Mexico sends arrest petition for TV producer charged in wife's death

Los Angeles, California (CNN) -- Three weeks after a Mexican judge ordered the arrest of Bruce Beresford-Redman in connection with the death of his wife, the reality TV producer is still living free with his children in Los Angeles, California.

The United States has Mexico's petition, but the U.S. State Department would not confirm when the extradition of Beresford-Redman to Mexico will begin, Mexican officials said.

Quintana Roo, Mexico, Attorney General Francisco Alor said he has a "very concrete" case against the former "Survivor" producer in the death of Monica Beresford-Redman at a Cancun resort.

The extradition request must go from the State Department to the Justice Department in Washington, which would then pass it to the federal prosecutor in Los Angeles.

The extradition request has not yet arrived at the U.S. attorney's office in Los Angeles, which would ask a federal magistrate to issue an arrest warrant, a spokesman there said.
Defense lawyer Richard Hirsch has said he would fight extradition.

Hirsch accused Mexican officials of "a rush to judgment" in charging Beresford-Redman, saying "it appears that this case is being handled in a manner outside the normal procedures in Mexico."

Beresford-Redman was briefly detained after his wife's body was found April 8 in a sewer at the Moon Palace Resort. His passport was taken by investigators, and he was told not to leave Mexico until the probe was concluded.

Beresford-Redman attorneys appeal extradition

RANCHO PALOS VERDES, Calif. (KABC) -- The Southern California reality TV producer accused of murdering his wife in Mexico is fighting extradition.

Prosecutors say attorneys for Bruce Beresford-Redman have filed an appeal to try to block his extradition from Rancho Palos Verdes to Mexico.

The filing asks a higher court to consider whether the arrest warrant is even valid.

Quintana Roo state prosecutor Rodolfo Garcia says the petition arrived Friday.

What really disgusts me is the way people with money and power are able to draw out, and often altogether avoid, facing consequences for criminal behavior. This poor woman, who sounds like she was an amazing human being, was savagely murdered, while her murderer still walks the planet. And just like Vander Sloot (however you spell his name), and plenty of other wealthy animals, justice will be long delayed. Sickening, truly.

On April 9, 2010, a forensic expert examined the couple's hotel room.
He found stains on a pillar in the room, on the sheets on the bed, and on a railing on the balcony of the room.
The stains tested presumptively positive for the presence of blood.
Beresford-Redman reported his wife missing on Tuesday April 6, telling police and relatives that she never made it back to the hotel after a solo shopping excursion the day before.
But police say there is no record of her having left the hotel grounds.
Security guards check all cars that come and go.

A guest at the hotel reported hearing a commotion coming from the room occupied by the couple on the day Monica died.
The hotel staff in Cancun was notified that the guest heard "a woman screaming for help" around 6 a.m. on Monday April 5.
The guest also reported the "sounds of furniture being moved or thrown" coming from the Beresford-Redman room.
A security guard said that a hotel employee called the room to check on the complaint and said, "A man answered the phone and said that everything was fine."

Jeane Ferreira Burgos said[...]her sister had the locks changed on the couple's home before the vacation, and told their children's schools that her husband should not be allowed to pick them up.

That bothers me greatly. I agree with those who say that the relatives of the suspect should not get custody unless an equally good alternative does not exist. The courts favor the status quo and thus, since the kids have been with their paternal grandparents since April, it would be hard for Monica's sisters to get the kids. But gosh, they're with the grandmother who lied to them about their mom's death and grandpa seems somewhat "unusual" to me, shall I say. They seem to be enablers, like the Petersons and the Anthonys. It saddens me that the aunts do not have custody.

