Chelsea, Amber cases redefine urge to protect their kids

In the weeks since Chelsea King&#8217;s disappearance and the discovery of Amber Dubois&#8217; remains, parents across the county have been holding their children a little tighter, watching them a bit closer. They are checking the Megan&#8217;s Law registered sex offenders database, looking into martial arts training, organizing neighborhood watch groups.

Children are bringing a buddy wherever they go, texting their parents hourly. They are looking at strangers differently, and some are having a hard time sleeping.

From Carlsbad to El Cajon, parents are wrestling with the overwhelming urge to protect their children from harm while fielding sensitive queries some feel ill-equipped to answer. And they now are wondering whether time will soothe their fears and dull their hyper-vigilance &#8212; and whether it should.

Even as parents enforce new, stricter rules, they wrestle with the delicate dance between a child&#8217;s safety and a semblance of independence.

Runners planning to honor slain teen

Organizers of a 3-mile jog planned for Saturday want to honor Chelsea King, even though most of them never knew the slain Poway High School senior who vanished after heading out for a run at Rancho Bernardo Community Park.

Finish Chelsea&#8217;s Run will start at 9 a.m. and wind through the popular open space park south of Lake Hodges.

At least a thousand people are expected, and participants are encouraged to park at Westfield North County shopping mall, off Interstate 15 on Via Rancho Parkway in Escondido. Free shuttles will take runners to the event, said Tommy Sablan, one of the organizers.

Participants are invited to run or walk the route, and children and pets are welcome.

The city has issued an event permit and businesses are donating insurance coverage, shuttles, cleanup services and portable toilets.

Chelsea&#8217;s parents, Brent and Kelly King, are not involved in organizing the event, but they have endorsed it on their Facebook page, Chelsea&#8217;s Light.

Accused killer collected string of citations in various vehicles

SAN DIEGO, Cailf. (CBS 8) - The murder of Poway High School senior Chelsea King, allegedly at the hands of a known sexual predator, has sparked outrage in the community.
News 8 is continuing to investigate John Gardner's past run-ins with the law and the vehicles he was driving since his release from prison.
We are learning more about missed opportunities the case of accused killer John Gardner. A News 8 review of court records shows Gardner was cited for marijuana possession while still on parole.
A string of other citations did not seem to raise any red flags with law enforcement.
News 8 searched records in four different courthouses to compile eight citations filed against Gardner in a little over three years. Four of those citations were filed while Gardner was still on parole, including one for possession of marijuana.
News 8's review of the records shows a total of two citations for marijuana possession, one for driving with an open alcohol container, and several other traffic violations.
The records also show Gardner failed to appear in court, didn't pay court fines, and had his driver's license suspended for two months at the end of 2009.
Despite that history, when Riverside Sheriff's deputies pulled Gardner over at DUI checkpoint in Lake Elsinore in January 2010, they let him go with a traffic ticket for expired registration and no insurance.
Speaking in general terms, Riverside Sheriff's spokesperson Sgt. Joe Borja told News 8 that's not unusual. "You normally would not book (a driver) for that type of traffic violation," Borja said.
At the time of the stop in Riverside, Gardner had already missed court appearances on three different citations.
Even so, DMV records show Gardner's suspension on his driver's license had been lifted by the time he was pulled over in January 2010 and jail space in Riverside County is at a premium these days, according to Sgt. Borja.
"It's a matter of housing and what's available for housing. They're not going to be housed in the county jails on misdemeanor traffic citations," said Borja.
The list of vehicles Garder drove is almost as long as his list of citations. News 8's investigation reveals at least five different vehicles Gardner was driving over the past three years.
Gardner owned a white, 2004 Chevy Silverado pickup truck between 2006 and early 2009. He collected four traffic tickets in that pickup: two for speeding, one for running a red light, and one for possession of marijuana, records show.
In 2008, Gardner was cited again for possessing marijuana in a silver 2005 Hyundai Elantra registered to his step-father, Kevin O'Reilly, according to the records.
In 2009, Gardner was pulled over driving a 2005 gray Ford Focus registered to his girlfriend. He was not carrying a driver's license and had an open container of alcohol.
In June 2009, Gardner paid cash for a 1999 gold Pontiac Grand Prix. He totaled it in a parking lot, according to one family member, but not before receiving a speeding ticket for driving in excess of 70 miles per hour near Bonsal.
Which brings us to back to January of this year, when Gardner was driving his girlfriend's black 2002 Nissan Sentra and Riverside sheriffs wrote him up at that DUI checkpoint for having no proof of registration or insurance.
That was one month before Poway high school senior Chelsea King went missing and Gardner was eventually arrested for her rape and murder.
News 8 wanted to speak with the sheriff's departments in both San Diego and Riverside counties about the past citations against Gardner, but officials are unable to comment because of a gag order issued in Gardner's case.
Gardner has been charged with the rape and murder of Chelsea King, and is also being investigated in the murder of 14-year-old Amber Dubois.
Gardner's preliminary hearing &#8211; which will determine if there's enough evidence to send the case to trial &#8211; is set for August 4th.

