Yale lab technician Raymond Clark is making an appearance in Connecticut Superior Court on Church Street Tuesday afternoon in connection with charges that he killed 24 year-old Yale graduate student Annie Le and hid her body inside a wall at a medical building. Following is a live minute-by-minute account from the courthouse.

2:20 p.m. Discussion begins on the motion by the Hartford Courant, joined by the New Haven Register and The New York Times, about whether to un-seal the arrest warrant and other court documents. The defense wants to keep the documents sealed.

2:19 p.m. Judge Roland Fasano has set a date of Nov. 13 for a probable cause hearing.

A judge heard arguments Tuesday about whether to make public the police documents in the case against Raymond Clark III, who is accused of murdering Yale graduate student Annie Le, but he made no ruling.

Judge Roland D. Fasano told attorneys in Superior Court in New Haven it may take him weeks to make a decision on whether to continue the seal on the documents.

Clark &#8212; handcuffed, shackled and wearing an orange prison jumpsuit &#8212; did not enter a plea Tuesday. The judge set a deadline of Nov. 3 for the prosecution to finish the discovery portion of its case.

At Clark hearing, both sides seek continued seal

The family of murdered Yale pharmacology student Annie Le GRD &#8217;13 has asked that the documents relating to the case against her accused killer, Raymond Clark III, remain sealed.

At a pretrial hearing Tuesday in New Haven Superior Court, state prosecutor John Waddock said Le&#8217;s family is concerned that releasing any information about her death would invade the family&#8217;s privacy, making &#8220;this difficult time much more difficult.&#8221;

But Clark&#8217;s defense attorney, Beth Merkin, said keeping the information in those documents secret would help ensure &#8220;a fair and impartial jury, one that is not affected by any adverse pre-trial publicity.&#8221;

His defense attorney, Joseph Lopez, asked for more time to decide whether to request a probable cause hearing, at which the judge would decide whether the prosecution has enough evidence to proceed to trial. Lopez said Clark is waiting to see more of the evidence against him.

The prosecutors, meanwhile, asked that the court documents remained sealed for at least another two weeks. After several news organizations requested last month that the search and arrest warrants be unsealed, both the defense and prosecution argued at an Oct. 20 pretrial hearing for the documents to remain sealed. The attorney for the Hartford Courant, which is leading the motion, was also not in court today.

The defense attorney for Raymond Clark III, charged with murder in the death of Yale graduate student Annie Le, told a judge today that the police file in the case is &#8220;trickling in&#8221; so slowly to him that he cannot yet decide whether to seek a probable cause hearing.

Public Defender Joseph E. Lopez asked Superior Court Judge Roland Fasano to waive the 60-day period defendants have to decide about the hearing, during which prosecutors try to show there is enough evidence to maintain the charge.

Fasano granted the request and set the next court date for Dec. 21st at 2PM.

The released material will also include some new information, including speculation by police. The ultimate reason to unseal the documents, Fasano wrote, was to promote openness and transparency in the criminal courts. But to protect Clark&#8217;s right to a fair trial, Fasano excluded six pieces of the reports that he considers inflammatory, unfairly prejudicial or invasive of privacy.

Murder suspect's fiancée, sister and brother-in-law return to Yale labs

Clark&#8217;s fiancée, Jennifer Hromadka, his sister, Denise Kent, and his brother-in-law, Shawn Kent, first did not show up for work two days before Clark was arrested on Sept. 17, a person who works with Clark told the News at the time. But Hromadka and the Kents are now back at work in the same positions, Vice President for Human Resources and Administration Michael Peel confirmed Tuesday. Peel said human resources staff had met with all three to discuss how the University could ease their transition back into the workplace.

Administrators felt obliged to help Hromadka and the Kents return to their normal work routines, Peel said, adding that the three have not been accused of any wrongdoing.

A Superior Court judge agreed to release portions of an arrest warrant affidavit that contains information that led to the arrest of Raymond Clark III in the killing of Yale graduate student Annie Le.

Judge Roland D. Fasano's decision, released Friday afternoon, says the information will remain under seal for 72 hours. Since courts are closed Wednesday for Veterans Day, the document &#8212; with some portions removed &#8212; will be released Thursday or Friday morning, a court official said.

They cited language in the ruling issued by Judge Roland Fasano last Friday at 3 p.m.: contents &#8220;shall remain under seal for 72 hours (three business days) from the date of issuance of this decision&#8221; unless the ruling were appealed.

The court official, who asked not to be identified, said Fasano&#8217;s intent was that the material not be released until Friday, absent appeals. The official said the key phrase in Fasano&#8217;s ruling is &#8220;three business days&#8221; and that they are counted in their entirety: all of Monday, all of Tuesday and all of Thursday.
