Accused Killer Remembered

Bipolar disorder. Sexual molestation by a male family member. Anger management issues that frequently got him in trouble with teachers. Wacky, unpredictable behavior. These are among the ingredients in the background of John Albert Gardner III, the 1997 Rim High School graduate charged with the capital murder of Poway high school student Chelsea King and with assaulting a female jogger.

Insights into Gardner's troubled past were provided to The Mountain News this week by Jennifer Maylone Brandt, a Rim classmate of Gardner's who was in his inner circle of friends for three years after their high school graduation. Brandt, who now lives in Indianapolis, Ind., contacted the newspaper after hearing of Gardner's arrest in a text message sent by another classmate, who now lives in San Bernardino.

Though she was aware of Gardner while both were still students, Brandt said she didn't really get to know him until the year after they graduated. Then, from 1998 into 2000, Brandt (then known as Jennifer Maylone) and a handful of Gardner's buddies would hang out, going rock climbing in Cedar Glen, watching TV at Maylone's grandparents' home in Crestline or eating fast food together, she said.


FRIENDSHIP ENDS
For Brandt and the others, that friendship ended in 2000 when Gardner was convicted of committing a lewd act on a 13-year-old girl.

MOOD SWINGS
Brandt said Gardner had admitted to her that he had bipolar disorder, a condition in which moods can swing from manic to depressive. His bipolarity, she said, may have contributed to his "getting into things like stealing from grocery stores."

Brandt said she recalls Gardner telling her his mother, a single, working mom, as she recollects, worked at Patton State Hospital. On one occasion, he told her, she'd gotten him committed for some reason. "He proudly claimed, like Houdini, that he could work his way out of a straitjacket," she said. "He was quite proud of himself for that."


SEXUAL ABUSE
Something Gardner shared with Brandt might have been another significant impact on his developing personality. He once confided in her, she said, that he had been sexually abused by a male family member on repeated occasions. Though she said she knows how they were related, she declined to identify that relationship.

When not displaying anger, Brandt said, Gardner had impressed her as "soft spoken, but nothing feminine."


'STUPID KIDS'
"We rallied around him on his day in court," she said. "We were 19, 20 at the time. We were stupid kids. He'd never done anything like that before; why would he do it now? It was so not like him."

Seating passes issued for Chelsea King memorial

Anticipating large crowds of mourners and well-wishers, the family of slain Poway High senior Chelsea King announced Wednesday that they are issuing priority-seating passes to her relatives, close friends and former classmates planning to attend a weekend memorial at the school. Community interest in the scheduled Saturday afternoon event "has exceeded anyone's expectation and grows each day," King family spokeswoman Sara Muller Fraunces said.

"Therefore, we are working closely with officials from (the school), Poway Unified School District, the Sheriff's Department, other law enforcement agencies and scores of San Diego businesses donating their services to meet the event's needs," Fraunces said. It was not immediately clear how any overflow crowds would be handled.

Kelly and Brent King issued the following statement regarding the planned remembrance ceremony in honor of their daughter: "It is our wish to hold Chelsea's memorial celebration at Poway High School, where she spent almost four years developing special relationships with students and faculty. Because the Poway High School stadium has limited capacity, it has become necessary to issue passes to ensure that Chelsea's friends, family and the Poway High School community are able to share in her celebration first-hand."

"We never anticipated that so many people would want to honor Chelsea in this way, and very much wish we could accommodate every single person. We apologize in advance if that turns out not to be the case. Thank you for your understanding and support."

The family also suggested that people attending carpool to ease congestion and parking problems.

New details reveal that John Gardner fathered twins

We&#8217;re learning more about John Albert Gardner III. The man charged with Chelsea King&#8217;s murder and rape, and who is being investigated for Amber Dubois&#8217; murder, is a father and the son of a highly-educated mother. John Gardner&#8217;s mother and his stepfather, Cathy Osborne and Kevin O&#8217;Neill, are both members of the San Diego Hash House Harriers, a group that describes itself as a &#8220;Drinking Club with a Running Problem.&#8221;

On Dec. 27, the group hosted a running event on the same day and location where John Gardner is accused of attacking a woman. Gardner&#8217;s stepfather wrote in the group&#8217;s newsletter that day, &#8220;Disturbing news at the start&#8230;when other members&#8230;give us word that a girl had been attacked that morning in the trails where we would be running.&#8221;

Now we&#8217;re learning Gardner is a parent of twin boys. But the convicted sex offender never married his children&#8217;s mother. By 2009, The Enterprise Report says, he was living with Jariah Baker at an apartment not far from Escondido High School where 14-year-old Amber Dubois disappeared. Sources tell us Baker is now working with authorities on the Dubois murder investigation.

