The first motion, filed by Brad Conway, attorney for George and Cindy Anthony, was to prevent prosecutors from releasing the note which George wrote in January after he disappeared for several hours and left threats of suicide. He was later found at a Daytona Beach hotel. Judge Stickland granted the motion to keep the note private. He did leave open the possibility of revisiting the issue.

Judge Strickland found the defense's request for bench notes to be moot. He asked that the defense make a formal request for information from the Federal Bureau of Investigations and private labs at the University of Tennessee, which were involved in the testing.
Judge Strickland then addressed the defense's request for sanctions against the prosecution because they were not informed about all the evidence removed from Casey Anthony's 1998 Pontiac Sunfire GT on July 16.

The judge called attorneys to the bench and after about a 5-minute private meeting, Strickland ruled against the sanctions.

Judge Strickland briefly addressed motions regarding screen shots taken from the computer belonging to Ricardo Morales, one of Casey Anthony's ex-boyfriends. Morales had posted a picture of a woman on his MySpace page which included the words "win her over with chloroform."

A suicide note recovered from the car of Caylee Anthony's grandfather will not be made public as part of the discovery process in the murder case of the slain toddler's mother, a judge ruled Thursday.
Casey Anthony's attorney, Jose Baez, asked the judge to issue sanctions against prosecutors for failing to disclose to the defense that they had hired an insect expert and a botanist to assist them -- and that those experts had been sent evidence for examination. The judge denied the request.

UPDATED: Judge Denies Every Motion From Casey's Defense Team

Casey Anthony headed back to jail and her defense team headed back to square one. Her lawyers lost every ruling in court Thursday regarding evidence and proposed sanctions on prosecutors. The prosecutors' antics appeared to frustrate the judge.
Casey walked into the courtroom Thursday afternoon wearing a white Cardigan sweater and had her hair pilled back in a bun. She sat down and smiled as she waited for the hearing to begin. Casey sat fidgeting, not wearing the red lipstick she had ordered from the jail's commissary last week.
Casey seemed more subdued in her manner and in her dress. But the usually subdued and laid back circuit Judge Stan Strickland appeared to lose patience with the defense team and he ended up not giving them anything they wanted at the hearing.
Casey Anthony appeared to give her father a passing glance as she shook hands with one of her new defense attorneys Todd Macaluso. George and Cindy Anthony attended the hearing and at one point, appearing to cry, George wiped his eyes.

It was a tough day for her defense team.
Linda Kenney Baden wanted the judge to order the prosecutors to hand over the FBI's bench notes from the DNA testing it did on the evidence. The judge didn't do that because prosecutors don't have them and the judge has no jurisdiction over the FBI outside of Florida.
The judge told the defense to ask the FBI for the evidence. The defense wanted the judge to sanction prosecutors for allegedly keeping evidence from them and concealing the experts who examined the trash bag and a paper towel from Casey's car from the witness list.
"The motion for sanctions is denied." said Judge Strickland.
Thursday's hearing comes on the heels of another brewing battle over jail video of Casey Anthony the day Caylee's remains were found on December 11.
Casey's defense team also wanted all computer evidence from her ex-lover Ricky Morales, who according to investigators had deleted files the day he turned it over to officers. Investigators say Morales had a page in his computer when he was dating Casey that read "Win her over with chloroform."

Judge hears all motions in Casey Anthony hearing

5:17 p.m. After today's hearing, Casey Anthony's defense attorneys said they plan on contacting the FBI and asking for various notes from the agency.
The defense also said one thing they plan to follow-up with at trial is the fact that Orange County Sheriff's Office crime scene investigators destroy their notes once they write their reports.
4:58 p.m. Judge Strickland has heard all the motions scheduled for today. He said that if the investigator who reviewed the ex-boyfriend's computer has notes, he or she needs to turn them over.
4:54 p.m. Judge Strickland denied the defense's request for sanctions.
4:47 p.m. Prosecutor Linda Drane Burdick told Judge Stan Strickland that Jose Baez is trying to argue something he hasn't proven. She said Baez is trying to insinuate some type of police misconduct.
4:40 p.m. Defense attorney Jose Baez was going to call another witness but changed his mind. He is now addressing Judge Strickland.
4:30 p.m. The crime scene investigator was at the Sheriff's Office when Dr. Henry Lee -- one of Jose Baez's experts -- arrived to inspect evidence. Lee was going to inspect the car and other evidence.
4:12 p.m. Defense attorney Jose Baez is now questioning a crime scene investigator who processed Anthony's car July 16.
4:00 p.m.The judge has called the attorneys to the bench and is talking to them now.
3:55 p.m. Judge Strickland has found the defense's request for DNA and evidence gathering is moot. Strickland wants the defense to request the information from the FBI and private labs.
3:40 p.m. Judge Stan Strickland granted Conway's motion. Conway asked the judge to block prosecutors from releasing a note George Anthony wrote in January when he threatened suicide.

