Peterson lawyers want help with discovery

Attorneys for Drew Peterson, charged with murder in the 2004 drowning death of ex-wife Kathleen Savio, were in court Thursday seeking help as they sift through more than 30,000 pages of investigative reports and hundreds of hours of audio recordings turned over by prosecutors.
Joel Brodsky argued six motions before Judge Stephen White, essentially asking that prosecutors be required to give more details about their theory of how Peterson killed Savio as well as "Cliff's Notes" versions of the 9,470 investigative reports he has received.
"Are they saying my client held her underwater or knocked her unconscious or hit her over the head with a blunt object?" he said, later adding: "How did he do it? The state certainly has to prove that."
John Connor, chief of the Will County State's Attorney's major crimes unit, argued that all that information was detailed in the reports given to Peterson's lawyers.
"I've never seen a request like this in any homicide case I've participated in," he told the judge.

White denied or continued the motions. He did tell prosecutors to give Peterson's attorneys an estimated time that Savio was last seen alive as well as an estimated time her body was discovered in the bathtub of her Bolingbrook home

34 year-old Jeffrey Pachter is a warehouse worker who got to know Drew Peterson in the mid-90s when they both worked for a cable wiring company, that according to Pachter’s wife.
Peterson at the time was moonlighting from his job as a Bolingbrook Police Sergeant.
Pachter, who was 18, had been charged with criminal sexual abuse for his relationship with a girl who court records indicate was 13-to-16 years old.
Peterson reportedly helped Pachter get court records that later resulted in Pachter pleading guilty to a lesser charge.
When prosecutors arrested Peterson and charged him with the 2004 murder of his third wife, Kathleen Savio, they alleged he tried to hire a hit man in late 2003, while divorcing Savio.
Pachter’s wife, whom Jeffrey is now divorcing, said he never mentioned it at the time.
But late last year when Pachter tried to reconcile with his family, he told her all about it.
According to Mrs. Pachter, Jeff said Peterson called one night and offered him $25-thousand to kill Savio but he said no and no money was ever paid.
He only told one person at the time. That friend, she says, kept the secret until Peterson’s fourth wife Stacy disappeared, and then he went to police.
Pachter is vacation with his parents in Wisconsin.
We reached his mother by phone and she said they had no comment.

Peterson trial witness list: 805 people

One of Peterson's attorneys, Joel Brodsky, argued that the first-degree murder indictment against Peterson was too vague.

He wanted prosecutors to provide detailed descriptions of such matters as how Peterson allegedly drowned his third wife, Kathleen Savio; whether he used any weapons or tools to kill her; exactly where and when the alleged 2004 murder occurred; and how Peterson may have gained entry to her home.

Connor countered that all of the information Brodsky is entitled to can be found in the discovery evidence already handed over by prosecutors. But Brodsky said it was too much for him and Peterson's other attorneys to sift through.

Judge Stephen White denied all the requests in Brodsky's motion, but did tell Connor to come up with an approximate time Savio was last seen alive and about when her body was found

Brodsky also took issue with the 805 men and women listed as possible witnesses against Peterson. Connor is supposed to come up with the 50 most likely to testify by July 10, but was not forbidden from calling the remaining 755 at trial, which is scheduled to start Aug. 24.

White also shot down Brodsky's request for Peterson to take possession of the evidence against him while he is in jail. White said Peterson could review the evidence in the presence of his attorneys, who have been granted unlimited jailhouse visits with their client.

Brodsky asked whether Stark, Wawczak or Morphey were paid money or given consideration in regard to criminal charges that may have faced them.

White said this issue would be resolved July 10.

Some legal wrangling went down this week in the case against Drew Peterson, set to stand trial for the murder of wife #3, Kathleen Savio. Among the more notables moves made, Judge Stephen White asked prosecutors to cut their witness list down from a mind-boggling 805 to 50. One battle prosecutors did win was an attempt by Peterson's defense team to make the large amount of discovery evidence "easier to navigate." John Connor, the chief of the major crime unit for the state's attorney, claimed, "I think what the counsel is asking us to do is give them CliffsNotes on this," and said all the information the defense was seeking was available in the evidence. Another issue raised by Peterson's attorney - whether three key state witnesses received compensation for their testimony - will be reviewed and ruled on by Judge White at a July 10 hearing.

