Well, that was super-interesting. The defence moved yesterday for a beefed-up jury instruction on the hoodie business. They obviously aren’t satisfied with the modest one they got 1st time round & probably feel (rightly IMO) they dropped the ball when Brennan was pulling off his stunt with Wolf. Interestingly, the judge observed they didn’t object at the time & Alessi responded saying they couldn’t see properly while Brennan held the shirt up to the witness.

This excuse is inadequate IMO. They could have intervened to ask what he was showing but they didn’t. They were caught off guard & failed to react & the issue has clearly been gnawing away since.

I haven’t seen the ruling on the motion. Anyone better informed?

have not seen many rulings....including Yanetti's suggested instructions. Bev in a big rush today already.

RG: Yes. I’ll start with the 26th and just go without going through more than just the day high and low, a high of 28, a low of 12, on the 27th the high was 27 and the low was just 9 degrees Fahrenheit, on the 28th Friday the high temperature reached 36 and the low was 22, and then on Saturday the 29th the high temperature was 29 the low was down to 15.

AL: Now sir if I could ask you specifically within that time period, specific time period, of approximately 1.30am on the 29th through 5am on the 29th, what does the data demonstrate with respect to the air temperature during that period?

RG: From 1.30 to 5.30?

AL: Yes please.

RG: On the 29th I’ll consult this data from Norwood airport if that’s the way we should look at this, I would suggest to do that. At 1.30 the temperature was 31, by 5.53 in the morning it was down to 24 degrees.

Dr Lapositas testimony and other MEs trumped anything you have written here. The jury took note of this and will use the fact that there was no frost bite nor hypothermia finish case. Imo

That kind of reasoning is like saying a wife should have known her abusive husband was going to smack her out of the blue. Have to stay alert and prepareckasdic victim bkaming. It was Brennan'd 24/7, or else!
It's not the job of the defense to prevent Brennan from pulling dirty unethical stunts. The defense didn't cause Brennan to perform his stunt. Brennan is the one at fault - not the defense team.

I was about to respond. Classic victim blaming. It is Brennan's problem. He did something unethical and misleading which compromises the right to a fair trial. The defense has every right to seek a robust remedy. I could hardly believe what I was reading. Shameless. Moo

I mentioned in an earlier post that this was the first trial I’ve watched/followed from beginning to end, so I need to ask if it’s normal for a DA to make a statement like this about 5 weeks before a murder trial? It seems to me as though he’s trying to poison his potential jury. IMO, he lied about the ME reporting the injuries on JOK’s arm
DA Morrissey said that the ME concluded those injuries were caused by blunt force trauma, but this is her actual testimony: Scordi-Bello described the arm injuries as scrapes or scratches, but said there was no exposed fat or muscle. She said because there was no depth to the injuries, she did not make any notes about their depth. Scordi-Bello said she does not have an opinion on how those injuries may have occurred.

We learned from the science and the data...

The defendant in her Lexus drove away, at less 35 feet away.
She stopped and she put the Lexus in neutral… and she waited ...
She then put the Lexus in reverse…. (approx. 24 mph) and accelerated to 74% throttle (striking/sideswipe/clipping action)

rsbm. There is nothing in the data to claim she "waited."

I have read that the 2 jurors she moved.. she moved one into seat 1... and that is usually who she picks for foreman....
the juror in seat 1, I think from reporting is the one that does not take many notes.

This was a motion filed by the defense yesterday or this morning? Do you happen to know when it was denied?

They all just came back in. From what it looked like, the judge was returning to the bench as if she had been away from it while we were watching the fan.
