Casey Anthony Defense Files New Motion
Baez Wants Release Of Recorded Inmate Call Blocked

Casey Anthony's defense team has filed a motion requesting that a recorded call between defense attorney Jose Baez and a prison inmate not be released to the public.

In the motion, Baez said he was not made aware that the call two months ago between him and Robin Lunceford, an inmate at Lowell Correctional Institute in Ocala, was recorded.

Corrections facilities are allowed to record inmates' telephone conversations, and under Florida law those recordings are public record. However, Baez argues in the motion that he was unaware the conversation was being taped. Under Florida law, it is a felony to record a telephone conversation without the consent of both parties.

The prosecution said it plans to release the call to the public.

Anthony attorney &#8220;Jose Baez is hanging his hopes on a state prison inmate,&#8221; WFTV-Ch. 9 anchor Bob Opsahl said in introducing a report tonight. The inmate is Robin Lunceford, and she says that Anthony&#8217;s jail pals Robyn Adams and Maya Derkovic &#8220;made up incriminating stories&#8221; about Anthony, WFTV&#8217;s Kathi Belich reported.

Baez has asked Judge Belvin Perry to seal a phone call, recorded by the prison, between him and Lunceford. &#8220;One of the first lessons the defense learned in this case was there&#8217;s no expectation of privacy in either a correctional facility or a jail,&#8221; WFTV legal analyst Bill Sheaffer said.

WESH-Ch. 2&#8217;s Amanda Ober talked to a mental health counselor about Cindy&#8217;s I-believe-Caylee-is-alive statement. What&#8217;s up with that? &#8220;I really don&#8217;t know of anyone who could go through all she has gone through and not need help,&#8221; counselor Jim West said.

And what of Lee&#8217;s mouthing &#8220;I love you&#8221; at his sister, causing her to weep? &#8220;It sounds to me that he was trying to forgive her, and when she burst into tears, that to me looked like she was feeling guilty,&#8221; West said. In letters to a jail pen pal, Casey Anthony accused her brother of sexually abusing her.

You may not be a mental health counselor, but feel free to draw your own conclusion. There&#8217;s so much speculation in this case.

Casey Anthony attorney wants 'illegally recorded' phone call with prisoner sealed

Casey Anthony attorney Jose Baez has asked the court to seal what he calls an illegally recorded phone conversation he had with a state prisoner who conspired with other female inmates to tell lies about his client.

Much of what inmate Robin Lunceford told Baez &#8212; as well as other details &#8212; is unknown. Baez provided few specifics in a document he filed with the court and during brief interviews with the Orlando Sentinel on Friday.

Many inmate calls are recorded by officials who run the institutions where they are incarcerated. That was the case with this call, Baez said. But at the time he was unaware he was being recorded and did not consent to the recording.

Orange-Osceola Chief Judge Belvin Perry on Thursday said he would schedule a hearing later to consider Baez's request. Meanwhile, the recording is not to be released. In his motion, Baez argues that "disclosure of the unlawfully intercepted conversation would be a third-degree felony."

How long can trial witnesses remember?

By the time jurors hear the Case Against Casey, nearly three years will have passed. The trial against the Orange County mother accused of killing her is scheduled for May 2011.

A legal analyst says that lapse could spell trouble. It's not uncommon for it to take a number of years for a case to reach trial, especially when the death penalty is involved. However, it does pose problems when it comes to witness testimony.

These were common utterances Thursday in court while Cindy and Lee Anthony recalled the day they learned Caylee was missing. Many times attorneys had to show them transcripts of past interviews to refresh their memory.

"They've put their stories on record so many times that when they're being asked do you remember making this statement at this time, it's going to be hard for them to parse it out and say 'God was that the time I talked this time or was this the time I talked before?'"said Will Jay, legal analyst.

Jay said this is a problem most of the witnesses who aren't experts or law enforcement will have when taking the stand when the case does reach trial. When it comes to their testimony about what Casey told them, it's the detail that's key.

Cindy Anthony: Caylee is still alive

A 911 recording in which Casey Anthony's mother tells a dispatcher that her daughter's car smells like a dead body can be used during the Florida woman's first-degree murder trial. Judge Belvin Perry, Jr. ruled during a pretrial hearing Thursday that the 911 recording can be introduced during the trial next May.

Casey Anthony's mother, Cindy, testified that when she called 911 in July 2008 she wanted to get the dispatcher's attention so that officers would come out to her house.

More than an hour after sitting on the stand testifying on Thursday, Cindy Anthony said something that took the courtroom by surprise. "I still think Caylee is alive."

