UPDATED: Motion Filed To Have Judge Removed In Casey Case
Updated: 11:39 pm EDT April 16, 2010
<snipped>
Casey Anthony’s defense filed a motion Friday to have Judge Stan Strickland removed from the case. Jose Baez claims that Strickland should be removed because he has had contact with a blogger, who covers the Casey case, named Dave Knechel, otherwise known as Marinade Dave.

The defense cited the incidents with Knechel and called Judge Strickland a publicity hound who's concerned about politics, and made a comment about not wanting to set a trial date until after his re-election.

Knechel spoke to Eyewitness News on Friday night, and said he thinks the defense is taking a big risk by filing the motion to remove Judge Strickland. "They're putting their hands in hot water. They don't know what the outcome is going to be. Who will the next judge be?".

Eyewitness News Legal Analyst Bill Sheaffer agrees, saying the motion is a mistake because Knechel is not directly involved in the case. Sheaffer said the defense could not ask for a more impartial, patient, or fair judge.

Defense Files Motion Alleging Judge Had Inappropriate Relationship

POSTED: Friday, April 16, 2010
UPDATED: 7:21 pm EDT April 16, 2010

In the motion, Anthony's defense team alleged that Judge Stan Strickland struck up an inappropriate relationship with a blogger known as "Marinade Dave." "The defendant, Casey Marie Anthony, reasonably fears that she will not receive a fair trial because of the conduct and apparent prejudice and bias of the judge," the motion said.

The motion alleges that Strickland contacted Dave Knechel, also known as "Marinade Dave," through his blog and eventually by phone and developed a passing, yet personal relationship with him, but did not disclose the relationship to the defense.

According to the defense, Knechel has blogged about the murder case against Anthony on several occasions, including blogs titled "Casey Anthony must die!" and "Caylee's murder: Premeditated and pretty stupid, too." The defense said Knechel told them Strickland told him, "I got to tell you, you've got the best blog going out there. You've got the best one, really fair."

"Judge Strickland's endorsement of Mr. Knechel's blog is evidence of Judge Strickland's own pro-prosecution slant in this case," the motion said. The defense said Knechel's blog is pro-prosecution and portray Anthony in a negative light, while praising Strickland for his "wise decisions."

Knechel spoke to Local 6 Friday evening. "The fact that he's a nice guy proves he's going to be a fair judge," Knechel said. "I think what the defense is looking for -- they're on a fishing expedition."

In an interview with News 13, Knechel said Strickland told him "needless to say, I do go on the Internet and read about this case. I must say that you have the best Web site regarding this case. You investigate and you are very fair to everyone." Later in the conversation Strickland said “No, you are very good as a writer and you stick to the facts. You are very fair and I'm impressed." Anthony’s defense said that conversation is grounds for the Strickland to remove himself from the case.

News 13 spoke a local attorney, who has been following this case very closely, who said Strickland stays, Anthony's defense team could use his ties to the blogger as a point to appeal.

Meanwhile, if he steps down, another judge would take over the case, and the case would likely pick up right where it left off. However, the defense could go back and question every motion since the beginning of the trial.

Marinadedave.com used to get about 5,000 hits a month when he had only feature content on his site. However, ever since he started writing about Casey Anthony, it has skyrocketed to around 100,000 hits a month. He told News 13 he's a writer who is naturally inquisitive, always asks questions, and talks to just about anybody.

Now he's become a part of the Anthony case. Dave Knechel is more commonly known as Marinade Dave. It's his webpage where he mostly blogs about Anthony. "I go to the hearings, I write about it and I try to take a more neutral stance," Knechel said.

One day after a court hearing in October, his writing was recognized by Judge Stan Strickland. Anthony’s defense said that conversation is grounds for the Strickland to remove himself from the case.

In his opinion, Knechel said what the judge reads or watches on TV doesn't make a difference. "I don't think he would formulate an opinion based on what somebody writes on a newspaper on a blog on a forum on any sort of media outlet," Knechel said.

News 13 asked Knechel about his relationship with Strickland, who said there's nothing there. "I wouldn't say that we’re friends,” Knechel said.

On Friday Anthony's defense team asked to have Judge Stan Strickland removed from the case.

