Waterville Police Deputy Chief Charles Rumsey said Tuesday that police were called shortly after noon on Monday by 27-year-old Justin Linnell of Waterville. According to Rumsey, Linnell was walking along College Avenue at about 12:15 p.m. when Lance DiPietro rode by in a vehicle driven by his brother, Justin DiPietro, who is Ayla’s father. Lance DiPietro later told police that Linnell shouted something at the DiPietros which caused Justin DiPietro to pull his vehicle over in a parking lot.

The verbal altercation escalated into an assault,” said Rumsey. Lance DiPietro allegedly threw the baseball bat to the ground and began fighting with Linnell. Linnell, who Rumsey said was knocked down and kicked in the face by Lance DiPietro, suffered a laceration on the back of his head and contusions on his face. Linnell refused medical attention at the scene but was later treated and released at an area hospital.

The assault charge, a Class D misdemeanor, carries a sentence of up to a year in jail and a fine of up to $2,000. He is scheduled to appear April 17 in Waterville District Court.

Justin DiPietro was not charged in the incident.

Lance DiPietro was convicted of seven misdemeanors and five civil violations since 2002, according to Waterville District Court records, including allowing a minor to possess alcohol, underage drinking and theft.

Justin DiPietro drove his SUV into a nearby parking lot and stopped. Next, Lance DiPietro climbed out of the passenger side carrying a wooden novelty baseball bat and confronted the man.

"DiPietro confronted him and said, 'You've been saying stuff about my family. Knock it off,'" Massey said.

Can you just imagine what this crew is capable of after dark ?

Nancy Grace last week, reported it as splatter....she was asking an expert what exactly does splatter mean...I'll try and find the link, it was the episode she showed my family on the family album btw :)

I was more looking for the word splatter from LE ~ I know they said some blood visible, some cleaned up ~ they also said some was Aylas ~ they also said that it was more than a small cut. So far, out of all of those statements, I'm not totally freaked out.

Some visible, some cleaned = all the same persons blood? all the same length of time? exact same location? Why wouldn't it all be cleaned up?

More than a small cut amount = could be the size of a postcard ... could be the size of poster....but more than a small cut amount COULD still be a small amount.

Concerned? Of course they would be concerned! A child is missing and regardless of how much, her blood is found in the basement, BUT that could be explained on so many levels.

Splatter -- different story. I have not, as of yet, seen that reported as coming FROM LE, so until I do, I'll keep the faith :) :please:

I recall the entire house was deemed a crime scene in the beginning. Did LE re-assign it as a "crime scene" when the blood in the basement was identified? Is LE calling it "a crime scene"? I'm not following closely but do know that the blood was found later . . . IMHO it's not evidence of a crime, and I haven't heard "blood splatter" anywhere but here & NG/JVM.

Honestly, there are blood droplets practically everywhere in my basement/back porch/sidewalk from me gardening. I don't typically clean up immaculately & there's never been a crime here (that I know of).

And, was the blood Ayla's? I don't recall what LE reported - thanks!

Where is Ayla & what happened that night? I'm still :fence: and wondering what her mother's doing . . .

The blood was confirmed by LE to be Ayla's.

The problem I have with any of these things. . .the broken arm, the bruises and Ayla's blood in the basement, is that you can explain any one of them individually, but when you look at them as a whole, over the period of time they occurred and in the context of her now being missing and the fact that three adults that were there that night stories don't add up, that paints an alarming picture.

Snipped and BBM: Yes, LE has confirmed the blood IS Ayla's.

And as to Ayla's mother, Trista :

Trista is doing ahelluva lot more than Ayla's "father" ...

Trista has been cooperating with LE ... Justin has NOT been cooperating with LE ...

And neither have Justin's GF and his sister cooperated with LE ...

And Justin's mother changed her "story" about the night Ayla went "missing" ...

JMO ... but Justin and his family KNOW what REALLY happened to little Ayla ...

LE said SOME of the blood belonged to Ayla. Whether they just did not test it all, or whether some of it didn't match hers, IDK. However, they did say it was more than a small cut would produce so I am assuming there was quite a bit of it. I never heard them describe it as spatter though. I wonder where NG got that from? They had to use luminol to see some of it, so apparently they tried to clean it up.
You're right, it's very alarming to imagine what happened in that basement.

I believe LE stated that the amount was more than a small cut would produce. I don't think they have been more specific other than to say that it was Ayla's.

I really can't see a miniature bat breaking windows and high up ones at that. These things are about 2 ft long and the thickness of a broom pole. They would hurt if you were hit with one, but I think it would break before the windows as they were replacement windows, and that glass is quite thick. JMO

Lance was the one with the miniature bat.
