Anthonys Hope Death Penalty Won't Be Imposed
Sources Say Family Surprised, Not Surprised Over Monday's News

The Anthonys' spokesman e-mailed a statement to WESH 2 News: "The state's decision to seek the death penalty will not change the support and love the Anthonys have for Casey."

The attorney for Lee Anthony, Casey's brother, said he did not expect the state attorney's office to make this move given the evidence that's been made public. He described what his client is going through.

"He is probably in shock and horror as is the rest of his family that the state is prosecuting the case to this level," Thomas Luka said.

Baez said the state's announcement was not a surprise to his client.

"She was fully aware that this was a strong possibility. She's aware of the forces that are out to get her," said Baez, who is a strong opponent of the death penalty. "If they think that this is going to make her plea, they're sadly mistaken. They've been trying to intimidate Casey Anthony from day 1 and it didn't work then, and it's not going to work now."

New Law Gives More Power To Seek Death Penalty Against Casey

If she's convicted, Casey Anthony could become the first person in Florida sentenced to death under a new Florida law. It gives prosecutors more power to seek the death penalty against parents who kill their children.

WFTV legal analyst Bill Sheaffer says prosecutors usually make the decision once they have all the evidence, which could mean the FBI is about done with its work in the case.

Investigators believe that Casey Anthony did her best to make sure that her daughter Caylee's body was never found. She never reported Caylee missing she changed stories about when and where Caylee disappeared, but after Caylee's body was found around the corner from Casey's house things have changed.

Congressman Wants To Honor Caylee With Missing Child Program

Federal taxpayer money could soon be used to set up a program in honor of Caylee Anthony.

Months after Caylee's remains were found in east Orange County, Central Florida state congressman Alan Grayson (D-Orlando) wants to fund a $500,000 program that would help find missing children.

The funding, which must still be approved, would provide additional resources for law enforcement to look for missing children.

Dominic Casey's Past Includes Financial, Legal Issues

According to state records, the England-native has been in the construction and consulting business since at least the mid-80s.

Casey's Web site claims he and his team have more than 20 years experience with civil and criminal investigations.

Casey told investigators that Baez contracted him to help look for Caylee less than two weeks after the toddler was reported missing.

A spokeswoman for Baez said the defense never paid Casey for his services.

Casey's colleague, Jim Hoover, said Baez and Casey parted ways over a money issue.

Men In Casey's Life Keep Money In Her Account

Casey's jail account is staying full thanks to two men in her life. One benefactor, Michael Kelley from San Diego, sends Casey $25 almost every week.

The Orange County deputy accused of missing a major Caylee tip last summer took another step in his appeal to save his job.
George Anthony also deposited $100 in Casey's account on Monday. She spent nearly $65 on food, toiletries and snacks.

An Administrative Review Captain will now hear Richard Cain's appeal. The sheriff's office says Deputy Cain lied twice about how deeply he investigated a tip from meter reader Roy Kronk last August about bones in a trash bag near Caylee's house.

New Documents Released In Case Against Casey Anthony

Hundreds of pages were released Friday in the case against Casey Anthony. Among them is new information about the Orange County deputy fired for how he handled a tip about the case.

Also in the documents are results from FBI testing on evidence found in Casey's house and in her car. The tests show that the kitchen knife found in Casey Anthony's car did not have any duct tape adhesive on it, but did have a clear sticky substance of some kind.

Casey Anthony: What does the snake show?

New documents released today in the Casey Anthony case evidently could help the defense.

FBI test results show that dirt and debris in her car trunk could not be matched definitively to the spot where daughter Caylee's remains were found, WFTV-Channel 9 reported at noon. The same goes for "limited amounts of debris found on several pairs of shoes taken from the Anthony home," WFTV's Kathi Belich said.

"Even though investigators say it's possible one of those pairs of shoes had trampled through the forest, the lab found no soil matches," reported Mike DeForest of WKMG-Channel 6.

Lab Test Results Shed No Light On Caylee's Death
Land Where Caylee Anthony Found Heads To Auction

The release of documents included results from some of the tests that legal experts said were the basis for the prosecution's decision to pursue the death penalty.

Also, according to the newest documents it wasn't just a meter reader but also a volunteer searcher who tipped off deputies to the location where Caylee's remains eventually were found. This was in August 2008, and one volunteer searcher told authorities he even took some of the evidence straight to Cindy Anthony, who is Casey Anthony's mother.
Keith Williams, 30, of Orlando grew up in the Casey Anthony's neighborhood and last summer returned to help search for Caylee.

This occurred just five days after Deputy Cain is accused of failing to respond properly to a call from meter reader Roy Kronk. Cain eventually lost his job over lying about the incidents

He is a Bar member in good standing, his office spokeswoman reminded the Orlando Sentinel in a prepared statement. She also questioned the motives behind the newspaper story.

"Based on your questions and actions," she wrote, "this profile you are writing has nothing to do with Jose Baez's representation of Casey Anthony and appears to be a sensationalist persecution of a Hispanic lawyer who has been targeted by a newspaper lucky to find itself at the center of a national story."