A motion was sought after Anthony's attorneys learned that Strickland has a casual friendship with Dave Knechel, a well-known blogger known as Marinade Dave.

Casey Anthony: In WFTV exclusive, jail friend says Casey Anthony explained how she put Caylee to sleep

<snipped>
WFTV anchor Martie Salt explained that Derkovic shared “whispered conversations” with Anthony in the Orange County Jail and later told investigators about their chats. Anthony is charged with first-degree murder in the death of daughter Caylee.

“She said that she used to knock the baby out so she could go party,” Derkovic said. “She would put her to sleep. Then she would come back and the baby would still be asleep.”

Derkovic hadn’t told authorities about chloroform, Belich reported. But Derkovic shared that detail in the WFTV interview even though she had trouble pronouncing the word.

Derkovic said Anthony put the child to sleep to keep the child from Cindy Anthony, Casey’s mother. Derkovic said Casey felt something of a sibling rivalry toward her child and was jealous of attention the toddler received.

Derkovic tried to get Anthony to open up about Caylee, but was unsuccessful, Belich said. “Nothing I ever said to her actually registered,” Derkovic said.

Belich said that Derkovic answered all of her questions in a 90-minute interview. Belich also reported that Derkovic said she wants no time off her 30-year sentence for sharing information about Anthony.

Casey Anthony: Defense team wants Judge Stan Strickland removed for relationship with blogger — what do you think of that?

"Within the past hour, Casey’s defense team filed a new motion demanding a new judge,” WFTV-Channel 9 anchor Martie Salt said on the 6 p.m. news. “Their motion claims Judge Stan Strickland developed a personal relationship with a journalist-blogger, who told a defense investigator the judge called him personally. Casey’s attorneys say this could influence Judge Strickland.”

Strickland has 30 days to decide whether to disqualify himself and determine whether the defense has made “sound legal arguments regardless of the truth in this matter,” DeForest reported.

In a refreshing bit of frankness, DeForest said it was too early to speculate what it all meant. But speculate he did, saying that a new judge could take over. :(

WKMG anchor Lauren Rowe shook her head and rolled her eyes in disbelief.

“Another wrench thrown in the Casey Anthony saga,” DeForest said.

“A big heavy wrench,” Rowe added.

Casey Anthony: Defense team’s motion to remove Judge Stan Strickland draws withering reviews

Casey Anthony’s defense team was getting bad reviews for filing a motion late Friday asking Judge Stan Strickland to remove himself from the case.

“There is little doubt that one day the defense will be looking back on this motion as the worst move they’ve ever made,” said Orlando defense attorney Richard Hornsby in offering analysis for WESH-Channel 2. “Judge Strickland has previously shown fairness to Casey Anthony in the way he sentenced her in the check case.”

Knechel told WFTV that Strickland was very fair. And Knechel said of the defense motion: “They’re putting their hands in hot water. They don’t know what the outcome will be. Who will the next judge be?”

WKMG anchor Louis Bolden reported that Strickland may have to rule on the motion in the next 30 days — and if he doesn’t, the motion would automatically be granted. WKMG said that Strickland wasn’t commenting.

WFTV anchor Liz Artz said, “We’re not expecting to hear anything from Judge Strickland until he takes up the motion in court.”

Defense Wants Judge To Step Down After Learning Of Friendship With Blogger

Casey Anthony's defense team filed a motion on Friday asking Judge Stan Strickland to take himself off of the case after attorneys said he formed a friendship with a pro-prosecution blogger.

Defense attorney Richard Hornsby, who has been following the case every step of the way, said the request wasn't a smart move.

"There is little doubt that one day the defense will look back on the motion (as) the worst move they've made," Hornsby said. "Judge Strickland has previously shown a fairness to Casey in the way he sentenced her in the check case, and now they don't know who their judge will be."

Hornsby said the No. 1 rule in criminal defense is to know the judge presiding over the trial.

Dave Knechel said he never looked for trouble.

Knechel started his online blog Saturday by saying, "To say I was blindsided by this defense is an absolute understatement." He went on to say "this motion is eating me up inside because I will forever be remembered as the defense's scapegoat."