Two of the mother's sisters — Carla Van Bastelaar and Jeane Burgos — had sought custody of the children, but agreed to give it to David and Juanita Beresford-Redman, who have been serving as temporary guardians of Camila, 5, and Alex, 3.
"The settlement is in the best interests of the children and on behalf of my clients I'm thrilled that we were able to do something cooperatively," said Patricia Phillips, attorney for the aunts.
"I want what's best for the kids you all care so much about," said Judge Mitchell L. Beckloff, who signed the agreement after talking Tuesday to lawyers for both sides, who said they wanted to avoid trial.
Adrienne Hahn, attorney for the grandparents, said the agreement will allow the children to remain with their father, who lives with his parents and the kids in Rancho Palos Verdes.
"They should be home with their dad," Hahn said.
The aunts added a provision to the agreement saying Bruce Beresford-Redman had to wait a year before he can ask that his parental rights be restored.

The maternal aunts of 5-year-old Camilla and 3-year-old Alec asked the judge to grant them overnight visitation rights, but that request was denied. The children will remain with their paternal grandparents for the time being.
Monica's sisters have been very vocal about their suspicions of Beresford-Redman and his alleged involvement in their sister's murder and do not want their niece and nephew to be near him. The sisters said Monday that they're concerned about the living situation that the children are currently in, as they're living in their father's house with their grandparents.
"It's very frustrating. I think it's traumatizing everybody, because the kids are living with a person who has been charged with first-degree murder of their mother, so it's traumatic," said Monica's sister Jeane Burgos.
Monica's other sister, Carla Burgos, said in court that the two children are unhappy living with their grandparents. Still, the judged ruled that the guardianship will remain as is until full legal custody is determined at trial in November.
The judge in the case has previously refused to give Beresford-Redman custody of his two kids because of the pending murder charge.
He has granted the maternal aunts visitation rights while the kids stay with Beresford-Redman's parents, but the judge also said the constant custody tug-of-war is not beneficial to the children as they try to cope with the loss of their mother.

Me too. I can't wait for him to begin his new life on the inside of a Mexican prison.

I hope that the agreement allows for liberal visitation with aunts, including overnights. I guess now he won't be able to petition to regain his parental rights in a year!

Apparently the arrest was a complete surprise.

And I disagree about Mexico. Mexico has a very low conviction rate for murder [although this IS a high profile case] and those convicted spend a very short time in prison.

Bruce Beresford-Redman will not get a fair trial if he is extradited to Mexico to face murder charges over the death of his wife Monica, according to the television producer’s father, who spoke out exclusively to RadarOnline.com.

"If he's extradited, he's done," a shocked David Beresford Redman told RadarOnline.com.

David believes there is “not a chance” for a fair trail in Mexico. “Not a chance and the reason is pretty simple, this is a resort town.”

He explained: “You understand how the court system works in Mexico to some degree I'm sure. It's local court, it's in a resort city and the attorney general down there in the state where this occurred has already said how guilty he is, etc., etc., etc., so our Mexican lawyer says it's pretty simple: if he goes down there he'll go before the local court and, you know, by late in the day he'll be convicted.”

On Tuesday, US Marshals took Bruce into custody in connection with Monica’s murder at the Cancun resort they vacationed at in April. David also revealed details of his son’s shocking arrest. “We went off shopping. Bruce was in bed. He's quite ill. He's got an extremely bad cold,” David said.

“Apparently they must have rung the bell and he went to the door and they presumably identified themselves and they served an arrest warrant and popped him in some kind of vehicle and took off. And when we came home there was a car parked at the curb and we drove in and Juanita [Bruce’s mother] thought it might be a reporter but he followed us up and he identified himself to Juanita as a Marshal.”

Bruce is expected to appear at a Federal court on Wednesday in Los Angeles. David said he believes his son’s attorney Richard Hirsch will ask for a continuance “because they're going to have pretrial services to review Bruce to see if he's a candidate for bail.”

I can't imagine that he would be granted bail after he was already asked to stay in Mexico while they investigated and he left. He would have to be considered a flight risk. Also, does his father really believe he didn't do it? Or is he just complaining because he won't be tried in LA where they rarely convict celebrities?
They can't have been surprised that this would happen. jmo
