Casey Anthony: When is the deadline on her jail letters?

WESH-Channel 2 Jim Payne put it this way this afternoon: &#8220;One insider tells WESH2 the 15-day deadline imposed by Judge Stan Strickland is up Sunday. There&#8217;s a hearing in the case Monday on another issue.&#8221;

WFTV-Channel 9, however, said today is the deadline. Anchor Bob Opshal said, &#8220;The clerk&#8217;s office is closed today, and as far as we can tell, Casey&#8217;s attorney&#8217;s did not file a motion to keep those letters private. Investigators say the letters are incriminating, and the judge has said he will probably release them.&#8221;

What&#8217;s the right answer on the deadline? The clerk&#8217;s office is closed, as Opsahl noted. Maybe we&#8217;ll learn Monday.

The 15-day deadline for the defense to look over the letters and object to the release has now passed.

Judge Stan Strickland could decide next week whether or not he wants to make them public. The letters in question are the 50 notes Anthony wrote to a woman she befriended while in jail.

On Monday, Anthony's defense team will ask a judge for Texas EquuSearch to turn over all of the names of EquuSearch volunteers and all documents in possession of the group. A motion just filed by the NeJame Law Firm said Anthony's defense is wasting the court's time and taxpayers&#8217; money with these frivolous motions.

RIVER IS NOT ZANNY THE NANNY

RIVER&#8217;S INFORMATION MAY BE INVALUABLE IN THE CASE
River is not a bad person at all. She made a mistake, which she clearly admits in that she got involved with a married man who pursued her-George Anthony. She is ashamed of what she did and knows it was wrong.

Still, she did provide valuable information about the case in that George told her that Caylee&#8217;s death was an accident gone awry. That means George knew that Caylee&#8217;s body was in the WOODS decomposing while open hearted, loving, generous people went searching for little Caylee.

I completely believe that George told this information to River when they had their affair and that River is telling the truth about this, based on River&#8217;s body language, voice and speech analysis and my having spent time speaking with her over the phone.

I also think that it takes a big person to admit their mistakes and to sincerely apologize to another person. I wish River all the best and pray for her strength.

Deadline to Object to Release of Jailhouse Letters is&#8230;

The deadline for filing an objection to Casey Anthony&#8217;s jailhouse letters is Monday at 5:00 p.m. &#8211; meaning the earliest the State could release them is Tuesday morning. This is because all legal deadlines in criminal cases are controlled by Florida Rule of Criminal Procedure 3.040. (The rule is the same in civil cases as well, but defined under a separate number in the civil rules.)

Florida Rule of Criminal Procedure 3.040 - Computation of Time
In computing any period of time prescribed or allowed by these rules, by order of court, or by anyapplicable statute, the day of the act or event from which the designated period of time begins to run is not to be included. The last day of the period so computed shall be counted, unless it is a Saturday, Sunday, or legal holiday, in which event the period shall run until the end of the next day that is neither a Saturday, Sunday, nor legal holiday.


Anyway, the answer is that Casey Anthony&#8217;s defense team has until the close of business on Monday to file an objection to the release of the jailhouse letters. Meaning the earliest the State is legally allowed to release them is Tuesday morning (or maybe Monday at 5:01 p.m. &#8211; I&#8217;m not really sure on that).

The Casey Anthony case heads back into an Orange County courtroom Monday.

Anthony's lawyers want Texas EquuSearch to turn over all records relating to searches done near the woods where Caylee's remains were found.

But the group is fighting the request, saying it invades the privacy of many of the volunteers who joined in the search. And the group's lawyers say Anthony's defense team is just wasting taxpayer money with the motions.

It's also possible the judge will talk about the release of more than 250 pages of secret letters Anthony exchanged with another inmate at the jail.

Judge Stan Strickland denied a request from Anthony's defense regarding access to records for thousands of Texas Equusearch volunteers. Texas Equusearch is the search and rescue group from Texas that hunted around the same spot where Caylee was eventually found.

Judge Stan Strickland denied a motion by the defense to release search records in the Casey Anthony investigation on Monday.

Strickland delayed a ruling during the morning hearing and then released his decision in the afternoon.

Attorney Mark NeJame represented Miller at the hearing. He said that Miller and the records have been available for months, and no request was made by the defense to speak with him or visit his office to review the documents.

"I think they should have the time to come to my office and review the 4,000 documents they're jumping up and down they haven't had access to because they haven't made the time to come over," NeJame said. "It is beyond me. It is incredulous to suggest that there is this bombshell, that things have been hidden from them when they're still sitting in my office."

If defense attorney Jose Baez wants details about the thousands of volunteers who helped search for Casey Anthony's 2-year-old daughter, he's just going to have to look at the records that have already been available to him for seven months, a judge decided Monday.

Casey Anthony's attorney Jose Baez complained that Texas EquuSearch has not turned over all of the names of people who searched the area near the Anthony home in east Orange County where Caylee Marie Anthony's remains were ultimately found.

Texas EquuSearch attorney Mark NeJame said Baez hasn't taken time to come to his office to look at the documents and it's incredulous to suggest there's a bombshell hidden in them.

NeJame said Baez's lack of reviewing the records is "either laziness or sloppiness."

Later, Baez proclaimed: "Why is everyone so afraid of uncovering the truth in this case?" "They are trying to kill Miss Anthony, and we are trying to save her," Baez said. "How can we do it if we are handcuffed at every twist and turn?"

Judge Stan Strickland has withheld ruling on a motion from Casey Anthony's defense regarding records for thousands of volunteers who searched for Casey's daughter, Caylee.

Last year, EquuSearch turned over information about the 32 volunteers who helped search near the area where Caylee's remains were later found, but Anthony's defense team said it believes more people also searched the area.