While Candice Moncayo never told CNN&#8217;s Larry King that the man who attacked her was John Gardner, she did say she would testify against the man accused of murder in the death of 17-year old Poway teenager Chelsea King and charged with assaulting her Dec. 27 at Rancho Bernardo Community Park..

Moncayo was home for Christmas break and was just about to finish a run around Lake Hodges around 10:30 a.m. when she was attacked.

&#8220;It was a beautiful day. I was passing people the entire time. And I was coming up to the end of the trail and was in sight of the houses. And I noticed a man who was walking toward me. And he was -- I noticed him because he was not dressed in workout clothes. But it was so close to the houses that I just assumed that he, you know, was a resident going for a walk, because the day was so beautiful. And he waited until we were next to each other and then tackled me and threw me to the side of the trail,&#8221; she said.

&#8220;He threw me down on to the ground and he pinned me to the ground. And like I said, I was screaming. And he said, "Shut up." And I said, "No!" And he said -- he told me to shut up again. And I said, "No!" And then I said, "Well, you're going to have to kill me first," because I thought that he was trying to rape me. And he said, &#8216;That can be arranged,&#8217; she said.

&#8220;And there was this small moment of silence. And then there was intervening conversation that I'm not comfortable discussing. And at one point, he picked me up by my shoulders and he started shaking me, the way you're not supposed to shake a child. And I managed to get one hand on the ground, my left hand. And I took my right elbow and I -- I bashed him in the nose. And he grabbed his face and turned away from me and yelled some things. And I got up and I ran faster than I think I've ever run in my life.&#8221;

In 2006, Californian&#8217;s voted to pass Proposition 83, otherwise known as Jessica&#8217;s Law. Among other things Jessica&#8217;s Law mandates that, prior to release from prison, violent sex offenders who meet certain offense criteria be evaluated in person by two expert psychiatrists or psychologists. If the experts agree that the prisoner is a violent sexual predator with a high risk of reoffending the prisoner must be referred to the District Attorney for civil commitment proceedings.

Currently, California&#8217;s Department of Mental Health (DMH) Sex Offender Commitment Program managers are simply providing a cursory &#8216;paper screening&#8217; or record review of potential predators by one mental health professional in lieu of an expert panel in-person evaluation. This violation of California law has thus far dumped more than 17,000 potential sexual predators back into society.

In 2007, convicted rapist Gilton Petri was released as a result of a &#8216;paper screening&#8217; and within 4 days kidnapped, raped, and murdered 15-year old Alyssa Gomez. Petri is currently awaiting trial for Alyssa&#8217;s murder.

Are you as outraged as I am that California&#8217;s DMH is ignoring the law at the expense of public safety? "I am so glad she was able to fight him off," said Brent King, Chelsea's father. "It was very painful to listen to, though."

Moncayo said her assailant tackled her at the end of her run, pinned her to the ground and threatened to kill her. She screamed and he told her to shut up, but she refused. Moncayo told him if he wanted to rape her, he'd have to kill her first, she said.

"He told me that could be arranged," she said calmly.

He swore at her and shook her "like you're not supposed to shake a baby," then she bashed him in the face with her elbow, she said.

