Mexican Justice: Is There Such a Thing?

What happens when a citizen of the US vacations in Mexico and something bad happens, something really bad, something violent, or worse, murder? We all think we have some grasp of how our own criminal justice system works; the bad guys are caught, charged, go to trial, are convicted and sentenced. Well, maybe in an ideal world.

In as much as we feel the justice system in the United States needs to be overhauled, changes in plea deals and light sentences, among other things, how many of us can truthfully say we know how the criminal justice system works in other countries? We love to vacation in Europe, Asia and Central and South America, many buying vacation property and retirement homes in third world countries, but what happens when trouble starts?

In April, Bruce and Monica Beresford-Redman agreed to take a trip to Cancun to help repair their marriage, which, by all accounts, was quite troubled. Many around Monica, including her family, didn't feel that Bruce was "sincere" he was up to something and acting strange. Monica's family warned her not to take the trip. Two young toddlers, 3 and 5 were vacationing with their parents while the couple embarked on, what Monica had hoped would be, a second chance; a second honeymoon with her husband, the producer for the hit tv show, "Survivor."

At what point did trouble start? In my opinion, it was when he began his premeditated plan, likely with some help, to elimate his wife and mother of his children in paradise in a foreign country. Pretty clever if you ask me.

Article written by Susan Murphy-Milano after radio interview with Private Investigators, Vito Colucci and Al Dressler who both gave good information about how to handle things while in a foreign country. Makes me want to stay right here!

I saw this earlier. Unbelievable!!! Where are Monica's rights? I'm not sure if she was a United States citizen but their children are...What about protecting them here? How could anyone from the US condone this situation? Those grandparents should NOT have those children, I don't care what anyone says. The mother lied to protect herself and Bruce when he was growing up, now she lies to "protect" the children. Who knows what else she would lie about or cover up?

Murder Charge Sought For Beresford-Redman

Prosecutors in the Bruce Beresford-Redmancase want the former "Survivor" producer charged with first degree murder ... Bruce's Mexican lawyer tells TMZ.

AttorneyJaime Cancino Leon tells us prosecutors will make their move by end of day Monday.

According to Mexican law, the Attorney General will submit his recommendation to a judge, who will then review the evidence. If the judge determines there is probable cause, Beresford-Redman will be formally charged with the murder of his wife, Monica Burgos Beresford-Redman, and the judge will issue an arrest warrant.

We're told it will take the judge several weeks -- minimum -- to determine if probable cause exists.

Cancino is critical of Mexican officials, saying it's easier to just charge the former "Survivor" producer than to properly investigate the case.

Cancino adds, "Bruce has never had the chance to defend himself. They didn't even give him the chance to participate in the investigation."

If Beresford-Redman is extradited and then convicted of first degree murder, he would face 4 to 20 years in prison. There is no death penalty or life sentence in Mexico.

I'm thinking if you want to defend yourself you don't leave the country without assisting in the investigation...JMO:sick:

I can't quite understand what he means by these statements. Not had the chance to defend himself? As you said, he could've cooperated with LE and stayed in Mexico. Participate in the investigation? Well, he could've confessed and helped LE immensely! :waitasec: MOO

He's likely going to regret that. There's now at least one insurance company with a substantial financial interest (paying out $500,000 on a claim) in Bruce being found guilty of his wife's murder. Insurance companies have huge in-house legal and investigative staffs. Wouldn't be surprised if they throw some assistance to the mexican officials in charge of investigating this case (manpower / financial / both).

You would need one to get on a plane otherwise the carrier wouldn't let you board, but if you presented yourself at a border post you only need some form of ID. So, he could have just driven home.

You post as if an authority, but leave info out - which is unfortunate.
It is your opinion on grandparents instead of aunts/uncles raising children, certainly not California law - and in fact a passport is needed for most re-entry into the states. http://www.dhs.gov/files/crossingborders/travelers.shtm

I just got on this case, so excuse me for any assumptions.
But.........I did read a bit (not everything).

Why would he take his children along on a vacation if he planed to kill his wife there?
If the kids were there, didn't they at least hear some kind of loud noise?

Last but not least in MEXICO you can not be roaming around free till a trial comes up...They all move at the pace of a snail, or Manyana....so this case can get to court years from now, WHY would he want to stay there? Why shouldn't he be waiting here till the case does come to trial?
And since MEXICO does not even want to investigate this, he would be hung with out justice.

