Casey Anthony: Nancy Grace asks guests to speculate about evidence that state isn’t disclosing
posted by halboedeker on February, 27 2010 12:02 PM
<snipped>
Eleanor Odom, a felony prosecutor, wondered “if this is some type of evidence that could easily be destroyed, or maybe there’s a privacy right of somebody and that’s why they don’t want the evidence to get out just now.”

Odom echoed a point made by Grace: The defense will get it well before trial.

The take from WFTV’s hard-charging Belich? “One thing that I’m hearing is that — you were asking earlier, Why does this have to be kept secret? From what I understand, investigators don’t want any interference. If they start releasing information about who they might be talking to and what they might be talking to those people about, the concern is that, you know, the evidence or the witnesses might be contaminated and there might be some interference by the defense. And so I think they just want to settle this, figure it out, and then we’ll hear about what all of this is, whether it’s relevant or not.”

'Mitlock' gives law firm its million-dollar teeth
John Morgan's go-to guy

February 28, 2010
<snipped>
His nickname is "Mitlock" and he's often called John Morgan's "set of teeth." He has represented judges, world-famous musicians and most recently a Kissimmee woman suing Casey Anthony.

While Morgan is arguably Central Florida's most notorious and recognizable lawyer, it's his legal partner who is known for fierce courtroom battles: Keith Mitnik.

Mitnik's just as at-ease in front of the cameras and reporters as Morgan, and has plenty of high-profile cases to put him there, but you won't see his face on billboards or commercials. Mitnik is Morgan & Morgan's courtroom warrior — a specialist dispatched to pick jurors and go to battle.

This summer, Mitnik will likely make headlines again when he and fellow Morgan & Morgan attorneys take on accused murderer Casey Anthony in a defamation suit. And though he's got plenty of big-figure verdicts, the best work is on the small cases, Mitnik said.

Mitnik said he feels a huge responsibility to head-off injustices and has told countless young lawyers he never tries a case over money. "If I don't believe in a case, I don't walk in a courtroom," he said.

Hundreds More Pages Of Anthony Evidence Released
New Developments Surface In Case Against Casey

POSTED: 3:13 pm EST March 1, 2010
UPDATED: 4:45 pm EST March 1, 2010
<snipped>
Prosecutors have turned over 650 new pages of evidence, including interview transcripts and photos, to Casey Anthony's defense team.

New evidence also includes interviews with former Equusearch volunteers like Joe Jordan. Anthony's defense team said Jordan will testify that Equusearch did search the area and found nothing while Casey Anthony was in jail.

Defense attorney Richard Hornsby said it is clear that investigators are trying to find information to counter the defense team's claims that the remains were put in the woods after Casey was put in jail.

"No matter how many experts you put on there, when you have multiple witnesses, including law enforcement officers, who say we went there and we didn't see anything, that raises some reasonable issues a jury could consider," Hornsby said.

Prosecutors also turned over more photos enhanced by the FBI of Casey's car trunk.

Casey Anthony: New evidence sends message about state’s case, WESH says
posted by halboedeker on March, 1 2010 6:40 PM
<snipped>
Richard Hornsby, an Orlando attorney who offers analysis for WESH, explained that the state is trying to rebut the defense’s claim that someone else put the toddler’s remains in the woods.

“Hornsby says the state wants to respond forcefully after Casey’s defense presents testimony from EquuSearch volunteers who say they searched and found nothing in the area where Caylee’s remains were later found, ” Kealing said. “That would open the door for Casey to claim that someone else put Caylee’s bones in the woods after she was locked up.”

Casey Anthony: Judge Jeanine Pirro says ‘horrific murder goes against the grain of everything parenting stands for’
posted by halboedeker on March, 2 2010 12:36 PM
<snipped>
Judge Jeanine Pirro pops up in a lot of places, from “Today” to “Larry King Live” to Fox News Channel, to offer legal commentary. On “Today,” Pirro has been especially frank about the Casey Anthony case.

“It holds a lot of fascination,” Pirro says during a stop in Central Florida. “You have what appears to be an intact family, a lovely mother and a beautiful child. When you peel back the layers of the case, the prosecutor feels it’s dysfunctional family with a murderous mother. It’s a horrific murder that goes against the grain of everything parenting stands for. I tried more than my share of child-abuse homicides. This one is particularly horrible.”