Judge Denies Motion, Allows Cindy's 911 Calls

Chief Judge Belvin Perry ruled late Thursday afternoon that Cindy Anthony's frantic 911 call about the smell of a dead body in Casey's car can be used in her trial. The case against Casey was back in court Thursday afternoon on the two-year anniversary of when Caylee Anthony was first reported missing. Casey is facing a first-degree murder charge in her daughter's death and a trial is set for next year.

Judge Perry, though, did give the defense one victory, granting their request to keep the list of evidence, which they reviewed over two days this week, sealed.

Baez also asked Judge Perry to seal an interview they did with a mystery state inmate and wants Casey to be able to come to court without handcuffs on. Judge Perry said he would consider it and told the prosecution to hold off on releasing the inmate interview once they get it.

Wild stories emerged Thursday in the case against Casey. Newly-released documents show the private eye who was supposed to find Caylee Anthony alive was relying on tips from psychics and making up stories to tell reporters. Over 2,400 pages of documents were released Thursday afternoon. They include more letters to Casey Anthony in jail and hundreds of pages of emails involving private eye Dominic Casey and psychic Ginny Lucas. A lot of the emails discussed where Caylee might have been and who she was with.

At least one of the emails shows that a psychic was making up a fantastic story to explain how someone kidnapped Caylee to Venezuela, a story the Anthonys' private investigator, Dominic Casey, was apparently helping defense attorney Jose Baez sell to Geraldo Rivera; and Geraldo was apparently planning to go there. Dominic Casey was cooking up stories with psychics about what happened to Caylee in the months before her remains were found in the woods near her house. One psychic and Mr. Casey came up with this scenario: Caylee was flown by private jet from Orlando Executive Airport to Puerto Rico; from there, she was taken to Colombia and then to Venezuela.

The back story they came up with was that Caylee's mother, Casey, had witnessed some major drug buy involving a Puerto Rican mob and that they threatened to harm Caylee if Casey snitched. The psychic told Mr. Casey to fill in the timelines and asked whether the story seemed too far fetched. Mr. Casey told the psychic that Casey's defense team was planning to sell the story to Geraldo.


MORE LETTERS RELEASED, INCLUDING FROM CINDY
For some reason, Cindy Anthony apparently sent mail to Casey at the Orange County jail using Casey's defense attorney's office address as her return address, trying to make it look like privileged defense correspondence, but no one fell for it.

Cindy sent several letters using defense attorney Jose Baez's office address as her return address, even going so far as writing "legal mail do not open" on one of them. The jail didn't fall for it and opened it anyway. Cindy was angry that she was called out for it and later wrote to Casey: &#8220;They must think I'm really stupid. Why would I send you a card and put another address besides mine on it?" A month after the first release of the Anthonys' letters to Casey, apparently Cindy wrote another one to her, on July 25, less than two weeks ago, telling Casey how much she supports her, wants to hear from her and believes in her innocence.


WHAT'S NEXT IN THE CASE?
Casey Anthony's next appearance in court hasn't been scheduled yet, but her defense team will check in with the judge on August 30.

Casey Anthony's attorneys also received more prosecution documents that will soon go public. The defense now has that controversial audio recording of attorney Jose Baez's phone calls with state prison inmate Robin Lunceford. It also has calls that Casey's jail friend Robyn Adams made from the Orange County jail and from federal prison where she's now serving a drug sentence

Her name is Robin Lunceford and she claims that former pen pals of Casey Anthony lied to Orange County detectives.

"She'd sit in front of the whole dorm and would brag how she's lying,&#8221; said Lunceford.

News 13 spent an hour last week with Robin Lunceford inside the Lowell Correctional Institute in Ocala.
She was housed with Maya Derkovic, the woman who told detectives Casey would "knock out" Caylee so she could go out.

&#8220;She told me she made it up. She made it up at my door,&#8221; Lunceford said.

Is This Call Being Recorded?

Well it looks like somebody got caught with their hand in the cookie jar while I was away, as our good friend Jose Baez filed an eight paragraph Motion for Protective Order Regarding a Telephone Recording of Robin Lunceford.

And since I had nothing better to do after a week long vacation, I thought it would be nice to annotate and analyze the eight paragraph motion for my unfaithful readers to help them understand what really transpired between Jose Baez and Robin Lunceford.

Did Jose Have an Actual Subjective Expectation of Privacy?
Even if were true that Jose Baez was never made aware that he was being recorded, the real question is whether he had an actual subjective expectation of privacy.

Considering that Jose Baez is a lawyer and he does not dispute he knew that Robin Lunceford was calling him from prison, it would defy logic for him to reasonably believe that any conversation with a person in a Florida state prison was not being recorded.


