Casey Anthony: WKMG asks if she can get fair trial in Florida cities

Reporter Tony Pipitone traveled to Jacksonville, Tampa, Fort Myers, Miami and West Palm Beach. He carried a photo of Anthony and approached people with this question: Could you give her a fair trial?

WKMG will air the report at 11 tonight and Tuesday, news director Steve Hyvonen said. He said the report was timely because attorney Jose Baez is seeking a change of venue for his client.

During the 6:30 p.m. Sunday telecast, Pipitone broke the news that Baez would seek the change of venue.

UPDATED: Anthony trial may move south

On Monday afternoon, lead defense attorney Jose Baez filed the motion at the Orange County Courthouse in order to get the high profile case moved out of Central Florida to a venue in South Florida.
The decision now rests with Judge Stan Strickland of the Ninth Circuit Court.

Baez initially intended to keep the location of the trial sealed. "But after extensive research, the defense believed it should not make that request, in good faith," said Baez.
When asked if he expected a different dynamic among possible jurors in South Florida, Baez responded, "We don't believe we can avoid finding people who have not heard about this case."

Casey Anthony: TV stations respond to Linda Kenney Baden's blasts

Baden said there were too many stories and that the local media hadn't given Anthony's defense team a fair shake.
What did local television have to say in response to Baden?

WFTV-Channel 9 news director Bob Jordan said, "I'm a little puzzled that the defense goes out of its way to get media attention, then in the next breath complains about the attention it's getting. That doesn't compute in my mind."

Belich tried to ask if he helped create that publicity problem.
She asked Baez: "How do you explain your complaints about publicity when you're the one holding news conferences all the time and going on national television?"
He said "excuse me" and started using his cell phone.

Belich's take on the situation: "He likes publicity as long as he likes what's being publicized. If he doesn't, not so much."
Belich also noted that Casey Anthony, in an affidavit, faulted WFTV for Belich's questions. One such question: Did Casey kill Caylee?

WFTV anchor Martie Salt said that Baez tomorrow will question a jail guard who was with Anthony when she learned her child's remains had been found.

An experienced Miami death penalty attorney said just knowing Anthony from a picture is not enough to keep someone off a jury unless the potential juror has an opinion about what she did and wheteher she's guilty of the crime.

Anthony's defense wants to have her trial somewhere where details about the case, like perhaps whether Caylee's body was in the trunk of Anthony's car, that may not be put into evidence are not in the juror's heads.

Baez neglected to ask the judge to seal the statements of Lt. Tammy Unser and others who were aware of Casey's anxiety attack on December 11. So, even though the jail video has not been released, the public already knows how Casey reacted.

Baez seems to have backed off his accusations that Casey's privacy rights were violated, as he tries to keep the videotape out of the public eye and possibly out of the trial.

"We need to get to the bottom of everything that occurred in the case," Baez said Tuesday

Orange County corrections officer and a deputy are going to be questioned under oath today by Casey Anthony's attorney, Jose Baez.

Lt. Tammy Unser led Anthony to the jail's medical center on the day child's remains - later identified as Caylee - were found by an Orange County meter reader. She told investigators how Casey Anthony hyperventilated when she saw a news report. of the findings.
Deputy Phillip Graves also will be questioned by the defense.

The headlines in the Casey Anthony case from noon newscasts:

*** The state turned over more than 700 pages of evidence to the defense team in the case.

"The question is: Does it contain some of the critical evidence that Jose Baez says he's been waiting for, like Caylee Anthony's autopsy report," WESH-Channel 2's Bob Kealing said.

Baez described the defense team as "frustrated for a long time" in getting the evidence. Anthony is charged with the first-degree murder of her daughter, Caylee.

The press hadn't gained access to the documents at noon, Kealing added.

More depositions scheduled today

Casey Anthony’s defense team is expected to depose two Orange County officers today.

Corrections Officer Tammy Uncer was working at the Orange County Jail when Casey Anthony was told that a child’s remains were found near her home. Those remains were later confirmed to be those of Anthony's 2-year-old daughter, Caylee.

Uncer’s deposition is scheduled for 10 a.m.
Deputy Phillip Graves is also expected to answer questions this afternoon at 1:30 p.m.

Officer Deposed In Anthony Case

Baez said Unser may have been eavesdropping on his private conversations with her, which he said would be a violation of the attorney-client privilege.