The defense said it believes some of the volunteers would be able to testify that Caylee's remains were not in the woods in September 2008, the final time Anthony was arrested.

Even if records are turned over, the search group said no one was ever in the exact location where Caylee's body was found.

Strickland said he could rule as early as today.

Lawyers yelled in court Monday during the latest hearing in Casey Anthony's murder case, but Casey sat expressionless, rarely cracking a smile and hardly saying a word to her lawyers. In the end, Judge Stan Strickland denied Casey's defense team their request.

Baez did most of the speaking Monday; Casey's new high-profile attorney, J. Cheney Mason, didn't play a big role.

Late Monday afternoon, Judge Strickland denied the defense request, but said Casey's attorneys can still go and look at the documents and, if they flag something that could be important, they can go back to the judge and try to get that released. The judge, though, isn't going to blanket release all the documents.


WHAT'S NEXT IN CASEY CASE?
Here's what's next in the case against Casey. Later this month, more discovery documents are expected to be released. In May, the civil case brought against Casey by Zenaida Gonzalez will have a pre-trial hearing.

Pen pal letters Casey wrote from jail to another inmate, Robyn Adams, could be made public as early as Tuesday after no one objected to the release of 50 jail house letters. A corrections officer suspected of passing those letters is on paid leave, but the defense decided not to fight their release. &#8220;We're not concerned with anything in there, there's no admissions,&#8221; Baez said after Monday&#8217;s hearing.

Baez said not releasing them would only fuel massive speculation in the media. &#8220;If you look at them within the context, they're of a person locked up 23 hours a day,&#8221; he said.

New accusations are flying against Casey Anthony's defense team.

The attorney for Texas EquuSearch is describing Anthony's dream team of lawyers as &#8220;lazy and sloppy.&#8221;

Anthony's lawyers wanted Judge Stan Strickland to grant them access to the names of every volunteer and all documents the group has relating to the search of Caylee Anthony. Defense attorneys said information the volunteer group is holding could clear their client.

But on Monday, Judge Strickland ruled Texas EquuSearch will not be forced to turn over information on its volunteers.

An FDLE investigation reveals Anthony wrote dozens of letters to another inmate in the Orange County Jail. Anthony's defense says they have nothing to hide.

"We're not concerned with anything in there,&#8221; Baez said. &#8220;There's no admissions. If we move to keep them private, you guys are going to speculate all over the place as to what's in there. You're going to find if you look at them in the context there of a person who&#8217;s locked up 23 hours a day."

There's no word on when the letters will be released.

Cheney added: &#8220;We are not going to lightly be relegated to having to rely on the judgments and expertise of Mr. NeJame or anybody else as to what&#8217;s relevant or is not. Even the state can&#8217;t determine that. They have to give it all to us.&#8221;

Mason repeated his contention &#8212; which he made long before he joined the defense team &#8212; that there is no forensic evidence to link Casey Anthony to her child&#8217;s murder.

And what about those 50 letters that Anthony wrote to a fellow inmate at Orange County Jail? Baez told &#8220;In Session&#8221; that they contain his client&#8217;s communications about food and what she&#8217;d like to do when released.

Circuit Judge Stan Strickland on Monday denied a request by Casey Anthony's defense to gain access to documents on over 4,000 volunteers that helped search for Caylee Anthony.

Anthony's defense recently tried to force TES to turn over documents on all volunteers who had helped search, not just the ones identified by the company as having been in the area.

TES argued that the files on all the volunteers have been available to the defense since Aug. 27, 2009, and that Anthony's lawyers would be welcome to review them at their office. TES also said that no visit to review the documents has yet been made.

Strickland said since all documents are available to the defense, and Buchanan's affidavit supports the claims made by TES, that there was no reason to modify the previous court order.

If the order had been amended, thousands of volunteers could have lost their anonymity.

At 6 p.m., Pipitone had time to explain Strickland&#8217;s ruling. The judge had given the defense team the right to look at the documents seven months ago. Strickland wrote that nothing he heard &#8221;would justify the forced release of information&#8221; on all volunteers and that he &#8220;cannot sanction the wholesale upheaval&#8221; of the Texas EquuSearch system, &#8220;potentially impeding future searches.&#8221;

Anchor Jacqueline London asked about searchers that could be &#8220;bombshell witnesses.&#8221;

&#8220;You hate that term bombshell &#8212; it&#8217;s so overused,&#8221; Pipitone said. &#8220;None of them say they were at the exact spot where Caylee&#8217;s body was dumped.&#8221;

Assistant State Attorney Linda Drane Burdick wants the transcripts for the two-hour hearing on Aug. 21, 2009. She doesn't explain in her one-page request filed Monday why the state seeks the information.

At the August hearing, attorney Todd Macaluso, who is no longer a member of the defense team, announced in court: "The body or remains of Caylee Anthony were placed there after Anthony was locked up in the Orange County facility."

The defense at the time wouldn't go into details about what evidence they had. Macaluso's statement was part of the defense's request to obtain records from Texas EquuSearch, the volunteer group that helped search for Caylee.

The group claims there was too much flooding in the area and they could not search the exact location where Caylee was later found.

In the summer of 2008, Texas Equusearch was contacted to help in the search for Caylee Anthony. 4000+ volunteers helped in the search. Anthony's lawyers believe the records may help prove Casey Anthony's innocence.

So far, the defense received information on 32 volunteers who initially searched the area near where Caylee's remains were later discovered. Flooding at the time kept people from looking too closely in that exact location.
Volunteer Joe Jordan later claimed Caylee's body had been moved to the area.

"I am a little disappointed in that, I mean, Joe Jordan was out there in that area, seen how high the water was, and I honestly believe that (he) was put under a little bit of pressure by the defense P.I.," said Miller.
