Jose Baez, attorneys haggle over jail video, phone records
Casey Anthony's defense team argued that jail video should stay sealed and also introduced a new member of its team, DePaul University law professor Andrea Lyon.

Defense lawyer Todd Macaluso argued that a video of Casey Anthony taken inside the jail the day her daughter's remains were found should not be released. He said it violates her privacy and constitutional rights.

He accused Orange County Sheriff's Office and corrections officials of orchestrating the events that led to Casey Anthony watching a local television station as the December day unfolded.

"This is cruel. This is inhumane. This is illegal," he said.

A county attorney and prosecutor said they didn't object to sealing the video. But Strickland said he wanted to provide the media an opportunity to argue why it should be public record.

Big headline today in the Casey Anthony saga: The trial won't start in October, said the death-qualified attorney who joined the defense team.

Andrea Lyon, a professor from DePaul University, noted that she has to learn the case.

Preparing the case will require "quite some time and quite some work," Lyon told reporters.

WFTV-Channel 9's Kathi Belich said Lyon "was trotted out today like a prize horse even though she [has] not properly filed notice with the court that she is hoping to join the defense team officially."

WFTV's Belich also examined Anthony attorney Jose Baez's efforts on the videotape. "The defense brought another incomplete and late-filed motion," Belich said. "He has to come back again to discuss whether the jail video of Casey Anthony's reaction ... will go public."

The owner of the property where the remains of slain toddler Caylee Anthony were found did not remove a massive makeshift memorial that had accumulated on the site, listing agent Tina Martin said.

Caylee's grandparents George and Cindy Anthony and the Orange County government have also said they did not remove the memorial.

Hundreds of stuffed animals, dirty and wet from exposure to the elements, had been at the site for the past six months, along with signs, religious items and a fair amount of debris. The memorial was removed earlier this week.

Outside the Orange County Courthouse Thursday, Lyon was quick to say she may be the lead attorney on paper but considers herself an equal member of an "excellent team," which includes Jose Baez from Kissimmee, Linda Kenney Baden from New York and Todd Macaluso from San Diego.

She said prosecutors are seeking the death penalty for "strategic reasons."

"You will hear about those strategic reasons in motions that I will be filing, challenging their right to even ask for the death penalty in these circumstances," Lyon said. "I believe Florida law simply doesn't allow asking for the death penalty in these circumstances."

Lyon also said: "I believe that the Florida law simply doesn't allow asking for the death penalty in these circumstances."

WESH's Bob Kealing noted that Baez "bragged in court" that Lyon had never lost a death-penalty case.

WFTV's Salt said that Baez might have revealed his defense strategy by pointing to Jesse Grund, Anthony's former fiance, as a suspect.

"Baez is going to try to say there were other suspects in this case," Salt said. "The sheriff's office never named Grund as a suspect in Caylee's disappearance or murder."

Was Casey death penalty a Lamar blunder?

Initially I credited Lawson Lamar with making a smart move by seeking the death penalty against Casey Anthony. While he never would get it, the move put pressure on Casey, increased the cost of the trial and increased the odds of getting a jury more likely to convict.

But now I am reconsidering. Noted DePaul law professor Andrea Lyon has joined the defense because it lacked an attorney who met the qualifications to defend a death penalty case. Lyon is a very accomplished attorney who more than meets the qualifications.

What this means is that amateur hour is over and Jose Baez will be taking a backseat in the trial. I'd no more let Baez defend my life than I'd let Fred Flinstone remove my brain tumor.

I tend to think that the bigger the role Baez played in this trial, the better the odds for the prosecution. By seeking the death penalty, Lamar has shrunken his role, and expanded the role played by an attorney who may well be the best one in the courtroom when the trial begins. Lyon certainly will not let Baez interfere with her defense, and eventually will take over the case, just like Johnnie Cocharin took over O.J.'s defense from Robert Shapiro.

Removal of Caylee Anthony's makeshift memorial remains mystery

George Anthony said earlier this week that he didn't know who did it. His lawyer, Brad Conway, also told me earlier this week he didn't know when or how it was removed.

No one with Orange County government took the items away either.

And yesterday, the real estate agent selling the wooded property told me the seller did not remove the memorial.

