Jose Baez, Casey Anthony's attorney, filed a motion Tuesday asking Judge Stan Strickland for an exparte hearing.
All along, Baez has said he knows information that will help explain why Casey Anthony didn't report Caylee missing for a month -- and why Casey Anthony didn't kill her daughter.
Baez wants to explain why he is requesting to subpoena certain records that he believes may be critical to Casey Anthony's defense, but he wants to block those records from being made public because he doesn't want to divulge what Casey Anthony's defense will be. Baez said he doesn't want to release to anyone else his so-called theory of defense.

"He wants somebody's records and he does not want to say who. Apparently they won't give it to him if he's tried to through other channels," criminal defense attorney Richard Hornsby said. If prosecutors find out just what records Baez wants, Hornsby said the secrecy strategy could backfire.

Strickland or prosecutors have not responded to the request.

Jail Sergeant Questioned In Case Against Casey

Casey Anthony's defense team interrogated a witness late Tuesday afternoon. Jail Sergeant 58-year-old Dennis Moonsammy was questioned by her attorney, Jose Baez.
Moonsammy supervises Casey Anthony at the jail, and told Eyewitness News he did not see Casey's response the day Caylee's remains were found.

Jose Baez said he believes the depositions he has lined up this week are a serious part of this case.
"It's a life changing situation so I think every part of it is," said Baez.

Baez on Tuesday started the first of 10 depositions by questioning a corrections official, Sgt. Dennis Moonsammy.
The deposition took an hour and 10 minutes, WKMG-Channel 6's Adam Longo said.
WESH also reported that Amy Huizenga, Casey Anthony's friend and a key witness for the state, has hired a lawyer and won't give a deposition to Baez this week.

For an hour, Sergeant Dennis Moonsammy answered questions asked by Baez.
Sgt. Moonsammy is a witness for the State Attorney's office. His attorney, Eric Trivedi, answered a few quick questions after the depositions on his client's behalf. "He was asked general operating procedure and what would have been documented and what would not have been documented," said Trivedi.

Court documents show that the reaction was recorded. Moonsammy was not working that day.

Two sources tell WESH 2 that the friend of Casey Anthony deposed on Wednesday accepted $20,000 for her story from a tabloid.
Casey Anthony's attorney Jose Baez said Cruz' decision to sell her story doesn't immediately diminish her credibility.
"It really only affects someone's credibility if they change their story," he said.

Cruz' deposition lasted just under two hours and was not open to the public. After the session ended neither she nor Baez would talk about what was said behind closed doors.

Escorted by an employee of the state attorney's office and her fiancé who's built like a bodyguard, Kiomarie Torres Cruz would not look at the cameras or answer any questions.

Brad Conway represents Casey Anthony's parents. "It's garbage....garbage. Casey never discussed putting that child up for adoption. If Caylee needed to be taken care of, George and Cindy would have cared for their grandchild as their own," said Conway. Conway went on to say Casey never had a pet that she could have buried back there.

Baez said he felt the tabloid article would only kill Cruz's credibility if she changed her story during depositions or dramatized it to be more.
Three Corrections Officers from the Orange County Jail and James Hoover, the Anthony's Private Investigator are scheduled for depositions with the defense Thursday.

In Strickland&#8217;s order denying the motion, he wrote that Baez&#8217;s request to discuss sensitive matters off camera was not possible as a part of a particular Florida Criminal rule.

That rule provides that an in camera inspection and an ex parte proceeding are not one and the same, and an ex parte proceeding is only proper where permitted by law.
Strickland wrote that no legal authority has been provided to allow such a hearing under the circumstances filed in Baez&#8217;s motion.

Defense attorney Jose Baez questioned Casey's childhood friend, Kiomarie Cruz. She is best known for selling her story to a tabloid.
Cruz made a lot of money selling her story to the National Enquirer. She sold her story for $20,000 and sources say that takes away from her credibility.

The deposition happened Wednesday inside the State Attorney's Office in downtown Orlando. Cruz showed up for her scheduled deposition with a bodyguard leading the way. She's accused of selling her story the National Enquirer, but Wednesday she didn't feel like answering any questions.


At least three more corrections officers will be interrogated by Casey's defense team Thursday, along with the Anthonys' former private investigator, Jim Hoover. Orange County Sheriff's Office investigators will be questioned on Friday.

