Casey Anthony: WKMG see 'blockbuster developments' in defense's claim that someone else placed Caylee's remains in woods
posted by halboedeker on Aug 21, 2009 12:39:10 PM
<snipped>
Defense attorney Todd Macaluso told the court, "There is substantial evidence ... that the body or the remains of Caylee Anthony were placed there after Casey Anthony was locked up in the Orange County correctional facility. ... And that proves her innocence."

Bolden called attention to Casey Anthony's tears when her father took the stand to talk about the family's dealings with bounty hunter Leonard Padilla.

WFTV-Channel 9's Kathi Belich also highlighted Anthony's emotional reaction when took the stand. "When George got off the witness stand this morning, he looked at his daughter, Casey, as he walked past, with his hands folded and mouthed the words, 'I love you' to her."

Belich later said that Casey Anthony's body "actually shook" when George was called to testify. "She did not look at her parents when she walked into court," Belich said. "She shook hands with defense attorney Todd Macaluso instead."

At 12:30, WFTV showed Cindy Anthony talking to reporters about her daughter, Casey. "It was awesome to see my daughter today," Anthony said. "It gives me a lot of peace to see that she actually looks OK, she looks healthy. That's important to me."

UPDATED: Casey Anthony case: Defense claims someone else left Caylee's remains in woods
One of Casey Anthony's defense attorneys told the judge they have found evidence that shows Caylee's remains were placed after Casey Anthony was in jail.
5:24 p.m. EDT, August 21, 2009
<snipped>
"The body or remains of Caylee Anthony were placed there after Anthony was locked up in the Orange County facility," Macaluso said during the two-hour hearing.

Her defense team did not give details about its evidence.

"I can't get into that," lead defense attorney Jose Baez said afterward. "We have said all along that we are going to try our case in the courtroom."

The defense considers work that Padilla and his team did is an extension of legal services provided by Baez. The information should not be made public during the trial, Baez argued, because it is covered under attorney-client privilege.

Prosecutors disagreed, saying what Padilla and others have to say is not privileged.

Strickland did not rule on the issue.

Anthony did gain one win on Friday. Strickland granted the defense team's request for Anthony's former boyfriend Tony Lazzaro's phone calls and "pings" -- signals that show a cell phone location at a given time -- from June 1 to Dec. 18, 2008

Strickland did not decide today on the date of the fraud trial.

Casey Anthony: Cindy tells WESH there's no book deal
posted by halboedeker on Aug 21, 2009 4:40:54 PM
<snipped>
"At the end of the two and a half hour hearing, Casey looked emotionally exhausted, but her mother came away smiling," WESH-Channel 2's Bob Kealing said this afternoon.

"It was awesome to see my daughter today," Cindy Anthony said, surprisingly upbeat. Her daughter is charged with the first-degree murder of her daughter, Caylee.

Cindy Anthony also told WESH that she and her husband, George, do not have a deal to write a book.

"Before the start of today's hearing, Cindy told WESH her hairdresser had encouraged her to write about the struggles she and George have gone through," anchor Aixa Diaz said. "But she says there is no book deal."

The news: Anthony's defense team revealed a key part of their strategy, Kealing said. The team contends that someone placed Caylee's remains in the woods after Casey was jailed -- and that proves her innocence.

But defense attorney Jose Baez answered Texas EquuSearch by calling attention to footage of Anthony private investigator Dominic Casey searching the area in November. "It's clear it wasn't wet," Baez said.

Casey Anthony: WFTV analyst says defense's strategy defies logic
posted by halboedeker on Aug 21, 2009 5:53:03 PM
<snipped>
And that strategy wasn't impressing WFTV legal analyst Bill Sheaffer. The defense team is arguing that someone else placed the toddler's body in the woods after her mother was jailed -- and that proves Casey is innocent.

Sheaffer's take? "Not only does it not raise a reasonable doubt, it just defies logic," he said. "So the defense is going to have a problem in that area."

The Anthony family reactions at a hearing today were drawing a lot of scrutiny. It was the first time in three months that George and Cindy Anthony had seen their daughter.