"He told her what he thought and what had occurred. She did break down and cry in there. We could see that she was crying. He asked for tissue," Unser said.

Unser made the statements to Orange County sheriff's Deputy Phillip Graves, who will also be deposed on Tuesday.

So is a change of venue such a good idea?

A Miami death penalty attorney -- who wasn't identified -- said knowing Anthony's identity wasn't enough to keep a person off the jury. Having an opinion about the case would keep someone off the jury, the man said. Sure would like to know that man's identity.

The report grabbed the attention, and Pipitone presented the riveting material simply. He put his findings in context.

Deputies Deposed By Casey's Defense

Baez said he thinks Unser violated his client's rights.
News 13 asked Baez if he will sue the jail.

"I'm not thinking of any lawsuits or anything. If she feels she has a claim after we do our investigation, that is certainly her right to pursue," Baez said.

He expressed his frustration toward the slow release of evidence by the state. He said it needs to move along and that he still has not seen Caylee's autopsy.

Depositions Focus On Video Of Anthony's Reaction

Also on Monday, prosecutors released to Baez 700 more pages of evidence, including public works logs relating to Dec. 11, 2008, which is the day meter reader Roy Kronk found Caylee's remains.

The new documents have not been made public yet.

Baez said he is frustrated with the slow release of critical information from the state attorney's office and would not rule out asking the judge to do something about it.

A state attorney's spokesman said they will be meeting in the next day or two to discuss how they will react to Baez's motion to move the trial out of Orange County, which was filed on Monday.

"Everyone's going to be pretty surprised as to what actually transpired. I disagree totally with the way she was treated and I don't think it was appropriate and it's all going to come out in court at the right time," Baez said, in reference to the depositions.

More depositions are scheduled for next week. The defense wants to question two more deputies, a DCF worker and someone from Universal Studios. Those depositions are scheduled for next Monday and Wednesday.

Jose Baez's spokeswoman is blasting as false a report by WFTV-Channel 9's Kathi Belich in the Casey Anthony case.

Hard-charging Belich reported yesterday that Baez "faxed copies of his motion for a change of venue to some reporters before he ever filed it with the court."

Not so, Baez spokeswoman Marti Mackenzie told me. She is asking WFTV for a correction. In an e-mail to the station, Mackenzie writes, "Please retract this fabrication that you reported. Let us know when you plan to retract your report."

"[Jose] Baez got an avalanche of new evidence today, but that doesn't necessarily mean he's happy," said WESH-Channel 2's Bob Kealing.
"They know what we want, they know how long we've been asking for it," Baez said of the prosecution. "There comes a certain point where cooperation ends."

Baez will depose more witnesses next week, including a co-worker of meter reader Roy Kronk, WESH reported.

WKMG-Channel 6's Mike DeForest reported Zenaida Gonzalez's lawyers plan to interview former Anthony pal Annie Downing in several weeks. Gonzalez is suing Casey Anthony for defamation for linking her to Caylee's disappearance. But Anthony's attorney's hope to get Gonzalez's civil lawsuit thrown out, DeForest added.

a. Purpose and scope of exemption

Arrest and crime reports are generally considered to be open to public inspection. AGOs 91-74 and 80-96. And see AGO 08-23 (officer trip sheets revealing identity of officer, location and hours of work and locations to which officers have responded for emergency and non-emergency purposes are public records). However, s. 119.071(2)(c)1., F.S., exempts active criminal intelligence information and active criminal investigative information from public inspection. To be exempt, the information must be both "active" and constitute either "criminal investigative" or "criminal intelligence" information. See Woolling v. Lamar, 764 So. 2d 765, 768 (Fla. 5th DCA 2000), review denied, 786 So. 2d 1186 (Fla. 2001) (in order for a record to constitute exempt active criminal investigative information, "the claimant must show that the record is both 'active' and that it constitutes 'criminal investigative information'").

Baez Says He's Not Done With Corrections Officers

In the case against Casey Anthony, attorney Jose Baez says he is not done questioning corrections officers who were with his client when she learned her daughter's remains were found.

Casey's attorneys also got access to more documents. However, all of the information had already gone public.

The documents included copies of the Anthony family's depositions in the Zenaida Gonzalez defamation lawsuit. It also included Orange County dispatch records from when meter reader Roy Kronk discovered Caylee's remains.
