Sources told 10News Scripps Mercy staff members were summoned to a 3 p.m. meeting Thursday to discuss the issue of Cathy Osborn's return to the hospital. The staff members were asked to dress in street clothes and come in through the front door. Osborn is a registered nurse and is a supervisor in the behavioral health unit at Scripps Mercy. However, a 10News viewer and co-worker of Osborn sent in the following e-mail:

"Cannot tell you who I am for fear of being harassed, but his mother Cathy Osborn is going back to work at Scripps Mercy Hospital in behavioral health. She let her son live with her and had a key to her house and now is in a position of authority on a psychiatric unit where other sex offenders or psychiatric patients are placed based on her position &#8230; She knew he was a danger and never reported him. Her judgment could let other people out of a psychiatric facility that should not be. Staff do not respect her anymore and have to listen to her because she is in a position of authority. This is not right &#8230; Staff do not want to work with her and she is coming back to work."

Another co-worker called 10News and said "there's quite a few of us" feeling the same way and that there was a "big sigh of relief" that the word got out. She also said she believed it was in "bad taste" that Osborn continue teaching self-defense classes, and "when she came back Tuesday and walked in ready to teach class as usual, a lot of them walked out."

Scripps Mercy refused to discuss anything regarding the information the anonymous co-workers shared with 10News and said it was "inappropriate &#8230; a personnel issue." While it will be five months before her son has his preliminary hearing, Osborn is already being judged at her place of employment.

Poway High tries to heal after tragedy

The signs are everywhere at Poway High School. Dozens of bouquets and notes still hang from a campus fence where red paper cups spell the initials CK. &#8220;Remember Chelsea&#8221; fliers with photos of the pretty senior remain taped to classroom walls. Windows still bear students&#8217; messages to Chelsea King. Many students say tomorrow&#8217;s memorial for Chelsea in the school&#8217;s stadium will help them begin to heal from a trauma that has put them in an unwanted national spotlight. News of her violent death and the arrest of a sex offender has rippled across the country.

&#8220;I want to honor my friend as much as I can,&#8221; said Evan Shirley, 17, who knew Chelsea as part of the campus peer-counseling program. &#8220;Doing that in something official like this memorial is really important." &#8220;But by this time next week, I hope things will get a little bit back to normal on campus because that&#8217;s what Chelsea would want. Midterms are almost here and AP exams are coming up.&#8221;

Principal Scott Fisher said the campus has been shaken to its core. &#8220;In my 21 years (as a principal), there have been deaths,&#8221; Fisher said. &#8220;But there&#8217;s never been one that&#8217;s had this impact on a campus.&#8221; Poway High School students have lost three classmates this year, an unprecedented number.

Last week, spirits initially were buoyed by an arrest, only to be crushed by the discovery of Chelsea&#8217;s body. Distraught students attended a candlelight vigil March 2 that drew several thousand mourners. Hundreds of students sought refuge the next day in the school&#8217;s counseling center, where a room was set aside for them to talk, watch movies or just sit. The Poway Unified School District sent three counselors from other campuses.

The horror and, ultimately, exhaustion of last week has mostly moved to resignation and sadness this week, teachers said. Activities have resumed, although students and teachers still have trouble focusing on academics. For the first time in the school&#8217;s history, the end of the grading period was postponed a week from last Friday to today. Preparations for the memorial help.

The peer counselors met early yesterday to coordinate as ushers. The Poway High School Wind Symphony has been rehearsing several musical pieces to perform. The cross-country team decided to attend the memorial together, leaving a seat empty for Chelsea.

In 2000 testimony, teens say episodes began innocently, then turned violent

Two days after turning 21, John Albert Gardner III donned a blue shirt and tie and sat in a San Diego courtroom for an hour and a half as two teenage girls testified that he&#8217;d molested them. Both girls said the encounters began innocently enough, according to the transcript of an April 11, 2000, preliminary hearing that The San Diego Union-Tribune obtained Thursday.

The 74-page transcript provides, in a 13-year-old victim&#8217;s own words, the most details yet of the March 16, 2000, assault that sent Gardner to prison. It also offers the only description available of an episode involving Gardner and a 14-year-old girl several months earlier.

