Each time Casey Anthony's defense team puts her in a position where she's asked to answer questions but refuses, Sheaffer said, it paints her in a bad light. So even if, despite their legal missteps in the Zenaida Gonzalez lawsuit, Casey wins the right to take the fifth and not answer questions, she loses.
"Who among us, the minute you hear someone has asserted a Fifth Amendment privilege, doesn't think they have something to hide," Sheaffer said.

"It doesn't add up," Gonzalez's attorney, Keith Mitnik, said. "We want to get to the bottom of it. That's why we need to put (Casey Anthony) under oath -- with a court reporter (present) -- and have our opportunity to get to the bottom of the truth, so we can ultimately clear Zenaida Gonzalez's name after all."
"Miss Anthony does have her Fifth Amendment right to remain silent, even though it is a civil matter. If it can incriminate her in a criminal procedure, we feel that she should not have to testify under oath," said attorney Jose Garcia, who represents Casey Anthony.
