And adding a bit more confusion to the mess, Observatório do Algarve (http://www.observatoriodoalgarve.com/cna/noticias_ver.asp?noticia=21510) publishes an article that is titled 'The Spanish counter-attack', reporting that Nacho Abad, the journalist from Telecinco who broke the story, claims to possess documents that deny the Police.

According to Abad: "What I can say is that if the McCanns themselves have tacitly confirmed the news, stating that there was an information leak, that position from the police makes no sense".

The journalist promises to make new revelations on live tv today, at noon local time (11 a.m. in Portugal and in the UK).

Abad says his conscience is tranquil, because in Spain, a journalist is not guilty for a leak that breaks the judicial secret, while adding that neither the McCanns nor the PJ were likely to be pleased by the revelations that were made last week.

Portimão PJ to sue McCann's spokesman


The declarations of Kate McCann reminding a conversation with her daughter Maddie the day she disappeared, concerning the fact that the day before she left her crying in the bedroom, are not part of the official process of the Criminal Police, as it was discovered by the CM. They were reproduced by the Spanish television Telecinco and the journalist Nacho Abad says he has proof that they are true ' but they will be clarifications made by Kate to private detectives.

The process still remains in secrecy of justice but "the day it will be open to the public it will be easy to prove that those declarations are not there" said a source close to the investigations. Therefore, this leak could never have come from the PJ.

"The day that that situation will be duly clarified" Clarence Mitchell will be sued by damages caused against the image of elements of the Department of Criminal Investigation of Portimão, after being "unjustly accused" by the McCanns spokesman of passing informations of the process to the media.

The British police also know that those declarations of Kate, about her relationship sometimes difficult with her daughter are not in the process. When the Spanish channel reproduced them a delegation of the PJ was in Leicester to hear the McCann's friends and the British authorities confirmed that it was a deposition made by Kate to private investigators. It is a company that worked for the couple before Método 3 and in the end printed a report with those sentences. According to our sources, only 3 parts have copies of those documents: the company, the McCanns and the British authorities.

The problems with the international press continue and yesterday the Telegraph advanced declarations of Guilhermino Encarnação after a meeting with the prosecutor quoting him saying that the "case will be solved whoever it hurts". Source close to the responsible of the Faro's PJ guarantees to the CM that none of this is true.

ASFIC supports the process

Contacted by the CM, the president of the PJ Union, Carlos Anjos, guarantees that "all legal support is available" in case the investigators of Portimão want to sue Clarence Mitchell, spokesman of the McCanns, by damages against the image of the department.

Reconstruction

Carlso Anjos believes that the controversy created around Kate's declarations, with accusations to the PJ by the eventual leak of information that discredits the couple, "is a mere artifice to avoid cooperation with the Portuguese justice". The PJ wants to reconstruct the crime but according to the couple spokesman this will only happen if they stop being arguidos.

"The Public Prosecutor has already enough evidence to accuse the McCanns with or without the reconstruction of the facts that occurred in the day that the girl disappeared". The guarantee was given to 24 Horas by a judicial responsible that has been following the investigation. The same source added that the accusation will only be made in July and that the McCanns can face a penalty "till 10 years in jail". Another responsible connected to the case stated: "We know that the girl disappeared and there are strong evidence that she died in the flat, apparently in an accidental way. There are also strong probabilities that her body was hidden. Nonetheless, independently of that there is clear evidence face to our law that the parents of the child left her and the twins exposed to an eventual crime of seizure.
They had the duty of protection and that is a crime of negligence".

Investigations continue

Contacted by the 24 Horas, Guilhermino Encarnação, Director of the PJ of Faro, said: "the investigations continue and when there is something relevant to divulge" about the media case "that will be done through the official channels".

They will continue as arguidos

A source of Portimão's court said to the 24 Horas that the public prosecutor Magalhães e Menezes that conducts the enquiry is already working in the accusation against the McCanns and that it will be made public "shortly". Meaning, the probability of the McCanns stop being arguidos in the next months is almost null. 24 Horas also discovered that Robert Murat and his old partner have strong possibilities of not being involved in the accusation.

