A very interesting point. So what we have here is...

Wolfe said if it's the arm being hit, he would expect shoes to stay on. If it's a full-body hit, then it is likely the shoes will come off. Wolfe testified earlier that he expected more damage to the car/near tail light if it was involved in a collision, he also testified that the damage to JO's arm was not consistent with being hit. So what's the situation with JO's shoes?!
obviously the shoe got where it did in some other way if we believe Dr Wolf

ADA Lally does the cross examination. he asks if it's fairly common for a pedestrian to lose a shoe when being hit bay a car. Wolfe agrees that happens. But would not expect that if a car just hits a person's arm.

Waiting for Lally to ask Crash Daddy aka Wolfe if he has a subscription to the Boston Globe.
He might as well given the silly questions he's asking right now to try and trip Wolf up and failing dismally imo.

Lally is now trying to establish common sequences of pedestrian vehicle impacts.
Wolfe is resisting a bit around word choice, and the push to classify some as likely

Jurors are paying attention.
Some are taking notes.

But folks, that what experts witness testimony does and why it is so useless. All of the stories the defense is telling are plausible stories. They get to say anything they want to and they are not required to prove it in any way. They never have to be right, they only have to confuse you. They can accuse the Alberts, they can harass witness through surrogates, they can drag every police officer through the mud, they can berate the poor paramedics. They get to do all of that without any proof what-so-ever.

The expert testimony is summarized as: "We can't figure out how this happened so it probably didn't". We know because me and my friends myth-bustered a car hitting him..."

Its was almost idiotic what they said on the stand.

Wolfe says they put the items used in their testing were at a temperature of 29F. Lally asks if they accounted for wind gusts in their testing. Wolfe says wind wouldn't have been a factor.

I hate the way Lally speeds up his sentences until they almost run together. it's off putting

Eta and now he's beginning to raise his voice/shout towards the end of his sentences. Back to mute and sub titles
