In the Anthony murder case, the state responded today to a defense request for documents. &#8220;The defense wants resumes for sheriff&#8217;s investigators whom it calls experts, but prosecutors say they are not considered experts under the law,&#8221; Opsahl said.

WESH-Channel 2 anchor Martha Sugalski said that on Friday the Anthony defense team is scheduled to depose five people, including a neighbor from whom Anthony borrowed a shovel.

Belich noted that one photo showed a breach in the packaging of evidence. She speculated that the defense might try to get the evidence tossed, even as she noted that it wasn&#8217;t clear what was in the package. And Belich reported that evidence from Anthony&#8217;s car trunk was sent to FDLE and private labs for testing. But the FBI wanted the evidence itself and later learned that the testing never happened elsewhere. &#8220;WFTV legal analyst Bill Sheaffer says the defense could try to raise questions about how many people had access to that evidence before it came back to the FBI,&#8221; Belich said.

WKMG-Channel 6&#8217;s Louis Bolden focused on the state&#8217;s interest in Anthony&#8217;s handwriting. &#8220;They are being very meticulous about verifying that it is her handwriting,&#8221; Bolden said. &#8220;Anthony wrote hundreds of letters while incarcerated at the Orange County Jail.&#8221;

The state sent all of Anthony&#8217;s letters to fellow inmate Robyn Adams to be analyzed by the FBI, Bolden said. &#8220;They are being compared to known samples of Casey Anthony&#8217;s handwriting,&#8221; Bolden said. &#8221;But the letters do not contain the most damaging information that Adams claims Casey told her.&#8221;

Caylee Anthony: CBS News shares new photos

CBS News has shared new photos of Caylee and Casey Anthony at its Web site for 48 Hours Mystery. I would imagine that these photos are part of the earlier deal under which CBS News licensed material from George and Cindy Anthony.

But I&#8217;ve asked CBS News what the story is.

CBS News last year paid $20,000 to George and Cindy Anthony to license photos and other material. The parents of Casey Anthony appeared on &#8220;48 Hours Mystery&#8221; and &#8220;The Early Show.&#8221;

State, Team Casey Spar Over Evidence

Prosecutors in the Casey Anthony murder case told a judge on Monday that they do not have information being sought by her defense team.

Anthony's attorneys want the state to turn over forensic documents, including tests performed on evidence.

Meanwhile, Jose Baez, one of Anthony's attorneys, filed an updated list of witnesses to be questioned in the case, including a neighbor of the Anthony family and an Orange County Sheriff's Office employee.

Prosecutors said Tuesday that Casey Anthony's defense team is not entitled to certain forensic evidence from out-of-state experts.

Also Tuesday, attorneys for Texas Equusearch said they were not notified prior to a June 1 hearing being scheduled. They're asking the date for any issue involving them to be rescheduled.

Meanwhile, in response to the defense team's request for eight witness transcripts, the state justice administrative commission said they will only pay for transcripts necessary for the defense of the case. Judge Belvin Perry has yet to rule on this issue.

Prosecutors File Response In Casey Case

Prosecutors filed their response Thursday in the case against Casey Anthony, to the defense's motions challenging the death penalty. The state is calling Casey's attorneys&#8217; arguments against the death penalty, premature since evidence has not been formally presented to the court.

Casey's defense team has submitted seven motions trying to prove a death sentence would be unconstitutional in this case.

Casey Anthony is scheduled to be in court Tuesday afternoon, June 1, where Judge Belvin Perry will hear motions involving jail visiting log records, rulings by a former judge, aggravating circumstances, and a supplemental motion to compel forensic evidence.

New Casey Anthony photos part of old CBS News deal

WFTV reported that CBS News paid $20,000 for several photos of Casey and Caylee Anthony that were recently posted on the CBS web site. Those photos included one of Casey after giving birth to Caylee. Another showed Casey in her high-school senior portrait.

"CBS News says it got those photos last year," WFTV anchor Bob Opsahl said.

Actually, CBS News last year paid George and Cindy Anthony $20,000 for a trove of material &#8212; videos and photos &#8212; that the network used on "The Early Show" and "48 Hours Mystery." The parents of Casey Anthony appeared on both those programs as well last fall.

Could more be coming?