"He grabbed his face and turned away from me and yelled some things, and I got up and ran faster than I think I ever ran in my life," she said.

A woman who said she was attacked at a Rancho Bernardo park by accused killer John Gardner talked about the incident on CNN Tuesday.

With local state Assemblyman Nathan Fletcher by their side, Chelsea parents, Brent and Kelly King also spoke on the show. Kelly King reacted to Moncayo's first-hand account and said it was painful to listen to.

"To hear what a victim has to go through when attacked like this. It's extremely difficult ... it's multiplied 1,000 times when it's your own daughter that's been through it as well," said Kelly King.

"It's clear in this case the system failed. You had a known sex offender whose psychology report said he will re-offend. He's a danger to society. He's callous. He violated his parole seven times, yet he was still let out. I think it's imperative that we do everything possible to change this," said Fletcher.

Weeks later, body officially ID'd as Chelsea's

Sheriff Bill Gore has officially confirmed what everyone has known for weeks now: the body found by the banks of Lake Hodges on March 2 was that of 17-year-old Chelsea King. Even though funeral services and a large public memorial celebration were held, it is the first official confirmation by authorities. On the day of the discovery, Gore said only that there was a strong likelihood that it was Chelsea.

Under orders from the District Attorney&#8217;s office, the Medical Examiner&#8217;s report on the case was sealed immediately, and all involved in the case were ordered not to reveal any information, including confirmation of the identity.

A gag order issued later by a judge concerning the case against John Albert Gardner III, who is charged with murder and rape in the case, has further silenced officials. Sheriff&#8217;s Department Spokeswoman Jan Caldwell said Wednesday that after consulting with the District Attorney&#8217;s Office, Gore doesn&#8217;t believe confirming the identity violates the gag order.

REGION: Department of Corrections releases Gardner's central file

The state Department of Corrections and Rehabilitation on Wednesday released the central file for John Albert Gardner III, the registered sex offender accused of killing 17-year-old Chelsea King and suspect in the disappearance and death of 14-year-old Amber Dubois.

Department of Corrections spokesman Gordon Hinkle called the release "unprecedented," saying intense public interest in Gardner and his supervision after his release prompted the department to release the files.

"We wanted to be completely open," Hinkle said.

The California Public Records Act allows the state to keep much of an offender's central file confidential, and the Department of Corrections normally declines to disclose entire files, Hinkle said.

However, department officials believe the public interest in releasing Gardner's file outweighs the interest in withholding it, Hinkle said.

ESCONDIDO: Joggers, walkers to meet Saturday to Finish Chelsea's Run
Slain teen to be remembered by hundreds in Lake Hodges event

Chelsea King never got to finish her jog through the trails around Lake Hodges, but hundreds of runners are expected to finish it for her in a heartfelt memorial Saturday. "I never met Chelsea," said Rancho Penasquitos resident Tommy Sablan. "I never met Amber. But I love them both."

Sablan is not a runner, but as a father of two teenagers he was moved to action by the deaths of Amber Dubois and Chelsea. Along with friends Todd Velasquez and Dave Jewell, who are runners, Sablan organized the Saturday event and created the Facebook page Finish Chelsea's Run.

Participants are asked to meet in the parking lot of Westfield North County, 272 E. Via Rancho Parkway, to catch shuttles to Rancho Bernardo Community Park beginning at 7 a.m. A three-mile run/walk through the trails will begin at 9 a.m. Pets on leashes and children are welcome. "It's a statement that we're going to take this park back," Sablan said.

Chelsea went for an afternoon run Feb. 25 on the south shore of Lake Hodges at Rancho Bernardo Community Park and never returned. Her body was found in a shallow grave near Lake Hodges on March 2.


Jeff Garvik and his dog, Cody, walked along the trails of Lake Hodges the day after authorities recovered the body of Poway teen Chelsea King. "This was my and my dog's special hang out," Garvik said. "It will never be the same."

Calif. rape suspect lived by school for 16 months

A convicted sex offender charged with murdering a California teenager lived near a preschool for at least 16 months before parole agents forced him to move, according to state corrections records released Wednesday.