There were a lot of items out there, including some sizable wood signs. It would have taken quite some time for someone to remove the items by hand.

Did anyone see the items being removed?

The makeshift memorial for Caylee Anthony, daughter of Casey Anthony, has been removed.

It is not clear who removed the makeshift memorial to the slain 2-year-old on Suburban Drive, just a short walk from where she lived with her mother, Casey Anthony, and her grandparents, George and Cindy Anthony, in east Orange County.

A real estate agent who has the property listed said the seller did not remove it.

George Anthony told the Orlando Sentinel that a neighbor told him Tuesday the lot was cleared. He didn't know who did it.

A county spokeswoman said Orange County did not clear the lot.

Strangers turned the lot into a memorial after investigators scrubbed the property for clues and declared it was no longer a crime scene.

Casey Anthony's attorney, Jose Baez, told a morning news program that his fight to stop the release of a jailhouse video is far from over.

"I think we have to get all of the facts in front of court. We've taken two depositions with both correctional officers who were there. Both of them had told us that what they did to her was cruel and unusual," said Baez.

Judge Stan Strickland delayed making a decision on the video at a hearing Thursday. The judge gave the media a week to decide whether they want to fight to get a copy of the jail video.

Vigil Planned For Anniversary Of Caylee's Death
Event Slated For June 16

Some of the many people who helped search for slain toddler Caylee Anthony are planning a vigil to mark the one year anniversary of her death.

A source told WESH 2 the vigil will be held June 16 -- the day investigators believe Caylee died.

Organizers hope to hold the event at Jay Blanchard Park in East Orange County.

The event will include a balloon release and communal prayer.

More than 200 pages of transcripts from interviews with two Orange County Jail officials were filed in court this afternoon in the case against Casey Anthony, a 23-year-old accused of killing her daughter.

Lt. Tammy Unser and Sgt. Billy Richardson were questioned last month about what happened at the jail on Dec. 11 the day the remains of Anthony's 2-year-old daughter were found less than a mile from her family home.

Unser and Richardson were questioned by Anthony's defense team, including Jose Baez and Linda Kenney Baden. Prosecutor Linda Drane Burdick also was present.

Baez has asked Orange Circuit Court Judge Stan Strickland to prevent the video from being released to the public.

Strickland has not ruled on the issue.

Casey Anthony's team hires 'best' death-penalty lawyer out there

And Lyon will not come alone.

She will have several law students to help her. Casey's case has become something of a class project for The Center for Justice in Capital Cases, which Lyon formed at DePaul to train students and attorneys in death-penalty cases. Part of the center's mission statement includes "hands-on experience" for students.

They will provide endless hours of eager, free labor, performing tasks such as going over transcripts and motions, and contributing to closing arguments.

In the case of Casey Anthony, accused of killing her young daughter, Caylee, Lyon plans to get the death penalty taken off the table before the trial begins. She will file motions that argue the evidence does not rise to a death-penalty case and that prosecutors are seeking it for strategic reasons. These probably will include a common complaint by defense attorneys &#8212; that prosecutors seek the death penalty even when it is not warranted because it predisposes the jury to a guilty verdict.

Baez Files New Motion To Seal Jail Video

Attorney Jose Baez filed another motion Monday regarding blocking released of the video. Baez filed the same motion last week, but the filing came so late that the judge didn't have time to read it.

Tuesday afternoon, Eyewitness News obtained depositions by Casey Anthony's defense team of the two corrections officers who were with Casey at the time of the remains discovery. Baez claims the videotape was staged. He says Casey was brought in front of the camera and told the remains were found just to see her reaction.

Women Say They Saw Couple Removing Caylee Memorial Signs

At about 10:30 p.m., they said they saw Caylee Anthony's grandparents George and Cindy Anthony removing the signs.

"I saw Cindy last night taking the cross and putting the cross in George's car, no doubt whatsoever," Peter said.

The said they two took a picture of a dark vehicle with a white haired man resembling George Anthony on the driver's side. After they took the picture, the women said they were pursued out of the neighborhood by the Anthonys and their friends from the group Kidfinders, Dennis and Sherry Milstead.

Hill said the two couples finally cornered them at the entrance of a nearby gated community.

"The Milsteads and the Anthonys blocked us in, got out of the car and came over to our car. We called 911," she said.