Legal Analyst Bill Sheaffer on Casey Anthony Case
INTERROGATORIES, QUERIES & BURNING QUESTIONS

by William J. Sheaffer on March 3, 2010
<snipped>
Many of you have expressed your exasperation with defense delays, stalling tactics and excuses to earn further continuances of the trial date. You wonder why the judge doesn’t “crack the whip,” “say enough is enough already” and “stop wasting the Court’s time.” This is for JEANSEE, BJ, TISHEL, CASEYISGUILTY, JUSTIN, VICKI and LITTLEBEAR among others.

ANSWER: Firstly, both the current discovery and trial schedules were agreed upon by the state and the defense and then approved by the judge. Secondly, as long as the death penalty is on the table, the judge will, more than likely, continue to be flexible as to schedules and dates with both sides. However, even Judge Strickland’s patience has its limits and, should he determine that either side is not proceeding with due diligence and in good faith, we can expect to see him “crack the whip.” Remember, this is a complex, circumstantial evidence case requiring many, many witnesses to establish the circumstantial chain of guilt. Included among those witnesses are forensics experts seeking to gain admission of “novel scientific evidence,” requiring a great deal of preparation by both the state and the defense. In this instance, justice delayed will not equate to justice denied. Casey is facing the ultimate penalty.

That’s all for now. For those of you whose questions I did not yet answer, be patient. I will be back to answer more when my schedule permits.

Casey Anthony: John Walsh says Casey Anthony will pay; he marks 1,000 episodes of ‘America’s Most Wanted’
posted by halboedeker on March, 4 2010 2:30 PM
<snipped>
Why do so many terrible crimes happen to children in Florida? “A lot of cases happen because we’re a big state,” Walsh told me. “We just have our share of terrible crimes.”

He has strong views about Casey Anthony, who is charged with the first-degree murder in the death of her daughter, Caylee. “It’s an awful, awful case,” Walsh said. “I do believe she killed her daughter and will pay for it.”

The milestone episode of “America’s Most Wanted” airs at 9 p.m. Saturday on WOFL-Channel 35 and briefly features President Barack Obama. Walsh went to see Obama and called it “one of the most positive meetings I’ve ever had at the White House.” (They’re shown in this official White House photo by Lawrence Jackson.)

Walsh described himself as “not a huge death penalty advocate,” but added that the murder of an innocent child warrants death.

Casey Anthony, indigent?

Her attorneys say Casey doesn't have enough money for an expensive death penalty case. The motion means that the State would have to help pay out.

As a result, the defense is seeking state assistance to subsidize the costs of travel, serving subpoenas, hiring experts to interpret evidence and transcripts, deposing in- and out-of-state witnesses and investigating all aspects of the case.

A judge will have the final say.

Casey Anthony case: Defense wants state to cover costs
9:04 p.m. EST, March 5, 2010
<snipped>
In a statement released this evening, Anthony spokeswoman Liz Brown said the defense team has incurred "extensive costs" defending the 23-year-old mother in the first-degree murder case. She would not specify a dollar figure.

The statement says initial cost estimates to defend Anthony have skyrocketed since the state decided to seek the death penalty. If Anthony is to receive a fair trial, the government needs to pay the cost of travel, serving subpoenas, hiring experts, deposing witnesses and investigating "all aspects of the case," her team contends.

"This assistance is critical to enabling the defense to interview the 100+ individuals on the State's witness list, investigate thousands of tips, and analyze complex forensic evidence," the statement reads.

The statement says Anthony's attorneys were filing a motion for the financial assistance Friday. It was not in the court file when the Orlando Sentinel inspected it shortly before 5 p.m..

UPDATED: Defense Wants Help Paying For Casey's Defense
Posted: 6:30 pm EST March 5,2010
Updated: 10:30 am EST March 6,2010
<snipped>
Casey Anthony’s defense team asked a judge Friday to declare her indigent, for some of the costs of her case. Orange County taxpayers would pay for part of the trial, if a judge accepts the motion.