A regional administrator let John Albert Gardner III continue living within 126 yards of the San Diego County preschool until his lease expired in 2006, a top corrections official told The Associated Press. But no one noticed he was still living there until a year later.

Assistant Secretary Oscar Hidalgo said there was confusion in part because of a change in parole agents.

Parole and prison records released to the AP under a records request and made public Wednesday show Gardner was living little more than a football field's length from the preschool on the Miramar College campus after he was paroled from prison in 2005 after serving five years for molesting a 13-year-old girl. :furious:

New John Gardner file sheds light on prison, parole time

The 282-page file sheds light on incidents involving Gardner during his prison sentence from September, 2000 to September, 2005 for lewd and lascivious acts with a minor under 14 and his subsequent parole and supervision.

In a document dated Sept. 13, 2007, the Division of Adult Parole Operations reports that Gardner was in violation of his parole by residing within a half mile of any private or public school from kindergarten through 12th grade (page 231).

The document states that Gardner&#8217;s Mira Mesa residence was within 125.5 yards of the child development center for ages 2-5 at Miramar College. The document goes on to state &#8220;also located in the surrounding area is Scrips (sic) High School 356.2 yards and San Diego County Regional Park (Hourglass Park) 478.8 yards.&#8221;

In response to the violation of his parole, the Department of Corrections and Rehabilitation ordered Gardner to be monitored via GPS from Sept. 25, 2007 through Sept. 26, 2008. (page 233). Gardner remains a suspect in the investigation in the death of 14-year-old Amber Dubois, who went missing Feb. 13, 2009. Dubois&#8217; remains were discovered in Pala on March 7. She disappeared Feb. 13, 2009, four months after Gardner&#8217;s GPS monitoring expired.

The preliminary hearing for Gardner is set for Aug. 4, 2010 and a gag order was signed in the case on March 9.

A 282-page document released in an &#8220;unprecedented&#8221; move by state officials reveals new details about Chelsea King&#8217;s accused killer.

John Gardner was kept in protective custody while in state prison and was disciplined several times for smoking but was also commended for his work as a teacher's assistant in a prison classroom, according to his central file.

The file on Chelsea King's accused killer assembled by state officials reveals Gardner had minor run-ins with prison guards, and at least one fight with another inmate.

The file contains Gardner's probation officer's report and documents hand written by Gardner in prison defending his actions when he got in trouble.

Gardner pleaded not guilty earlier this month to murdering 17-year-old Chelsea King, whose presumed body was found in a park near her hometown of Poway north of San Diego. He also is charged with assaulting a woman in the same park last year and is under investigation in the death of 14-year-old Amber Dubois in Escondido in early 2009.

Gardner is not due back in court until August.

State releases Gardner's prison file

John Albert Gardner III got into relatively minor trouble while in prison, primarily for smoking and ditching work, but he also excelled as a teaching assistant, according to records released Wednesday by state corrections officials. The records show he was moved in and out of solitary confinement, had privileges taken away and restored, and was involved in at least one &#8220;mutual combat.&#8221; &#8220;I don&#8217;t even know this guy, but I don&#8217;t want to be near him,&#8221; Gardner is quoted as telling prison guards after a fight at Avenal State Prison in July 2005.

The paper trail recounts Gardner&#8217;s time in custody and the three years he spent on parole following his release on Sept. 26, 2005.

Paul Sutton, a criminal justice professor at San Diego State University, said first-time convicts typically have a difficult time adjusting to the inmate hierarchy. &#8220;The first thing the shot-callers want to know is what are you in for,&#8221; Sutton said. &#8220;They don&#8217;t ask you; they want to see your paperwork. If you don&#8217;t provide your paperwork, they&#8217;re going to hit you.&#8221; Child molesters are considered extremely vulnerable in general prison populations, Sutton said. So Gardner would typically have faced threats from other prisoners during the five years he was incarcerated. &#8220;When you come in as a sex offender, the guards don&#8217;t like you and the inmates don&#8217;t like you,&#8221; he said. &#8220;He may have gotten himself in trouble to get off the yard.&#8221;

Lance Corcoran, a spokesman for the union that represents California prison guards, said prisons have special rules for child molesters. &#8220;It&#8217;s no secret that child molestation is looked down on &#8212; not just by society but by the prison population,&#8221; he said. &#8220;So the prison does everything it can to provide opportunities to ensure the safety of the offender.&#8221;

The Sexual Habitual Offender Program of the state Department of Justice requested at least portions of the Gardner file on March 2, the day Chelsea&#8217;s body was found along a tributary of the lake.

