Baez Files Motion To Obtain Phone Records

Casey Anthony's defense team files another motion Wednesday. Jose Baez and his team want the phone records of private investigator Dominic Casey after he decided to prevent Casey's defense team from getting his cell phone records, even though he's posted them on his website.

Dominic Casey and another private investigator named Jim Hoover, recorded themselves searching a wooded area where a child's remains were found. The remains were later confirmed to be those of Caylee Anthony.

On the video recording, Casey is seen talking on the phone. Baez and his team want to know who was on the other end of the line.

Casey Anthony: George, Cindy give access to calls to private eye

The parents have given Baez access to any privileged phone conversations they had with their private investigator, Dominic Casey, WESH-Channel 2 reported this afternoon.

"This should prove once and for all whether Dominic Casey was talking to Cindy Anthony, as some have speculated, during this November search of the woods," WESH's Bob Kealing said.

The Anthonys' attorney said the phone records will prove no Anthony family member was talking the private eye during that November search, WESH anchor Jim Payne said.

Baez has filed a new motion to gain access to the private eye's phone records after the man made inconsistent statements about his calls. The meaning of the motion? "Any of the main witnesses in this case who went into the wooded area before Caylee's remains were found are sure to face intense scrutiny from Casey Anthony's defense team," Kealing said.

Facebook group to hold Caylee Marie Anthony vigil

A Facebook group formed in memory of slain toddler Caylee Marie Anthony is organizing a vigil to commemorate the one-year anniversary of her disappearance, an organizer said.

The vigil, run by In Memory of Caylee Marie Anthony, will take place 6 p.m. June 16 at Jay Blanchard Park, said Scotti Simpson, the group's organizer.

They hope to meet at a pavilion there, but are still raising money for the $125 rental, Simpson said.

Richard Grund, who at one time thought he might be the grandfather of Caylee, is speaking at the event.

The public is welcome.

UPDATED: Caylee's Autopsy Won't Be In Release
Hundreds Of Pages Of Discovery To Be Released Friday

A judge intervened and the prosecution decided not to release the autopsy results with the rest of the documents on Friday. It is unknown when the results will be released or if a hearing will be held.

Medical Examiner Dr. Jan Garavaglia said the results contain her "strong opinion" about what happened to Caylee. The toddler's death has already been publicly ruled a homicide, but Garavaglia said it would be impossible to determine how the toddler died.

The release is expected to include everything that has been released to the defense so far, but the exact contents have not been disclosed.

The toxicology results, which could reveal whether Caylee had been exposed to chloroform, could be included in the release. A previous discovery release included Internet searches for chloroform from Casey Anthony's computer.

The defense has also received raw video of private investigator Dominic Casey's search of the woods where Caylee's remains were later found and a 3D animation of the crime scene.

A spokeswoman at the state attorney's office confirmed to WESH 2 that Caylee's autopsy report is part of 1,000 pages of new evidence it plans to make public Friday.

In a motion filed by their attorney, George and Cindy Anthony argue that "the information contained within in the report will cause great anguish to the Anthony family."

A spokeswoman for state attorney Lawson Lamar said that as of Thursday at noon, they are planning to release the report as part of the normal discovery disclosures required by state law.

TV reports are saying Caylee Anthony's grandparents, George and Cindy Anthony, are fighting the release of the toddler's autopsy report.

Orange Circuit Court Stan Strickland issued an order late Thursday that will delay the release of the autopsy reports, which were expected to be made public on Friday, until the issue is addressed in court. He wants to hear from the media about the Anthonys' request.

"For reasons unknown to the court the motion was served only upon the State Attorney's Office," Strickland wrote in the order. "The real party in interest in this matter is the various news media."

The State Attorney's Office is releasing the information in response to public records requests. Prosecutors are required by law to release the documents that they provided to the defense. Some information, such as autopsy photos, can be exempt from public record laws.

"This request certainly begs the question: What's in that report that the medical examiner did not make public when she announced back on Dec. 19 that Caylee's death was as the result of a homicide and the decomposition was so advanced that they could not make a definitive determination on how she died," Kealing said.

Anthony PI Dominic Casey says he should not be held in contempt of court

Private investigator Dominic Casey on Thursday answered a call that he should be held in contempt of court for not showing up for a deposition.

"This litigation is a cynical and frivolous exploitation of a family's tragedy," Casey's attorney said in a motion filed for a protective order in the Orange County civil case against Casey Anthony.

Judge Jose Rodriguez has not ruled on the contempt motion.

"How would information from Dominic Casey help the Zenaida Gonzalez defamation case?" attorney Diana M. Tennis asked in her brief to have the contempt motion dispelled. "It wouldn't."

Casey Anthony: Autopsy findings won't be released tomorrow

The reason: Judge Stan Strickland wants to hear what the media have to say about George and Cindy Anthony's motion -- filed by their attorney Brad Conway -- to block the autopsy's release.

Strickland issued a temporary stay of autopsy findings late this afternoon.

"The real party in interest in this matter is the various news media," Strickland wrote. "Pending formal notice to the media, including the Orlando Sentinel, this Court will enter a temporary stay of the autopsy reports and findings set to be released. Following a written response to the motion by interested media the Court will either rule on the pleadings
or set a hearing as necessary."

But hundreds of other documents will be released tomorrow.

Lawyers for Casey Anthony have filed a new motion to get the cell phone records of a private investigator who once worked for them.

They previously tried to get Dominic Casey's cell phone records, but a judge denied their request and told them to file a more specific one.