Gardner was 20 in late 1999 when he complimented a 14-year-old girl as they sat alone by a waterfall in Rancho Bernardo, and he asked if he could kiss her. He leaned in even though she said, &#8220;I&#8217;m not sure.&#8221;

The following March, a month before his 21st birthday, he asked a 13-year-old if she needed a massage as they watched a movie alone at his mother&#8217;s townhouse in Rancho Bernardo. He gave her one even though she told him she was &#8220;okay.&#8221; She said that despite repeated objections, he carried her to an upstairs bedroom, telling her to close her eyes, as if it were &#8220;a surprise or something.&#8221; She would end up being groped and beaten.

In all, three teenage girls testified against Gardner during the hearing. The third was a friend of the girl Gardner assaulted.

New Details Uncovered of John Gardner's Background

We're learning more about John Albert Gardner III. The man charged with Chelsea King's murder and rape, and being investigated for Amber Dubois' murder, is himself a father and the son of a highly educated mother. John Gardner's mother and his step-father, Cathy Osborne and Kevin O'Reilly, are both members of the San Diego Hash House Harriers, a group that describes itself as a "Drinking Club with a Running Problem".

Last week, Chelsea King's parents told San Diego 6 that they believed Cathy was putting neighbors in danger by allowing her son to stay at her home. "Anyone who is a parent cannot in good conscious sit there and say, 'yes, it's okay to let this person live next door.' You cannot -- you cannot tell me."

Now we're learning Gardner himself is a parent of twin boys. But the convicted sex offender never married his children's mother.

By 2009, The Enterprise Report says, he was living with Jariah Baker at an apartment not far from Escondido High School where 14-year-old Amber Dubois disappeared. Sources tell us Baker is now working with authorities on the Dubois murder investigation.


The black Nissan Sentra that Gardner was seen driving is registered to Baker. The Enterprise Report obtained a ticket John Gardner received while driving the sedan on January 30th in Lake Elsinore.

Is This Gardner's Car?

A car believed to have belonged to the man accused of murdering Chelsea King was towed from an Escondido wrecking yard on Thursday morning and taken to a city holding facility. As of 1 p.m., Escondido police had not returned a phone call to confirm the car did, in fact, belong to Gardner or the circumstances surrounding the impounding of the vehicle. Earlier this week in San Diego Superior Court, Judge David Danielson issued a gag order in the case involving John Gardner, who, in addition to being a suspect in the King case is also a focus of the investigation in the death of Amber Dubois.

The owner of Cardinal Auto Wrecking, however, said detectives asked him not to comment on the vehicle, an indication that there is a possible connection to Gardner. The owner would not say, however, who brought in the vehicle to the salvage yard or confirm when it was brought in. The yard is located exactly three blocks from Gardner's last known residence in Escondido on Rock Springs Road.

The car towed from the wrecking yard on Thursday morning is a gold 1999 Grand Prix. That information may be significant.

"If we were to return to custody individuals with these types of infractions, the system would not be able to take it," said Oscar Hidalgo, a department spokesman. "We would flood our agents and our parole offices with technical violations that we couldn't sustain. The system itself couldn't sustain it."

The violation of the residency rule could have led to a hearing process with parole officials. "It never got that far with Gardner," said spokeswoman Terry Thornton, adding that he moved within two weeks of being notified. "If a parole officer gives someone a direct order, move, and the guy moves, there's no reason to revoke him."

Some critics believe other factors were at play. Todd Spitzer, a prosecutor and former state assemblyman from Orange County, said the department has eased up on parole violators because of prison constraints. "They were ignoring public safety with one goal in mind: They were trying to solve the prison overcrowding," Spitzer said.

Jennifer Brandt and Gardner weren't close in high school, but became friends shortly after they graduated from the Class of 1997 at Rim of the World high school near Lake Arrowhead, California. "He was a fun and crazy guy," Brandt said.

That was the John Gardner who Jennifer Brandt thought she knew, until his 2000 conviction for molesting and assaulting a 13-year-old girl. "Pretty much all of his friends were hurt and betrayed by him after that. We stopped all contact with him," Brandt said.

She hasn't spoken to Gardner since then. In fact, she says she hasn't even thought of his name in years, until he made national headlines. "It was shocking. This was a guy I hung out with, I stayed the night on his couch," she said.

