right there that day watching that whole deal go down) they were NOT engaging with a juror. Not sure what they were finding so amusing or whatever but it wasn't any kind of "look" or anything else w/ a juror. That's all I meant.

There was that story of the expert who changed his mind on the stand. I can't find it off-hand but will keep looking.

Basically the prosecutor asked the expert if he'd had more information about the defendant and his wife (whom he killed), would he have changed his opinion? The doctor said yes. That's what I'm hoping for.

That was in OUR case. The defense expert Dr. Vincent DiMaio ended up flipping and identifying the defendant as the sole killer of my sister (although he wasn't the only one, just DiMaio tried to argue there was a sole killer and she flipped him to "if that's true then it's THIS one isn't it?" and he said "yes"). Thanks to the brilliant research and cross examination of our prosecutor the incomparable Catherine Hughes.

If I were a juror, while she was on the stand I would have looked her in the eye and smiled brightly and move my head like I'm intently listening. IMO, it might lead to her thinking her BS is selling and feel confident enough to make them larger. JMO

I understand we all feel bad for TA's family, but she's right. There are a lot of worse murders out there. I think what's making people so angry is that it's always the current in the news.

So what? Is this not the one we are addressing and reacting to? There's always something worse out there. I don't see the point.

I was in a motorbike accident in '04 (Thailand); suffered multiple facial and head fractures. Had 4 reconstructive surgeries.

And I remember it all too.

BTW...re: the Arias trial...I have PTSD as a result of a horrible car accident and I can tell you that I remember EVERY second of it.

I'm sure this has been discussed but...
Were Travis' roommates gone all week until they discovered his body? I heard they believed he had already left for Mexico, but were they away those 5 days too? Did the roommate expected home at 6 pm on the 4th actually come home?
If they did come back during the 5 days before he was discovered, what about the laundry? Seems like they would have used the washer/ dryer at some point for their own laundry, yet Travis' laundry was left in both the washer and the dryer all that time.

I think Samuels thought he would skate on his charm and projection of authority. He never expected to be asked for raw data, because as Wilmot said, what do attorneys know about raw data. The DT did not expect this, I'm thinking. Ha!

Wasn't it something like 2600 calories a day? I know they said the stew was made with soy (not meat). I would think that would cover everyone unless you had a soy allergy so that special meals do not have to be provided. jmo

all of you do not have to agree on whether it was &#8220;premeditated murder&#8221; or &#8220;felony murder.&#8221;

They don't all have to agree it is premeditated. Some can think it is and some can think it is 1st degree murder. In sentencing JA will still be facing the DP or LWOP.

And another thing that has been driving me crazy. She was living in N California and working at some seasonal restaurant < always a restaurant,.....And she just up and quits her job and moves to Mesa AFTER they break up? She told Flores it was because "plans were ALREADY in the works", and she was moving in with a friend. PLEASE. There were no plans. The girl she moved in with kicked her OUT after a week or so. She had NO where to live, NO job. She moved there because and only because she was OBSESSED with TA and she could watch/stalk his every move.