The black Nissan Sentra that Gardner was seen driving is registered to Baker. The Enterprise Report obtained a ticket John Gardner received while driving the sedan on January 30th in Lake Elsinore. Sources said the black Sentra was seized by investigators.

Chelsea King Murder Suspect Broke Parole

Records obtained by The Associated Press show that the man accused of Chelsea King's murder could have been sent back to prison for violating his parole. The records show that parole officials found Gardner was illegally living within a half-mile of a school in September 2007. They decided to keep him on parole.

Had Gardner been returned to prison, he could have been evaluated for commitment to a state mental hospital as a sexually violent predator. He also would have qualified for a lifetime of GPS tracking of his whereabouts. "It was just an incompetent decision that didn't protect public safety," said state Sen. George Runner, who wrote Jessica's Law, the sex offender law approved by voters in 2006. "And now we have, what, two victims and who knows what else is out there?" he said.

The parole records show state officials found Gardner illegally living within a half-mile of a school in September 2007 and decided to keep him on parole. The records show at least five later violations, the last on Sept. 8, 2008, just 18 days before Gardner was let go from parole supervision and his location-tracking GPS bracelet removed from his ankle.

Each time, the decision was "COP:" Continue on Parole.

Girls&#8217; Deaths Reignite Calls For More Predator Laws

It's been a horrifying couple of weeks for parents of teenagers in San Diego. First, 17-year-old Chelsea King goes missing, and turns up raped and murdered. A few days later, another teenage girl who'd been missing for over a year turns up dead. Convicted sex offender John Gardner has been charged in the first murder, and is under investigation into the death of the second girl, 14-year-old Amber Dubois. Both cases have spurred calls by politicians and parents for tougher laws to deal with sex offenders.

A String Of Recent Tragedies

What's On The Books
California already has a slew of sex offender laws. Among them is Jessica's Law, barring sex offenders from living within 2,000 feet from schools or parks. And there's Megan's law, which created a public registry of sex offenders. But legal experts say the case of Gardner &#8212; charged in King's murder and a target in the Dubois investigation &#8212; is exhibit A in the limitations of Megan's law.

A Cry For Stronger Laws

Not Enforced
But San Diego criminal defense attorney Gerald Blank says one-strike laws for sex offenders already exist. The courts just aren't enforcing them. And Blank says John Gardner is a prime example.

RB High junior pens song for Chelsea

A Rancho Bernardo High School junior has penned a song called &#8220;Angel Forever&#8221; to help ease peoples&#8217; grief over the loss of slain teenager Chelsea King.

Kristi Krause, 16, is offering the song on her MySpace music page for free download beginning Thursday afternoon. The title of the song is inspired by the words of Chelsea&#8217;s parents, who called their daughter their &#8220;angel forever.&#8221; While Kristi didn&#8217;t personally know Chelsea, she heard about the pain felt by several friends at neighboring Poway High School who knew Chelsea well. Chelsea, 17, was a senior there. &#8220;It was a way for me to express my feelings about Chelsea and the wonderful person she was,&#8221; Kristi said in a statement. &#8220;I just wanted to find a way to keep her in our hearts.&#8221;

Gardner's parole violations didn't trigger rearrest

The man accused of raping and killing Chelsea King could have been returned to prison during the three years he served on parole, but he was allowed to remain free following his parole violations, state prison officials confirmed today.