Even if there was an Expectation of Privacy, Does Our Society Recognize it as Reasonable?
Even assuming that Jose Baez had a subjective reasonable expectation of privacy, the real question is whether our society is prepared to recognize his expectation as reasonable considering he was talking to a person whom he knew was a convicted felon, in prison, and who was not his client.

Ironically though, even if Ninth Judicial Circuit Chief Judge Perry were to throw Jose Baez a bone and grant him some relief, Judge Perry does not have jurisdiction over the Lowell County Annex located in Marion County of the Fifth Judicial Circuit.

Thus a public records request there would require the Lowell County Annex to release any phone calls of Robin J. Lunceford from May of 2010. (hint, hint)

Central Florida News 13 interviewed prison inmate Robin Lunceford last week before her name emerged in the Casey Anthony saga. &#8220;She had sent letters to me. That&#8217;s how her name came to my attention,&#8221; reporter/anchor Adam Longo said.

Longo estimated that two weeks elapsed between the time he heard from Lunceford and their interview Wednesday at the Lowell Correctional Institute in Ocala. Anthony attorney Jose Baez filed a motion Thursday to seal a call he received from Lunceford.

&#8220;I knew she had reached out to him,&#8221; Longo said. &#8220;I didn&#8217;t know about the recorded phone call and Baez wanting to suppress the recorded call. The story focuses on her claims. Can she be believed? You decide.&#8221;

Prison officials told Longo that Lunceford had a lengthy disciplinary history, that she is manipulative and has limited credibility. Derkovic did not reply to Central Florida News 13&#8217;s requests for comment, Longo said in the report.

&#8220;She [Derkovic] was transferred in May to Broward Correctional Institute in Fort Lauderdale,&#8221; Longo said. &#8220;It&#8217;s another part of the story. Why was she transferred? Baez believes it&#8217;s for one issue. Prison officials say it&#8217;s another.&#8221;

Casey Anthony: WFTV asks if defense is trying to discredit George Anthony

There was no response from the defense team in WFTV&#8217;s report, which often sounded more like a commentary than a report. The segment was heavy on speculation.

How might the defense try to do that? Sheaffer speculated that the defense might want to show George was mentally unstable, because of the suicide attempt, or even present him as a possible murder suspect. &#8220;He was the last person to see Caylee along with Casey,&#8221; Sheaffer said. &#8220;The duct tape came from his house. The heart-shaped stickers came from his house.&#8221;

Or, Belich speculated, the defense might use George&#8217;s suicide attempt to show the family is dysfuntional and, for that reason, Casey deserves mercy.

The judge in the Casey Anthony case today ordered the State Attorney's Office to give him a copy of a recorded prison phone call between defense attorney Jose Baez and a prison inmate.

Chief Judge Belvin Perry's order directs the state to give him a copy of the call so he can review it in private.

Perry's order also directs the state to file a written response to Baez's motion to seal.

Baez: Suicide Threats May Help Jury Spare Casey's Life

Casey Anthony's lead attorney, Jose Baez, told Local 6 News that his team is investigating the incident and could use what's discovered in the death penalty phase of Casey Anthony's murder trial, if she's found guilty.

Baez said George Anthony's suicide attempt may convince a jury to spare his client's life because it shows how Caylee's death has affected the family.

Baez said he plans to prove Casey Anthony's innocence, but added that he must prepare for the worst-case scenario.

Judge Belvin Perry ordered prosecutors on Monday to turn over a disputed recording that was the subject of a new court filing from Casey Anthony's lawyers.

In his motion, Baez claimed not to know the call was being recorded. Prosecutors have obtained a copy of the tape and plan to release it as discovery evidence.

Perry ordered prosecutors to turn over the recording so he can listen to it. He also told them to respond to the issues Baez laid out in his motion in case Perry decides to have a hearing on the matter.

Casey's Defense Investigates George Anthony
Baez Says Team Must 'Investigate Everything'

Casey Anthony's defense attorney, Jose Baez, acknowledged that his team is investigating his client's father, George Anthony.

Once a jury has found someone guilty of first-degree murder, mitigation is testimony offered by the defenses to convince the jury to vote for life instead of death. George Anthony's attorney, Brad Conway, said mitigation evidence would involve events that lead up to Caylee's death. "They're going to have to prove the relevancy of a suicide attempt after the fact," Conway said.

Conway said the defense's investigation comes as no surprise to him. "I expected they would investigate George just like any other witness," Conway said. "We've cooperated with the defense and the state attorney's office transparently."