Gardner also threatened suicide a couple years after high school when his then girlfriend Jennifer Tripp dumped him, said Brandt. Tripp is a couple years younger than Gardner and was still in school at the time of the breakup, according to Brandt.

"He missed her and he would cry about it and there was nothing left to live for without her," Brandt recalled Gardner telling her.

Brandt also believes Tripp &#8211; the girlfriend who broke Gardner's heart -- resembles both Chelsea King and Amber Dubois. "From the photos that I see&#8230; the blue eyes, the straight hair&#8230; they all look like the girl he dated in high school and broke his heart," Brandt said.

Murder suspect cited for marijuana possession, traffic violations

Over the last three years, registered sex offender John Albert Gardner III was stopped at least seven times in San Diego and Riverside counties for traffic violations.

He drove at least three separate cars, including one matching a vehicle involved in a 2009 Lake Elsinore attempted child abduction, according to officials and court records.

According to a citation from a June 11, 2009, traffic stop, Gardner was driving a gold 1999 Pontiac Grand Prix north of Escondido. (A car of similar make and model was seized Thursday from an Escondido junk yard and taken to a city holding facility.) He was cited for driving without insurance on Interstate 15 near West Lilac Road. The gold Grand Prix matches the description of a vehicle used in an attempted child abduction reported on Oct. 28, 2009, in Lake Elsinore.

Court records also show Gardner was convicted of speeding in June 2008 and of a red-light violation in December 2006. Details of those cases, including the type of car he was driving and where, were not available Friday.

Gardner is listed as an Escondido resident, living at a Rock Springs East apartment complex, on the citations from November 2008 and June and April 2009.

The complex is less than two miles from Escondido High School. Amber Dubois vanished Feb. 13, 2009, while walking to the school. She was 14 at the time and a freshman.

In addition to the June 2009 stop, Gardner's other traffic violations include:
-- Jan. 30, 2010; cited for expired registration and no proof of insurance in Lake Elsinore during a DUI checkpoint. He was driving a black 2002 Nissan Sentra at Corydon and Cereal streets.

-- April 2, 2009; cited for having an open container of alcohol, driving without a license and without a license plate on the front of the car in Escondido on El Norte Parkway at North Iris Drive. Gardner was driving a gray four-door Ford Focus at the time. The year was not noted on the citation.

-- Nov. 19, 2008; cited for misdemeanor marijuana possession while driving in Oceanside near Buccaneer Park. Gardner was driving a white 2004 Chevrolet Silverado truck at the time.

When John Albert Gardner III walked out of a Central Valley prison a free man in September 2005, state prison officials classified the convicted sex offender as a &#8220;high control&#8221; parolee.

That meant agents should conduct two face-to-face checks on Gardner every month, including one unannounced visit to his home. It also meant surprise drug testing, mandatory counseling and a vigilance on the part of parole agents reserved for the worst offenders.

The 43 pages of parole records released by prison officials Thursday do not show whether those practices were followed in Gardner&#8217;s 2000 case, in which he pleaded guilty to molesting a 13-year-old Rancho Bernardo neighbor.

But they do show that agents and their supervisors passed up opportunity after opportunity to return Gardner to prison &#8212; an action that might have safeguarded the lives of two North County teenagers. He is charged in the killing of one and is a focus of the investigation of the other.

&#8220;This guy should never had been released from parole,&#8221; said Caroline Aguirre, a retired parole agent of 24 years who has been following the Gardner case. &#8220;This business of sex offenders not being properly supervised has been going on for years.&#8221;

8,000 Sunflowers Will Be Handed Out At Memorial

Students have wrapped ribbons around 8,000 sunflowers to hand out at a memorial service for Chelsea King, the 17-year-old girl whose murder has shaken her community and spurred calls for legal changes in how child sex offenders are treated.

"A lot of people are getting ready to bring closure to it," said Evan Shirley, 17, a friend of Chelsea's. "I hope to see everyone come out to support the family and honor their friend in whatever way they see fit."

The service Saturday comes 11 days after Chelsea's body was discovered in a shallow, lakeside grave near Lake Hodges, ending a massive five-day search. Organizers were issuing passes to limit seating at Poway High School stadium, which holds about 6,000 people.

On Friday, Gov. Arnold Schwarzenegger ordered a review of the way the state handled the 2000 case.

Compassion for Chelsea King's family continues to pour out of the community. That includes a touching song written by a San Clemente father.

