The state on #AdnanSyed: "He was convicted because he did it and the state proved it."

Mariam Khan ‏@MKhan47 1h1 hour ago
#AdnanSyed defense will focus on ineffective counsel rendered by Cristina Gutierrez, and "unreliable" cell phone records

Mariam Khan ‏@MKhan47 1h1 hour ago
Justin Brown called his first witness, Phil Dantes, who worked with Adnan's previous lawyer. State objected to nearly every question/answer

Mariam Khan ‏@MKhan47 1h1 hour ago
Long-time #AdnanSyed advocate Rabia Chaudry had to leave the court room because the state will call her as a witness

Mariam Khan ‏@MKhan47 1h1 hour ago
.@serial's Adnan Syed makes court appearance in shackles, a baby blue jumpsuit, sporting a long beard and a prayer cap on his head.

Defense in recross makes point thru q that Guitierrez didn't pursue McClain's alibi with her which means it couldn't have been investigated

Justin Fenton ‏@justin_fenton 9m9 minutes ago
Vignarajah questions whether itd be prudent to share such alibi witness w state if it presents possible problem for Syed's account to police

Justin Fenton ‏@justin_fenton 10m10 minutes ago
Under defense questioning, Kanwisher said he didn't know why CG wouldn't disclose McClain to state as at least possible alibi ...

Justin Fenton ‏@justin_fenton 11m11 minutes ago
State also produces Guitierrez task list that includes "determine alibi", lists ppl who saw Syed at school, track practice & mosque..

Justin Fenton ‏@justin_fenton 12m12 minutes ago
...the period in which McClain says he was seen at library (2/2)

Justin Fenton ‏@justin_fenton 12m12 minutes ago
He produces a notation showing Syed gave attorney's his email and password; suggests they checked to see if he sent emails during (1/2)

I listened to serial recently, I cant work out what I think. I would be more sure he was innocent if it wasnt for Jay, what did he have to gain by lying? He was lying but the one thing that stayed the same in what he was that syed killed Hae.

Unless he was covering for someone, but who? And he did know where the car was.

Im really on the fence about this one.

I felt conflicted and thought Adnan had probably killed Hae until I listened to Undisclosed and Serial Dynasty/Truth & Justice. Have you listened to those? If not, you really should.

McClain on being here today: "I felt it was the right thing to do. In order for justice to be served, all information has to be on the table"

Justin Fenton ‏@justin_fenton 12m12 minutes ago
McClain said she didn't want to be taken advantage of this time, asked Koenig for help getting a lawyer. Koenig gave her two names

Justin Fenton ‏@justin_fenton 13m13 minutes ago
Of how Urick characterized her position: "I was I shock. I was fairly unhappy. I was mostly annoyed with myself" for being misrepresented

Justin Fenton ‏@justin_fenton 14m14 minutes ago
McClain, continued: "I came to find out, as Sarah (Koenig) said, maybe it *is* important."
"It def placed a greater weight on my heart."

Justin Fenton ‏@justin_fenton 15m15 minutes ago
McClain on being on Serial: "It was pretty freaky."
Before, "I didn't think I was very important at all."

Justin Fenton ‏@justin_fenton 16m16 minutes ago
Urick said he had spoken to McClain briefly; with help of Syed lawyer, she got her phone records that showed 34 min convo

Justin Fenton ‏@justin_fenton 17m17 minutes ago
McClain says she basically unwittingly participated in @Serial and after it was broadcast came to realize importance of her account

Justin Fenton ‏@justin_fenton 18m18 minutes ago
Unbeknownst to her, Urick took stand and misrepresented their conversation at post conviction hearing, she says

Justin Fenton ‏@justin_fenton 18m18 minutes ago
In 2010 McClain says trial prosecutor Urick convinced her that what she was not relevant; told her Syed was guilty and she was being played

Justin Fenton ‏@justin_fenton 41m41 minutes ago
By time trial began, she was a college student and no longer following the case. Says @rabiasquared sought affidavit, did not pressure her

Justin Fenton ‏@justin_fenton 42m42 minutes ago
McClain noted she had inquired w library about surveillance cameras there, said they could be useful. Said his defense never contacted her

Justin Fenton ‏@justin_fenton 42m42 minutes ago
She wrote a second, typed letter to Syed the following day again offering help: "I believe in your innocence."

