Baez Not Qualified To Defend Death Penalty Case

In the court filing, the state attorney's office said, "Based upon additional information that has become available since the waiver of the intent to seek the death penalty sufficient aggravating circumstances exist to justify imposition of the death penalty."

It is not known if new evidence has been revealed to initiate this filing.

"This is not a death penalty case. We will do whatever is necessary to defend Casey Anthony from the State trying to take her life. We already have death-qualified defense lawyers on our team and are prepared for a vigorous defense," Mackenzie said.

Mackenzie had did not respond when asked who the qualified attorney's are.

The State Attorney's Office confirmed Monday it will seek the death penalty against Casey Anthony in the death of her daughter Caylee Marie.

Marti Mackenzie, spokeswoman for Anthony's defense lawyer, just told the Orlando Sentinel: "This is not a death penalty case. We will do whatever is necessary to defend Casey Anthony from the state trying to take her life. We already have death qualified defense lawyers on our team and are prepared for a vigorous defense."

In addition, it's unclear whether Lenamon will rejoin the defense team. He said he spoke with Baez today, and Baez is reviewing a list of death-penalty-qualified attorneys.

Baez will have to add such a co-counsel if he wishes to continue as lead attorney, should the case indeed becomes a death penalty case.

A letter of intent was filed by prosecutors Monday seeking the death penalty Anthony who has been charged with the murder of her daughter Caylee.

"To be a lead counsel in a death penalty case in Florida, you have to have tried nine serious and complex cases to completion -- and been trial counsel or co-counsel on two death penalty cases," WKMG-Channel 6's Tony Pipitone said.
Baez did not meet the second standard "as far as we know," Pipitone added. The upshot: Baez cannot be lead counsel, although he can remain on the case, Pipitone said.


The Anthony defense team released a statement: "This is not a death penalty case. We will do whatever is necessary to defend Casey Anthony from the state trying to take her life. We already have death-qualified defense lawyers on our team and are prepared for a vigorous defense."

The state says the death penalty should be an option in the case against Casey Anthony.
Now new information is putting back on the table. This is, of course, if Casey Anthony is found guilty of first-degree murder.

We expect to hear later this week why they feel this should be a death penalty case.

Death-penalty possibility changes much in Casey Anthony case, experts say

Prosecutors raised the stakes in the Casey Anthony murder case Monday, announcing they will seek the death penalty for the single mother accused of killing her child.

Terence Lenamon, a Miami attorney who was once part of Anthony's team, gave prosecutors a report in November outlining why the mother should not receive the death penalty. "I'm greatly disappointed that the State Attorney's Office has decided to take this route," he said Monday after hearing the news.

He said this may be a sign that prosecutors are worried about a conviction. They may want "death-qualified jurors" &#8212; jurors who are willing to sentence someone to death. Those jurors also are more likely to convict defendants, Lenamon said. "It changes the dynamics of everything," he said.

Casey Anthony's lead attorney called the state's decision to seek the death penalty against his client a "sad day for justice" and said she's "aware of the forces that are out to get her."

Jose Baez spoke with Local 6 News late Monday night after spending about 30 minutes with Anthony inside the Orange County Jail. The visit took place after the state announced that it would be seeking the death penalty against Anthony, who is charged with first-degree murder in the death of her daughter, Caylee.

On WESH-Channel 2, attorney Mark NeJame said he expected the state's move and predicted it could bolster a plea deal for Anthony.
"It's often happened where the death penalty has been on the table, that the state agrees to withdraw the death penalty in exchange for a life sentence," said NeJame, a former attorney for George and Cindy Anthony.

Things would have been different months ago and the state's action signals a change. "I believe that the state believes it has been empowered with a stronger case and are probably far less likely to offer any type of deal that they might have considered in the past," NeJame added.

On NBC's "Today," former federal prosecutor Kendall Coffey described the state's decision as "a stunning development coming this late in the case." He said the state has "excruciating pressure" on Anthony to make a plea deal.

Baez entered the jail perimeter shortly after 8 p.m. and left at 9:15 p.m., according to official jail records. Casey has not received any other visitors since then.

Around 4 p.m. Monday, state prosecutors announced their plan to seek to have Anthony executed if she is found guilty in the death of her 2-year-old daughter, Caylee.

Jail records Tuesday show that defense lawyer Jose Baez has notified Casey Anthony of the state's decision to seek the death penalty.

Meanwhile, in the wake of Monday's stunning about-face by the state attorney's office to seek the death penalty against Casey Anthony, Baez is scheduling more depositions.

On Tuesday, Baez filed a notice to depose two law enforcement officers. One is a Corrections Lt. Tammy Unser, who said she witnessed Casey Anthony hyperventilate upon seeing TV coverage of a child's remains discovered along Suburban Drive, which was later revealed to be her daughter.

Execute Casey? Not a chance &#8212; but now she might cut a deal

State Attorney Lawson Lamar says he wants to kill Casey Anthony, which I suppose is one way of guaranteeing she dies of old age.

The odds of Casey taking a lethal snooze are about equal to the odds she'll celebrate with milk and cookies if exonerated.

Even Lamar understands that.

For historical reference, I refer you to Richard Adams, an evil psychopath who brutally beat and stomped his 6-year-old daughter Kayla to death. Lake prosecutors tried, but failed, to get a death sentence against him. <snipped>

Orange meter reader balks at Casey Anthony defense request

Roy Kronk's attorney, David Evans, wrote in the filing that Anthony's request for all cell-phone records was too broad and was not "reasonably calculated" to lead to information related to the case. The defense's request "constitutes harassment of Mr. Kronk and a substantial invasion of his privacy," Evans wrote.

The property, on Suburban Drive in east Orange County, is not under contract, Realtor Tina Martin stated in an e-mail.

Martin said the property may possibly be marketed on eBay in the near future.

She requests only interested potential buyers contact their office. Martin also said the memorial that has been created on the land may be addressed as the potential buyer desires.

Veteran Prosecutor To Helm Anthony Case

The lead prosecutor in the case against Casey Anthony is familiar with high-profile murder cases as well as child neglect cases.

Assistant State Attorney Linda Drane-Burdick was tapped to prosecute the case when Anthony was charged with child neglect, but now, the 20-year veteran will take the lead in one of the most publicized murder trials in Florida history.

In order to preserve the integrity of the case, Drane-Burdick has repeatedly declined to talk about Anthony in public, but the experienced prosecutor is well known for her aggressive questioning of witnesses and her desire to be a voice for the victim.

Detectives Track Casey Anthony Sleep Patterns, Travel

Eyewitness News focused on just how closely detectives were able to track Casey's movements in one crucial month last summer, the time from June 16, when Caylee was last seen, to July 15, when Cindy Anthony called 911.

WFTV reporter Kathi Belich tracked Casey's phone records and sleep patterns using a special sheriff's office computer file buried in evidence released last week. Casey made so many calls and text messages, she left a trail of bread crumbs for detectives.

Casey Anthony: More money sought; more documents coming

Zenaida Gonzalez wants more money in her defamation suit against Anthony. But her attorneys didn't say how much they are seeking, WESH-Channel 2 reported. A hearing is set for May 19.

On May 21, the judge will decide whether to force George, Cindy and Lee Anthony to answer questions in their depositions in the Gonzalez case, WESH anchor Jim Payne said.

More interviews and lab reports will be released Friday. WFTV-Channel 9 anchor Matie Salt said hundreds of pages of documents are expected.