Despite being found living too close to a college that included a day care center in September 2007, the state Board of Parole Hearings opted against returning John Albert Gardner III to prison. &#8220;The board continued Gardner because he had acquired compliant housing,&#8221; said Oscar Hidalgo, an assistant secretary at the Department of Corrections and Rehabilitation. &#8220;That is very consistent with how our parole supervision is applied statewide.&#8221;

According to state prison officials, Gardner racked up a total of seven violations during the three years he was on supervised release -- any one of which could have been used to return him to custody. But Hidalgo said six of the violations were not referred to the Board of parole hearings because they were minor infractions.

One violation was recorded when Gardner missed a meeting with his parole agent; another was filed when he was suspected of possessing marijuana, Hidalgo said. The last four violations involved low-battery alerts on the GPS system Gardner was ordered to wear in January 2008. &#8220;If we were to revoke and put a parolee in prison every time they have a low-battery alert, the system itself would not be able to sustain it,&#8221; Hidalgo said. &#8220;You would flood the system.&#8221;

The state corrections department has been increasingly criticized for its handling of Gardner his arrest Feb. 28.

Assemblyman Nathan Fletcher, the lawmaker who represents the Poway neighborhood where Chelsea lived, said: &#8220;The more we learn, the worse it gets.&#8221; &#8220;It&#8217;s clear the system has failed,&#8221; he said in a statement today. &#8220;We need a full investigation of Corrections immediately.&#8221;

Gardner's gold Pontiac towed by Escondido police

For months, Lake Elsinore police have been looking for a 1990&#8217;s gold, four-door sedan used in an attempted abduction of a teenage girl in October. Thursday, Escondido police towed a car matching that description from a local junkyard.

The 1999 gold Pontiac Grand Prix belonged to John Albert Gardner III. It was in the lot of Cardinal Auto Wrecking on Rock Springs Road in Escondido, on the same street and less than a half-mile from a place Gardner used to live. Rick Garcia, an employee at Cardinal Auto Wrecking, said Escondido police towed Gardner&#8217;s car from the yard Thursday morning. The car, which had major front-end damage from an earlier accident, had been in the junkyard since late January, Garcia said. He didn&#8217;t know where it was taken.

Lake Elsinore police have been investigating the attempted abduction of a young girl on her way to school Oct. 28. Gardner was living in Lake Elsinore and was registered as a sex offender there, but police weren&#8217;t aware of a possible connection to their case until after his arrest. Gardner, whose face resembles an artist&#8217;s sketch Lake Elsinore authorities released, lived less than four miles away from where the attempted kidnapping occurred. He asked for directions, showed her a handgun and demanded she get in. She refused and ran away.

Huge crowd expected for Chelsea King memorial

The memorial starts at 2 p.m. at the Poway High School Stadium. The stadium seats about 6000, and organizers expect many more people to attend. They are giving passes to King family friends and all Poway High School students and their families. The rest will be distributed on a first-come, first-served basis. Volunteers said there is a good chance many people won't be able to get inside for the service.

Details of the two hour service are largely being kept secret. All the flowers are being donated. Also, all the behind the scenes personnel and equipment are being donated by MSI Productions in the Miramar area of San Diego. Ken Freeman is the technical director. He said Wednesday the owner of the company is a long time Poway resident and they felt compelled to help out. "My son plays horn in the Vista band and has actually had the same teacher as Chelsea so this was something that was kind of very close to our heart," Freeman explained.

MSI Productions is used to organizing large events including White House events. The company is providing the sound system, speakers, microphones, porta potties, power, generators, and large screens for videos. "We're happy to contribute in what little way we can and obviously our condolences to the family and to the entire community for the very unfortunate loss," said Freeman.

In lieu of attending the memorial, Denise Tremaine is encouraging people to tie blue ribbons to their homes. "They put a notice out today that they weren't going to be able to have a lot of people other than close friends and family," said Tremaine of the message posted on the Chelsea's Light Facebook page. "A lot of people responded saying, 'Oh I wanted to go I wanted to pay my respects' and I thought there's got to be something we can do."

[She said people have joined the cause from 27 states and Canada. Tremaine said it's important to support the King family in their time of need.

Accused killer John Gardner and his public defenders did not want the court documents made public, but the judge ordered them unsealed anyway following a motion by the media.

The explosive probation report goes into graphic detail about Gardner's sexual attack on a 13-year-old girl in Rancho Bernardo in 2000. The then 20-year-old Gardner picked up the girl from a school bus stop and drove her to his house.

