Beheading case trial to begin Sept. 10

SALEM, Mass. — A Sept. 10 trial date has been scheduled for Mathew Borges, the Lawrence teen accused of beheading his classmate, Lee Manuel Viloria-Paulino.

Attorneys involved in the case were in Salem Superior Court on Friday morning, although Borges, 16, was not present.

The attorneys proposed the Sept. 10 trial date, which was approved by Judge Thomas Dreschler.

Cell phone records and text messages are among the potential evidence prosecutors said they have against Borges.

Among potential evidence investigators found on Borges' cell phone was a deleted message from October 2016 in which Borges allegedly wrote, "'You and I need to discuss demons we will face when the task is done,'" according to court paperwork.

Hayden and prosecutor James Gubitose are due back in court next week to argue motions in the case. It's unclear if Borges will attend the hearing.

A Boston gang expert said he’s being called to testify this fall in the trial of a Lawrence teen accused of beheading his high school classmate — the first hint at a possible motive in the gruesome slaying.

9/8/17 update: Def atty seeks to suppress statements MB made to police after body found/parents were not w/him; no Miranda warning given/scheduled for Dec., no date set.
Investigators seized Borges' cell phone on Nov. 29, 2016, two days before the body of Lee Manuel Viloria-Paulino, 16, was found decapitated on a riverbank off Water Street. The motion states Borges "enjoyed a reasonable expectation of privacy on Nov. 29, 2016" and he requests all evidence derived from the cell phone to be suppressed.
2/14/18 Update: Judge James Lang denied a Defense request to suppress the evidence retrieved from the cell phone that was seized by police. Defense also filed a motion asking for statements Borges made to police when he was initially questioned 11/23/16 to be suppressed. Lang also denied that motion. Borges is due back in court 4/13/18.
4/13/18 update: will be back in court next week (no date given) to argue motions in the case. It's unclear if Borges will attend the hearing.
9/7/18 Update: Motions hearing on 9/7. Trial delayed from 9/10 to November (no date).

His trial was supposed to start in Nov., but no date was given.

Mathew Borges, 16, is accused of beheading Lee Manuel Viloria-Paulino, 16, and was first scheduled to go to trial on a first-degree murder charge in September. That initial trial date was moved to Nov. 5.

Then, this week, a continuance was requested in the case as Borges' defense attorneys are still awaiting requested records.


Also, defense attorneys just notified prosecutors they intend to call six expert witnesses and "the Commonwealth needs additional time to prepare," according to court records.

Attorneys involved in the case are now scheduled to meet in Salem Superior on Nov. 15 to discuss another trial date.

Attorneys will be back in Salem Superior Court next month discussing expert witnesses that can potentially be called at trial, however.

In court papers filed already, defense attorneys for Mathew Borges have indicated they want to call as many as six expert witnesses to testify during his trial.

A discussion on Thursday in court about a motion pertaining to the expert witnesses was continued until Dec. 5.

The trial itself is now scheduled for April 22.
