PJ believes clues justify preventive custody

The Policia Judiciaria (PJ) believes to have “enough clues” in order to incriminate Kate and Gerry McCann, who have been constituted arguidos on Friday, and subject to ‘termo de identidade e residencia’ [basic coercion measure]. They are suspected of the death of the child, on May 3, in the apartment at Praia da Luz, and of hiding her body. But it will be on the coming days that it will be known whether the attorney from the Public Ministry (PM) in Portimao, who today receives the report of the interrogations that were performed on Thursday and Friday on the parents of the British child, decides to notify the couple at their home address in England, to return to Portugal, in order to present themselves before a judge.

And only that judge can change their present coercion measure, which could reach, in an extreme situation – which is not the present one – preventive custody. If that is the decision from the PM, Maddie’s parents will have to present themselves in Portimao at the date that is indicated by the attorney. If they fail to do so, an international arrest warrant could be issued against them.

But this is where difficulties start. One of the jurists that were heard by DN reminded us that “it will be sufficient to present a doctor’s certificate, alleging any kind of health problem, in order to postpone a questioning or a simple PJ diligence, thus compromising the ongoing investigation”. Anyway, the couple has said they are available to return to Portugal when they are notified to do so. But the PM could also just reach the conclusion that there is not enough evidence to sustain the death theory in court.

Trust in the evidence

As DN could confirm with sources that are close to the process, in the ten vehicles that were subject to forensic tests in August, it was only in the Renault Scenic that was rented by the McCanns 25 days after their daughter’s disappearance that “biological fluids that match the child’s genetic profile in 80%, were detected under the car trunk’s textile cover”. And it was only the fact that the sample that was sent to the lab in Birmingham, UK, was “reduced”, “didn’t allow to reach the 100%” in results of forensic testing. During the searches that were performed at the “Vista do Mar” villa, in the Luz Parque area, at Praia da Luz, which was occupied by the McCanns from July until yesterday morning, cadaver odors were detected on clothes that belong to Madeleine’s mother, and on the now famous soft toy that belonged to the child.

‘A sort of flight’

Although legally nothing prevented the McCanns from returning home, the Judiciaria ended up being surprised about their decision, which represents, in the perspective of several investigators, “a sort of escape”, which, naturally, “may have consequences on the process’ development, with delays”. Even more so as PJ, according to what DN knows, had “advised” the McCanns not to leave Portugal without knowing what decision the judicial instances will make concerning an eventual change in their present coercion measure.

The other arguido

Francisco Pagarete, the lawyer for Robert Murat, who remains an arguido in the case for suspected kidnapping, although there are two suspects of death, was not surprised about the McCanns’ new juridical situation. “The fact that they have been made arguidos does not surprise me. But we have no further comment to make”, he told DN. Concerning his client’s situation, he said he is still “waiting for a rapid solution”, but will not propose any initiative. “The PM has to analyse the clues and see if there is any indication that leads to my client to stop being an arguido”.

PJ only found out the day before and was not informed by McCanns

The Policia Judiciaria only knew about the exact date that the McCanns were returning to England, on Saturday afternoon, less than 24 hours before the plane that took the couple left, and was not informed about the fact by anyone that is connected to Madeleine’s family. The return should have been tomorrow.

The Portuguese investigators were caught by surprise, given the fact that the couple – who was constituted arguidos last week for suspicion of hiding the child’s corpse and for participating in the child’s death – had told police they were returning tomorrow only. A source with PJ admitted to JN that he was told about the trip’s booking on Saturday afternoon, through persons that are completely unrelated to the family.

The spokesman for Policia Judiciaria, chief inspector Olegario de Sousa, told JN that the police knew about this trip, reminding us that the couple is subject to ‘termo de identidade e residencia [basic coercion measure], that they gave their UK address, therefore they are “just fulfilling a right that is given them by Portuguese law”.

The surprise trip, which was revealed by JN yesterday, was announced only to British journalists, during the informal meeting that the couple’s spokesperson held, on Saturday morning, with the British professionals. The agreement, as JN could find out, was to announce the return would be in the coming days, and not to disclose the exact date. But around 00.30 a.m. yesterday, British television Sky News was announcing the McCanns’ return during the morning of the same day, which led dozens of journalists to the family’s residence, in Praia da Luz, and to Faro airport.

Special treatment

They entered the VIP door, away from the journalists’ eyes, around 8 a.m. A few minutes later, they entered the EasyJet plane that left Portugal at 9.45. Flight 6552 ende at the East Midland airport around 12.15, but Kate and Gerry, who were carrying the 2-year old twins, only left the plane 15 minutes after it landed.