I am sorry, but I do not remember where I read this at. I will try to find out and post it. If any one of you sleuthers out there happen to know or have read about this, please help me out. THANKS!

I would suggest to read more on this case given what you have posted. There is a lot of info out there that you must not have read yet. Info that will answer some of your questions.

Investigators say that Monica was beaten and then strangled to death.
Hotel staff told police that they witnessed Bruce and Monica having a heated argument on Sunday. And despite Bruce's story that he hadn't seen his wife since Monday morning, other guests reported that they heard the couple fighting in their room that night. Authorities also noticed scratches on Bruce's body.
Evidently, the Beresford-Redmans' marriage had been strained for months, ever since Monica discovered that Bruce was having an affair.


In this country, this would be pretty much a "slam dunk".....
with motive and opportunity!

Off the top I can think of a lot of things that point to him. This seemingly unplanned trip to Mexico on her part would practically rule out anyone else she knew committing the murder. Her body being found on the hotel property also tells me the perp didn't have any way of taking it elsewhere and/or was unfamiliar with the area. She and her husband had been in a heated argument, overheard by staff and other guests, and he had scratches on him. He'd just taken out large life insurance policies on her. And now his family is apparently telling the children she died as the result of a car accident, which is a lie. He'd also said she'd gone shopping when he originally reported her missing, but there's no proof she'd even left the hotel. Yes, a stranger could've done it, but what are the odds? And for what? And how coincidental would it be that immediately after the fight, she turns up dead at the hands of a stranger? :waitasec: MOO

The children of a Los Angeles woman found dead at a Mexican resort last month will not be allowed to attend a memorial service for their mother Sunday, a judge ruled Friday.

A therapist hired by their father, a former "Survivor" producer named a "person of interest" in the investigation of his wife's death, said the service could be emotionally harmful to the young children.

Mexican authorities detained the father, Bruce Beresford-Redman, as a suspect the day his wife's body's wife was found. He was released a day later.

Sunday's memorial service is planned by Monica Beresford-Redman's sisters, who are also fighting for custody of the children.

"We respect the decision of the court, but we are very disappointed the fact that the children were denied to participate in the celebration of their mother's life," Jeane Burgos said.

OMG!!! This could be emotionally harmful to the kids to attend their mother's memorial service. But it's no big deal to have grandma blab to the kid's the "big lie" that their mother died because she was ran over by a car!!!

CANCUN, MX .- A month and a half later, Mexican authorities are ready to file charges and seek a warrant for the murder of Monica Burgos, wife of former Survivor series producer, Bruce Beresford-Redman.

The state attorney general of Justice of Quintana Roo, Francisco Alor Quezada, announced that "on Monday we will be able to enter (submit) the file" before a criminal court, but declined to specify whether it will be against the producer, who is listed as the main suspect.

"We will be seeking an arrest warrant for murder with all its aggravating," said the official. "Obviously the judge will assess all the proofs, documents, witnesses and experts that we are bringing in the file and we will have to wait for the timely manner that the judge considers necessary and the judge will determine (whether or not there will warrant)" .

The Quintana Roo Penal Code provides that the sentence for a person found guilty of murder is between 12 and 30 years, but if you look aggravating these terms increase.

According to the Code means qualified when the offense is committed with premeditation, treachery, advantage or treason.

"If we can prove what we are sustaining in the file, wait until (the judge) to give us orders of apprehension or arrest warrant against the person or persons responsible,''he said without offering details.

The former Survivor producer was confiscated his passport and had been ordered to remain in the country while an investigation continued. But his lawyer said Beresford-Redman returned to the U.S. to be with their children and address family and personal affairs. (Source: Associated Press)

I do not know how old the children are, but I totally agree with the judge. I always believed that is no place for children.

I'm sorry but as a clinical social worker who works with children, I must respectfully disagree. Tastefully handled memorials are very important parts of the grieving ritual and I'm sure the family and mourners would be sensitive enough to ensure the children are protected but allowed to be part of saying good bye to their beloved mother. Children have great difficulty developmentally accepting the finality of death and funeral rituals are something than can be very helpful in this process.

I think the grandmother's lie about how their mother died was the most inappropriate and potentially damaging thing that has happened since their mother's death. There was no need to tell a story such as this. A much simpler statement that their mother had died and the police were doing their best to find out why would have been more appropriate as another poster (panthera?) stated earlier. IMHO

BTW, I believe the children are 3 and 5.
