Here’s an update that makes me want to throw up …. His victims have to be so upset by the possibility of him getting away with this in 4 weeks.

***Keep in mind, he refuses to give another dna sample to prosecutors because why? guilty.

Perhaps they (ETA: the DNA testing lab) lost the original sample and are trying to avoid admitting it as long as possible. They don't sound very organized nor professional. Such a pity this very important job was given to them. All just my personal opinion.

I feel like I’m missing an important piece to this puzzle (or I’m not smart enough to follow along).

Even if….DNA is missing and / or he refuses to give new samples, why can’t they just take it like before (ie out of his trash or however the previous sample was used)? Even if he is super vigilant in not taking trash out, assume there has to be officers smarter than he is? And, how can a defendant refuse anyway?

This is what I think is going on.

If we go back to the beginning of the case we find a couple of threads we can pull together to get a complete picture.

First, Nilo's case was made through an investigation from a special task force that received a grant to look at untested rape kits and find serial rapists: Specialized Boston police sex assault unit marks first conviction

Fun fact from that article: Boston police alleged in their grant application that there might be as many as 200 unidentified serial rapists in the area.

Anyway, if you think of the case against Matthew Nilo as a wall that is built up brick by brick, the first "brick" in that wall was the discovery that the DNA showed the same unknown person was responsible for all of the North End/Charlestown rapes. Not all of the cases had equally "good" DNA to work with, apparently. LE took a small amount of DNA that they thought would yield the best results at finding the identify of the rapist through genetic genealogy, and they sent it to a laboratory called Bode, which then subcontracted the work to Gene by Gene. That laboratory came up with the next brick in the wall - a genetic profile for the rapist that was then used to build out family trees until they identified a possible lead, which wasn't enough, on its own, to arrest anybody. But investigators were able to tie together other "bricks" like the age, the description, and the fact that he lived in the North End all lining up. At that point, the surreptitious collection of DNA from his glassware/tableware at the work event would provide the last piece of the puzzle: does DNA collected directly from Nilo actually match the DNA that came from the crime scenes? Once testing of the secretly-collected discarded glassware proved a match, the brick wall was complete and probable cause for his arrest existed.

His defense attorney in the beginning of the case (a different one than is there now) said that the collection of the DNA sample from the discarded items was unconstitutional. So they are asking for more information about how the genetic genealogy match was originally made, and prosecutors have not yet been able to turn that over. But they are going to challenge it on privacy laws and also on the warrantless collection of the "discarded" DNA. In essence, they want to knock the whole wall of the case down by targeting just one of the original bricks against Nilo.

The outcome is important because there are a lot of other task force cases in MA that are riding on this same technology.

I think the judge needs to order a warrant for his DNA rather than this pro defense approach. If someone was innocent of these heinous crimes and allegations, wouldn’t you just offer your DNA willingly to squash the issue? That’s where my mind set keeps taking me. Instead of brilliantly proving your own innocence and squashing the matter sooner than later, he chooses to look at the judge with the “who, me?” look and ride on the prosecutions unfortunate luck.

I am praying that law enforcement issue a warrant for it in Houston. Blows my mind with this whole dropping the ball.

I’m new to the case and following along. Reading one of the old articles, I would just like to say the composite artist who created the sketch below was a genius. Such an eerily close likeness. IMO.

Labs like this are often not as large or sophisticated as you might think. There may be only a few employees and 1 or 2 critical employees who make everything work and know where to find things. We encounter the same issue with small outside labs (where they may not respond because the contact is on vacation for 3 weeks).

In any event, I am sure LE is visiting them this week in person.

More concerning is why it would be an issue at all. So what if the original sample might have led police in other directions, the direction it did lead them in was this guy and his subsequent DNA sample was consistent with high degree of statistical certainty. That can't be an accident and no re-analysis is going to negate that.

It has been over a month. Was the prosection able to find the dna sample? Has the defense made a motion to dismiss? Does anyone have updates?

We need more coverage because this is still so incredibly important for his victims. They do not deserve to be forgotten. Along with the rest of society.

Remember last Halloween, he was due in court? He still gets to dress up as himself tonight, an alleged serial rapist.

I think I’m going to try Debbie at NBC Boston on Monday and see if I get lucky. A few weeks ago I called again but she was in a meeting. Happy beginning of November to everyone. Let’s get more answers this month!

Gee I wonder if he's still with his "glamorous" (per the DM) fiancee. Have they set a wedding date yet? I want to plead with her, "Run, girl, run hard and run fast!"

It's pretty obvious the reason why he doesn't want to submit his DNA. If he can stall this long enough, maybe he could make a run for it. Nilo reminds me Alex Kelly in some ways.

His victims deserve justice.

My apologies for the delay of an update, the election was why I postponed my call to Debbie a bit.

Fear not, I have updates as I just got off the phone with her at NBC Boston! I stayed on hold for 15 minutes and forgot I was even on the phone but it was worth it.

1. Prosecutors finally heard back from the lab in Texas and came up with the evidence by the 30 day deadline. Therefore, the case has not been dismissed.


2. Matthew Nilo is due back in court for a status hearing on December 17th, 2024.

3. His finance is still by his side and continues to show to every one of his hearings, confirmed by Debbie.

Saw that Matthew Nilo had a status review for his cases today in Boston. Not clear yet if anything came of it but I’ll keep an eye out! I’m praying for justice in these cases.

Unbelievable. I thought I'd seen everything, but this whole case is absolutely ridiculous.