The FBI has seized a white pickup truck that sex offender John Gardner may have been driving at the time Amber Dubois went missing. Investigators are looking for DNA inside the truck that could link Amber Dubois to the accused killer. In this News 8 Investigation we learn that vehicles driven by Gardner could become key pieces of evidence.

The 2004 Chevy Silverado was repossessed from Gardner around the same time Amber Dubois went missing in February 2009. It was sold to a new owner last year at used car lot in the Wilmington neighborhood of Los Angeles. The manager of the car lot remembers buying the truck at auction. "It's just a standard, white Silverado pickup with four doors. We purchased it on the 9th of March of 2009 at the South Bay Auction, which is in Gardena," Ulises Galvez said. FBI agents seized the vehicle Wednesday in Los Angeles from its current owner, an immigrant who purchased the truck last year from the Kar Connections lot in Wilmington. Agents told the current owner they needed to impound the truck for several weeks to test it for DNA.

Court records show Gardner has received five traffic tickets and citations since 2008, and each time the citation shows him driving a different vehicle. In 2008 he was driving a black Hyundai four-door sedan. In 2008 and 2009 he was driving the white Chevy pickup recently seized by the FBI. In April 2009 a traffic ticket shows Gardner was driving his girlfriend's grey Ford Focus. Later in 2009, he was behind the wheel of the gold Pontiac Grand Prix. Finally, in Jan. 2010, a traffic ticket shows him driving a 2002 black Nissan Sentra with a significant amount of damage.

Records show at least two of those cars were registered to Gardner's girlfriend, 28-year-old Jariah Baker. News 8 has confirmed Baker is currently living in a residential drug and alcohol rehab house in Escondido called Serenity House. She did not respond to News 8's emails and phone messages asking for a comment.

Memorial To Be Held Saturday At Poway High School

Anticipating large crowds of mourners and well-wishers, the family of slain Poway High senior Chelsea King announced Wednesday that they are issuing priority-seating passes to her relatives, close friends and former classmates planning to attend a weekend memorial at the school. Community interest in the scheduled Saturday afternoon event "has exceeded anyone's expectation and grows each day," King family spokeswoman Sara Muller Fraunces said. Due to the size of Poway High's student body and the number of friends Chelsea had, the King family anticipates that pass-holders attending this weekend's memorial may fill the school sports arena to capacity, leaving the rest of the well-wishers without seats.

Gardner's attorney, Michael John Popkins, did not return a telephone message seeking comment. He is under a court-ordered gag order not to talk about the case.

He pleaded not guilty last week to murdering Chelsea King, 17, whose presumed body was found March 2 buried in a park near her hometown of Poway north of San Diego. He also is charged with assaulting a woman in the same park in December, and is a suspect but has not been charged in the disappearance of 14-year-old Amber Dubois as she walked to school in Escondido in early 2009. Her skeletal remains were found Saturday on an Indian reservation.

The California Department of Corrections and Rehabilitation issued a statement saying it was working to determine if the actions taken regarding Gardner's parole were consistent with policy and law. "There was nothing to indicate then that he would do this, or allegedly do this," said Oscar Hidalgo, spokesman for the department. "I guess one can always look back, but we don't have the luxury." In fact, Gardner was considered to be a low- or moderate-risk sex offender, based on the assessment in use at the time, Hidalgo said.

Laura Ahearn, executive director of New York-based Parents for Megan's Law and The Crime Victims Center, said parole agents missed a chance to possibly put Gardner away for years. "A technical violation is an opportunity to take sexual predators off the street. Most would be looking for that opportunity," she said. "He could have been confined, and this may never have happened."

During his parole, Gardner was required to undergo drug testing, abstain from alcohol and have no contact with anyone under age 18. He also was prohibited from possessing pornography, children's games, toys or pets. While in prison, Gardner had six minor rules violations for problems such as smoking and being late for class. He was placed in segregation and later transferred to another prison in 2004 "after he experienced verbal and physical confrontations from other inmates," the department said.

If officials ruled that Gardner violated his parole, they could have sent him back to prison, though most serve only about four extra months behind bars. However, the new prison term would have extended his parole supervision.