Anthony's lawyers said they now want Casey's cell phone records dating back to July 2008.

More Anthony documents to be released

Brad Conway filed a motion late Wednesday, asking the judge to stop the final results from Caylee's autopsy from going public. But Conway tells FOX 35 reporter Holly Bristow that the autopsy won't contain any bombshells, like exactly how Caylee died, or when.

According to court documents, along with Caylee's autopsy, there are hundreds of pages of transcripts. Included are detective interviews with bounty hunter Leonard Padilla, who posted Casey Anthony's bail the first time that she was released from the Orange County Jail.

Padilla also had a woman living in the Anthony's house, keeping an eye on Casey for a brief period. Her name is Tracy, and her statements are in there as well.

In addition, we expecting interviews with Padilla's partner, bounty hunter Rob Dick. He drove Casey to and from her attorney's office day after day.

Orange County medical examiner Dr. Jan Garavaglia said Friday that the autopsy report on the remains of Caylee Anthony draws no new conclusions as to her cause of death.

Garavaglia reported in December that the toddler's death was a homicide of unknown origin. However, she added that she included a summary in her 30-page report that draws some conclusions about what happened to Caylee based on tests and other evidence gathered since she made her initial findings.

A copy of Universal Orlando's Web site was also among the 1,000 pages of evidence released. Earlier in the case, Casey Anthony led investigators to Universal , identifying it as her place of employment, then did an about-face in the hallway and admitted she was lying. The pages appear to list and contain photos of former or current employees.

The Anthonys argued that the release of the autopsy results would cause the family great distress.
Judge Stan Strickland is expected to hold a hearing on the matter next week.

Hundreds of pages of discovery documents were released by the state attorney's office Friday morning in the case against Casey Anthony.

The documents contain the previously released transcripts of several depositions taken for the civil case against Anthony, as well as police interviews with Joy Wray, Sean Krause, Ricardo Morales and Michelle Murphy.

Krause is a blogger who told police Cindy Anthony told him during an interview that she feels Casey Anthony had something to do with Caylee Anthony's death. Krause blogged about the interview on his Web site. Krause said Cindy Anthony "admitted her daughter was a sociopath."

Caylee Anthony's autopsy and toxicology reports were also supposed to be released Friday, but Judge Stan Strickland ordered a stay on them following a motion by the Anthonys' attorney, Brad Conway, asking to block the results of the findings. The Anthonys say they fear the results will be exploited.

Legal analyst Bill Sheaffer says the motion is a waste of time.

"This is a complete waste of judicial time in addressing this motion," Sheaffer said.
It could be a couple of weeks before a hearing is set on whether to release the autopsy findings. The Anthonys' lawyer wants to hold off on the public release until a medical examiner can explain the results.

The papers revealed that around the time that bounty hunter Leonard Padilla was conducting his own search for Caylee Anthony, Cindy Anthony made a startling statment to an internet.

In one deposition of internet reporter Sean Krause, Cindy Anthony reportedly told Krause that Casey was the reason Caylee is gone.

"She didn't say disappearance," Krause told detectives. "I asked her whether she believed that she murdered Caylee," Krause said in the deposition. "She, Cindy, was quiet."

During a vigil, George Anthony confessed to Murphy that all of this could have been avoided.

"You know if we had only gotten custody," Krause quoted George Anthony as saying, "You know if we had only just done it instead of just talking about it."

The Orange County State Attorneys Office released an additional 1,000 pages of discovery documents in the state's case against Casey Anthony.

The documents also include pages of employment history from Universal Studios, where Casey claimed she worked as an event planner.

There is an interview with Joy Wray, the woman who claims she had pictures of the area where Caylee was found. She also brought out a boat to help bounty hunter Leonard Padilla in his search of the Little Econ River where he thought Caylee&#8217;s body was dumped.

The stations noted they were still going through the many documents for reports that will air later today.

WFTV said the first book on the case, "Mommy's Little Girl" by Diane Fanning, will be released in November.

The first book about the Casey Anthony case is available for preorder months before its release. Eyewitness News found a book online called "Mommy's Little Girl".

The book was written by Diane Fanning, a true crime author with no connection to the case. It is scheduled to be released in early November.

Casey Anthony defense wants to question jail staff about video

In a motion filed Friday in Orange County Circuit Court, Baez asked Judge Stan Strickland to enter an order allowing him to depose five witnesses: Capt. Dennis Warren, Major Sherry Johnson, Dr. Lynn Branch, Nurse Dykes and Capt. Nancy DeFerrari.

Baez stated the defense is investigating the matter and has discovered there were several jail and medical staff working who were present "and/or were involved in the orchestration of said event."

Also on Friday, the state filed an objection to Baez's request for Strickland to postpone his decision on whether to release the jail video.

In her objection, Assistant State Attorney Linda Drane Burdick stated that Baez's motion wasn't just to allow Andrea Lyon, a new defense lawyer working on the case, to get caught up.

". . . It became apparent that the delay requested is not for the benefit of Ms. Lyon, but for the purpose of continuing the defendant's effort to deflect attention from the evidence in the case and to focus on the unsubstantiated and irrelevant propaganda associated with her claims of government 'misconduct,'" the objection states.

"It is the position of the State of Florida that the defendant can not support, either factually or legally, her claims of misconduct on the part of any participant in this case."

The objection goes on to state, "It is time this matter is put to rest so that the actual parties to the litigation can extricate themselves from this quagmire and move forward with the justiciable issues in the case."
