Deputy Refuses To Accept Firing Over Response To Call

Deputy Cain testified on December 18, 2008 and again on January 14, 2009 and the investigation deemed his testimony to be "untruthful."

The resulting punishment for his actions is two-fold, according to the sheriff's office. Cain is to receive 160 hours suspension without pay for "Unsatisfactory Performance" and termination for being untruthful.

However, Cain didn't accept the termination and is fighting the recommendation. He gets two appeals. If he loses the first appeal, he'll be fired immediately. A second appeal would be heard after his termination.

The Orange County Sheriff's Office intends to terminate the deputy involved in the search of the area where Caylee Anthony's remains were found.

Kronks lawyer, David Evans, issued the following statement on his client's behalf:

"He (Kronk) says he's told the truth about what happened from the beginning - and feels that this bears that out. But he doesn't get any satisfaction from seeing this punishment. That's between the Sheriff's Department and Deputy Cain. Whether it's fair or unfair, he's not going to take a position on that."

Shortly after the report on Richard Cain was released, Marti Mackenzie, the spokesperson for Jose Baez released this statement:

The information that Deputy Cain lied about the most critical piece of evidence in this case played second fiddle all week to attempts to analyze
Casey Anthony's behavior at various junctures in this tragic case. The defense knows what's relevant, and we are concentrating on that.

The Florida Bar is now confirming a private investigator is the one who filed the latest complaint against Casey Anthony's attorney Jose Baez.

Cain's "untruthfulness" relates to various interviews with investigators in which he said he did find a bag but it was filled with trash and leaves and other times when he said he didn't find a bag.

Cain can appeal the decision.

Defense Attorney Seeking More Complete Phone Records

In the motion, Baez is asking judge Stan Strickland to order 11 different cell phone companies to turn over certain records to the defense.

Baez wants complete records for meter reader Roy Kronk, the man who found Caylee Anthony's remains; Jesse Grund, Anthony's ex-fiance; Tony Lazzaro, the man Anthony was dating when she was arrested in July on charges of child neglect in the disappearance of her daughter; Richard Cain, the deputy who searched the woods where Caylee's body was later found; Anthony's friend Amy Huizinga; private investigators Dominic Casey and Jim Hoover; and the entire Anthony family.

WFTV-Channel 9's Kathi Belich drew comparisons between Cindy and her daughter, Casey, for the way they responded to questioning. "They both talk in circles and they both change their stories," Belich said.

WKMG-Channel 6's Mike DeForest highlighted how Cindy on Thursday contradicted what she previously said.
She admitted to a detective that she had sent people to the woods to look for Caylee. But on Thursday, Cindy said she hadn't and that such a statement would be a lie.

Cindy had written on MySpace on July 3 that "my Caylee is missing." On Thursday, she said she didn't think Caylee was missing until July 15.
How did Cindy reconcile that Casey said she was working late at night when she didn't actually have a job? "I don't," Cindy said.

An internal investigation revealed that Cain "allowed Mr. Kronk to depart the scene without seeking any assistance." The report goes on to state that Cain "failed to thoroughly investigate the call for service, which ultimately delayed the discovery of the remains."
Upon further review, it was concluded that Cain was not truthful in his testimony, and for that, he faces termination. He was notified on Friday, but will have an opportunity to appeal the decision and has elected to do so, according to the Orange County Sheriff's Office.

Deputy Cain was reassigned to a supply office in January and currently has no law enforcement authority. According to a spokesman with the Sheriff's Office, he will continue to work in that capacity until the appeal process is complete.

News 13 brought in body language expert Susan Constantine to take a look at the tapes of the depositions to give us some insight into how they were reacting to the questioning.

Constantine said George was near his breaking point, and his wife, Cindy, is also feeling the stress. She said she saw hostility from Cindy and sadness from George.

According to Constantine, while George continues to try to recover from the death of Caylee, He is wrestling with his own emotions. But his wife, who Constantine says is mentally stronger, is just fighting to stick with the story she has heard from Casey.

