Request for new judge delays Peterson hearing

Outside the courthouse, Brodsky blasted the state's motion to replace Schoenstedt, whom he called fair-minded.

"It's nothing but gamesmanship," he said. "I think it shows that the state does not want to try this case on the merits. It wants to try it on technicalities."

"For the prosecutor of the county to call the chief judge of the criminal division of this county prejudiced is quite extraordinary."

Brodsky, who today was granted face-to-face jailhouse visits with Peterson, said he was "leaning strongly" toward asking that a jury be picked from outside the county to hear the case.

He noted that Peterson had not cracked any jokes in court, and he added he had not instructed his client on how to behave. Still, after thearraignment ,there was a "little bit of levity" with Peterson, he said.

But Melissa Doman, Savio's niece, said she felt better seeing Peterson's demeanor changed.

"The smug smirk is gone," the Romeoville resident said. "I've seen him walking around for over a year with that smug smirk and it's gone. Now he's sitting in jail."

His trademark smirk gone, a shackled Drew Peterson learned in court Monday he'll remain locked up a while longer.
The prosecution's effort to eject a Will County judge from the case stalled the former Bolingbrook police sergeant's attempt to get a lower bond.

After Monday's arraignment, Henry Savio said it is his hope that the truth about how his daughter died comes out in court. The 73-year-old father said he is convinced that Peterson killed her for financial and child custody issues.

"My wish is to have this done," Henry Savio said. "My daughter was very determined. I always knew what happened to her couldn't just be an accident."

Added Melissa Doman, the slain woman's niece: "I've seen (Peterson) walking around for over a year with that smug smirk. Now, the smug smirk is gone."

State, Peterson Team Fight Over Judge

JOLIET — Prosecutors bounced the judge from Drew Peterson's murder case, but lawyers for the alleged wife-killer are fighting to get him back on the bench.

At Peterson's arraignment Monday, State's Attorney James Glasgow accused Judge Richard Schoenstedt of "prejudice against the state" and moved to have him taken off the case.

"I think at this point I should step down and have another judge sit in my stead," Schoenstedt said as he made way for Judge Gerald Kinney to preside over Peterson's initial appearance with counsel. Kinney was in no hurry to get things under way, saying, "I haven't done much of anything in this matter."

And nothing much will get done until Thursday at the earliest, when Kinney will possibly hold a hearing to determine whether Glasgow can get Schoenstedt off the case.

Monday, Peterson remained silent, and even left it to Brodsky to reply "not guilty" when asked how he pleaded.

Still, the new Drew let his serious side slip long enough to "taunt" the relatives of his murdered wife, at least according to Savio's nephew, Michael Lisak. "He was waving at my mom, just continuously looking at my family, the Savio family, almost in a mocking way," Lisak said.

Brodsky, who during the hearing was granted daily, face-to-face visits with Peterson in the jail, claimed to be unaware of this.

Source: Grand jury ends Peterson probe

The grand jury investigating the fate of Drew Peterson's last two wives wrapped up Tuesday with the testimony of potential star witness Thomas Morphey, a source said.

The grand jury's 18-month term is set to expire Thursday, but the source said it finished two days early.

The grand jury indicted Peterson two weeks ago on first-degree murder charges in connection with Savio's death, but no indictments are on file relating to either Stacy Peterson or Stebic's disappearance, although they may be under seal.

Pelkie declined to comment on whether or not the grand jury has returned indictments in either Stacy or Stebic's case.

Morphey, the last witness to testify before the grand jury, received immunity from the state's attorney's office within days of Stacy's October 2007 disappearance. The state police put Morphey in hiding for his safety for months, but he was called to testify for the first time just last week.

The grand jury investigating the fate of Drew Peterson's last two wives wrapped up Tuesday with the testimony of potential star witness Thomas Morphey, a source said.

Charles B. Pelkie, the spokesman for the state's attorney's office, said he could neither confirm nor deny whether the grand jury, which was hearing testimony regarding the murder of Peterson's third wife, Kathleen Savio, and the disappearance of his fourth wife, Stacy Peterson, as well as the apparently unrelated disappearance of Plainfield mother Lisa Stebic, was in fact done.

Peterson's attorneys also say they have not decided on whether to have a judge or jury try this case, but if they go with a jury, they will ask for a change of venue.

