Good morning! I am in Salem Superior Court and we are waiting for Judge Helene Kazanjian and jurors and then the #Borges first degree murder trial will resume. Prosecutors will continue calling witnesses today @EagleTrib


Judge Kazanjian is back on the bench. Defense attorney Amy Smith is addressing the judge on a 132-page exhibit (phone records) the defense just got on Tuesday. Jury is not in the courtroom yet. Smith is asking that some of the calls be deemed irrelevant.


Sounds like a state trooper is going to be testifying as a prosecution witness soon about phone calls and text messages between #Borges and others.


Family of murder victim Lee Manuel Viloria-Paulino is back today in court, sitting in the front row of the courtroom gallery, as they have every day of the trial. #Borges


Looks like we are going to have a delay starting court today. Defense has posed some issues with a prosecution exhibit re; phone records involving #Borges and the other. We are not in a recess. I'll be back as soon as possible with updates.


Judge Kazanjian is back on the stand. Defense attorney Amy Smith is questioning the relevance of some content in 132 pages of telephone records the prosecution is using as an exhibit. We are still waiting on the jury. #Borges


Defense attorney is asking messages involving Mucio Lopez, who has not testified in the case (he pleaded the 5th before trial) to be removed from the exhibit. Amy Smith says they are not relevant. #Borges


Prosecutor Jessica Strasnick said Mucio Lopez's messages show a "furtherance of a conspiracy" though. Judge says the content does constitute "co-conspirators statements." #Borges


#Borges and Mucio Lopez communicated via cell phones more than 350 times between Nov. 11 and Nov. 29, Strasnick said. #Borges


#Borges deleted records with Mucio Lopez from his phone, Strasnick said. Judge is going to allow the records with Mucio to be presented as evidence by the prosecution, she says.


Defense attorney Amy Smith is now asking for other messages between #Borges and Stephanie Soriano, a teen who testified previously. In one message, #Borges said he was "...too much of a jealous person."


Prosecutor Jessica Strasnick said the texts are "corroborative." During part of this text conversation, #Borges confronts Soriano about walking to school with Lee Paulino, the murder victim. #Borges characterized himself as a "jealous person," she said.


"I see it as a admission of how he feels. And his admission of jealousy, in this time frame, are relevant," Judge Kazanjian said. "I will allow those statements." Defense attorney Amy Smith objects. #Borges


Defense attorney Amy Smith is moving forward in the 132-page exhibit of phone records. "I don't see the relevance there," said Smith, who is attempting to get more of the records redacted. #Borges


In these messages, Stephanie Soriano texted the reasons why she felt distant to #Borges, according to Smith. Strasnick said these messages were 9 days before the murder. The only guy #Borges mentions to her is Lee Paulino, Strasnick said.


Judge is going to allow these messages in the phone records too, despite defense objection. #Borges


Jury is coming out now. Prosecution will call more witnesses. #Borges

Defense rests in beheading trial after no witnesses, no evidence (with clip)

"SALEM, Mass. —
The defense and prosecution rested Thursday in the trial of a Massachusetts teen accused of killing and beheading a high school classmate....

When it came time for Borges' attorneys to present his defense, they asked the judge to dismiss the case for lack of evidence. The judge said no....

Earlier Thursday, detectives were on the stand reading phone messages Borges exchanged with friends. In one of them, he sent a picture of a knife with a gold dragon on the handle. Prosecutors seemed to imply this could have been the weapon used to kill Paulino and cut off his head and hands.

Also on Thursday, one of the jurors was dismissed for what the judge said were "reasons personal to her."

Closing arguments are scheduled for Monday...."

Ryan Burke, an FBI agent (Violent Crime Task Force); also assigned to the FBI's cellular analysis team. The trial will not be in session now until Thursday (5/9) at 9 a.m.
