Anthony Tries To Avoid Answering Questions In Civil Case

In a newly-filed motion, the civil attorney for Casey Anthony is asking the judge in the case for a "protective order," which would declare her off limits from answering questions from Zenaida Gonzalez.

"We're not going to help the state of Florida prosecute my client by giving statements which could hurt her. And I think that that's clear," said Anthony's civil attorney, Jonathan Kasen. "If they really had an interest in the truth, what they should do is stay the civil case until the resolution of the criminal case and then they could ask her any question they want. At that point there would be no criminal penalty hanging over her head."

Casey Anthony's attorney wants civil court to put questioning off until criminal case is done.

The attorney for Casey Anthony in her civil case this week filed paperwork, saying the 23-year-old mother should not have to answer questions while her criminal case is pending.
Every question proposed is "inextricably intertwined" with her first-degree murder case, wrote Fort Lauderdale-based attorney Jonathan Kasen in the four-page document.

Gonzalez's attorneys haven't questioned the detectives &#8211; a move they should have done before attempting to question Casey Anthony, Kasen wrote.
Kasen is asking the judge to stop Gonzalez's attorneys from getting the questions answered while the criminal case is pending. No hearing date has been set.

Local defense attorney, Diana Tennis thinks the defense's motion was a smart move. "I think it would be very unusual for a judge to make a criminal defendant answer this type of question until a criminal case is done. So I think they'll probably get the protective order," said Tennis.

Tennis thinks the plaintiff has a weak case to begin with. Casey Anthony told investigators a nanny by the name of Zenaida Fernandez Gonzalez stole her daughter Caylee. The woman who is suing is just "Zenaida Gonzalez." FOX 35 asked Tennis the relevance of that. "Depending on how important you find your middle name. I think it makes a big difference. "At some point I think this case is going to get thrown out, the civil case that is," said Tennis.

CALIFORNIA MAN KEEPS SENDING CASEY MONEY

The same stranger seems to be looking out for Casey in jail. Since mid-January, a San Diego man named Michael Kelley has sent Casey nearly a dozen checks at $25 each. He sent his latest check on Tuesday.
That combined with checks from two other people, from California and Arizona, means Casey has received a total of $55.

Casey spent nearly $60, on toiletries and snacks, this week.

Casey Anthony case: WESH explains Cindy's new low profile

The crucial insight came from Brad Conway, attorney for George and Cindy Anthony. Conway told WESH that she was hurt deeply by the recently revealed words of her own mother, Shirley Plesea, to law enforcement. Plesea had said that Casey may have hated Cindy more than the young mother loved her own daughter, Caylee. Casey is charged with the first-degree murder of Caylee.

Kealing also swung into analytical mode and said that Cindy won't be able to stay quiet for long. The reason?
Criminal defense expert Richard Hornsby speculated that the state will use Casey's anger at Cindy as a motive for murder.

Fresh from his court victory Wednesday, Jose Baez, Casey Anthony's attorney, told WESH 2 Thursday that he's planning to take a number of key depositions next week. At the top of that list is Casey Anthony's friend, Amy Huizenga.
Huizenga has provided details about Casey Anthony's attempts to explain that smell in her car, and Anthony's apparently carefree, party lifestyle at the same time she told investigators she was out looking for Caylee on her own.
Baez said he also plans to finish deposing Richard Cane. He's the Orange County deputy who may have missed a chance to discover Caylee's remains in August.

Feuds Between Casey, Cindy May Become Key For Prosecution
From the new evidence, criminal defense lawyer Richard Hornsby said the state will use Cindy Anthony's battles with Casey Anthony over how to raise Caylee as the motive for her murder.

Baez To Depose Deputies, Jail Workers

Casey Anthony's attorney will depose several key witnesses next week in his client's first-degree murder case.
Anthony's lead attorney, Jose Baez, will question several Orange County sheriff's deputies who were involved in the search for Caylee along with a private investigator who briefly worked for Anthony's parents, George and Cindy Anthony. Private investigator Jim Hoover, who was questioned by lawyers representing Zenaida Gonzalez in her civil lawsuit against Anthony, will not be questioned under oath in the criminal case.

In addition to those witnesses, Baez will also depose four employees of the Orange County Jail. It's not known if Baez will be seeking answers from them about surveillance video taken inside the jail's medical unit that allegedly shows Casey Anthony hyperventilating when she learned a child's remains had been found in the woods near her home.

The state is preparing to make another large release of evidence in the case against Casey Anthony in the coming days.
A spokeswoman with the state attorney's office said some time next week she's looking to put out hundreds of pages of new material.

Also next week, Jose Baez, Casey Anthony's attorney, plans to depose the Anthony's former volunteer security guard, James Hoover.
Baez said he wants to probe more deeply in to why Hoover and private investigator Dominic Casey searched the woods where Caylee's remains were later found.

Baez is better known these days as Casey Anthony's lawyer. But last spring he was busy defending Nilton Diaz.