PJ intends to obtain access to the banking transactions for Madeleine McCann's parents and their seven friends who accompanied them on the holidays in the Algarve.

The investigators' objective is to determine the purchases made before and after the girl's disappearance. PJ is also waiting to receive the report of the analysis of the biologic vestiges sent to the Birmingham lab.

The McCanns are indignant. Maddie's parents do not understand why, according to what 24Horas reported yesterday, it is only now that the Public Ministry assumes that there is enough evidence to condemn them to ten years in prison for exposure and neglect. The formal accusation is to take place in July, pressuposing that Maddie died an accidental death in the apartment and that her cadaver was then concealed. Apart from that, the authorities believe that Gerry and Kate left the little girl exposed to a sequestration situation, just like their twin children, when they abandoned them inside the apartment while they dined with friends on the evening of the disappearance.

"We are not going to comment on that matter because we have not received any officialinformation from the Portuguese authorities", Clarence Mitchell said to 24Horas yesterday. The McCann family's spokesman said that Gerry and Kate were "suprised" when they heard about the possible accusation.

"They found it strange that that matter became public only now. Why was that not discussed a few months ago?", Clarence Mitchell questioned, and did not comment further.

Gonçalo Amaral retires

Gonçalo Amaral former coordinator of the Department of Criminal Investigation of the PJ of Portimão, goes into retirement. The request for retirement was presented a month ago and was accepted last week by the National Directory of the PJ. The JN knows that one of the motives for this decision were more than 38 years in the force and the wish to recuperate his "freedom of expression". The former coordinator was the head of the investigations in the case of the British girl Madeleine McCann and was removed due to declarations given to the "Diário de Notícias" with critics to the British police.

Phone calls analysed with magnifying glass


Only now the PJ received the list of the phone calls made by Maddie's parents and friends. The registers of three persons are still missing.

"Drop by drop". This is the way how a responsible connected to the investigations on the disappearance of Madeleine McCann describes the way that the data of the phone calls made by the parents and friends on that day arrive to the PJ. The registers were asked more than six months ago to the British but only now they begin to arrive. "The British authorities already send us several invoices of phone calls made by the group, included the McCanns, but there are still some registers missing", said the same source. We discovered that the missing data are from three friends of the McCanns and that is the reason why the complete analysis cannot be made. "Everything is being duly analysed but the crossing of the data means that we have to get the missing calls. Without them is impossible to reach any conclusion because two of the persons involved in the process are fundamental to the investigation", the source explained.
An investigator that was connected to the case in its initial phase said that "since the first hour the investigations came up against bureaucratic problems".
"An investigation in a case like this must be quick. But when we tried to obtain evidence we were confronted with incredible bureaucracy. An urgent rogatory letter took more than five months to be authorised", he added.
To cross phone data is now a team task directed by the director Guilhermino Encarnação and by the coordinator Paulo Rebelo.

Police and banks in silence

But apart from the phone calls the public prosecutor Magalhães e Menezes still waits the register of the bank transactions made by all people that dinned in the Tapas Bar.
The objective is to know where the arguidos and the main witnesses were in the day the child disappeared.
"Although that request was made informally to the British police more than seven months ago and officially requested afterwards in the rogatory letter ( five months ago) the truth is that we did not have yet any reply", said to the 24 Horas a police source. Officially Encarnação and Paulo Rebelo are laconic about the case. None of them say anything because the process "is in secret of justice".

Rothley Church Hosts a Prayer Day to mark One Year

. . . A service will be held on the morning of Saturday, May 3, at the Anglican parish church of St Mary and St John, in Rothley.

No expectations are being placed on Madeleine's parents, Gerry and Kate McCann, to attend.

The church is to remain open during the day for people to visit and say their own prayers for the little girl and others like her.

