Casey Anthony case: Defense points fingers at Roy Kronk as potential murder suspect

"In their zeal to defend Casey Anthony, defense counsel has filed papers with the Court that are filled with allegations that have no basis in fact and falsely accuse Mr. Kronk of various types of bad behavior," Evans said in an e-mail. "The State will respond to these papers in due course in the criminal proceedings."

Transcripts of interviews with Kronk's two ex-wives, son, and a longtime live-in girlfriend's daughter depict the former meter reader as an untrustworthy man willing to resort to violence. No police reports or other supporting documentation were provided.

WESH-Channel 2's Bob Kealing summed up the motion: "They are trying to paint him [Kronk] as a suspect rather than a witness." Kealing noted that the motion was "in direct contrast to everything we heard from Kronk and his attorney earlier today."

Kronk's attorney, David Evans, told Kealing that the defense team obviously has to find another person to point a finger at, that it's Kronk, and that this development is unfortunate.

Pipitone offered analysis of the motion: "One big problem with that is that there's no evidence we know of that Roy Kronk knew Casey Anthony, had any contact with Casey Anthony or Caylee Anthony."

WFTV legal expert Bill Scheaffer called it a low blow by Baez, who he says appears lost in his own case.

"The defense has continued to have a suspect de jour other than Casey Anthony," said Scheaffer. "This is beyond a pathetic attempt. This is a despicable act on the part of the defense in this case."

In other words, Baez and Anthony are walking a fine line with the accusations. So far, the defense has not spoken publicly about the bizarre turn of events.

Following is the complete and unedited statement issued by Roy Kronk's attorney, David Evans, about allegations made by Casey Anthony's defense team. The statement was e-mailed shortly before 6:30 p.m. Thursday:
Today, the Casey Anthony defense team commenced, but did not complete, the deposition of Roy Kronk in the State v. Casey Anthony case. Shortly after adjourning the deposition, the Anthony defense team filed a Motion, Memorandum of Law, and accompanying materials suggesting that Roy Kronk, the individual who found Caylee Anthony's remains and repeatedly reported his find to law enforcement agencies, should be considered a suspect in the murder of Caylee Anthony.

Quite simply in order for a person to be charged with perjury, he must make a material contradiction of the facts to which he is testifying, under oath. In other words, lie from one sworn statement to another.

We still have a long and winding way to go until trial commences in this case. And, as you saw late yesterday (with the defense motion accusing witness/meter reader Kronk) there seems to be no end to the surprises arising from either side. So, again, while I do not foresee perjury or obstruction charges against either of the Anthonys any time soon, anything could happen, before or even after, Casey&#8217;s murder trial.

Members of the defense team appeared on NBC's "Today" and CBS' "The Early Show." ABC's "Good Morning America" quickly recapped Thursday's major development: The defense is pointing to former meter reader Roy Kronk, who found Caylee Anthony's remains, as a possible suspect in the child's death.

An ex-wife of the former Orange County meter reader who discovered the remains of Caylee Anthony told the CBS "Early Show" that she thought her ex-husband was responsible for or involved in the girl's death.

None of the new information will be heard by the jury in Casey Anthony's murder trial unless the judge rules for the defense on the latest motion and allows it into evidence.

The state has yet to respond to the new information, but Kronk is expected to be a key witness for the prosecution in the Casey Anthony case.

Hearings in Casey Anthony's check fraud and murder cases are scheduled for Dec. 11.

Through the new, volatile motion about Kronk, Hornsby said that, for the first time, Casey's defense is making a credible attempt to point the finger elsewhere and raise reasonable doubt.

"This the first significant and credible shot the defense has taken at the state, and it has a high likelihood of success," Hornsby said.

A source close to the investigation said that the judge will not allow Casey's defense to bring in Kronk's past and effectively put him on trial. WESH 2's source called the new motion "jaw droppingly sleazy."

Casey's defense team admits it has no physical evidence to support its theory, Cobiella points out. And Kronk's lawyers say this is just a ploy to deflect blame from the real suspect -- Casey Anthony.

Legal analyst Wendy Murphy told Cobiella, "(Caylee's) mother is the one who's charged with a crime here. So, you can point the finger at Mr. Kronk all day long ... it doesn't explain away the evidence against Casey Anthony."

There are no police reports on Kronk, or arrest reports, that have surfaced, Cobiella adds, to substantiate the claims against him. And investigators ruled Kronk out as a possible suspect early in the investigation.

Kronk&#8217;s bitter ex-wives have accused him of almost everything but the Kennedy assassination and the 9-11 attacks, but they were not questioned under oath and the defense did not provide one iota of evidence to support any of the allegations, no police reports, nothing.

Sheaffer points out that, if the defense team repeats unsubstantiated allegations like this outside of court, they could be sued. They didn't during their morning network blitz Friday, which tells him they have no evidence to back them up.

Sheaffer says it's another indication that this is another media stunt without any evidentiary or legal substance.

This so-called defense tactic, designed to shift the focus of blame away from their client Casey Anthony, is neither new nor unusual in this case.

As officers of the court, Mr. Baez, Ms. Lyons and Mr. Conway, have you no sense of decency? Stop these tactics. Our system of justice, its participants and the rest of the citizens observing this case deserve better.
