Baez Continues To Question Witnesses In Casey Case

In the case against Casey Anthony, defense attorney Jose Baez is questioning witnesses under oath Wednesday, including a DCF worker who investigated a previous child abuse charge against Casey and an Orange County deputy

Defense attorney Jose Baez arrived Wednesday morning at the State Attorney's Office alone to question witnesses under oath.

Baez has been questioning a state child abuse investigator who talked to Casey last year before she was indicted for first-degree murder of her daughter, Caylee Anthony.

Jose Baez will also question a Universal Studios security guard, who Casey tried to convince while with investigators, that she worked at the theme park.

Former Casey Anthony attorney Lenamon says he clashed with Jose Baez

Lenamon explained his disagreement with Baez this way: "We had a difference in what I believed should have been the approach, which is I think mental health-related."

In a report given to prosecutors in November, Lenamon explained why Anthony's case didn't fit the state's criteria for the death penalty. Lenamon explored Anthony's erratic behavior.

"After Caylee was born, people noticed a different person," Lenamon wrote.

Her spending, bad-check writing and multiple unstable relationships "indicate episodes of extreme emotional disturbance," he wrote.

Does Jose Baez want to put Casey Anthony on the stand and claim that Caylee's death was an accident?

That theory came from a legal analyst during a WESH-Channel 2 report this afternoon.

In a noon report, WFTV-Channel 9's Kathi Belich discussed Baez's arrival at the state attorney's office for the depositions. Baez "showed up all alone today" and "didn't stop to talk," she said. "Baez never even took his sunglasses off."

And she added: "After facing criticism for complaining that the murder trial should be moved because of all the publicity in the case, when he is the only one who conducts regular interviews, he seems to be clamming up."

DCF Worker Say Casey Called Caylee "That Child"

The DCF worker says Casey referred to Caylee as "that child." He says Casey told him she was very interested in telling her side of the story and repeated she was innocent. Casey told him Caylee's father, a middle school classmate who was killed in a crash after moving to Kentucky, had set up a trust fund in her name. She said his family now lives in Italy.

Though she said she could get overemotional about Caylee, she was the opposite, very cool and smooth. Casey told DCF that she enjoyed working with the agencies and volunteers looking for Caylee, but she did not cooperate with them or help them in the search.

Sheaffer said it's highly unlikely an attorney of Lenamon's experience would advise a client to admit to something they didn't do.

"We must assume that, prior to making this statement, that this attorney was fully apprised of all the facts in this case," Sheaffer said.

But Sheaffer says a client must support the defense argument and it's possible Casey won't back off of her story that the mysterious nanny did it.

The parents of Casey Anthony said they're still surprised that granddaughter Caylee's body was found. And they can't believe daughter Casey is responsible for the child's murder.

The parents defended Casey as a loving mother, and Cindy dismissed the idea that Casey had acted weirdly while the toddler was missing.

They acted more subdued than usual. Cindy talked about her faith, and she lost the chewing gum that has been a hallmark of many TV appearances.

A motive for the murder? "There is not motive," Conway said.

George and Cindy said they didn't approve of the death penalty. Cindy said they wouldn't cut ties to Casey if their daughter is found guilty.

During the interview, the two said that even if their daughter Casey is found guilty of killing their granddaughter, they will still support her.

"I don't want to believe I have a child that would hurt a child and I still don't think she would hurt a child," said Cindy Anthony.

The Anthony&#8217;s said they went on the show to cope with what they have been going through.

They have said over and over again that they are tired of the media circus, but that didn't stop George and Cindy Anthony from talking up a storm on CNN&#8217;s "Larry King Live" on Wednesday night.

George and Cindy Anthony were flanked by their attorney, Brad Conway. Both of them said they support Casey 100 percent, and they have no doubt about her innocence.

"I don't want to believe that I would have a child that would harm somebody else," George Anthony told King. "To say I believe my daughter would hurt my granddaughter, no."

"It's a huge stretch for anyone to think because I'm positing mental-health issues that I'm conceding guilt," Lenamon said. "That's so far from the truth. What we're talking about is looking at explanations that someone would act that way in a certain period of time."

Lenamon said he had great concern over the case's future because of media exposure. He feared that "the death penalty lawyer who will be brought in will be rubber-stamping a preplanned defense."

"I am suggesting that whoever that lawyer is has to be independent of the strategy in evaluating the case," Lenamon added.

"I am hopeful they bring in some big-shot death penalty lawyer," he said. "I will be the first one to say it's the best move Mr. Baez has made since bringing me in."

King asked the Anthonys why their Casey Anthony did not call police until 31 days after Caylee went missing and was photographed out partying while Caylee was missing.

"A lot of people do weird things under stress and tragedy. It doesn't make her guilty," Cindy Anthony said.

When King asked the Anthonys about what should happen to whoever did kill Caylee, Cindy Anthony said she did not believe in the death penalty for anyone.

George and Cindy Anthony also discussed a foundation they have launched in Caylee's name. They said the proceeds will go to counsel families when a child goes missing.

Casey's Ex-Death Penalty Attorney Releases Statement

Casey's former death penalty attorney Terence Lenamon released a statement Thursday that appears to be a thinly veiled criticism of her current defense team.

Lenamon says American Bar Association guidelines require conflict free investigation, evaluation and preparation.

He and defense attorney Jose Baez parted ways over a disagreement about whether Casey should use a mental health defense.

Eyewitness News has learned that Baez is keeping very tight control over Casey and her defense, even though he is not a death penalty attorney and has not yet met the requirements to hire one.

Franck, and his e-mail address, are fake. Casey Anthony did not work for Universal in May 2008, and it appears she fabricated the e-mail and sent it to herself to make it look like she had to work, Pipitone reported.

Anthony left Caylee with her parents that night and went to a party at Voyage nightclub in downtown Orlando with her boyfriend at the time, Ricardo Morales, friend Amy Huizenga and Troy Brown.

"We went out to Voyage that evening. We came back to Ricardo's house. We were there for &#8211; she was there for maybe 10 minutes, then she left. She called us 10 minutes later asking us to come and help her because she got two flat tires," Brown told investigators.

Attorneys for Casey Anthony are expected to ask a judge to dismiss the defamation suit against her next Tuesday.

Friday morning, Gonzalez' attorney Keith Mitnik said he's confident the case will not be dismissed. Mitnik told WESH 2 that they were in the process of amending their original complaint and in Tuesday's hearing will ask that they also be allowed to seek punitive damages against Casey.

"There could be some fireworks," Mitnik said.

Later in the week, another hearing is expected before Judge Jose Rodriguez to determine whether he will order the Anthonys to answer certain questions they would not in their depositions at the offices of Morgan and Morgan last month.