The vicar of Rothley, the Rev Rob Gladstone, said: "The four churches in the village have agreed to open one of the churches for the day so people can drop in and pray if they want."

One year without Maddie
Policeman went from hunter to prey


It would be just another burglary at a residence, like so many others, if it weren't for the fact that the victim is a neighbour of Gonçalo Amaral, the former coordinator from the Policia Judiciaria (PJ) who investigated the case of Madeleine McCann, the English girl that disappeared in Praia da Luz, Algarve, one year ago next Saturday.

As far as CM was able to establish, only documents were stolen, despite the fact that the house, located in the outskirts of Faro, in an inland area, was filled with valuables. An aspect that was strange for the house's owner, but failed to surprise the PJ's inspector, who suspects that his own house was the target and that the criminals had a specific mission to accomplish.

"Since the moment when the PJ started investigating the possibility that the child died inside the apartment where she had been spending holidays with her parents, Gonçalo Amaral went from hunter to prey", a source close to the PJ investigator interpreted. At the same time, the same source revealed to CM that during the last few months the policeman, who is now under pre-retirement status, "has been persecuted and controlled" by someone who wants to "intimidate" him, and that he has received threats.

According to previous reports from CM, Amaral is writing a book containing explosive data about what happened on the evening of May 3, at the Ocean Club. The book is to be tiled 'The Truth of the Lie' and it promises to divulge data that had been kept secret until now. According to revelations made to CM by the PJ inspector's lawyer, Paulo Santos, it's intended to be "a report, from the inside out, of all the evidence that was investigated by him", while guaranteeing that "he does not intend to blame or to accuse anyone", just "to publicise facts".

The defendant - who was detached to intervene in any issues that relate to Gonçalo Amaral's image - understands that "someone realised that he may be a dangerous piece and may upset many people", he said.

For Paulo Santos, "a strategy was built to discredit his competence and his personality". He only laments that the PJ "abandoned and betrayed him when he needed them most".

At a time when he is leaving, the hierarchical superior official of the PJ in Faro, Guilhermino Encarnação, states that Gonçalo Amaral "will be missed", and portrays him as "the model of a good policeman, with a spirit of sacrifice and totally devoted to the cause that he is delivered".

THE DAYS OF PRESSURE ON GONÇALO AMARAL

- As the head of the Maddie case investigation, Gonçalo Amaral was always subjected to pressure from foreign journalists, who approached him at the Portimão PJ's door.

- As a coordinator of the Criminal Investigation Department of the PJ in Portimão, the investigator led several operations against drug trafficking.

- Because he led the Joana case, Amaral was accused of failing to provide help in the process of the alleged aggressions on Leonor Cipriano. He was heard by the instruction judge at the court in Faro.

- After he was removed from the coordination of the Portimão PJ, Gonçalo Amaral was substituted by Paulo Rebelo. The national director, Alipio Ribeiro, gathered the intervenients in a café in Faro.

- No. He does not move against anyone. All he wants is to contribute to the discovery of the truth of the facts that relate to the process, and all the others that he has contacted. He will make some revelations that may become inconvenient for many people.

- Isn't he afraid of suffering the consequences?

- Gonçalo Amaral is not a person who is afraid. From this moment on, he will use his freedom of expression to defend himself against the campaigns that have targeted him, given the fact that he could not do so, until now.

MCCANNS CRITICISE AMARAL AND WRITE A BOOK, TOO

Kate and Gerry McCann revealed yesterday that they are also writing a book about the family's life since the night that Madeleine disappeared, in the Algarve.

According to British newspaper 'Telegraph', the couple is "determined to dispute many of the false stories that have been circulating since their daughter disappeared" in Praia da Luz.

Although they consider it to be "scandalous" and "sad" that Gonçalo Amaral intends to, according to them, "gain money" from the disappearance of their daughter, Gerry and Kate expect to receive a considerable profit from their story, to add to the Fund.