"As Casey was leaving court, her mother Cindy jumped around and waved to get Casey's attention," WFTV's Kathi Belich said.

Talking to reporters later, Cindy described Casey's sobbing reaction as "very touching."

WOFL-Channel 35 also studied Casey's tears. "Casey Anthony started crying when her dad unexpectedly took the stand," anchor Cale Ramaker said.

Reporter Holly Bristow said, "What I saw clearly in the courtroom: Casey Anthony shedding big tears, sobbing instantly the second her father started talking. Four minutes later, when the camera turns to Casey, she had calmed down."

WOFL succinctly recapped the issues. Anthony's team got access to her former boyfriend Anthony Lazzaro's phone records. But Judge Stan Strickland made no rulings on whether testimony from Padilla's team will be blocked, on whether Casey's check fraud will be delayed and on whether Tim Miller of Texas EquuSearch will be designated a material witness.

Casey Anthony: WFTV asks if defense is holding it together
posted by halboedeker on Aug 21, 2009 6:29:29 PM
<snipped>
At 6, the station studied mistakes by the defense team.

"Last-minute motions, incorrect motions, lack of motions -- it's not the kind of work we were told to expect from Professor Andrea Lyon, as the defense likes to call her," WFTV's Kathi Belich said.

Belich listed the mistakes: In seeking Texas EquuSearch records, defense lawyer Lyon had a last-minute motion with the wrong case number. Lyon hadn't filed the proper paper work to join the Anthony check fraud case. And the defense team failed to alert the media that it wants to keep public records secret.

"There were several missteps," WFTV legal analyst Bill Sheaffer said. And he added that Lyon had been touted as an expert and "a lawyer's lawyer."

What does it all mean? Could Anthony's legal dream team be a nightmare?

Casey Anthony hearing provides glimpse at defense strategy
August 22, 2009
<snipped>
Attorney Todd Macaluso told Orange Circuit Court Judge Stan Strickland that the defense discovered evidence that will prove Anthony's innocence — and that someone else left her daughter's dead body in the woods.

"The body or remains of Caylee Anthony were placed there after Anthony was locked up in the Orange County facility," Macaluso said during the two-hour hearing.

Her defense team did not give details about its evidence.

"I can't get into that," lead defense attorney José Baez said afterward. "We have said all along that we are going to try our case in the courtroom."

Friday's developments
Strategy: Casey Anthony's defense team said in court that daughter Caylee's remains were placed in the woods after Anthony was jailed.

Testimony: Anthony's father, George, said that bounty hunter Leonard Padilla acted as security for the family.

No ruling: The judge has not said whether Padilla's work is privileged as legal services.

Ruling: Anthony's lawyers gained access to her ex-boyfriend's cell-phone records.

Change of venue court cases are extremely rare
August 22, 2009
<snipped>
"It's rare everywhere. Very, very rare," said Robert Weisberg, a law professor and director of the Criminal Justice Center at Stanford University. "The court system does not like it, because they're very complicated and expensive."

"The burden on the defense is fairly hard," said Mike Vitiello, a professor at the University of Pacific McGeorge School of Law in Sacramento, Calif. "Counsel has to do substantial investigation, polling prospective jurors to show not only familiarty with the case but a settled view of the guilt of the defendant."

In Florida, Casey Anthony is charged with murdering her 2-year-old daughter, Caylee, whose remains were found last December near their home. And in May, her attorneys filed a motion to move her trial from Orlando to the Tampa area, citing heavy media coverage.

"The local coverage has been so constant and at times so inflammatory that members of the local community have already formed their opinions without even hearing one piece of evidence," said Jose Baez, one of Casey's attorneys.

Anthony might have a chance. According to the Florida State Court Administrator's office, there were approximately 87 change of venues in 2008 and 114 similar actions in 2007.

Florida's extremely broad public records law often translates into extensive media coverage that makes it difficult to get a fair and impartial jury in a county where the crime occurred, said Lester Garringer, a senior attorney in Florida's Office of the State Courts Administrator.