Just hours before the motion was filed, Knechel told News 13 about his relationship with Strickland. Knechel said the judge had noticed his writing and even told him, in person, he thought his blog was fair.

Knechel said he now wishes he would have kept that interaction to himself. But Knechel isn't holding back on what he thinks should happen with this case and his feelings for Anthony's defense team.

“What the judge needs to do is toss this motion out because it smacks of desperation. When Baez and Mason must attack a blogger and a distinguished member of the court, clearly, they have run out of options," Knechel said.

Casey Defense Team May Have To Re-File Motion

Eyewitness News has discovered there could be a problem with the motion Casey Anthony's defense team filed to remove Judge Strickland from her case.

If you look closely at the bottom of the motion, Anthony's newest lawyer, J. Cheney Mason, notarized it himself. But an inspection of the notary seal shows Mason's certification as a notary expired in November 2009.

WFTV talked to legal analyst Bill Sheaffer Sunday. He said the fact that it's expired could be seen as a defect and an opening for a judge to deny the motion.

However, the defense would be free to re-file the motion with new notarization.

Defense attorneys for Casey Anthony succeeded in getting Judge Stan Strickland removed from the case on Monday.

"Any judge would want to be very careful about what they do in terms of how it's going to be perceived by others," Florida A&M University Law School professor LeRoy Pernell said.

Pernell wouldn't say if Strickland should recuse himself, but he said the relationship with the blogger was questionable, and Strickland removed himself from the case on Monday evening.

"Particularly a judge in a high-profile case has to always consider the impact of what they say or do, whether it's intentional or not," Pernell said.

UPDATED: Stunner: Judge disqualifies himself from Casey Anthony case
Chief Judge Belvin Perry, known for being no-nonsense, will handle Casey Anthony’s case

7:13 p.m. EDT, April 19, 2010
<snipped>
The man who arguably became Central Florida's most recognized judge — without ever making public comment about the case that thrust him into the national spotlight — left some piercing, parting words for Casey Anthony's defense attorneys on Monday.

In an order granting Anthony's request for him to step down from the case, Orange County Circuit Judge Stan Strickland wrote: "At its core, defense counsel's motion accuses the undersigned of being a ‘self-aggrandizing media hound.' Indeed. The irony is rich." In his order, Strickland noted that he did talk to the blogger in court — with a TV camera rolling, microphones on, and in front of the attorneys.

Strickland wrote that he recently began looking at Internet material and blogs to get an idea of what people are saying about the case, which is relevant to the defense's motion for change of venue. The judge noticed Knechel "admonished and frequently chastised those who came onto his blog for the sole purpose of bashing the defendant and her family." Strickland thanked him for being "fair and civilized." "The content of my words and context (open court) both seemed unremarkable," the judge wrote.

Strickland noted that no one from Anthony's defense team provided him a copy of the motion when they filed it "(courageously!) at 4:48 p.m." Friday.

"Obviously, defense counsel's intent was to maximize exposure, and minimize or delay any response," Strickland wrote.
He noted that Anthony's defense has filed a litany of motions in the last 20-plus months, "in between media interviews, guest appearances on television shows, and press conferences."

Strickland also stated that Anthony's defense was aware of his "brief discussion" with Knechel for months. The defense "seems to have only recently lost confidence in the court's ability to be fair and impartial," Strickland wrote. "The Court takes heed of the Defendant's present uneasiness," he stated. "If past is prologue, some defense motions may be denied," Strickland wrote. "Since the undersigned has now been accused of bias and wrongdoing, potentially each denial of a defense motion will generate renewed allegations of bias."

Strickland said the effect "will be to elevate an otherwise meaningless situation into a genuine appellate issue."

Strickland also noted that the accusation that he's biased in favor of the prosecution "must serve as a source of bemusement" to the three prosecutors assigned to Anthony's case, "each of whom has verbally sparred with the Court many times…"

Anthony's lawyers also asked the court not release any information about witnesses the defense may call during the trial's penalty phase, if she is convicted of murder. They claimed identifying witnesses favorable to Anthony might prevent them from testifying.