A tv camera was waiting for the family. After having promised a short statement to all the journalists at Praia da Luz, Gerry opted for a brief statement on English soil. He explained that their return home was decided after “much thought” and was related with the twins’ emotional well-being, whom he wants to have “a normal life”.

Arguidos and return

The last fourty eight hours have significantly marked the Madeleine case. The parents have abandoned national territory with the justification that their younger children needed to return to their normal life in the United Kingdom. We think that, after 129 days in Portugal, they could have waited another four or five, in order to clarify unequivocally, when the Policia Judiciaria holds all the forensic results, that which they believe to be their total lack of responsibility in the disappearance of little Madeleine. The truth is that the status of arguidos that was imposed on them, is the normal consequence after the appearance of strong clues that could question their former statements as witnesses. It is also true, and they know it well, that whether in the United Kingdom or in Portugal, leaving three children on their own in an apartment that provided access like that one did, is a penally relevant illicit act.

It is not less true that, contrary to what relatives that are close to the couple have been referring over the last two days, the Policia Judiciaria has always treated them as victims, which means they were always seen as parents whom a daughter was taken away from. That was the way it was, and the way it was supposed to be. The presumption of innocence is applied to all those about whom no condemning sentence was spoken. Initially, there was no reason to make any more or less evaluative judgment about this couple. They were parents whom a daughter had been taken away from, and that is enough for the police. It just happens that investigations are always a string that one pulls without knowing how long it is, or what could be inside the ball. Police have reconstructed that night the best way it was possible to do. It was the unmaking of the string ball that naturally lead to the last fourty-eight hours, when, according to what the Penal Process Code instructs to do in such situations, the couple had to be granted the right not to say anything that might incriminate them; not to answer any questions and even to lie without any punishment for it. Given these facts, can anyone still seriously say that there is a will from the Police to falsely and intentionally incriminate Maddie’s parents? Wouldn’t it be more comfortable for the police to keep them as witnesses, a status that forces them to speak about everything and to respond without any possibility to omit or lie about any fact? The answers are obvious.

One doubt disturbs us. Being a fact that close relatives have widely defamed the Portuguese police, saying they planted evidence and comitted other actions that are difficult to describe, will the McCanns return to Portugal, if and when the Portuguese justice calls them for further clarification? And, if they eventually refuse to do so, will the British government place them in Portuguese territory? We will have to wait. From our side, we will certainly continue to pursue an unbiased, committed investigation, which will stay immune to northern winds that will certainly blow harder over the coming times.

PJ believes Kate killed her daughter


Madeleine may have been assaulted. But she could also have died because of an accident, after having been sedated to sleep. This is the Policia Judiciaria’s conviction, as they believe that Kate killed Maddie, either accidentally or in a conscious form. There are no certainties, just clues that point to the child’s mother. For her behaviour, for the way she acted about her daughter’s disappearance, for the cadaver smells and forensic evidence that were collected by scientific police.

Kate presented herself at Policia Judiciaria on Thursday, visibly out of control. Police forces that were contacted by CM say she had several hysterical reactions during the more than 13 hours of interrogation. And she refused to answer many questions. She did not explain the blood that was found in the car, she did not answer whether she slapped her daughter in the face. And she didn’t even clearly confirm if she sedated the children.

Only the facts are certainties for the PJ. And those facts revealed it was Kate who usually took care of the children, putting them to bed regularly, while Gerry played tennis or rested by the pool. The deposition of the senior British citizen (Pamela Fenn), who occupied an apartment on the floor above the one that was used by the McCanns, also indicates that Kate sometimes became violent. She lost control, and it was easy to hear the girl’s screams, calling out for her father. Another witness, also a British citizen, refers the same scenario. Kate seemed to have moments of aggression towards her children, while the father, although more absent, revealed more emotional control.

Kate refuted all these suspicions at the Policia Judiciaria in Portimao, where she was interrogated, and it was then that the penal circumstances of negligent murder were explained to her. CM knows that the investigators, while not confronting her directly with a possible aggression, explained her that by not confessing to the accident, she could be opening the doors into a more serious penal setting.

Which means it would stop being treated as negligent homicide, and would pass into a qualified crime or with eventual harm.

Father asks PJ for evidence

Gerry also had an unusual behaviour during the judicial interrogation. When he was confronted with the PJ’s suspicions, Maddie’s father repeatedly asked for evidence to be presented to him. He did not promptly deny the facts, but was trying to assess whether the authorities had enough clues to support the homicide theory.

For PJ, there is another strange situation. If it was an accident, why did the McCanns get rid of the body and simulated an abduction? The possibility that they could be trying to hide something more than a thoughtless action is on the table, and investigators are just waiting to exhaust all the chances that they may explain the death themselves. After that, they will advance the formal murder charge, with hiding of the corpse.