Diaz, 31, insists he did not kill or harm 2-year-old Noeris Vazquez, granddaughter of legendary Puerto Rican prize-fighter Wilfredo Vazquez. Instead, Diaz claims he lost his freedom because of Baez' trial performance, strategy and failure to disclose evidence to prosecutors, a tactical decision that prevented jurors from viewing a defense video.

Jose Baez will question -- under oath -- four people with Orange County Corrections on Thursday. These are the folks watching his client in jail.

On Tuesday, he plans to interview two people from the Orange County Sheriff's Office and private investigator Jim Hoover, who volunteered his services to the Anthony family last fall.


On another matter, prosecutor Linda Drane Burdick filed a document, saying she turned a CD of "duct tape photos" from the FBI lab to Baez.

Baez also will question Jim Hoover, a private investigator who worked for George and Cindy Anthony.
Baez has scheduled at least nine depositions for next week, WESH's 2 Bob Kealing reported. "Most are law enforcement and corrections officers, but some are friends of Casey," Kealing said, mentioning Amy Huizenga.
WESH anchor Martha Sugalski said: "The list of names just keeps getting longer and longer."

In recently filed court documents, Nilton Diaz, 30, called Jose Baez "defective" and asked for a new trial.
In the documents Diaz claimed Baez wanted to surprise the prosecution, but the tactic blew up in the defense's face. He also accused Baez of failing to disclose evidence to prosecutors.


"I imagine that Jose did the very best job possible when he represented Mr. Diaz, but as he said, he doesn't let his ego get in the way of what is best for the client and if this motion gets him a new trial, that would be good," said Baez's spokeswoman Marti Mackenzie.

"He doesn't let his ego into the way," Mackenzie said of Baez. "If this kind of motion helps an innocent man get a new trial, he hopes it's successful."

Florida Licensing Statutes are clear; The Private Investigators who involved themselves in the Anthony case appear to have acted in violation of the regulatory provisions governing the investigative profession as set forth in FSS 493. Public should be aware of Licensing Statutes

Feegel is referring to Florida Department of Agriculture and Consumer Services Chapter 493, which governs and licenses private investigators in Florida. &#8220;The chapter clearly states that someone possessing a Class C Private Investigators License &#8211; as did James D. Hoover, the subject of the deposition on March 25th, must be employed by a licensed Class A Private Investigation Agency. It is clear from the deposition that Hoover, with only a Class C, was sub-contracting his services to several Class A Licensees, namely D&A Investigations, owned by Dominic Casey, and Class Action Detective Agency, owned by Alan Buchanan&#8221;.

In Hoover&#8217;s deposition, he testified that he performed investigative work for both agencies and unless D&A was subcontracting work to Class Action, or unless Hoover was an employee (not subcontractor) of Class Action and subsequently D&A, Hoover and both agencies allegedly violated the law.

&#8220;The 493 Chapter is very clear on this point,&#8221; says Chambers, who has been licensed as private investigator since 1982, &#8220;Class C licensees may not engage in investigative services except through a licensed Class A agency. Moreover, Class C licensees are prohibited from subcontracting, which, according to the sworn testimony of Hoover, is what he has been doing for years&#8221;.

I was. But she isn't.

Allen Moore, spokesman for the Orange County Jail, said this recurring topic is a hoax. In a message to a colleague, he said:
"1. Inmates are not allowed access to the Internet or cellular phones.
"2. Attorneys cannot bring mobile phones into the jail.
"3. While an attorney is allowed to bring a laptop into the jail with an air card, inmate clients are not allowed to use it or touch it."
If someone tells you Casey Anthony is Twittering, don't believe it.

WESH-Channel 2 reported tonight that "a source close to the family" says that "the wheels are now in motion for that meeting so the family can mourn Caylee together for a short time."

Anthony's attorney Jose Baez has depositions lined up this week. WESH said one with volunteer private eye James Hoover had been postponed. It was supposed to be tomorrow.
"If the defense tries to go with the theory that maybe Caylee was not out there in November, then that meter reader, Roy Kronk, is going to pose a very serious problem," DeForest theorized. "Perhaps that's why next week Jose Baez plans to interrogate in a deposition the supervisor of that meter reader with Orange County Utilities. That supervisor did not see a body out there back in August."

George and Cindy Anthony asked permission to gather with their daughter to hold a family requiem of sorts for Caylee.
A source close to the family told WESH 2 News the wheels are in motion for that meeting, so the family can mourn Caylee together for a short time.

The depositions -- questioning under oath -- are not open to the public.
So far, Thursday has three more Corrections officers on the list as well as private investigator Jim Hoover, who volunteered his services to the Anthony family.

Friday has Alex Roberts, who is the supervisor of Orange County meter reader Roy Kronk. Kronk discovered Caylee's remains on Dec. 11.
In the afternoon, Orange County Sheriff's Investigator Awilda McBryde is set to be questioned under oath. She is an investigator with the missing persons unit. McBryde spoke with Zenaida Gonzalez, a 38-year-old Kissimmee mother of six, about whether she knew Casey Anthony.