Could State Help Pay For Anthony's Defense?
It's Possible, Orlando Attorney Tells WESH

Orlando criminal defense lawyer Richard Hornsby said Thursday this is the only way attorney Jose Baez will be able to hire the experts necessary to defend Anthony in what will be an expensive death penalty case.

"I think the taxpayers are going to get stuck with paying for his costs," Hornsby said.

Hornsby said Baez has a legal right to argue the state should pay for a chunk of Anthony's defense fees.

New Lawyer Joins Casey Defense Team

A new lawyer is joining Casey's defense team. Judge Stan Strickland gave Todd Macaluso the green-light Friday to join Casey's team.

Macaluso said that his expertise is in cross-examining expert witnesses. The judge let Macaluso on, despite ongoing problems with the California bar.

Casey's lead attorney, Jose Baez, has also had problems with the Florida bar.

California attorney on Casey Anthony's defense team can practice law in Florida
Judge grants Todd Macaluso permission

Orange Circuit Court Judge Stan Strickland permitted a California attorney - who is on Casey Anthony's defense team - to practice law here once he pays filing fees with the Florida Bar, according to paperwork filed today in court.

Todd Macaluso joined the Casey Anthony team last month. He told reporters on March 2 that he excels at cross-examining technical experts.

"This is my world. I deal with the best experts in the world and I deal with the best attorneys in the world," he said after a court hearing last month."And on a case such as this where I believe that she is innocent, I'm going to fight as hard as I can to prove that in a court of law."
In January, Macaluso was accused of unprofessional conduct in California.

So far, we have three posts (03/27/09; 04/16/09; 04/20/09) that deal with the role of a judge – at both the trial and appellate levels – in a death penalty case. There’s a lot more to consider about the impact that judges have in death penalty considerations, but before we delve further into their role, it seems wise to bring the attorneys into the mix.

First, the criminal defense attorneys. (Next, the prosecutors.)

Before a lawyer can represent a client who is facing capital punishment in a Florida case, he must meet many, many requirements. Why? The Florida legislature as well as the Florida courts have recognized that when a defendant’s life is at stake, his legal counsel plays a vital role in making sure that due process of law is achieved.

Other mothers murder their children because the children are not wanted or are resented. One such mother, Susan Smith, strapped her two small boys, a fourteen month old and a three year old, into the backseat of her car, rolled up the windows, and pushed the car into a lake.

She first claimed her two sons were taken in a car jacking by an unidentified black man. Smith concocted elaborate lies in the national media, pleading for the safe return of her two children. Later, Smith told police she intended to kill herself, but changed her mind at the last minute and jumped from the car.

Gonzalez Attorneys Prepare For Anthonys On Oprah
No Sale Pending For Caylee Memorial Land

The Anthony's attorney scolded Gonzalez's lawyers for their line of questioning.

Now Gonzalez's lawyers are questioning if it pains the Anthonys so much to answer their questions, why are they willing to go on national television and relive the nightmare of losing Caylee with Oprah?

Gonzalez's lawyers are also preparing what they said are videotaped examples to send to Winfrey of the Anthonys contradicting themselves in sworn testimony. Why?

Casey Anthony case: No sale on memorial land, WESH reports

In a report yesterday, the station asked if the land might have been sold.
But a Web listing for the land remains active, WESH's Bob Kealing said today. The asking price: $89,900.
The real-estate agent has been told by the land's owner not to make any statement about the sale, WESH added.

Casey Anthony's jury: Could you be impartial?

Last week, Orlando Sentinel reporters asked county residents whether they would be willing to serve as jurors in the wake of Orange-Osceola State Attorney Lawson Lamar announcing he wants Anthony put to death if she is convicted of killing her child.

Hardly anyone declined comment.

Here are some more details from television that caught my attention:

*** "Casey Anthony apparently likes shoes. She owns lots of them, more than 20 pairs," WKMG-Channel 6's Mike DeForest reported. Lab tests do not show a conclusive link between soil samples collected from bottom of the shoes and dirt at the spot where Caylee's body was found was found, DeForest noted. Casey is charged with daughter Caylee's murder.

*** WKMG's Louis Bolden explained Roy Kronk's reasoning for looking for Caylee's remains in the area where they were later found. Bolden read Kronk's comment: "It just made sense to me that if you were going to get rid of something like that well you would put it in a place you knew there would be very little traffic whatsoever."

Protective Order Calls Phone Records Subpoena 'Overboard, Harassment'

Roy Kronk is asking Monday for a protective order so he does not have to turn over certain phone records to Casey Anthony's defense team.

In new court papers obtained by WESH 2, Kronk said Jose Baez's recent application to subpoena phone records is "overbroad, and constitutes harassment."

Meter Reader Refuses Records Request
Phone Records Request Part Of Motion Filed By Baez

Evans said he and Kronk would not object to a "reasonable" subpoena: one that limits the amount of information turned over to Baez. The existing request calls for all of Kronk's phone records – including cell phone pings and text messages with times and locations.

According to Evans, Kronk does not want the phone numbers of his friends and family to be fodder for the defense team and the millions of other people following the case throughout the country.

Monday night, Beaz said other people do not get to decide what is important to his case