UPDATED: Inmate Claims He Knows Who Killed Caylee
Posted: 2:43 pm EDT August 24, 2009
Updated: 4:04 pm EDT August 24, 2009
<snipped>
Jerry Jackson is a 21-year-old inmate behind bars since 2004 on a 30-year sentence for crimes committed in 2002, including sexual battery with a weapon, armed burglary and kidnapping.

The letter, written on July 22, 2009 and addressed to "whom ever is representing Ms. Anthony," suggests that Jackson knows who killed Caylee Anthony and claims it was not Casey.

"I happen to know for a fact who killed her in which who is not Casey Anthony," Jackson wrote in the letter. "The person that killed her was a guy whose name I will not reveal at this time."

In April 2006, a then 18-year-old Jackson claimed in a letter written from behind bars that he kidnapped missing 13-year-old Ashani Creighton and killed her. However, his claims were dismissed amid a history of mental illness.

Eyewitness News is working to learn what actions were taken on the letter he wrote regarding the Casey Anthony case.

Bondsmen: I Wasn't Working For Anthony's Attorney
Tony Padilla Says He Wasn't Part Of Defense Team
POSTED: 4:06 pm EDT August 24, 2009
UPDATED: 6:43 pm EDT August 24, 2009
<snipped>
Attorney Jose Baez has argued that anything Anthony told Tony Padilla or his employees is protected by attorney-client privilege and therefore should not be used in her trial. Padilla, however, said that he was not working for Baez and that Baez did not want him to work for him.

"As far as signing any paperwork to be part of the defense team, I never signed anything like that," Padilla said. "Jose was very adamant. He did not want any of us at all working for him."

Padilla said Anthony never confessed anything to him, but that his employee, Tracy McLaughlin, was in close company with Anthony and had insight into her mindset.

"When the time comes I'm sure Tracy's going to shed a lot of light on what kind of person Casey is," he said.

Casey Anthony: Bail bondsman says she talked a lot about jail, not Caylee
posted by halboedeker on Aug 24, 2009 6:36:46 PM
<snipped>
Self-absorbed was the impression left by a WESH-Channel 2 report tonight. The station offered a "Today" interview with bail bondsman Tony Padilla, whose uncle is bounty hunter Leonard Padilla.

In the "Today" interview, Tony Padilla said Anthony mostly talked about jail and never talked specifically about Caylee or trying to find the toddler.

Padilla said Anthony's mood ranged from "very concerned and very overwhelmed" to "very upbeat and very much into like a kind of festive atmosphere." Padilla said that his employee Tracy McLaughlin, who spent a lot of time with Anthony, will be able to offer a lot of insight into the young mother. Kealing added that in an off-camera interview, McLaughlin once told WESH that Anthony never talked about the child.

WESH also reported that the state attorney's office isn't putting much weight in an inmate's letter that he knows who killed Caylee. The prison inmate, Jerry Jackson, says a sex offender confessed to the murder.

3 Rulings Awaited In Anthony Case
POSTED: Monday, August 24, 2009
UPDATED: 4:32 pm EDT August 24, 2009
<snipped>
The judge in the Casey Anthony murder case has not yet ruled on three motions presented at a hearing last week.

Orange County Circuit Judge Stan Strickland will soon decide whether to ban celebrity bounty hunter Leonard Padilla and his associates from testifying about what Anthony said in their presence while out on bond.

Strickland will also determine how much information the defense can receive about volunteers from Texas EquuSearch, which looked for Caylee Anthony's body before it was discovered in December.

Strickland also has yet to rule on whether Casey Anthony's murder trial will take place before her trial on bad check charges.

UPDATED: Anthony Tattoo Pic, Docs Turned Over
POSTED: Tuesday, August 25, 2009
UPDATED: 2:42 pm EDT August 25, 2009
<snipped>
The photos turned over by prosecutors include an image of Anthony's tattoo, which was photographed last week during a jail visit.

The state attorney's office also gave the defense more than 2,000 new documents, including FBI lab reports, as well as CDs containing images from an Internet Photobucket account.

