The defense attorney for the alleged killer in the Baby Doe child murder case may file an emergency appeal to the state’s highest court to delay the trial’s scheduled start on Tuesday after a Superior Court judge yesterday ordered him not to reference bizarre diary entries written by the state’s star witness, the girl’s mother, in his opening statement.

Saying Bond is “incredible and unreliable,” Shapiro yesterday sparred with Judge Janet Sanders over whether he can discuss Bond’s claims in the diary — called “Mama’s Dream Journal” — that she fought off a fake policeman who tried to rape her, and smashed a man in the head with a 45-pound barbell. The stories, Shapiro said, show
Bond “was not afraid of anybody.”
Bond also described numerous bizarre images from her childhood in the diary, Shapiro said, including a young woman being tortured in a fiery pit that the lawyer argued “falls into the category of bizarre, satanic beliefs.”

Shapiro may still be able to bring up the diary when cross-examining Bond and said he will decide over the holiday weekend whether to file a petition with the SJC.
A panel of nine women and seven men, only two of whom have children, according to the defense, is set to hear the case.