Is Drew Peterson angling for an insanity defense or is he addicted to attention?

On the surface it would be easy to get the opinion that Peterson targets younger women because they are easy for him to control. When they start to reject his abusive behavior and absolute control over them he can't deal with it so he eliminates the problem.

One could easily argue that Drew Peterson is mentally ill and they would very likely be correct. But where he's in trouble is there is a very big difference between being mentally ill and legally insane. He will never past that litmus test. Clearly he understands the difference between right and wrong, he simply doesn't care. He can aid in his own defense although he'll likely continue to torpedo it. It appears at this time that he took great lengths to cover up his suspected crimes. So an insanity defense will never fly no matter how crazy he act or for that matter actually is right now. He will be judged as competent at the time the crime was committed.

But Drew Peterson has one more big stage with which to act out on and that will be his trial. Look for some over the top wacky behavior when he has a live jury and judge to play for. If the judge has any sense he will bar cameras from the court room. If Peterson sees a camera the dog and pony show will turn into the biggest three ring circus
ever played out in an American court room.

Estate of Third Wife of Drew Peterson Reopened

In March of 2008 Savio's father and siblings filed a petition to reopen the estate and remove Carrol as executor due to new evidence from Savio's exhumed body showing that her death was probably a homicide. The petition claimed that a wrongful death claim against Peterson and Carrol's poor performance as an executor supported their request. The trial court agreed and appointed Savio's father as the new executor.

The appellate court affirmed because the manifest weight of evidence supported the trial court's holding. First, the court held that the estate could be reopened because the wrongful death claim was a newly discovered asset of Savio's estate under the state's Wrongful Death Act. Under Illinois law, a newly discovered asset is one ground for reopening an closed estate. Second, the court held that Carrol's removal was justified because his actions in Savio's divorce case were contrary to the best interests of the estate and its beneficiaries. Finally, although Savio's children were next in line to be appointed executor under Illinois law, the appellate court felt that a court would not likely allow the minor children's guardian, Peterson, to be appointed as executor. Since Savio's father was the proper choice after the children, the court upheld the appointment.

Drew Peterson murder trial delayed

Drew Peterson's murder trial won't be going ahead next month as planned, after he waived his right to a speedy trial today.

During a hearing at the Joliet courthouse, Peterson attorney Joel Brodsky told Judge Stephen White that the defense team needs more time to review some 40,000 pages of evidence.

Peterson was scheduled to stand trial Aug. 24 on charges that he murdered his ex-wife Kathleen Savio in 2004. But White canceled that trial date today, after asking Peterson whether he understood that he was giving up his right to a speedy trial.

Peterson, wearing blue jail scrubs, stared down at his lap and replied "Yes, your honor."

Peterson is next due to appear in court Aug. 14, when his attorneys will try to have the case moved outside of Will County and to challenge the constitutionality of a hearsay law passed last year that allows Savio to testify "from beyond the grave."

No new trial date has been set.

Speaking outside court after today's hearing, Brodsky said the defense team "can't digest all the information" prosecutors have given them without more time.

Peterson trial postponed; venue and constitutional questions abound

The cases for and against Drew Peterson&#8217;s trial won&#8217;t be ready by August 24.

With more than 40,000 pages of discovery to wade through, Peterson&#8217;s lawyer Joel Brodsky asked and got more time, according to reports from a court appearance today.

"We can't digest all that information and be ready by the end of August," Brodsky told the Herald News of Joliet today.

Peterson will go back to court Aug. 14, Brodsky said he will ask for a change of venue because there is no pool of impartial jurors in Will County . Brodsky also will dispute the constitutionality of the hearsay law passed last year, he said.

Peterson lawyer: Cop hit on Drew's fiancee

JOLIET &#8212; A state police detective took a break from the Drew Peterson case long enough to ask the alleged wife-killer's young girlfriend out on a date, Peterson's lawyer said after a court appearance Tuesday.

Attorney Joel Brodsky said, "I'll confirm that," when asked whether a state police investigator asked out Peterson's 24-year-old girlfriend and supposed fiancee, Chrissy Raines.