Glasgow's office would only say in a two-page document that it wants Schoenstedt replaced "on the ground of prejudice against the State ..." Brodsky said he would press Glasgow at a hearing on Thursday to explain his reasoning. Schoenstedt dismissed the gun charges in November 2008 after prosecutors refused to hand over internal documents between their
office and the Illinois State Police that led to their decision to arrest the former Bolingbrook police sergeant. Will County prosecutors told the judge such a move would open a "flood gate" for future cases.

Even a mundane request from Brodsky asking for daily visits between Peterson and his legal team was met with a long pause from Glasgow before he ultimately agreed.

The defense has not decided whether it will ask for a jury or bench trial but Brodsky said he was "leaning strongly" toward
seeking a jury from another county. He also said he doesn't know if Peterson will testify on his own behalf.

Peterson lawyer: Drew's bond 'astronomical'

Drew Peterson may own his Bolingbrook home and a small fleet of vehicles outright, but he has "no substantial savings or investment(s)" and relies on his $6,000-a-month police pension to support himself and four children.

That's what Peterson's attorney, Joel Brodsky, is arguing in court papers that seek to reduce his client's $20 million bond on charges he murdered his third wife Kathleen Savio.

Brodsky also says that Peterson, 55, spent two years in the Army -- where he "on occasion" worked in President Gerald Ford's security detail -- has no criminal background and is rooted in Will County.

The former Bolingbrook police sergeant owns two cars, two Harley-Davidson motorcycles, an Ultralight aircraft and has paid off a line of credit on his home, according to the filing in Will County circuit court.

Both sides are due back in court Thursday before Chief Judge Gerald Kinney, who is expected to hear the defense team's objections to a motion by prosecutors to replace the judge now hearing the case, Richard Schoenstedt.

WGN 720-AM "Legally Speaking" hosts Greg Adamski and Karen Conti plan to stage a mock trial of "The People v. Drew Peterson" next week to air in June. Yet would that potentially taint a jury pool in Peterson's murder trial? Or is that a moot point considering how much attention the case has already attracted?

Prosecutors get new judge in Peterson case

Will County Chief Judge Gerald Kinney today allowed prosecutors to replace a judge in the Drew Peterson murder case, saying the defense had not established a pattern of abuse by the state of its right to replace judges.

"I do not find that this has been established by the defense's response," Kinney said during a hearing held at the Will County courthouse.

Prosecutors had filed a motion to replace Judge Richard Schoenstedt, arguing he was prejudiced against the state.

Kinney assigned the case to Judge Carla Alessio Policandriotes -- at which point Peterson's attorney, Joel Brodsky, said he wanted to replace that judge. But after a brief recess, Brodsky withdrew his request.

A hearing with the new judge is scheduled for 1:30 p.m. Friday.

Circuit Judge Carla J. Alessio Policandriotes took over the murder case Thursday, after prosecutors successfully removed the Will County persiding judge who they claimed was "prejudice against the state."

Policandriotes will hear arguments Friday afternoon over whether the former Bolingbrook police sergeant's bond should be reduced, allowing him a chance to get out of jail pending trial.

Results of a Thursday autopsy on decayed partial human remains found along the Des Plaines River were inconclusive, but Stacy Peterson's family is hopeful they are hers. An expedited DNA analysis will likely take about two weeks.

Drew Peterson's lead attorney said he and his infamous client are confident the grisly discovery is insignificant to their case.

"I can just tell you we are not at all concerned," attorney Joel Brodsky said. "Not one bit."

Prosecutors say Drew Peterson tried to hire a hitman to kill his third wife, Kathleen Savio.

The information came out in a hearing in Will County Criminal Court on Friday, where a judge said there would be no change in his $20 million bond.

A source tells CBS 2 that the new judge's husband is an investigator with the Will County Sheriff's office.

Sue Doman argued in vain five years ago that Peterson had killed her sister Kathleen. Today, she had this message for the sister she always called Kitty.

"I love you, Kitty," Doman said. "It took five years. I put a note in your coffin, you finally answered my prayers. I love you and I miss you. And we're gonna get him."

year before his third wife drowned in a bath tub in 2004, Drew Peterson offered someone $25,000 to have her killed, Will County Prosecutor James Glasgow alleged in court today.

And just three weeks before Kathleen Savio was slain, Peterson, then a Bolingbrook cop, allegedly said to a fellow officer: "My life would be easier if she were just dead," Glasgow alleged in court.

After hearing the claims, a Will County judge refused to lower Peterson's $20 million bail this afternoon.