CM tried to contact Clarence Mitchell, the couple's spokesman, several times yesterday, but he never picked up the phone. But he told the English press that the publishing of the book "is a legitimate manner to gain money for the fund", while allowing for Gerry and Kate to "publicise their version of the story".

ALIPIO SET GONÇALO ASIDE ON HIS BIRTHDAY

On October 2, it was Gonçalo Amaral's 48th birthday, and the gift that he received from the police force that he served for 17 years, was to be dismissed from the Maddie case investigation, which he had been leading since May.

The PJ's national director, Alipio Ribeiro, was infuriated over the statements that he read in a daily Portuguese newspaper, where the PJ's coordinator in Portimão accused the British police of investigating only what was convenient to the McCann couple.

Amaral was in Huelva and he tried to allege that the statements had been truncated. He alleged that he was referring to the retired policemen that were performing private investigations. His explanations were worthless. The PJ's national director said that confidence had been broken, because he understood that the pact of silence had been broken.

In February, Alipio publicly stated that there was "precipitation" over making the McCanns into arguidos. He was criticised but kept his position.

The PJ inspector's book, titled 'Truth of the Lie', will be translated into English, following a suggestion from the editing firm that is publishing it.

One year after the disappearance, Praia da Luz registers almost the same number of tourists as last year, in May.

Amaral has a substitute already

The PJ has proposed the McCann couple and their friends to make a reconstitution of the events of May 3. Gerry and Kate replied that they would only accept it if they would stop being arguidos.

The bank accounts belonging to the McCann couple and their seven friends that spent holidays with them at the Ocean Club, will be analysed by the PJ, to understand where they spent their money in the Algarve.

Documentary on ITV

The British channel ITV is marking the first year after Maddie's disappearance with a documentary, on Wednesday. The couple makes an appearance while campaigning for a European child alert system.

Inspector Gonçalo Amaral will sue the media that 'defamed' him


The inspector from the Policia Judiciaria in Portimao and former investigator in the Maddie case, Gonçalo Amaral, is going to sue the media that "defamed and insulted him", his lawyer stated today

"All the persons that have directly or indirectly insulted and defamed him, and questioned his honorability in the media, will be sued", António Paulo Santos guaranteed.

The lawyer offers some examples of "offensive" words that were used by the English media, like "drunk, womanizer, greasy and torturer".

The former coordinator of the investigation into the disappearance of Madeleine McCann recently requested his retirement from the Policia Judiciaria (PJ), alleging that he "has no conditions to continue".

"He wants to leave because he was personally attacked while performing his professional duties, and the institution failed to defend him, as it should", the lawyer said, adding that the inspector, who has been at the service of the Policia Judiciaria for over 20 years, "feels lonely".

Questioned about an article that was published in Spanish newspaper El Mundo, which attributes several citations to Gonçalo Amaral, portraying Kate, the mother of Madeleine McCann, as "cold, astute, an actress", the lawyer says they are "a complete lie".

"Those statements are a complete lie. Gonçalo Amaral never told the journalist anything. They seem to be citations that were collected from the book about Maddie, which was written by former PJ inspector Paulo Cristóvão", he referred.

Madeleine McCann disappeared on the 3rd of May of 2007 from the Ocean Club tourist resort, located in Praia da Luz, Algarve, while she slept with her siblings Sean and Amelie and her parents, Kate and Gerry, dined with friends at a nearby restaurant.

El Mundo Article: Lies and Plagiarism

In a article published yesterday by Aníbal Malvar in El Mundo:

Malvar quotes a conversation between the inspectors João Tavares describing the virtues of "improvisation" of the "Portuguese cops" to Francisco Meireles, a conversation the journalist affirms he heard and met on the 23rd of April of 2008, '23 de abril de 2008. El periodista aparca el coche en el mismo lugar donde Tavares y Meireles esperaban' [The Journalist parks the car in the same place where Tavares and Meireles waited for him] - this is odd, and the Spanish 'journalist' could never had been in a meeting with these 2 inspectors, less alone to hear them speak. Why?