Termination Recommended For Deputy In Caylee Discovery

As one who represented Casey Anthony during negotiations on whether Florida would seek the death penalty, I think it's time that we evaluate the American media coverage of this hitherto unknown twentysomething single mother. Anthony is accused of killing her 2-year-old daughter, Caylee Marie.

Why look at media coverage? Because she has the same rights under the U.S. Constitution as you and I do. And those rights are being disrespected and trampled in what may well be a permanent loss of not only her right to a fair trial, but yours and mine as well.

This is not an issue of adjudicating guilt or innocence. Our constitutional right to due process &#8212; our right to a fair trial &#8212; is being weakened by the commercial incentives of media witch hunts exemplified by the Casey Anthony case. We need to recognize and stop this attack upon us all.

Casey Anthony case: WKMG finds another Caylee searcher who got the cold shoulder from deputy

In an "Only on 6" report this weekend, the CBS affiliate says a volunteer who searched for Caylee Anthony in August also received "the cold shoulder" from Cain.

Volunteer Keith Williams told WKMG that he searched the woods in August and found a bag of undamaged stuffed animals. "Williams immediately alerted the Orange County Sheriff's Office and soon found himself meeting with Deputy Richard Cain," WKMG's Mike DeForest reported.

Cain looked at the bag of stuff animals and threw it back in the woods, Williams said.
The Williams-Cain meeting happened five days after Kronk was "blown off" by the deputy, DeForest reported. Caylee's remains were found in December after another tip from Kronk.

Here's what the show says:

That's an important sweeps ratings period, although the Winfrey people didn't give an exact date for the interview.

Casey's Defense Team Files Motion To Obtain Phone Records

Casey Anthony's defense team is asking a judge to help them get very detailed phone records from 12 prosecution witnesses in the case, including Casey's own family members.

Casey Anthony's attorneys want records of calls, texts and even cell tower pings from Casey's parents and her brother, as well as from the family's private investigators, Casey's friends and ex-lovers, and meter reader Roy Kronk.

Casey's lawyers say the information is "material" to her defense.

In a change of heart, the state attorney's office has filed a letter of intent Monday to seek the dealth penalty for Casey Anthony.

A spokeswoman for Jose Baez, Casey Anthony's attorney, has confirmed that the defense has been notified. Baez is not qualified to defend a client in a death penalty case because he does not have the required amount of experience by the Florida Bar.

The court has also been notified of the state's intention.
The state attorney's office is citing "sufficient aggarvating circumstances" as the reason for Monday's decision.

The defense wants records, including phone calls, text messages, cell tower pings and Internet usage. Baez can't get this information from investigative documents turned over by prosecutors, Baez wrote in the motion.

Kealing, citing a source was in the clerk's office, said the state's position was that "sufficient aggravating circumstances now exist" for the death penalty.

Anthony's defense team has filed a motion to subpoena cell phone records from George, Cindy and Lee Anthony, Kealing also reported. Defense attorney Jose Baez also wants the phone records of meter reader Roy Kronk, who found Caylee's remains.

WESH's legal analyst Richard Hornsby, a criminal defense attorney, says the motion signals that Baez's defense stragety will be to raise reasonable doubt.

"Based upon additional information that has become available since the waiver of intent to seek the penalty of death filed on December 5, 2008, sufficient aggravating circumstances exist to justify the imposition of the Death Penalty," the filed letter states.
The legal aggravating circumstances that would apply in this case would be that the murder was cruel and atrocious and cold, calculated and premeditated.

Prosecutors might also argue financial reasons were behind the murder, so Casey would not have to support Caylee. There is evidence showing Casey's mother was planning to kick her out of the house.
And, just last year, two new and relevant aggravators were added to the law. The victim is younger than 12 and the victim was particularly vulnerable because Casey had authority over Caylee.
