"Getting duped"​

Daniel Wolfe and Andrew Rentschler, two experts who work for ARCCA, an expert engineering and crash reconstruction firm, were called by the defense as witnesses in Read's first trial. They testified that O'Keefe's injuries were not consistent with being hit by a car.

Read's lawyers said at the time that the crash experts were not hired by the defense. But before court was suspended Tuesday, Brennan told the court that he had obtained a bill from ARCCA to the defense for $23,925. He also said there are emails between Read's team and the ARCCA experts, with Wolfe telling the defense in one instance "if you don't want me to say this, that's fine."

"That's not trial by ambush, that's getting duped," Brennan said.

What was revealed today is incredibly serious. Now, the Judge must determine whether there was a fraud perpetrated on the Court by the defense team. As officers of the Court, lawyers have an ethical duty to act with honesty and candor.

Prosecutors filed a motion looking to keep two experts ARCCA off the stand in the second trial. Special Prosecutor Hank Brennan says the state and the court weren’t given full disclosure about the experts. In the first trial, he says the commonwealth was never told the defense was paying the experts $23,000 and collaborating with them on their testimony.

”I don’t care about their opinions, but I care that it’s unfair, imbalanced and hidden, and the commonwealth like the defense is entitled to discovery," Brennan said Tuesday.


 
Read’s defense team has expanded since her first trial, and her attorneys have petitioned to add another lawyer to their counsel table. Robert Alessi was retained last year, and now Read has petitioned the court to allow her to add New York-based attorney Mark Bederow. Brennan said he would not oppose Bederow’s addition to Read’s team, but alerted the court to Bederow’s connection to blogger Aiden Kearney.

Kearney, also known as Turtleboy, was indicted on multiple counts of witness intimidation related to Read’s case. Brennan said that he is concerned about a “history of a symbiotic relationship” between Read and Kearney’s attorneys, accusing them of giving each other mutual assistance and sharing documents in violation of protective orders.

"The court is very troubled by the ARCCA experts and whether that information was properly disclosed, whether there was an attempt to mislead the court, specifically Judge Cannone when she asked questions about whether had counsel spoken to these experts," said NBC10 Boston legal analyst Michael Coyne. "And also about the question about the payment of their fees and the like."

He adds that it's too soon to know how serious the matter is, but Cannone's concern suggests she will dig deep into the issue.

"It could be somewhat of a misunderstanding but it also could be a much more serious matter where the court may have to intervene and potentially even take steps as drastic as limiting the roles of these attorneys who have been admitted to the court," Coyne said.

I'm not saying they're not qualified witnesses but it certainly shows some bias

I've turned over a lot less in this case than this

Would be fair to say because you had a lot of nighttime visitability work your cases frequently involve pedestrians

Yes unfortunately there is a direct correlation between the time of day in pedestrian fatalities

statistically speaking most pedestrian fatalities occur during the evening and night hour


That would have been nice to have

So my specialty in the area of lighting and human factors results in a lot of my cases involving pedestrians

And then a bill from ARCCA to the defense for $23,925

That's not tramble, that's not trial by ambush, that's getting duped

So I didn't know any of this, but I've tried a few cases
I've been around the federal court a little bit
I know how it works

Sometimes parties pick sides

creates an imbalance and unfairness and then it allows the ability of one side to use ghosts

they create Illusions and Shields and say something's there and something's happening a federal investigation and

this person and then this happens
I don't care if the ARCCA Witnesses testify at trial
I don't care about their opinions but I care that it's unfair

imbalanced and hidden and the Commonwealth like the defense is


entitled to Discovery so if they can produce the discovery I'd welcome ARCCA

You know Julie, I have cases where I really had a good case for the defendant and the defendant is the one that really messed it up and in this case Karen Read appears to be appealing to the court of public opinion wrong court, and I applaud the judge because I could hear it in her voice yesterday.

I already knew it was something unethical because you can hear the shaking in her voice and how she was very cautious of what she said.

so down goes that portion and I also applaud the prosecutor.

Often times when I practice I always inform the jury that the prosecutor is supposed to seek justice and not a conviction and I really believe the prosecutor in this case wants a fair chance at trial and unfortunately he’s
unable to do that without the help of the court --- so I really believe that the judge is going to make the proper ruling in this case because she's appealing to the wrong party and she's going to be the cause of her downfall in trial.


Casey, I agree with everything you said and you know what, I was thinking as you were talking, if we had had Hank Brennan from the outset prosecuting this case, I don't think we'd be having this discussion here right now. He would have done it right from the beginning.