Brodsky also said he believes state police protocol "does not include dating a witness as a proper method" of investigation.

Brodsky said the detective asked Raines out to "dinner and a movie."

Raines' father, Ernie Raines, was shocked by Brodsky's claim.

"This is news to me," Ernie Raines said. "What is Joel trying to do?"

Ernie Raines thinks he has an idea.

"So this is what (Brodsky's) going to use for his defense, my daughter and this detective," Ernie Raines said before lashing out at the lawyer for messing with "the wrong family."

Charles B. Pelkie, the spokesman for the state's attorney's office, said there was no truth to Brodsky's claim.

"This is an absolutely ridiculous assertion," Pelkie said.

"You have two officers who have had multiple professional contacts with Christina Raines. They told her they would leave the door open to talk to her at any point, whether it was during business hours, whether it was after business hours, whether it was over coffee, lunch, dinner, whatever made her comfortable," he said, stressing that two investigators were always present with Christina Raines and calling their offer to meet with her "good detective work."

Drew Peterson lawyers to challenge hearsay law named for him

Hoping to thwart prosecutors, Drew Peterson's lawyers said Tuesday they will challenge a new "beyond the grave" hearsay law nicknamed after the former Bolingbrook police sergeant.

A new trial date has not been set, but lead Peterson attorney Joel Brodsky warned the hearsay law challenge is so crucial, both sides may fight all the way up to the U.S. Supreme Court.

"The state would have to stop the prosecution in its tracks and seek an appeal," Brodsky said if Will County Circuit Judge Stephen White agrees with him. "It would require, I believe, Drew's release."

Brodsky also said he will file a change-of-venue request to move the trial out of Will County due to the intense publicity - much of which Peterson fueled through national media appearances and other antics.

Sometimes called the Drew Peterson law, it allows a judge at a pretrial hearing in a murder case to determine whether hearsay evidence - testimony or documents that quote someone second hand who is not available in court - may be admitted at trial.

Prosecutors must prove in the pretrial hearing those statements are reliable and that the defendant's wrongdoing made the witness unavailable to testify. Brodsky argues it runs contrary to the Sixth Amendment, which guarantees a criminal defendant the right to confront his accuser in court for cross examination.

New Autopsy Details: Drew Peterson&#8217;s 3rd Wife Fought for Her Life

Kathleen Savio, the third wife of former police officer Drew Peterson, struggled with her killer, a pathologist concluded in autopsy notes recently obtained by CNN.

Kathleen Savio&#8217;s body was re-examined by well-known forensic pathologist Michael Baden in 2007. According to the new details, Baden found bruising on the body consistent with a struggle including &#8220;a 1-inch blunt-force laceration on the back of her head, five scraping abrasions and six blunt-force, black-and-blue bruises on her extremities, abdomen and buttocks.&#8221;

Savio's family has long voiced suspicions about the circumstances surrounding her death. In a lawsuit filed by the family, it is alleged that Peterson went to Savio's house on Feb. 28, 2004, to "brutally ... stalk, attack, repeatedly beat, then drown,&#8221; his third wife. Savio survived the attack for an unknown period of time before drowning, the lawsuit says.

Drew Peterson is being held at the Will County jail on $20 million bond, but denies wrongdoing. He said he misses his children and has prayed and read the Bible during his imprisonment. He also contends his fourth wife, Stacy, left him for another man when she disappeared in October 2007, and is most likely living outside Illinois.

Private autopsy: Ex-cop's third wife fought killer

The private forensic pathologist who conducted an autopsy on Drew Peterson's third wife affirmed the official findings that ruled the death a homicide, a copy of the autopsy report shows.

The report, obtained by CNN legal analyst Lisa Bloom, was written by noted pathologist Dr. Michael Baden. He conducted a third autopsy on the body of Kathleen Savio at the request of Savio's family in November 2007.

Savio's body was exhumed on November 13, 2007, and state pathologist Dr. Larry Blum performed a second autopsy. Three days later, Baden conducted another autopsy on behalf of Savio's family.

Baden also noted that even though the body was partially decomposed, "bruises and contusions caused by blunt force injuries shortly before death" were still visible on the right breast, the upper right thigh and the abdomen.

