Has Casey Anthony's defense team made a tactical mistake?

WESH-Channel 2 explored that issue tonight. Criminal defense attorney Richard Hornsby told WESH's Bob Kealing that Casey's defense might have suffered because no death-qualified attorney has been asking questions in depositions.

"If you don't have a death-penalty-certified attorney ... conducting those depositions, well, it affects the quality of that deposition," Hornsby said. "Under Florida rules, you can't do a second deposition of a witness."

The first deposition is scheduled at 1 p.m. Jose Baez and his defense team will depose Deputy Adriana Acevedo with the Orange County Sheriff&#8217;s Office. Acevedo is the deputy who helped checked out tips from meter reader, Roy Kronk.

Tim Armstrong, Roy Kronk's boss, will be deposed at 2 p.m. A third deposition is scheduled at 3 p.m. with David Dean who is also employed by Orange County Public Works with Roy Kronk.

Casey Anthony's defense team conducted another round of depositions on Monday.

At 1 p.m., defense attorney Jose Baez and his team deposed Adriana Acevedo, an Orange County deputy who helped check out tips from meter reader Roy Kronk in August. Kronk found 2 -year-old Caylee Anthony's body in December.

Two Orange County Public Works employees, Tim Armstrong and David Dean, followed Acevedo later Monday afternoon. Kronk was on the job for Public Works when he found Caylee's remains.

WFTV legal analyst Bill Sheaffer, who has tried death cases, says Baez should not be doing the depositions without a death-qualified co-counsel, because he might miss something that could help Casey avoid the death penalty if she's convicted.

Sheaffer questions whether Baez really does have a death-qualified attorney lined up to join the defense team, because he says it's highly unusual for the defense to try to create drama by delaying the identification of co-counsel. Usually someone joins the team and gets to work.

Jose Baez will be questioning even more witnesses later this week.

On Wednesday he'll talk under-oath to another deputy, a DCF worker who investigated a previous child abuse case against Casey and an employee at Universal Orlando where Casey claimed to work, but didn't.

Baez is also expected to address a battle is forming in the case against Casey Anthony surrounding the state's motion to find out who will defend her.

Jose Baez, Casey Anthony's primary attorney, does not have anyone qualified on his team to try a capital case, but newly filed court papers say he will soon. But an Orlando defense attorney said Casey Anthony's defense has already suffered because of this issue.

In a new filing, Baez tried to minimize prosecutor's concerns that right now he has no death penalty certified defense lawyer on his team.

"Baez will try to establish doubt that the remains were really there all that time," WESH-Channel 2's Bob Kealing said. "If he can, that would mean Casey Anthony could not have put them there."

News 13 did not hear from Baez Monday, who typically talks at the end of the day.

He snuck out the back most likely to avoid answering questions about a death qualified lawyer.

Larry King teased last night to George and Cindy Anthony's appearance on his CNN show on Wednesday. "A lot of traffic on our blog about it," King said. He asked viewers to take part in the conversation at CNN.com/LarryKing.

People who have followed the case will watch to see how King pushes the couple to answer questions. Will they say something of value? Or flub another opportunity?

"Anybody in that jackpot of trouble needs to tell their story," Sachs says. "They don't need to look like Brad Pitt. They have to be a regular person who's believable. They have erred on the side of being pathetic, but not sympathetic. It's one of the worst cases I've seen of a poor performance on a giant stage when the stakes are life and death."

A report that Casey Anthony yelled and turned angry last month is untrue, the Orange County Jail says.

The jail disputed Narsesian's story in a written statement. "There is no indication that the incident, as reported in the tabloid media, ever occurred," jail spokesman Allen Moore wrote.

He added that Anthony "has been a very cooperative inmate." It was the rare instance someone said something nice about Anthony.

Casey Anthony's defense team once had a death penalty qualified attorney, but last week he dropped the case.

Attorney Terence Lenamon now says he stopped representing Casey because he did not agree with the legal strategy of her lead attorney Jose Baez.

"We had a difference in what I believe should have been done with the approach that is mental health related," Lenamon told CNN's Nancy Grace during an interview Tuesday night.

Lenamon explained he would have had Casey plead not guilty by reason of insanity.

Nancy Grace had some real news last night, but she didn't linger over it. Oh, Nancy, why didn't you stop and ask for more detail?

She talked to Terence Lenamon, the South Florida lawyer and death-penalty expert who was formerly on Casey Anthony's case.

"I was brought in originally to try to get the state not to seek the death penalty," Lenamon told the HLN host. "I put a comprehensive package together. And in December, I withdrew from the case. Prior to me withdrawing, I had some significant disagreements with Mr. [Jose] Baez about what I believe the approach to the case should be. Nevertheless, I withdrew from the case."

Defense attorney Jose Baez deposed a Department of Children and Families investigator for most of Wednesday morning.

Investigator William Procknow visited Anthony twice to look into child abuse allegations; once while Anthony was in jail and later while she was out on bond. At that time, Anthony was charged with child abuse in her daughter's disappearance.

Procknow said Anthony referred to her missing daughter, Caylee Anthony, as "that child," suggesting some form of detachment.

George and Cindy Anthony are scheduled to be on "Larry King Live" Wednesday night.