Justin Fenton ‏@justin_fenton 43m43 minutes ago
"I hope you're not guilty and I hope to death you have nothing to do w it. If so I will try my best to help you.." letter said

Justin Fenton ‏@justin_fenton 44m44 minutes ago
"It was kinda weird if he was normal & calm, and now he's in jail for murder," McClain testifies about the letter

Justin Fenton ‏@justin_fenton 45m45 minutes ago
McClain penned a handwritten note to him that night. "I remember chatting with you," it said. "I have reason to believe in your innocence."

Justin Fenton ‏@justin_fenton 46m46 minutes ago
After Syed's arrest, McClain went to his family home and told them she had been with him that afternoon.

Justin Fenton ‏@justin_fenton 47m47 minutes ago
McClain says she was stuck at library waiting for bf & struck up conversation w Syed at around 2:15. He was "completely normal."

Justin Fenton ‏@justin_fenton 48m48 minutes ago
First q: Were you with Adnan Syed on Jan 13, 1999 at Woodlawn public library? "Yes."

Justin Fenton ‏@justin_fenton 49m49 minutes ago
McClain on stand. She is now married, with two children & living in Washington state. Giggling thru her testimony & says she's nervous

You have too. Serial was great but it wasn't much of an investigation. You'll be blown away by the bombshell evidence presented in Undisclosed and Truth & Justice.

I feel weird recommending Reddit because so much deplorable stuff happens on that site, but as I see it, the people in the serialpodcast sub and the serialpodcastorigins sub have done the best research and thinking on this case.

Is anyone following the updates Sarah Koenig is posting about the current appeal? is it considered an "appeal" if they're trying to prove the original lawyer (Christina Gutierrez) was incompetent?

I haven't been listening to SK's, but I have listened to Undisclosed's daily updates. These proceedings are considered Post-conviction Relief (PCR) Hearings, as Adnan has exhausted all of his appeal rights at this point. Basically, the hearings are held when a defendant believes he didn't receive a fair trial. (In this case, Adnan's argument is that he didn't receive a fair trial because his lawyer did not contact or properly investigate a potential alibi witness (Asia McClain). Additionally, the AT&T cell tower expert used by the state during his original trial no longer stands by his testimony--and has signed a sworn affidavit stating this--because they did not disclose a fax cover sheet that accompanied the subscriber's activity report, which contained a disclaimer that said cell tower locations should not be considered reliable for incoming calls, prior to his testimony).

If the judge agrees with him, Adnan will be granted PCR and a new trial. The new trial will allow Asia's testimony to be heard, and the state will not be able to use the cell tower information from the subscriber activity reports to back up their claims that Adnan was at Leakin Park at a specific time.

The difference between an appeal and a PCR hearing is that appeals only review issues and/or evidence provided to the court during the trial (new information/evidence cannot be introduced), whereas PCR hearings bring in issues not previously reviewed at trial (new evidence, ineffective counsel, Brady violations, juror misconduct, etc.)

I'm listening to the updates. The way they're set up is bugging me a little--SK sounds much more biased than in the original series, and she seems to downplay any daily developments that are not in Adnan's favor. In short, it sounds like she's rooting for him, which makes me think her objectivity is gone, so the overall journalistic quality isn't there. More like a fan podcast.

I agree. She never really was objective though. I'm not even sure she was completely trying to be objective. She clearly became friends with Adnan, you can hear it.

I didn't know anything about the case before Serial, and while I've followed a lot of true crime, I was somewhat new to the podcast format (and of course we were all new to 'injustice porn'). I remember thinking that she sounded excited, like someone getting into their first real 'mystery' case. But I always thought Adnan sounded sketchy, like he was heavily editing his answers in his head, trying to guess what someone expected him to say and always say the right thing/cover his butt, etc. And at the end I had the sense that SK was unconvinced, so I don't know, I guess I came away feeling like I had listened to a legit 'documentary', one that didn't pretend to have the answers.

But that was a year ago, and since then I've become considerably more skeptical about this whole new entertainment industry that has cropped up.

Unfortunately, they're just the loudest voices, because all the rational contributors have gone to private subs to avoid being attacked. The Serial Podcast sub and Serial Podcast Origins sub are largely made up of people who believe Adnan is guilty and are insultingly dismissive of any other viewpoint. I just had someone tell me I'm "not capable of wrapping my head around the concept" that Abe Waronowitz didn't recant his testimony from the trial. He was literally on Undisclosed Tuesday after the hearing, explained how he could no longer validate his testing results due to the fax cover sheet that had important instructions being left out of the evidence exhibit. When you publicly state you no longer have the same opinion as before, that's recanting. But I'm too stupid to understand how that's not recanting lol.