“The defense team is faced with extensive costs to defend Miss Anthony, ensure she receives a fair trial, and prevent the State from taking her life. The initial cost estimates for defending Miss Anthony have been far exceeded by the additional costs incurred since the State’s decision to pursue the death penalty. As a result, the defense is seeking state assistance to subsidize the costs of travel, serving subpoenas, hiring experts to interpret evidence and transcripts, deposing in- and out-of-state witnesses and investigating all aspects of the case,” the defense team’s media spokesperson wrote in a release issued early Friday evening.

Eyewitness News found out the fees for Anthony's attorneys would not be included in what taxpayers have to pay.

Since taxpayer dollars could be involved, the judge could question Anthony's attorneys about any possible book or movie deals that may be planned. If Anthony does have money coming in from any such deals, she would be obligated to reimburse the county.

Casey Anthony: Defense asks state to pick up costs, WKMG reports
posted by halboedeker on March, 5 2010 6:17 PM
<snipped>
The bottom line: The defense wants taxpayers to pay for such items as depositions, transcripts, investigators, legal research, expert witness fees and travel expenses — costs that Pipitone said could reach $200,000 to $300,000.

This request would not affect the attorneys’ fees, Pipitone said.

Defense attorney Jose Baez told Pipitone that the death penalty changed circumstances for his client. That change “exhausted” Anthony’s ability to pay for her defense.

Motion Asks State To Pay Anthony's Defense Costs
POSTED: Friday, March 5, 2010
UPDATED: 7:25 pm EST March 5, 2010
<snipped>
Jose Baez filed the paperwork at 5 p.m. Friday. He is asking Judge Stan Strickland to declare Anthony indigent for costs, meaning she does not have the money to fund her defense. Anthony has already paid Baez and death penalty expert Andrea Lyon $111,954, but Baez said that is not enough to give Anthony the defense she needs, and taxpayers should make up the difference. Nearly $90,000 of the amount was used for Baez's fees, the remainder covered Lyon's costs. She is working on the case for free.

Baez said Anthony, 23, was willing to pay for her defense until the state put the death penalty back on the table, making her unable to cover the expense. The motion asks the state to cover the cost of depositions, transcripts, investigators, legal research, expert witness fees, medical or mental examinations, travel expenses and other costs the defense has or will incur.

Legal experts said defending a complex death penalty murder case like Anthony's can easily run into the hundreds of thousands of dollars, especially when potential witnesses and experts are dispersed around the country. Baez estimated the total cost of defending Anthony will amount to hundreds of thousands of dollars.

If Strickland signs the order, Florida taxpayers will pick up the bill for the defense costs, but not the defense fees. The state has more than $14 million set aside this year to pay for indigent criminal defense.

UPDATED: Should Taxpayers Pay For Casey Anthony’s Defense?
Saturday, March 06, 2010 7:13:15 AM
<snipped>
Casey Anthony’s lawyers said it is time for Florida taxpayers to help pay for her defense. A representative for Anthony’s defense team said they have filed a motion asking the government to pay for the cost of their travel, along with money for serving subpoenas, hiring experts and deposing witnesses.

The defense said the assistance is needed to subsidize their costs, especially since they said they have to interview more than 100 people on the prosecution’s witness list, investigate thousands of tips and analyize complex forensic evidence. It was not immediately known how much money Casey’s lawyers wanted. The defense has been tight-lipped throughout the case regarding how they were being paid in the first place, and who was footing the bill.

Casey Anthony: Judge will declare Casey Anthony indigent for costs, WFTV analyst predicts
posted by halboedeker on March, 6 2010 7:01 AM
<snipped>
“This judge will not deny this motion,” WFTV-Channel 9 analyst Bill Sheaffer predicted.

The notion that taxpayers would have to help pay for Anthony’s defense might outrage some readers. But Sheaffer predicted the change would speed up the case because the state would have more control. Anthony is charged with first-degree murder in the death of her daughter, Caylee.

WFTV anchor Liz Artz this morning said the station had learned Anthony is keeping her legal team instead of getting a state-appointed attorney. But Artz offered no details.

Anthony says she is broke again in an affidavit she signed Tuesday, Pipitone said.

Yet Pipitone outlined that Anthony paid $22,500 to defense attorney Andrea Lyon for costs and $89,400 to defense attorney Jose Baez. Lyon is working pro bono. An affidavit did not break down Baez’s money between costs and fees.