The judge ruled against that request from Casey Anthony's defense attorney, WKMG-Channel 6 reported at noon today. "The judge just ruled Baez failed to show any legal authority allowing such a meeting," anchor Erick Weber said.

Cruz was not talking to reporters on her way to the private deposition.
Brad Conway, attorney for George and Cindy Anthony, told WKMG that much of the information in the Enquirer story was false
"So much inaccurate things have been said about Casey Anthony that I think no one has the first clue of who she really is," Baez told reporters in a clip that WKMG aired.

Judge Stan Strickland rejected attorney Jose Baez's motion for a secret meeting with the judge. Baez, who is representing Anthony, evidently had hoped to subpoena records but keep them secret.
WESH-Channel 2's Bob Kealing said his station "has learned Baez may try a slightly different tactic to get the evidence he is looking for."

In an interview with WESH, Brad Conway blasted Cruz's statement that Casey wanted to give up Caylee.

WFTV explained the lineup in Baez's depositions: three corrections officers and private investigator Jim Hoover go tomorrow. Investigators from the Orange County Sheriff's Office will go Friday.

Here's the list of those to be questioned today:

Orange County Corrections Lt. Billy Richardson. He was involved with taking Casey Anthony to the medical facility the day the child's remains were found.
Orange County Corrections Lt. Tammy Uncer. She told investigators about a conversation she heard between Casey Anthony and Baez. Uncer also talked about Casey Anthony's medical history while in the jail.
Orange County Corrections Officer Marlene Baker. While in jail, Casey Anthony gave her a letter addressed to then-Sheriff Kevin Beary.
Private investigator Jim Hoover.


Allen Moore, a spokesman for the Orange County Jail, has released a statement:
"No one in the security staff has access to inmate medical records. Only Corrections Health Services Medical Staff would have access to an inmates medical records. None of the Correctional personnel being deposed are part of the Corrections Health Services Division."

Another round of questioning took place on Thursday in the case against Casey Anthony.
Anthony's attorney, Jose Baez, scheduled depositions with three corrections officers and private investigator Jim Hoover. Hoover volunteered his services to the Anthony family.

Corrections Sgt. Johnny Richardson would not talk Thursday to the media about what role he played on Dec. 11, 2008, which is the day the defense team claims Richardson was involved in taking Casey to a jail nursing station.

Corrections officer Billy Richardson was deposed at 11 a.m., followed by Tammy Unser at 1 p.m. Both officers were present the day Anthony was informed about a child's remains being located down the street from her East Orlando home.
Marlene Baker is the corrections officer who Anthony gave a letter requesting a private meeting with her father, George Anthony. She was deposed at 2 p.m.
Baez was deposed Hoover last, at 3 p.m.


Meanwhile, the Anthony family's attorney, Brad Conway, said he expected the jail to deny his request for an in-person meeting between Casey Anthony and her parents, but he does have a request for the jail.
"At the very least what we want is for Cindy and George Anthony to visit with Casey without it being videotaped and released the very next day and on Nancy Grace that night. They just need some privacy with her," Conway said.
A jail spokesperson said Conway has made no formal request and the jail has no intention of providing any special treatment for Casey Anthony.

3 More People Deposed In Casey Anthony Case

The defense grilled jail Sgt. Billy Richardson for nearly three hours Thursday, so long they had to cancel the deposition of another jail officer scheduled for Thursday.
Casey Anthony's attorney, Jose Baez, questioned three more people in her murder case Thursday. Two of them were the jail guards who saw Casey's reaction the minute she found out her daughter's body was found.

Private investigator Jim Hoover was answering defense questions under oath Thursday afternoon about what he and the Anthony family's private investigator, Dominic Casey, were doing at the scene where Caylee's remains were found a month before they were discovered. He told Eyewitness News he believes Dominic Casey had inside information.


Baez is also fighting the release of a jail video of Casey recorded on December 11, the day Caylee's remains were found.
He has put off the hearing he asked for, to convince a judge not to release the jail security video of Casey's reaction on December 11, for some reason.
Friday, he's expected to question two sheriff's investigators. Eyewitness News has learned one of them investigated Deputy Richard Cain.

But there's something else to take away from raw footage that WFTV-Channel 9 posted of reporter Kathi Belich following Baez as she covered the Casey Anthony story.

Belich is tenacious. She is not afraid to get her petticoats dirty or to suffer someone's putdowns. She wants the story for her viewers. She keeps asking questions and sets the pace for others. Look at how the competition followed her indoors today.