Mike Speed has been writing songs for 50 years, but he's never had a song pour out of him like "Chelsea Runs," with touching lyrics he wrote in 10 minutes last Friday. Mike's band is called Speed, which is a fitting name, because in just a week's time the song was complete. His daughter flew in from Hawaii to record the song and shoot a video in a Santa Barbara recording studio.

The video was put up on YouTube on Thursday, and if the production looks professional, it should. "They had Katy Perry in last week and Paul McCartney is supposed to be there next week, so you know this guy was doing a huge thing," Mike said.

He says his daughter Stephanie, who sings backup on the song, was almost abducted when she was a six-year-old walking home from elementary school, so he launches a web site called defendchildren.com that calls for one strike sex offender laws. "There is a line in the song, 'Offend one and you're done because there is just one chance for a child to dance,' and that's about how many chances in my opinion that they should have," Mike said.

Mike says all of the proceeds from the song will be donated to Chelsea-related organizations and to protecting children.

Stung by revelations that the state missed chances to put John Albert Gardner III back behind bars long before Chelsea King&#8217;s murder, Gov. Arnold Schwarzenegger today ordered a far-reaching probe of the system and the suspect&#8217;s forgiving parole agents.

&#8220;We must learn from what happened in this case to make sure the public is protected from sexual predators,&#8221; Schwarzenegger said in a statement. &#8220;I have asked the Sex Offender Management Board to review this case and recommend what policy changes or improvements need to be made to make our communities as safe as possible.&#8221;

The brief statement from the governor did not provide specific targets. But a spokeswoman, Rachel Arrezola, said &#8220;everything&#8221; should be pursued, from prosecution to parole.

State Auditor Elaine Howle, in an investigation, discovered that from Jan. 1, 2007 to March 31, 2008, 20 percent of the 156 cases reviewed indicated that &#8220;district administrators discharged parolees against both the parole agents&#8217; and unit supervisors&#8217; recommendations to retain them and often did not provide written justification for discharging parolees contrary to staff recommendations.&#8221;

Assemblyman Nathan Fletcher, a San Diego Republican exploring legislation to fill system gaps, said: &#8220;It is critical that we identify and fix the failures of the correctional system immediately.&#8221;

Thousands Attend Chelsea King Memorial in Poway

Family, friends, classmates and throngs of others sat beneath her giant image over the football stadium grandstand, as the sun beamed through cloudy skies.

Poway High School Principal Scott Fisher, speaking from a stage festooned with sunflower bouquets, told the crowd the events in the two weeks since Chelsea's disappearance and the discovery of her body have filled the hearts of everyone at the school, and "millions who never had the privilege of knowing Chelsea.''

"While we mourn,'' Fisher said, ''Chelsea's passing has strengthened the bonds of this community more than I could have ever imagined.''

Memorial celebration for Chelsea King

*Entry: Priority passes are being given to the King family&#8217;s relatives, friends, supporters and members of the Poway High School community. After pass-holders are admitted, the public will be allowed in as space allows.

*Flowers: The high school will NOT accept delivery. The family asks that people tie a blue ribbon around a tree in their communities to honor Chelsea or make a donation to Chelsea&#8217;s Light.

*Where to donate: Chelsea&#8217;s Light, account no. 1838355913, at any Wells Fargo Bank in the United States. The King family has not specified how the money will be used.

No more seating available for Chelsea King memorial

Family, friends and classmates of slain Poway High senior Chelsea King will gather by the hundreds Saturday in the school&#8217;s football stadium &#8212; along with throngs of people the teen never met &#8212; to celebrate her life and to share in the grief of her loss. Thousands of people are expected on the North County campus for the 2 p.m. memorial, which will provide a focal point for a mass outpouring of grief and outrage over the slaying of a straight-A student who seemed to have the brightest of futures.

Early in the morning, all of the roughly 6,000 passes for seating at the event had been handed out, and King family spokeswoman Sara Muller Fraunces said the stadium has reached its seating capacity. Fraunces encouraged members of the general public wishing to view the
memorial to view it online.


Anticipating a crush of mourners, Chelsea&#8217;s family has been issuing priority seating passes to her relatives, close friends and fellow Poway High students. Members of the general public will be allowed into the 6,000-seat stadium as space allows.
