that is a recent law change for non violent or drug offenders. (recent meaning I stopped working in corrections in 2005 )

Although in OC CA prisons are overcrowded and some inmates are serving their prison sentences 6 years and less in the county jails. I visited a friend in Theo Lacy Jail and two inmates in his pod had been there 5 yrs