Aftermath of Chelsea King killing: Advocates push for self-defense training

Thirty-year-old John Albert Gardner is a repeat sex offender accused in the death of 17-year-old Chelsea King. The high school honors student from San Diego County went for a jog in a park near her house last month and never came back. Police found her body in a shallow grave. Gardner is accused of attacking and killing other teenage girls as well. Chelsea King&#8217;s parents are calling for stricter laws to prevent repeat offenders from striking again. But Jessica&#8217;s Law, Megan&#8217;s Law and Amber alerts are already on the books, named for other young crime victims. Some advocates of self-defense training say another approach is needed as well. They want more women and girls empowered with training to respond in violent situations.

Kendall Sallay graduated recently from Poway High School &#8211; the same school where Chelsea King would have graduated in a few months. "You know, it&#8217;s terrifying," she said. "It is terrifying for the whole community."

So Sallay initiated a petition drive to get self-defense courses taught in high schools as a physical education credit. "We want it to be part of the academic curriculum. This is something that would be so useful to girls more than games like over the line or other games that seem to be popular in high school P.E. courses."

Kendall Sallay is in college now. She says self-defense is actually an important college prep course. A U.S. Justice Department report says nearly one in five women experiences rape or attempted rape while in college. Self-defense instructor Ellen Snortland says personal safety courses should be routine as fire drills.

Poway High School officials say they&#8217;ll meet with Sallay soon. She and other self defense advocates say they&#8217;re working to have schools across California offer personal safety courses.

Expert Analyzes Gardner Handwriting Samples

Taken from Gardner's prison file, I-Team reporter Mitch Blacher had the samples analyzed by a handwriting expert. She was not aware that the signature belonged to a man accused of murder.

Of Gardner's sample, Sassi said, "The writing itself is all kind of low-form level, intense, so this is a person who just can't control themselves."

"You can tell all of that stuff from his signature?" asked Blacher.

"Oh yes, definitely," said Sassi.

"In the 'g' we have a hook at the beginning, and that shows they want to take or gain. This is sometimes a sign of someone who will steal. The upper part of the 'g' is kind of twisted and strange in several parts of the signatures which shows twisted and strange thinking. The 'd' in Gardner is very slanted to the right, which we call this the manic d, which means it is a person who has trouble controlling their impulses," said Sassi.

In one, he was with another sex offender -- and that man was sent back to prison

One night in November 2008, a police cruiser rolled up on two registered sex offenders drinking beer and smoking marijuana in the bed of a truck at an Oceanside city park.

One was returned to prison on a parole violation. The other, John Albert Gardner III, had been off parole for two months and so remained free, according to records obtained by The San Diego Union-Tribune.

The encounter was typical of life for Gardner after he got out of prison for molesting and beating a former Rancho Bernardo neighbor, a 13-year-old girl.

Time after time, he came in contact with law enforcement. Time after time, he walked away.

The episode did become a parole violation for Dominique Whitehair, who&#8217;s a registered sex offender for the misdemeanor charge of annoying or molesting a minor. Whitehair was sent back to prison for more than nine months, according to the state Department of Corrections and Rehabilitation.

For Gardner, it was merely a $640 lapse in judgment, one of three San Diego County Superior Court fines that a court spokeswoman said Gardner has had referred to collections.

Oceanside police Sgt. Jeff Brandt said coded driver&#8217;s licenses aren&#8217;t a bad idea but noted that some registrants may not hand over identification and others aren&#8217;t at real risk of reoffending.

&#8220;They still have rights,&#8221; he said. &#8220;I guess society has to decide how far we want to go with it.&#8221;