Anthony - who is required to attend all hearings - is sitting next to her attorney Jose Baez and co-counsel Linda Kenney Baden. She was seated before the public was allowed in the courtroom. Her hair is pulled back and she appears to be wearing a white cardigan atop a dark shirt and dark pants.
The courtroom is packed with reporters and onlookers. Anthony's parents - George Anthony and Cindy Anthony are sitting in the first row, behind their daughter. Orange County detectives John Allen and Yuri Melich are also in attendance.

Robert Guthrey, an assistant county attorney speaking on behalf of Orange County said they are working on gathering materials the defense has requested in item #19 of the motion, and said he can get the papers and ducments to the defense by March 20.
During the Motion for Sanctions, Geraldo Bloise, a crime scene investigator who processed Casey's car, was interviewed extensively.

A judge denied a defense motion to sanction prosecutors in the Casey Anthony case on Thursday.
Judge Stan Strickland, however, did grante a motion to keep George Anthony's suicide note private.The hearing lasted about 90 minutes. It opened with Strickland quickly ruling on a motion from the Anthony family that prevents the prosecution from releasing George Anthony's suicide note. Anthony survived an attempt to take his life in January.

WKMG-Channel 6's Tony Pipitone predicted many more hearings.
Pipitone's analysis gave WKMG the edge in coverage. He is just so knowledgeable, and he was the most valuable player, stepping in with cogent insights when the sound was cut off in the courtroom. He quickly summed up what had happened after the hearing ended.

WKMG's Jessica D'Onofrio described the scene outside the courtroom. Cindy Anthony, Casey's mother, hugged defense attorney Jose Baez before the hearing and "wiped away tears," D'Onofrio reported.

On WESH-Channel 2, Bob Kealing noted that the parents "only managed to get a couple of glances in court with Casey" and that George was wearing "a very visible Caylee button."
Conway said, "Caylee's always with them, and she always will be with them, and they want everybody to know that."


WESH's Michelle Meredith asked for Baez's reaction after he was denied two of his motions. One was for sanctions against the state. Was he disappointed?
"We're persistent, and we're going to stay persistent," Baez said. "Persistence beats resistance. ... It's part of the job. You don't always get what you want the first time around. But we're going to keep asking what we feel we're entitled to."

Meredith strained to get any reaction from George and Cindy Anthony. Both are evidently fighting colds, and Meredith tried to learn more. But they were mostly mum.
"Cindy, how do you think it went to day?" Meredith asked.
"She thinks it went fine," Conway replied.
Meredith also observed to Baez, "Casey looks scared."
Baez: "That's your interpretation."

Experts Discuss Possible Jury Makeup In Anthony Case

Pipitone asked noted defense attorney Cheney Mason and former prosecutor Elizabeth Rahter what kind of person they consider would make a good juror in Anthony's trial.

"I would want jurors that understand enough about life, that understand the frailties, the weakness of life, that have some empathy, forgiveness and that would not be young people," Mason said.

"I want people who are able to focus and kind of see through those smoke screens and listen to what evidence is being presented and see what's reasonable and what's unreasonable," Rahter said.

The process is part legal art, and jury consultant Susan Constantine says, part science.

Constantine was presented with what is known about the case thus far.

"A child disappears and the mother doesn't call the police for 30 days and makes up the name of a baby sitter she left her with and changes the story about where the baby was taken from her. Who's more apt to believe that kind of story versus those who say this is ridiculous and the woman's lying?" Pipitone asked.