Casey Anthony case: More documents filed in court today

More documents were filed today in the case against Casey Anthony, the 24-year-old accused of killing her daughter, Caylee.

Prosecutors respond to various motions from the defense that challenge Florida's death penalty. Assistant State Attorney Jeff Ashton wrote that some of the defense' arguments are "premature as the court has yet to take evidence in the case." He also sites previous case rulings that support the death penalty.

A hearing is scheduled on Tuesday when Orange-Osceola Chief Judge Belvin Perry will listen to several defense requests, including sealing jail visiting logs and reconsidering prior rulings by a previous judge who stepped down from the case.

When Perry ordered prosecutor Jeff Ashton to reveal the aggravating factors the state will argue to seek death against Anthony, attorney Jose Baez called it a major victory. "We're elated by the fact that the judge is ordering this to occur," Baez said. From elated to deflated: When Ashton filed that list, it was nothing more than five citations of law with no detail -- so little that Anthony's defense filed the motion to strike it as deficient. That motion will be argued before Perry at Tuesday's hearing.

"The aggravating factor issue is not complicated," defense attorney Richard Hornsby said. Hornsby said prosecutors are not required to justify those aggravating factors or reveal before the trial their theory of how Caylee Anthony was killed or why her mother deserves to die for the crime. "To Jeff Ashton, this aggravating factor issue is over. He has complied with it to the letter of the law, and he knows that Perry is not required to give him any more information," Hornsby said.

Perry will consider the defense request to reopen four prior rulings by Judge Stan Strickland on Tuesday. He'll also rule on the motion to strike the state's list of aggravators as insufficient, and he'll also consider a defense motion for more forensic evidence.

Prosecutors are asking Judge Belvin Perry to strike down seven defense motions challenging Florida law as it relates to death sentences in the case against Casey Anthony. In paperwork filed Wednesday, prosecutor Jeff Ashton called some of the motions "premature."

Anthony's defense is attacking Florida law that dictates whether someone convicted of a capitol felony like murder should be sentenced to life in prison or death.

Perry ordered the state to file a written response. He has yet to rule.

Prosecutors reveal legal reasons they believe Casey Anthony should die

Under Florida, law, prosecutors need to raise only one of 15 possible aggravating factors to support their decision to seek the death penalty. Assistant State Attorney Jeffrey Ashton cited five circumstances, according to a document obtained by CNN affiliate WESH and other Orlando, Florida, media outlets.

In death penalty cases, jurors are asked to weigh aggravating circumstances that make a crime especially heinous against mitigating factors that favor mercy, such as a lack of prior offenses.

Among the legal reasons cited: Caylee's death occurred during aggravated child abuse, was especially "heinous, atrocious, or cruel," and was committed in a "cold, calculated and premeditated manner without any pretense of moral or legal justification," according to the document.

Caylee was also under 12 years old, and Anthony "stood in a position of familial or custodial authority over her," the document states.

Anthony's trial is scheduled to begin May 9, 2011.

While reading some of your comments this Sunday, I ran across one from Bees Knees in which she provided Judy PC, a link to a case that seemed to indicate that the State Attorney&#8217;s Office could withhold certain evidence from the Defense until trial, just as long as it is not evidence helpful to the Defendant. Recognizing Bees as one of our blog contributors that is always on the cutting edge of current information, I went to the link she supplied. I found a 2001 revised Florida Supreme Court opinion in the case of Hoffman vs. State of Florida, which discusses the issue of the State&#8217;s failure to disclose evidence favorable to the Defense prior to trial in a death penalty case.

Bees was right in one respect. That is, that the State can withhold exculpatory evidence and get away with it, so long as the Courts conclude that even though the State did so, it doesn&#8217;t matter, because it would not, within a reasonable probability, have led to a different verdict. That, however, is a very dangerous game for a prosecutor to play, especially in a capital case, such as the Casey Anthony case. None of us, especially the taxpayers, want to run the risk of seeing a verdict and sentence overturned and a new trial granted. Therefore, from an ethical standpoint as well as a practical one, I do not expect to see either the State or the Defense fail in their duties to timely disclose all evidence to one another as required by the Rules of Criminal Procedure in Florida.

Motions Hearing Set For Tuesday In Casey Case

Chief Judge Belvin Perry has scheduled a hearing for Tuesday to consider several motions filed by Casey Anthony&#8217;s defense. Perry will consider requests filed by Anthony's lawyers to seal her jail visitation logs, reconsider rulings made by the previous judge, Stan Strickland, and two other motions.

In another development, the state filed a motion in response to the defense's challenge to Florida's death penalty. Prosecutors cited several precedents in asking the judge to deny the challenge.

On Tuesday, Anthony's attorneys will be fighting to keep the public from seeing who is visiting her; they want those visitor logs sealed. Attorneys are also asking Judge Belvin Perry to overturn some rulings in the case made by the original judge on the case, Stan Strickland, that did not go their way. The defense also wants the judge to force the State to be more specific as to why prosecutors are asking for the death penalty. Finally, Casey's defense team wants prosecutors to hand over any and all forensic information they have not received.

Noon update:
Today's Casey Anthony hearing starts at 2 p.m. One of the motions to be argued today: Casey Anthony's defense team wants the jail visitor log sealed. FOX 35 put in a public records request to see who has been visiting Casey Anthony in behind bars. In the month of May, the 24 year old only had five visitors. Jose Baez visited once. Michelle Medina, who is an attorney at the Baez Law Firm, visited twice. Andrea Lyon and her private investigators Mortimer Smith also visited Casey Anthony last month. Other visitors have included Jeanene Barrett, she's a mitigation specialist. She will working on saving Casey from the death penalty if Casey is found guilty of murdering her daughter. Casey's parents minister also visited once. That was in December of 2008, about a week after 2 year old Caylee's remains were found.

UPDATED: More Death Penalty Motions Expected In Casey Case

Casey Anthony's defense team wants the motions reconsidered by Judge Belvin Perry now that Strickland stepped down. There will also be more challenges to the death penalty. The defense says the state hasn't justified its case. Last week, the state responded saying it's too soon to make a decision. Perry will likely make a final decision Tuesday.

Later this week, the defense will begin a vigorous schedule of depositions. On Friday, three people are set to be questioned under oath, including two sheriff's officials and Casey&#8217;s ex-boyfriend, Ricardo Morales. This will be the first round of depositions that are scheduled nearly every week, for the rest of summer.

UPDATED: Casey Anthony Injured In Fall At Courthouse

Orange County Corrections Department spokesman Allen Moore said Anthony fell in the courthouse while being transported to the courtroom and suffered what appeared to be minor injuries. Anthony's restraints became entangled and she fell forward, but escorting officers were unable to catch her before she fell, Moore said. Anthony is currently being seen by medical personnel in an undisclosed location. Moore said the incident appears to be "purely an accident." Orange County Corrections Internal Affairs will conduct an inquiry into the incident, which is routine procedure. Anthony's defense team has been made aware of the incident.

Meanwhile, Anthony's defense team wanted the state to turn over forensic documents, including results on tests performed on evidence, but the state told the judge they didn't have the results. Other motions that will be addressed Tuesday include the use of certain forensic evidence.

Perry advised both the prosecution and the defense not to waste any time. "You've been working on this case for nearly two years," Perry said. There are deadlines and there comes a time when, or as close to as possible, all of the work needs to be done. You all know what needs to be done, so let's get it done." Judge Belvin Perry summoned a court reporter and the lead prosecutor to his chambers before the hearing to meet with the defense. It is not clear why the judge called for the prosecutor to meet with the defense.

Perry decided to seal records pertaining to Casey's visitation and said he will rule on that motion next week. Also, Anthony's defense argued the previous judge's ruling about an illegally made tape-recording of an investigator interview should be reversed. Perry decided that Judge Stan Strickland's ruling was sufficient and kept it.

Defense attorneys argued that they want prosecutors to share forensic information they have not received so far. Perry denied the motion.

Perry denied the defense's fourth motion. The judge said the state has done what he asked them to do and will not order them to reveal more about aggravating factors they plan to use in seeking death.

The defense argued they would like copies of email communications and said they already spent $1600 trying to obtain them. The prosecution said the records are waiting, but will cost $1500 in copying and labor fees. The judge allowed up to $2000 for the defense to retrieve the records.