Defense Alleged Inappropriate Relationship With Blogger

The judge presiding over Casey Anthony's murder trial has recused himself after allegations of impropriety.

Strickland commented on his decision in his order to disqualify. "Defense counsel, who has been aware of the Court's brief discussion with the blogger/journalist for many months now, seems to have only recently lost confidence in the Court's ability to be fair and impartial," Strickland wrote.

Strickland said that if he did not step down, allegations of wrongdoing could be renewed each time he turned down a motion from the defense. "The cumulative effect will be to elevate an otherwise meaningless situation into a genuine appellate issue," Strickland wrote.

After mentioning the defense's countless television appearances, Strickland added on final note before granting the motion to disqualify. "At its core, defense counsel's motion accuses the undersigned (Strickland) of being a 'self-aggrandizing media hound. Indeed. The irony is rich," Strickland wrote.

Judge Stan Strickland has recused himself from the Casey Anthony case. But it doesn't appear it was a move he was happy to make. In the order, signed Monday, Strickland states until now, enjoying his work has never seemed to pose a problem. The judge added some sarcasm in his motion. He said the defense has known about his brief discussion with the blogger for many months, but only now has lost confidence in the court's ability to be fair and impartial.

Legal analyst Will Jay said if Judge Strickland hadn't removed himself from the case, every motion could have been argued again, especially if Anthony is found guilty.

On the same day Strickland stepped down, the defense filed more motions, some regarding the death penalty. One claimed gender bias. Another claimed prosecutors asked for the death penalty after learning how much money Casey Anthony had for her defense.

Jay doesn't think the motions will go far. "I expect the motion to be denied. Almost every death penalty motion challenged gets denied at the trial level,” he said. “But what they're doing is preserving and making it in their record because it's going to be on review for the next 15-20 years, however long if she gets a death sentence.” Jay said any lawyer representing Casey Anthony would have to file any motion they could because they are fighting for her life.

Chief Judge Belvin Perry will now rule over the case.

UPDATED: Judge Strickland Steps Down From Casey Case
Posted: 4:56 pm EDT April 19, 2010
Updated: 7:04 pm EDT April 19, 2010
<snipped>
Big changes are coming in the case against Casey Anthony. She's got a new lawyer and now she has a new judge, too. WFTV found out why conversations with a blogger cost Judge Stan Strickland the case. Judge Strickland has presided over Casey's case for almost two years, but Monday he gave it up. The news broke last Friday when Casey's new lawyer filed a motion asking Strickland to step down, because he complimented a crime blogger in court and called him during a hospital stay.

Strickland made his decision quickly, stepping down Monday afternoon after granting the defense's motion asking him to do so. “At its core, defense counsel’s motion accuses the undersigned of being a ‘self-aggrandizing media house’. Indeed. The irony is rich,” Strickland pointedly wrote in his order.

In a separate order, Judge Strickland confirmed his recusal and Administrative Circuit Judge Reginald Whitehead appointed Judge Belvin Perry Jr. in his place; Perry is highly-respected and known as a tough, no-nonsense judge.

Judge Strickland wrote in his order that he was looking at Internet and blog sites to research the extent and content of the publicity, because the defense was asking to move the trial to another county. He wrote that he noticed that Marinade Dave was actually defending Casey Anthony and her family against the bashing. “This particular blogger/journalist admonished and frequently chastised those who came onto his blog for the sole purpose of bashing the defendant and her family. The Court thanked him for being both fair and civilized,” Strickland wrote in his order Monday. "The content of my words, and context (open court) both seemed unremarkable."

"Since the undersigned has now been accused of bias and wrongdoing, potentially each denial of a defense motion will generate renewed allegations of bias," Strickland wrote. "The cumulative effect will be to elevate an otherwise meaningless situation into a genuine appellate issue."

Marinade Dave shot back over the weekend, accusing the defense of wasting taxpayer money to find him rather than to find Caylee's alleged nanny, Zenaida Gonzalez.

DEFENSE FILES NEW MOTIONS
Casey's defense has also filed four new motions arguing against the death penalty. Two motions argue Florida's death penalty is unconstitutional, because higher courts are unable to adequately reconsider a case and because women accused of crimes like this face different expectations from jurors.