Baez: Deputies Missed Evidence In Casey Case

ORLANDO -- Serious accusations were made Thursday during a hearing in the Casey Anthony murder case. Anthony's attorney, Jose Baez said his expert found 17 hairs and several stains that the Orange County Sheriff&#8217;s Office never noticed in his client's car.

"And that is Dr. Lee went in there, inspected the vehicle and he took them to school, and basically showed them many items that they had not found originally," Baez said.

"If they want to put us through these hoops, we'll go through these notes. But ultimately it's going to hurt them by objecting or not taking the necessary steps because you'll hear me in trial and they'll ask 'did the prosecutor ever ask you for your notes' and guess what? The answer is going to be no," said Defense Counsel Linda Kenney Baden.

It's not just the defense who is crying foul.
The State Attorney's Office has filed a motion of their own, claiming a potential conflict of interest if Casey is selling her story to pay off her attorney. The motion will be heard in the coming days

Casey's New Attorney In Trouble With California Bar

ORLANDO, Fla. -- There's another new twist in the case against Casey Anthony. Channel 9 discovered that her newest, high-profile attorney is in some trouble with the California state bar association. Mark Todd Macaluso is accused of writing bad checks from one of his client's accounts.

Eyewitness News' legal expert said that is one of the most serious allegations an attorney can face. The new attorney was in court with Casey Anthony for her most recent hearing.

The most recent addition to Casey Anthony's defense team spoke with Anthony briefly in court before the hearing began yesterday. The man from California recently signed a motion asking to be allowed to appear in Florida court as a new attorney on the case alongside Jose Baez.

California state bar documents reveal, in January, the bar filed disciplinary charges against Macaluso. The charges allege he misappropriated client funds and misused a client's trust account. That type of account is set up for an attorney to hold the clients money. For example, after a settlement, the attorney would use the money in the account to cut a check.
When Eyewitness News asked Macaluso about the allegations he blamed his staff who didn't handle it appropriately.

The defense in the Casey Anthony case claims fibers in the accused mother's car show it wasn't fully processed

Nothing shocking emerged, but the hearing hinted at the type of questions Anthony's defense team might raise in the future.

Baez also pointed out that defense expert Dr. Henry Lee found 17 hairs and several stains while inspecting the trunk of Anthony's car. The state allowed Lee to examine the vehicle last fall &#8212; months after sheriff's investigators collected evidence from the vehicle.

"It tells us that the car was not completely processed at the time it was allegedly processed by law enforcement," Linda Kenney Baden, one of Anthony's attorneys, said after the hearing.
Forensic issues such as these will come up at trial, the attorneys promise.

Strickland told the defense to ask the labs for the evidence-gathering techniques before filing any motion.
Baden had argued that the FBI and others never gave out that kind of information to private attorneys but would follow the judge's instructions.

"We want all our motions granted," Baez said after the hearing. "If they are not, we will continue fighting step by step."

Local Attorney Looks Ahead To Anthony Trial
Nejame Believes Anthony Team Will Look For Liberals

Lawyers on both sides of the Casey Anthony case skirmished over motions at a hearing in court on Thursday, but the big fight will be at the murder trial itself.
The first part of the trial could be the most critical, which is when a jury will be picked. Noted defense attorney Mark Nejame has been picking juries for 28 years.
"You have drama and passion almost unparalleled," he said.

Nejame said he thinks Casey's team will look for a juror who is liberal and thinks out of the box.
"Someone who is open to other alternatives social services," he said. "Somebody who has had a lot of real-life experiences."

Nejame said the prosecution wants the opposite -- a conservative, someone who thinks in a straight line -- like an engineer who might latch onto the forensic evidence.
"Generally a prosecution is going to look for somebody who is more law enforcement-oriented or victim-oriented and someone appalled about the accusations," Nejame said.
He also said that the prosecution will be very interested in women with children.

Haleigh Cummings' dad rails against media on trip to New York; Jose Baez says Casey Anthony "holding up as best she can"

Central Florida crime stories received national attention Friday morning: the Haleigh Cummings case was on NBC's "Today," the Casey Anthony case was on CBS' "Early Show."

On "The Early Show," Jose Baez, attorney for Anthony, bemoaned "a lot of wild speculation" in the media coverage. He was in Orlando and didn't get a trip to New York.
"Are you setting the stage for an evidence-tampering defense"? anchor Maggie Rodriguez asked Baez.

