New Lawyer Joins Casey Anthony Defense Team

<snipped> ORANGE COUNTY, Fla. -- Eyewitness News has learned the name of the newest member of Casey Anthony defense team.
Todd Macaluso has been a trial lawyer for more than 20 years. His practice is based in San Diego, California.
Macaluso says he joined Casey's team, because he believes she's innocent and wants to prove that in a court of law.
"I believe that Casey Anthony is innocent. I'm going to fight alongside Jose Baez and Linda Kenney Baden, as hard as I can to prove that in a court of law," Macaluso said through a statement released Tuesday.

Late Tuesday afternoon attorney Brad Conway filed a Motion to Restrict Disclosure. Conway said he filed this motion on George Anthony's behalf, insisting the note is something the family does not want released. Conway adds that the suicide note has nothing to do with the State's murder case against Casey Anthony.
According to sources, there is going to be a hearing next Thursday. Conway's motion could be addressed then.
State could still seek death penalty against Casey

According to a spokesperson with the State Attorneys Office the state could still decide to seek the death penalty before the murder trial of Casey Anthony begins in October.
On December fifth last year the state said in a press release that “it is not in the best interest of the people of the state of Florida" to pursue the death penalty against 22-year-old Casey Anthony.
Published reports this week said the State would not reconsider the death penalty and that Anthony would face life in prison.
But Tuesday night spokesperson Randy Means said that “They are preparing the case before them and nothing has changed.” And the penalty they are seeking has not changed but this is "not a predictor of the future".
Baez Expected To Pick Up Casey Jailhouse Video

ORLANDO, Fla. -- In the case against Casey Anthony, Eyewitness News expects to find out Wednesday if defense attorney Jose Baez picks up the jailhouse video taken of Casey the day she learned her daughter's remains were discovered.
Baez could have picked up the videotape on Tuesday, but Eyewitness News learned he did not pick it up.
On Monday, Baez convinced a judge not to release the videotape to the public until he has a chance to see it and find out how it was recorded.
The state made a copy of the videotape for Baez.
The judge has 15 days to either release the video or seal it.
Casey Anthony Answers Questions In Civil Suit

ORANGE COUNTY, Fla. -- Eyewitness News has learned Casey Anthony did answer questions under oath and in writing in a civil lawsuit she's facing.
Zenaida Gonzalez's attorney, John Morgan, submitted 17 different topics, some with multiple related questions, for Casey to answer as part of her deposition in the case.
Of the 29 total questions, Casey answered to only two. Casey wrote her name to answer the question asking for it, but had a much stronger response to another question.
A court hearing is scheduled for May 19 when Casey's attorney will attempt to get the lawsuit thrown out.

CASEY TO BE BACK IN COURT MARCH 12
Wednesday afternoon, the judge set a court date for Thursday, March 12.
Casey's attorney is trying to get access to more evidence in the case related to DNA tests and evidence taken from a computer belonging to Ricardo Morales, Casey's ex-boyfriend.

In the second motion, Baez is looking for copies of evidence found during the search of Casey's ex-boyfriend Ricardo Morales' computer.
Morales apparently posted a picture of a woman on MySpace with the quote "Win her over with chloroform." Other motions include one to block the state from releasing George Anthony's suicide note, along with other documents from the case set to become public in a few weeks.

Lazzaro wore an "audio video recording device" during a meeting with Lee Anthony at a Subway in Winter Park. Orange County sheriff's investigators were behind a Target during the exchange.
The pages also include investigative reports and phone logs, text messages and leads from the public to law enforcement officers in this case.

Inlcuded in today's discovery is Casey Anthony's interview with detectives the day she was arrested on muder charges in Oct., 2008. There are also hundreds of text messages, images and data taken from Casey's Photobucket account.
There is a transcript of an interview with the private investigator who took video of the area where the remains of Caylee Anthony were finally discovered. FOX 35 has also learned that Casey Anthony's former boyfriend, Tony Lazzaro, was wired and had conversations recorded with Casey's brother, Lee.

Included in the more than 20 pages of material were pictures from Casey's Photobucket.com Web account showing skulls and skeletons kissing.
There is also a photo of Caylee Anthony with a heart. It's similar to the heart sticker that was found with the toddler's skeletal remains, according to WFTV.

If any of these dealings exist, prosecutors want Casey Anthony to sign a waiver saying she's aware of them. Baez said he's been consulting an ethics lawyer all the way. Tomorrow he said he'll file a sworn motion repeating his stance that he's done nothing unethical.
Repeatedly, Baez has refused to say who is paying for her legal dream team. He said it's nobody's business. For their part, prosecutors said they "are not trying to block Baez from representing Casey."
On Friday, Baez is set to depose Richard Kane, the Orange County deputy who may have missed a chance to find Caylee's remains last August.
Attorneys for Zenaida Gonzalez said Monday they are continuing to comb through the deposition of Casey Anthony's brother, Lee, to figure out what questions they will try to force him to answer. Casey Anthony's lawyer said that one of the questions he will not answer is whether he thinks his sister killed her daughter Caylee. Attorney Tom Luka said he thinks it is highly unlikely the judge in Gonzalez's civil suit will require Lee Anthony to answer that question. Gonzalez's attorneys said they do plan to ask a judge to make that call.
