My one main concern with a hung jury is that KR will not be able to afford to hire Attorneys for her defense if the case is retried. Still puzzled why the Defense want the hung jury. Playing reverse psycology with Cannone? Financial reasons? guessing the CW wont retry the case?

We don't know. She never asked.
Is it possible she knows but she didn’t divulge that detail in court? I would think that if it’s favoring a G verdict she wants them to continue. MOO

Is it usual for Mass for the Judge to assign the foreperson? This is the first time i've ever seen it, i think.

Interesting that is what they wanted. I think they get to see the split.

Yes. I think the majority is NG. I also think the G jurors are dug in and indicating that nothing is going to change their minds.
Probably on a power-kick.

Does the Judge have any legal recourse to grant them something like a majority 10-2, for example?

Exactly- we have seen a huge amount of commentary and re-analysis of testimony.

Also, will they retry when the other shoe drops with Proctor/FBI investigations? Seems risky.

Yes and no. I hoped all the jurors would be able to consider the actual evidence and use their reason. IMO this means at least one of them isn't doing that for whatever reasons (can think of many and is probably a mixed bag but will leave that in speculation land).

This unaminous ruling has to change as a matter of law. It should be a 75% majority, except in cases where the defendant is facing a possible charge of execution.

Judge decides they should continue to deliberate.
Jurors enter.
Judge tells them she knows how hard they’ve been working, tells them to continue to deliberate.


Two jurors vigorously nod affirmatively.
One of those jurors is someone who I thought might be at odds with the others.
Of course we don’t know what the split is.

Jurors’ collective mood, to me, did not seem down, or tired.

I called it IIRC at 13 hours deliberation that there is a hung jury. A hung jury is not good for either side, no matter how the defense and prosecution would spin it. I wonder if the jury is still hung and the judge calls it, if the prosecution would retry the case.

BREAKING: Karen Read jury says they are unable to reach a unanimous verdict. Commonwealth wants them to continue and is making argument now. Defense believes it has been sufficient time. Judge hearing both sides.

After hearing both arguments, the judge is sending the jury back in to continue deliberating. Some of these last 4 days of deliberations have been shortened; judge wants to see more from them before deciding they are hung.

i agree with judge. don't understand defense. bet they just want out now before the lunch.
The defense didn’t say they wanted a hung jury. They wanted the Allen statement read to the jury whereas the prosecution wants to wait to even have that read. Judge agreed w/the prosecution and is holding the big gun back for later.

What on earth! Ugh.
Yea, have to admit I find it sickening, literately feeling this in stomach. Sad, angry, depressing, one of those moments where faith in humanity takes a knock for the worse. Echoes of Harper Lee's to Kill a Mocking Bird vis a vis prejudice in general. All MOO IMO JMO