At a hearing last week, prosecutors asked a judge to set a trial date for Anthony's check forgery case, and prosecutors want that trial to take place within the next three months --- well before Anthony goes on trial for murder.

The judge has yet to rule on the issue.

Meanwhile, prosecutors have added two names to the witness list.

Sean Henady, who took aerial photographs of the area where Caylee's remains were later found, and James Thompson, who owns a Maitland computer repair business, are now listed as potential witnesses in the murder case. The role Thompson plays in the case is not known.

UPDATED: Casey Defense Gets Tattoo Photo, 1,700 Pages
Posted: 12:12 pm EDT August 25, 2009
Updated: 12:58 pm EDT August 25, 2009
<snipped>
Casey Anthony's defense team says her murder trial is now scheduled for 2010. In new paperwork filed in the case, Casey's lawyers said the trial is scheduled to begin in June 2010.

The defense also wants Casey's check fraud trial to start in October 2010 and then later pushed that back to November of 2010. Casey's defense team says they're too busy with the murder case to change gears before that date.

Prosecutors have also handed over more evidence for the defense to inspect in the murder case. The defense received a photo that investigators recently took of the tattoo Casey got on her back in the weeks after Caylee disappeared, which reads "La Vita Bella." The tattoo is Italian for "a beautiful life."

The defense also received 1,700 more pages of documents, eight more photo bucket files and FBI records. It's unclear when that evidence will be released to the media.

Prosecutors release more than 2,000 pages to Casey Anthony defense
1:27 p.m. EDT, August 25, 2009
<snipped>
Prosecutors released more than 2,000 pages of investigative documents and pictures to Casey Anthony's defense team, according to paperwork filed this week.

The state gave her defense team 29 compact discs, which included aerial photos of where Caylee's remains were found and pictures from a PhotoBucket account, a picture-sharing Web site.

It also included a picture of Casey Anthony's "Bella Vita" tattoo. The other documents had FBI operating procedures for various divisions, such as the latent print operations unit.

Her defense team filed paperwork in her fraud case. Casey Anthony is accused of stealing checks from a friend and using them at various stores, authorities said. The state wants to go forward with the case.

The defense requests the trial be held in November of next year – after her murder trial is complete. The judge has not ruled on the issue.

Prosecutors Say Anthony's Tattoo Suggests She Wasn't Looking For Caylee
POSTED: 12:26 pm EDT August 25, 2009
UPDATED: 1:20 pm EDT August 25, 2009

The state of Florida has released to her defense team some 2,000 new pages of evidence they plan to use against her.

That includes photos of the tattoo Casey got while her daughter, Caylee Anthony, was missing.

Based on the newly filed document, investigators have gone to see Casey Anthony in jail and taken a picture of the tattoo on her left shoulder.

There are other items of evidence the state has gathered, including eight CDs of images gathered from the public image sharing website Photo Bucket.

Also Tuesday, attorney Jose Baez is now asking for a trial date to be set on Casey Anthony's check fraud trial, and two people have been added to the state's witness list; an aerial imaging and computer expert.

Prosecutors hand over Anthony discovery
Updated: Tuesday, 25 Aug 2009, 5:23 PM EDT
Published : Tuesday, 25 Aug 2009, 5:23 PM EDT
<snipped>
Prosecutors have handed over two thousand pages of discovery to Casey Anthony’s defense team. Those documents include photos prosecutors just took of Casey’s tattoo.

Also in the discovery, new documents from the FBI and more pictures from photo bucket. FOX 35 will bring you more on these documents as soon as they are released.

Casey Anthony is charged with murdering her daughter and the defense is pushing for her murder trial to start next summer but if you ask a Florida prison inmate: Casey is innocent. 21-year-old Jerry Jackson says Casey did not kill her daughter caylee and he claims he knows who did.

Jackson sent a letter to the court house saying if investigators call him by August 15 he'd give a name.

Jackson claims Caylee's killer is an ex of Casey’s who'd been charged with child molestation in the past. The Orange County Sheriff’s Office maintains Casey Anthony is the only suspect in Caylee's death.