"No, your know, as far as what our defense is, we've kept that very close to the vest," Baez said. "We don't want to try this case in the media."
Rodriguez asked about Casey's frame of mind. Casey Anthony is charged with daughter Caylee's murder.
"I think she's holding up as best she can. She's trying to stay strong," Baez said.

A defense team questioned an Orange County sheriff's deputy who may have missed a chance to find Caylee Anthony's remains.

The deposition lasted for more than three hours at the State Attorney's Office in Orlando. It was held in private, and attorney Jose Baez said he is not done with his questions.

Cain's account could help Anthony's defense.
"I think he's an important witness, so everyone should stay tuned, I guess," Anthony's lead attorney, Jose Baez, said on Thursday following a court hearing.

If Baez can prove that Caylee's remains were not in the wooded area when Cain visited in August, then he may be able to show that his client could not have placed her daughter's body there. At that time, Anthony was either in jail or being electronically monitored.

How important to Casey Anthony's defense was the deposition today of an Orange County sheriff's deputy?
"His testimony is critical," defense attorney Jose Baez said today before questioning Deputy Richard Cain. Meter reader Roy Kronk in August pointed Cain to the area where Caylee Anthony's remains would be found in December. Cain earlier dismissed Kronk's discovery as just trash. Casey Anthony is charged with her daughter's murder.

At 5 p.m., WESH-Channel 2's Bob Kealing reported that Cain was "grilled by Jose Baez and Casey's defense team for about three and a half hours."
In various reports, Baez said he couldn't comment a lot about the deposition because it wasn't done.

Cain did not make an obvious entrance, Kealing said. "On this day, [he] might as well have been the Invisible Man," Kealing added. Cain has managed to avoid the media, WKMG-Channel 6's Mike DeForest said.

Stations reported that Todd Macaluso, a new attorney for Anthony, could face disciplinary action from the California Bar after being accused of writing $100,000 in bad checks. Macaluso says there was an accounting error by his office staff while he was away for a death in the family, WKMG said.

WFTV anchor Bob Opsahl said Macaluso was "changing his story after a Channel 9 report." The station reported that he was accused of writing the bad checks, yet he didn't disclose that information when he filed for permission to practice law in Florida. "After our report, he filed new paper work today admitting it," Opsahl said.
The judge will decide whether Macaluso can be involved in the Anthony case, WESH's Dave McDaniel reported.

Casey Anthony case: Stop leaking news to media, Orange sheriff says

Orange County sheriff's personnel are being told, firmly, to stop leaks to the media.

"We not going to lose cases because of loose lips," Sheriff Jerry Demings said Friday about what he's telling deputy sheriffs, investigators and supervisors. "If it's active criminal information, don't get caught leaking. If you get caught, it's going to get treated seriously."

The edict comes after months of intense competition by local and national media for scoops in the murder investigation of 2-year-old Caylee Anthony.

Around-the-clock coverage has been driven by anonymous law-enforcement sources and lawyers talking off the record, as well as psychics, bounty hunters and Internet sleuths claiming to have inside information about the child's death.

"Caylee" doll removed from Ebay
Texas doll maker wanted a "memorial out there"

LAKE MARY, Fla. (WOFL FOX 35) - Life-life and cuddly or just plain creepy, a doll with the name "Caylee" was being auctioned on a popular website until about mid-morning on Friday.

The doll's artist is in Texas. She explained the inspiration and back story behind the creation during a interview with FOX 35.

"I named her Caylee, because I thought she looked like Caylee," said Patricia Haydel-Jarrard, who keeps the doll in a crib in her bedroom.

Patricia has been following the Anthony case intimately since the early days of the investigation. When asked if she was attempting to profit from Caylee's death, she responded "I am not one of them. Anybody that knows me knows I don't profit off of a dead baby." When asked why she posted the doll on Ebay.com, Patricia said, "because I wanted the memorial to be out there."

The starting bid was set at $399, with a "buy it now" option for $500.

Brad Conway, attorney for George and Cindy Anthony talked to the dollmaker earlier this week. FOX 35 has learned that Cindy was not happy about the doll. Conway said the Anthony's did believe that the doll maker's heart was "in the right place."