Another motion argues prosecutors shouldn't be allowed to seek the death penalty, because they originally submitted paperwork saying they would not.

The last motion argues for the defense to keep any evidence for the penalty phase out of the trial itself.

WHAT'S NEXT IN THE CASE?
WFTV checked, and the State Attorney's Office gave another 160 pages of discovery to the defense. All WFTV knows is that it was based on documents they wanted after deposing an FBI agent.

At this time, there are no new hearings scheduled in Casey's case.

Casey Anthony: Law professors fault Judge Stan Strickland for reaching out to blogger
posted by halboedeker on April, 19 2010 4:31 PM
<snipped>
Here’s the original post: Did Judge Stan Strickland do the wrong thing in reaching out to a blogger in the Casey Anthony case?

The Anthony team wants Strickland off the case for making favorable comments to Dave Knechel, who writes the Marinade Dave blog. Anthony’s defense team describes the blog as pro-prosecution and says Strickland had validated the blogger.

Two professors at FAMU College of Law faulted Strickland this afternoon.

“Any judge would want to be very careful about what they do in terms of how it’s going to be perceived by others,” Professor LerRoy Pernell told WESH-Channel 2.

Central Florida News 13’s Jacqueline Fell talked to Professor Rhoda Pierre Cato, who said judges must always appear impartial even as social media flourish.

“Facebook and all these social networks are available,” Cato said. “Yes, judges have normal lives. But they’re handled a lot differently because these things are scrutinized when judges engage in these kind of activities.” Cato also told Fell that the Strickland issue needs to be resolved quickly.

UPDATED: Casey Anthony: Judge Stan Strickland leaves the case, cites irony

Judge Stan Strickland is stepping down from the Casey Anthony case, TV stations reported tonight. In departing the case, Strickland had some withering words for the defense. “He does indicate in so many simple words here that he has seen the defense seeking publicity in this case before,” WESH-Channel 2’s Greg Fox reported.

Fox read Strickland’s last line in a three-page response to a defense motion seeking his removal: “At its core, defense counsel’s motion accuses the undersigned [Strickland] of being a self-aggrandizing media hound. Indeed. The irony is rich. Motion granted.”

“Some very harsh words from the judge right there,” WKMG-Channel 6’s Mike DeForest said. WKMG DeForest put Strickland’s move this way: “He felt like he had to step down from this case because the defense team had questioned his impartiality.” DeForest highlighted Strickland’s “one last parting shot” at Anthony’s defense team and its “media interviews, guest appearances on television shows and press conferences” as well as its “litany of motions.”

Chief Judge Belvin Perry will preside over the Anthony case, Central Florida News 13 reported. Strickland was the judge on the case for 20 months. WKMG’s DeForest spoke to a legal expert who predicted that Strickland’s rulings will remain in place and Perry will continue the murder trial as it would have under Strickland.

WFTV-Channel 9 reported that more discovery documents are likely to be released this week. WFTV also noted that a pretrial hearing in Zenaida Gonzalez’s defamation suit against Anthony is set for May.

A Florida judge in the Casey Anthony murder trial is taking himself off the case. Circuit Judge Stan Strickland granted a motion Monday filed by Anthony's attorneys asking that he recuse himself.

Anthony's defense attorneys had argued that comments the judge made to a blogger recently showed he was prejudiced against Anthony.

In his decision, Strickland denied doing anything wrong. But he says he is removing himself from the case because Anthony's attorneys likely would allege bias each time he ruled against their motions.

In a motion filed Friday by her defense team, it states Anthony will not be able to get a fair trail because of a relationship the defense claims her trial judge has developed with a local blogger.

The blogger is known as "Marinade Dave."

In the motion, Casey's defense states "Marinade Dave" has historically presented stories of severe bias and prejudice against Casey Anthony.

Anthony's attorneys say Judge Strickland recently learned that "Marinade Dave" was ill through one of his blogs and that somehow, some way, got his phone number and called the blogger expressing the judge's concern for the his well being.

The motion also states the alleged relationship was not disclosed to counsel and that Casey's defense team only recently learned about it Sunday, April 11th when an investigator working for the defense was interviewing "Marinade Dave."