The severity of those injuries, Baden said in his report, indicated a struggle.

Autopsy Shows Struggle In Kathleen Savio's Death

As part of the investigation into the 2004 death of Drew Peterson's third wife, Kathleen Savio, the latest autopsy revealed signs of a struggle.

The autopsy said there was a 1-inch blunt-force laceration on the back of her head, five scraping abrasions and six blunt-force, black-and-blue bruises on her extremities, abdomen and buttocks, CNN reported Thursday.

State police renewed their interest in Savio's death when the next wife - the now 24-year-old Stacy - vanished in October. State police have labeled their investigation of the young woman's whereabouts a potential homicide.

Soon after, Will County State's Attorney James Glasgow announced he was reopening Savio's case and said the scene of her death appeared to have been staged to conceal a homicide.

Savio's remains were exhumed in November of 2007. Forensic pathologist Larry Blum examined her body and prepared the autopsy report released Thursday by Glasgow's office. A third autopsy was conducted by celebrity forensic pathologist Michael Baden at the behest of Savio's relatives. After his examination, Baden announced live on cable television his belief that the death was a homicide.

JOLIET -- Drew Peterson's attorney tried to get his legal fees paid through the disgraced former cop's home owner's insurance.

The attorney, Joel Brodsky, claimed Country Mutual Insurance Company is responsible for covering Peterson's defense against a wrongful-death suit filed by the family of his slain third wife, Kathleen Savio, said Keith G. Carlson, a lawyer representing the insurance outfit.

Carlson, on behalf of Country Mutual, filed to have the court declare the insurance company not only has no obligation to fund Peterson's defense, but that it should not be on the hook to pay damages if the accused wife killer loses the wrongful-death suit to Savio's family.

Carlson pointed out that while Peterson's homeowner's insurance provides coverage for bodily injury, it is not to be paid out in the event the policy holder deliberately caused it, as alleged in the wrongful-death lawsuit.

Brodsky failed to return calls for comment on why he believes the insurance company should have to foot the bill for his defense of Peterson.

The declaration filed by Carlson also named Henry J. Savio and Anna Doman as defendants along with Peterson. He explained that Savio's sister and father were listed to clarify that the insurance company is not obligated to pay them for any judgment entered against Peterson if he loses the wrongful-death suit.

Brodsky had demanded Peterson's trial begin within 120 days of his May 7 arrest, as dictated by law, but backed off when confronted by the mountain of evidence the state produced against his client.

A new trial date may be scheduled next month.

The Los Angeles attorney representing Drew Peterson's young love shot down a claim from the accused wife-killer's lawyer that a state cop hit on her client.

"Chrissie has not had dinner with or gone to the movies with any police officer other than Drew Peterson and she has no interest in doing so," the attorney, Gloria Allred, said in a written statement. "She does not feel that she was 'hit on' by any police officer. We do not think there is a basis for filing a complaint against any police officer and we have no plans to file such a complaint."

Following a Tuesday court hearing, one of Peterson's attorneys, Joel Brodsky, announced that a state police detective asked Peterson's 24-year-old girlfriend, Christina Raines, to go out with him on a date.

Charles B. Pelkie, the spokesman for the state's attorney's office, refuted Brodsky's accusation, calling it "preposterous and disingenuous."

Brodsky's claim infuriated Raines' father, Ernie Raines, who called Brodsky a "🤬🤬🤬🤬🤬🤬🤬." Ernie Raines also called Peterson a "🤬🤬🤬🤬🤬🤬🤬" and threatened to "kick the [expletive] out of" and "take apart" Brodsky if he happened to run into him.

Brodsky failed to return calls for comment on Allred's statement or to say how frightened he was of Ernie Raines.

Drew Peterson's murder trial could get moved out of Will County, as his attorney says he can't get a fair trial there.

Peterson's attorney, Joel Brodsky, told CBS 2 Tuesday night that media attention is jeopardizing his client's right to a fair trial.

When asked about claims that he and Peterson were seeking publicity, Brodsky said, "We would expect that would be the reaction from the (Will County) State's Attorney's office.

"We went through and we picked a number of examples of media attention that were initiated by the State's Attorney himself, or the police," Brodsky added.