For those who may not know, the inspectors João Tavares and Francisco Meireles are fictional characters from a book titled 'A Estrela de Madeleine', by Paulo Pereira Cristóvão, and the sentences that the characters speak in the novel are the ones the journalist affirms he heard.

Malvar's version in Spanish, from the El Mundo's article which is word by word a copy of the text from Paulo Cristovão's book in Chapter 9, page 63:

«No podemos perder nunca nuestra intuición de policías, cojones. Tenemos que seguir siendo mañosos... no somos noruegos, ni finlandeses, cojones. And a bit of creative writing where the journalist reports what he heard from João Tavares:

Incluso, si alguien la tuviera en su poder, ¿la iba a mantener viva sabiendo que es la niña más buscada del mundo? Yo creo que no. La publicidad desmesurada que le dieron [los padres, desde la primera noche] a su rostro y su iris especial fueron su condenación. El resto es palabrería, compañero. Murió y que Dios cuide de ella, porque era una inocente que cayó en un mundo de bestias puras». Lo dice Joao Tavares.

Which translated means: The little Girl, unfortunately for us and specially for her, is not in the world of the living anymore. Actually, if someone had her would they keep her alive knowings she is the most searched giel in the world? I don't think so. The huge publicity given by the parents since the first night to her face and eye in particular was her condemnation. The rest is words, mate. She died and may God take care of her, because she was an innocent girl who fell in a world of pure beasts. Said João Tavares.

Funny how the above seems to be a mix of comments done by Carlos Anjos and Moita Flores, actually I can't find this in the book 'A Estrela de Madeleine', anyway the main point here is that the journalist here is listening to João Tavares - a fictional character.

Gonçalo Amaral's alleged Interviews

As well, in this latest article Malvar reuses and adds some words in an alleged 'interview' to Gonçalo Amaral, an interview published back in September 2007, and pastes it in the new article giving the impression that he is still following the the investigation. Amaral declined and was forbidden to comment by the Portuguese secrecy code of Justice.

«The PJ general direction of Lisbon has denied him the permission to grant to us an interview, but it is necessary to try it. His denial is kind and flat.

- Don't you even want to answer to the personal accusations that were done to you by the English press?

- No.

- Don't you get bother with so much media noise? This doesn't obstruct your work?

- As Saint Joseph said, 'Justice is done in silence'. Muito obrigado. [Thank you]»

In the new interview the journalist, besides quoting fictional characters as if they were real the Spanish journalist also affirms he was the first to get an interview from Gonçalo Amaral - looks like another Nacho Abad baseless allegation. Malvar then adds that to do that interview he promised to keep Gonçalo Amaral as an anonymous source, but now because he is going to retire that fact doesn't matter at all. McCann's family will be in the media for the rest of their life

From empathy to distrust, several British journalists recognise that excesses were committed in the cover of the disappearance of Madeleine McCann but they deny that the interest for the private life of the family will decrease.

"What we have done to this couple was not our best moment as journalists", recognises the ex journalist Roy Greenslade in declarations to the Lusa agency, a year after the disappearance of the British child with 3 years old from a flat in Praia da Luz, Algarve.

Yesterday the on line edition of Expresso revealed that the PJ was preparing the filling of the case and clear the McCanns. Several judicial sources contacted by our newspaper rejected such possibility. "That hypothesis is unthinkable. No process is filled whilst there are still investigations occurring. There are still several steps to make and that possibility wasn't even equated" guaranteed a high responsible connected to the investigations.
The same source added: "If it was to fill we would not have asked the return of the McCanns and friends to Portugal. The McCanns will continue to be arguidos till the end of the process. No matter the time it takes. Who says otherwise does not know the law and is speculating".

A source of the Portim&#227;o's court assured that the public prosecutor is still waiting for the final report of the PJ about the process that according to what 24 Horas discovered is not yet done.
