Missing Lynn boy case continued pending DNA report

The case against Ernesto Gonzalez, the Lynn father charged with parental kidnapping and willfully misleading police in the disappearance of his 5-year-old son two years ago, has been continued until next month pending a DNA report from a forensic testing laboratory in Texas.

[snip]

Lu continued the case to Sept. 22 for a further DNA status report, as agreed by both the prosecutor and defense. Investigators claim traces of the boy's blood were found on a knife, on a piece of wood flooring, a cleaning liquid cap and the bathroom threshold in Ernesto Gonzalez's apartment.

Investigators took more than 30 samples from walls and objects inside Gonzalez's apartment.

Missing boy’s father considers plea deal

Posted by David Pierce, Boston.com Staff November 26, 2010 08:38 PM

By Maria Sacchetti, Globe Staff

The father of a missing East Boston boy is considering a plea agreement in connection with the child’s 2008 disappearance during a weekend visit in Lynn.

The development, disclosed this week in Essex Superior Court in Salem, could mark a significant shift in a case that has frustrated investigators since Giovanni Gonzalez, then 5, disappeared during a scheduled visit with his father, Ernesto Gonzalez, in Lynn.
......................................

The 38-year-old former meatpacker has since pleaded not guilty to charges of parental kidnapping and misleading police and is being held without bail in Essex County jail in Middleton.

Giovanni’s mother, Daisy Colon, urged authorities yesterday to fight a possible plea until Giovanni is found. She said a reward is still posted for the boy’s safe return.

Grandmother of missing boy torn by hope, fear

Says she wants son to tell truth about fate of Lynn youth

PATILLAS, Puerto Rico — She emerges in a flowered housecoat from her fenced-in house, in a remote corner of this Caribbean island where roosters and horses run wild. For two years, relatives have begged her to return to Massachusetts to visit her son in jail, to persuade him to solve the mystery of the missing grandson she never knew.

But Lydia Gonzalez will not budge.

“He’s a grown man,’’ she said in Spanish, in her first interview since her son, Ernesto, was accused in the August 2008 disappearance of his then 5-year-old son, Giovanni.

“He doesn’t need his mother to tell the truth.’’

Video at link with reporter who interviewed Giovanni's grandmother:

ETA: As the guy at the end of the video said...it's very rare for a reporter, two years after the fact, to go track down the grandmother of a missing child in a foreign country to get an interview. Kudos to her, and I hope she continues to keep his story out there.

I wish this mother would get the truth already! Enough of this man playing games, even behind bars he has some control.

Lawyer: Missing Lynn boy's father had same rights to child as mom

The lawyer for a Lynn man whose son has been missing for more than 21/2 years asked a judge yesterday to dismiss a parental kidnapping charge against Ernesto Gonzalez.

Defense lawyer Christopher Skinner argued that absent a formal custody order from a judge, his client is presumed to have the same legal right to the child as his mother, and that without such an order in place, grand jurors lacked any legal basis to indict Gonzalez on that charge.

[snip]

Salem Superior Court Judge John Lu granted prosecutors additional time to file another response to Skinner's motion and said he may rule on the motion at the next hearing in the case on June 1.

The parental kidnapping charge carries a penalty of up to five years in state prison; the other charge faced by Gonzalez, misleading investigators, carries up to a 10-year state prison term.

It must be horrible for this mom not to know where her son is, even if he has passed away... :(

:rose: Giovanni is our current Spotlight Case :rose:

This case makes me so angry. How can a person just "misplace" a five year old and not have commited a crime? There has to be some kind of justice for Giovanni and some kind of recourse for his mom. Grrr!!!!!

Thanks for spotlighting Giovanni. <3

Hoping for answers for his mom. :(
