@jepop When the judge spoke of other remedies - what else would she be referring to other than the polling?
Idk, I missed that. I hope she allows that then. Because I read a statute a while back, which I will try to locate again, which seemed to expressly forbid polling on a hung count where a partial verdict could have been rendered ( ie Count 2,). ICBW and sincerely hope that I am. Will try to dig up the statute.

if the last question came in 1st... I wonder if the juror have moved past that anyway? because they had a question about count 5?

I feel very badly for JOK’s family. They will never know the truth of what happened that night. Travesty on both sides, IMO.

Also.. the 4th (but really the 1st) question would explain Jackson's comment earlier on the live feed before they read the 3 questions:

"Bob, I can't do this again"

That last question was in before the other three. She did not want to answer it. She said so. But maybe she decided she better put it on the record. Bev is a poster judge for corruption. I think this jury is probably so fed up with her protecting the CW that they will just go NG across the board.

I hold out a tiny bit of hope that the truth someday will come out, if my prayers are answered, through the waterboarding of Jen McCabe.

The defense are stressed now as opposed to before lunch? Idk, Imo even if it came in before the others they have only learnt about it now?

Is it that question 4 came in before the other 3 — or is it just that they sent question 4 before they received answers to the first 3? So basically just piling on another question to add to the list

That is SHADY work.
IMO.
The judge did say something to Jackson like 'at first, you didn't even want me to answer it at all' ... in the last courtroom hearing at 1:30.

At the very least they should be wondering WHY she is so very one sided. Even without having specifics on the first trial, they know there was one. They sat in court every day watching her very short tone with the defense, the way she coddled the CW and all the facial reactions, the body language and the way she talked to each side. I think they could reasonably conclude where the judge stands in this. Now how she's dealing with their questions. I hope it's becoming clear to them why there is a need for a second trial and I'd be wondering WHY is the judge behaving like this. They have to know this is not "normal" for a judge to be so obviously biased to one side.

Also, the defense poked so many holes in the case and showed over and over how shady all the police work was and how various people in this case have lied or didn't do things or did things that were very odd.. now the judge too. I know what I'd be thinking if I was a juror.

I know who I believe. Listening to the judge stumble over her reading of the clarified count 2 verdict form before lunch, she couldn't even remember what words she had misspoken, after it was brought to her attention by the defense. She is definately capable of miss-,characterising what AJ said out of a combo of inattention and incompetence. Jmo

She got very dismissive and snarky - which if I read the tea leaves means she is not happy and that means the DA is not happy.
She pretty much tried to cut off AJ and go to Yanetti - then Alessi jumped in and then back to AJ.
He was clear of their position and that he wanted once again to be on record ( JBC kept saying I heard you already Mr Jackson)and reserve their rights.
She definitely was in a tither :oops:
