Casey Anthony team faces deadline for evidence inspection
Orange-Osceola Chief Judge Belvin Perry sets rules for evidence inspection in order released today.

Casey Anthony's defense team has until noon Thursday to reveal which items it wants to inspect next week with its experts, according to an order today from Orange-Osceola Chief Judge Belvin Perry. Perry's order memorializes decisions he made from the bench during a hearing Friday in the first-degree murder case. By noon Thursday, the defense team should provide a list of items to inspect, the order said.

Those should be grouped by the planned inspection date, either July 13 or July 14. Copies of the list will be sent to the sheriff's office, prosecutors and the court.

Anthony's defense team along with several of their experts are scheduled to go to the sheriffs office next week to look at the evidence.

Just before noon Jose Baez filed a Notice of Compliance. In it he informed the judge that he and co-council Cheney Mason had met with State Prosecutors Tuesday to go over the evidence list, leaving notes of what they were interested in seeing next week.

Baez also wrote that he furnished a copy of that list to the judge. The defense did not file a copy of the evidence list with the clerk of courts office.

Chief Judge Belvin Perry is off until Monday. He could decide then whether to file the defense list on what evidence they want to see next week in the clerks office to make it public.

Casey Anthony's defense team tells FOX 35 that several of the items they're experts are interested in seeing were collected at the recovery site on Suburban Drive where Caylee Anthony's remains were found.

A judge ruled against Casey Anthony's defense's request to not have the sheriff's office present while expert witnesses inspect evidence.

Judge Belvin Perry ruled Friday that Sheriff's Office officials and the prosecution can be present for the inspection of evidence. In addition, cameras will be present.

Perry said the videos will be released to the public after they are reviewed. The inspection will take place on July 13 and 14. Defense attorney Jose Baez must produce a list of the evidence he wants to inspect by July 8.

Casey Anthony's mom to answer questions about 911 call

Casey Anthony's mother must answer questions about a series of 911 calls she made after learning that her granddaughter was missing, according to her mother's attorney. Brad Conway, Cindy Anthony's lawyer, confirmed today that she and her son Lee were served with subpoenas in late June to be available for testimony for a critical hearing next week.

Part of the hearing, scheduled for Thursday, July 15, will focus on whether 911 calls Cindy Anthony made two years ago should be admitted during trial. "She's going to tell the truth," Conway said today. "She made the phone calls. It's factual. She's going to testify truthfully."

Lee Anthony, Casey Anthony's brother, was present during two of those 911 calls, which were made on July 15, 2008.

Anthony's defense team has just a few more hours to turn in a list of the evidence they want to inspect at the Orange County Sheriff&#8217;s Office.

Last week, Judge Belvin Perry ruled that deputies need to be present while Team Casey sorts through that evidence.

&#8220;They have met the deadline, but they haven&#8217;t made specific what evidence they want to review,&#8221; WESH-Ch. 2&#8217;s Bob Kealing said at the top of the station&#8217;s noon newscast. &#8220;All they&#8217;ve filed with the clerk&#8217;s office is this notice of compliance saying that they had this meeting with prosecutors, they pointed out what they want to look at, but they&#8217;re not making any more of the evidence more specific.&#8221;

Kealing said that &#8220;it appears in private&#8221; that the defense handed a specific list to the judge&#8217;s office. Kealing said the station was working to get more details.

In a notice of compliance filed Thursday, Anthony's attorney, Jose Baez, acknowledged that he and Cheney Mason met with prosecutors on July 5 and informed them of what they want to review.

Defense attorney Richard Horsnby said the defense's intention to file the list to the judge directly rather than through the clerk's office is their attempt to both comply the judge's order but also keep it out of the public eye.

"It's a public record. Whether it's filed with the judge or the clerk, it will still be put in the court file," Hornsby said.

In keeping with a judicial order, the Casey Anthony defense team filed a "notice of compliance" today, saying it has indentified a list of items held as evidence that it wants to inspect. But the list &#8212; and the items on it &#8212; have not been made public. The list of items the defense wants to review was not available through the Clerk of Court's office because it wasn't filed there. Instead, an inventory was provided electronically to Chief Judge Belvin Perry.

Court officials said the defense this afternoon provided a series of Orange County Sheriff's Office property forms via a password-protected website, but Perry has not yet had a chance to review the documents. "Judge Perry is out of the office until Monday," court spokeswoman Karen Levey said in a prepared statement. "He will review the material when he returns to determine if it can be distributed at that time." She said the property forms amount to at least 100 pages and were not formatted as a list.

Defense attorney Jose Baez said there is nothing secretive about Thursday's filing, but noted that his team has no obligation to identify the evidence it wants to inspect specifically with the Clerk of Courts. He has identified the items for prosecutors, the Sheriff's Office and the court. "We're not obligated to file anything with the clerk's office," he said. "It's just property receipts." In addition, he said he already has indicated in court what items the defense team wants to review, primarily those objects recovered from the area where Calyee's remains were found. The request amounts to about 50 or more pages of property receipts, he said. Each receipt may include more than one item. As for the public learning specifically what those items are, Baez said that will be up to Perry to decide. "If he wants to make the stuff public, he's the judge," Baez said.

Kealing talked to a court official who agreed with Hornsby and said the list will be made public once the judge gets it. In an update at 5 this evening, Kealing reported that a court official said the defense team e-mailed Judge Perry a link to property forms from the sheriff&#8217;s office and not an evidence list. Perry is on vacation. &#8220;Perry&#8217;s going to have to figure out what he wants to do on this issue when he gets back in on Monday,&#8221; Kealing said. Hornsby predicted that that the defense wants to look at Anthony&#8217;s car and the bag found with Caylee Anthony&#8217;s remains.

Casey's attorneys met the judge's deadline, which was Thursday at noon, to turn over the list requesting evidence from the sheriff's office and state prosecutors. The list is public record, but the defense did not file it with the clerk and sent it to Chief Judge Belvin Perry late Thursday, while he's on vacation.

The judge expects to release it early next week.

Next Tuesday and Wednesday, four defense experts will examine the evidence at the Orange County Sheriff's Office.


WHAT'S NEXT IN THE CASE?
At a hearing next Thursday, Casey&#8217;s mother, Cindy, and Casey&#8217;s brother, Lee, will be forced to testify under oath while Casey is in the courtroom. Cindy is expected to be questioned about her panicked 911 call to report Caylee missing, when she said it smelled like there had been a dead body in Casey's car. Prosecutors want the call admitted as evidence.

Then, a status conference is scheduled for June 20, but Casey is not required be there.

Judge denies Casey Anthony evidence request

Casey Anthony was in court Friday afternoon for an emergency hearing about the defense&#8217;s upcoming inspection of the evidence to be used against her. The defense has a right to inspect the physical evidence but they&#8217;re not allowed to be alone with the items. A representative of the State Attorney&#8217;s Office or the Sheriff&#8217;s Office is always present to maintain the integrity of the evidence to be introduced at trial.

Judge Perry considered the reasonableness of the defense&#8217;s argument but, in the end, denied the request. He ordered the State, however, to make available a room adjacent to the area where the evidence will be viewed so that the attorneys and experts can have private discussions throughout the day. The State is allowed to be present during the inspection which will occur on July 13 and 14.

The next scheduled hearing is July 15 at which time the judge will entertain defense motions for copies of Texas Equusearch documents and preclusion of two of Cindy Anthony&#8217;s 911 calls placed exactly two years earlier, to the day. Cindy Anthony reported her granddaughter missing on July 15, 2008.

Prosecutors Wednesday filed documents laying out their arguments for why the jury should be able to hear 911 calls made by Casey&#8217;s mother, Cindy Anthony, in July 2008. Casey&#8217;s lawyers have been trying to keep those calls from her mother excluded from the upcoming trial, but according to published reports, prosecutors want those calls allowed as evidence.

Prosecutors said the series of calls Cindy made to 911 lays out a timeline of how Casey created a kidnapping story to cover up her daughter&#8217;s disappearance after initially denying that Caylee was missing. Still, the defense argued the calls should excluded because they are testimonial and hearsay. It remains unclear when Judge Perry will rule on the motions.

One of Casey&#8217;s lawyers quits case

Andrea Lyon is the second lawyer to depart from the case in less than six months. In court papers, Lyon said she had "no choice" but to withdraw from the case. &#8220;It&#8217;s strictly a fiscal issue,&#8221; said Jose Baez, Anthony&#8217;s lead attorney.

Baez heaped praise on Lyon, saying she's done a phenomenal job for the defense. &#8220;I don't see much change in perspective. Maybe a small change in style,&#8221; Baez said. The case will continue at full speed ahead. The trial is schedule to being May 9, 2011.

Baez said lawyer Cheney Mason will take over the death penalty component of the case.

Expert witnesses for Casey Anthony look at trunk, trash

The trunk of Casey Anthony&#8217;s Pontiac Sunfire has been carefully inspected by a team of expert witnesses. They also combed over a bag of trash, loaded with tiny little bugs called coffin flies, empty soda cans, a dirty pizza box and broken hangers. Casey Anthony&#8217;s defense team arrived just after 9 a.m. on Wednesday and left just three and a half hours later around 12:30 in the afternoon.

Anthony attorneys Jose Baez and Cheney mason spent a second morning at the orange county sheriff&#8217;s office with the five forensic experts. Still, not one of them would tell us exactly what they are focusing on, which could include any number of articles documented in hundreds upon hundreds of files -- possible evidence in the murder of Caylee Anthony. &#8220;We collected from the list and property sheets what we felt was important to both the states case and ours,&#8221; said Baez.

On Wednesday, the team concentrated on evidence which deputies collected from the Pontiac Sunfire. The lead detective on the case said it smelled like there had been a dead body in the trunk. Investigators tested several stains in the trunk for proof. They also tested the bag of garbage.

In other developments, lawyers will grill Casey Anthony&#8217;s big brother, Lee, and her mother, Cindy, on Thursday. They will focus on a 911 call that started the search for little Caylee.

Casey Anthony's defense team and five of their expert witnesses spent all day from 9 a.m. to 5 p.m. at the Orange County Sheriffs Office. And, they'll do the same Wednesday.

Jose Baez and Cheney Mason aren't saying what evidence their team of experts is looking at today, just that there is quite a bit. "I think its close to 100," said attorney Cheney Mason.

Mason told FOX 35 the team would mainly be focusing on evidence that crime scene investigators collected after a meter reader found Caylee Anthony's remains on December 11, 2008. "Are you guys actually going to be able to test stuff today, take samples or just look at it?" asked FOX 35. "Look. The experts will decide if they want something else," answered Mason.
