The convictions came four months after jurors deadlocked on charges against Potterville resident Adam Fox and Delaware truck driver Barry Croft and acquitted two others who were accused of being part of a broader group of people angered by pandemic restrictions and hoping to spark a second Civil War. Fox and Croft face up to life in federal prison.
Croft had a look of resignation as the guilty verdicts were read, while Fox didn’t have a reaction...

I have been following and posting Mr Martin's twitter feed, a local Grand Rapids reporter. I believed him to be impartial on his reporting of this case. The 'followers' on his twitter page, responding to the verdict seem a bit outraged, IMO.
I am anticipating an appeal, obviously....

Guilty verdict reached for 2 men in Gov. Whitmer kidnapping plot trial
Two men have been found guilty on charges connected to the plot to kidnap Michigan Gov. Gretchen Whitmer.
They are going to have a very steep climb in regards to the appeal. To my knowledge, the only explicitly forbidden under cover or informant techniques are:
- Using romance as a lure.
- Promising the defendant "inordinate" sums of money.
But.... even the money aspect is narrowly defined. Appellate courts have upheld terror convictions for defendants who were offered a combination of cash, a cool car, and business assistance that was valued at many times their annual minimum wage income.
Appellate Courts have also upheld conspiracy convictions where the informant repeatedly approached the defendants, provided beer / weed, made contrived arrangements for "meetings, had shown defendants inflammatory material- then asked them to participate etc.
In my opinion....
The federal government should establish Civil Rights Review Office. This office would then need to vet under cover / informant driven conspiracy investigations before charges can be filed.
The linkage of terror investigations to agent / prosecutor promotions and the use of "professional" informants who need to find bad guys to stay employed is just a slippery slope for abuse.

IMO, The attempt to use LE entrapment has always been a difficult climb for any defense. And appealing that aspect will be difficult. This case, however has a bit more than that for an appeal. The very very limited and selected "snips" of video/audio allowed by the judge, and refusal to allow full context of the same is suspect. The sudden ( midway through the trial ) time limit set on only the defense attorneys by Judge Jonker during cross exam was suspect. This ruling also was quickly reversed the next day. Hmmm! Highly suspect, IMO.
I think you are right in that challenging the "mechanics" of the judge's rulings regarding time and evidence rather than the undercover / informant techniques are more likely to be successful.
The totality seems weird. The Constitution is geared towards the defense in criminal proceedings. So much so that additional rights have been created (right to an attorney).
As a result, one would think that it would take an awful lot of justification before a judge limits time allotted to defense attorneys. The fact that such an unsustainable (reversed) ruling was even made could point towards bias.
Likewise, my guess is that the defense is given more leeway in what evidence can be presented. Its not like they wanted to say.... introduce a purported membership roll of members of the "New World Order". Rather, they were simply requesting that prosecution evidence be shown in its entirety.

Lengthy testimony & repeated debriefings have been critical in building a case to counter defense arguments that revolve around free speech issues as well as accusations of entrapment by federal undercover informants, Nils R. Kaleb James Franks (26) – Plead guilty (2/7/22) to kidnapping conspiracy. Will testify at trial & will be sentencing afterwards.

Update on sentencing of Ty Garbin, per Michael Martin:
"UPDATE: Government has filed a request to reduce Ty Garbin's 75 month sentence, due to his continued cooperation with prosecutors. They are asking to reduce his sentence by 36 months. That would cut his time in prison down by 3 years if accepted by the court."

This can also be used in an appeal.
As illustrated by defense attorneys in a successful appeal for a stoned 'n duped "eco warrior", offering continuous reductions in exchange for still more testimony leads to witnesses concluding that the "better" their testimony, the more they get rewarded.
They then juice up their testimony with exaggerations- or out right lies. In the case of the eco, prosecutors eventually offered 90% reduction in prison time for continued "testimony".
That led to claims that the stoner was not only going to blow the dam (bomb making chemicals purchased at ACE- come on), but that he wanted to drown as many people as possible etc. etc.- all while living with mom and dad.
The stoner was then convicted and sentenced to 20 years in prison. His former partners, initially facing identical charges, got slightly over 2 years each.
Evidently the reductions offered in this case stand at 50%. But..... were the initial charges already watered down for the cooperating witnesses? If so, the actual reduction could well be higher, say 85%.

Next 3-day preliminary hearings on 4/14/21.
2/18/21 Update: Antrim County – Fix of Belleville, Molitor of Cadillac, M. Null of Plainwell & W. Null of Shelbyville were recently granted a 60-day adjournment with new preliminary examination dates pending. Defense attorneys said they needed more time to review evidence that’s yet to be turned over by the Attorney General’s Office. The awaited information was expected to be turned over to the defense within two weeks (around 3/11/21). Brian Higgins is another suspect charged in Antrim County, but he is currently fighting extradition from his home in Wisconsin Dells, Wisconsin. 3/2/21: Request for media coverage of Court proceedings from 7, 4 News, Fox News, Vandussen Productions & Interlochen Public Radio.
4/14/21 Update: William Null, Michael Null, Eric Molitor & Shawn Fix. At a court hearing earlier in the year, defense attorneys requested the preliminary exams to be held in-person. The hearing was scheduled to take place in a Grand Traverse County courtroom on Wednesday, 4/14/21 but that is now on hold - yet again. The reason for the delay is the recent increase in COVID-19 cases across northern Michigan. Twin brothers accused in the plot to kidnap Governor Gretchen Whitmer have been released from house arrest. Curfew restrictions were also lifted by an Antrim County Judge on both Michael Null & William Null. However will have to remain on electronic monitoring.
5/19/21 Update: In exchange for leniency, a Michigan man has agreed to help prosecutors in their efforts to convict fellow members of a militia group accused of plotting to kidnap Gov. Gretchen Whitmer. Maxwell Wyckoff, 22, of Clarkston, a Wolverine Watchmen militia member whose associates are accused in the kidnap plot, is charged with converting a semiautomatic weapon to an automatic weapon, a felony punishable by up to four years in prison; and possessing a muffler or silencer device, a felony punishable by up to five years in prison.
6/29/21 Update: Eric Molitor went before Antrim County’s 86th District Court to ask for his bail restrictions to be lifted. Molitor is one of five men being charged in the Antrim County court because of their connection to a surveillance trip to Gov. Whitmer’s vacation home in Elk Rapids. He was charged with providing material assistance to a terrorist organization & a felony firearm offense. Molitor has been on house arrest for five months since making bail on January 14. His lawyer asked the court to change the conditions so that he could work a job early in the morning, before his curfew allowed. Furthering his support of limited restrictions, Molitor’s lawyer argued that his client was not a willing participant. He admitted Molitor went on the surveillance trip but was scared of his companions, who had come armed. He added that Molitor was not a threat to the public & that other men alleged to have committed similar crimes have had their bail conditions relaxed. Prosecutors supported changing the curfew conditions if Molitor was provided a job offer, but asked for continued GPS monitoring. They argue Molitor was more than willing to participate in the surveillance. In court filings, prosecutors said he was close with Wolverine Watchmen ring-leader Adam Fox. They allege Molitor took photos & video of the governor’s home using Fox’s phone & tracked the distance to nearby police departments. The judge eliminated the curfew requirement but kept Molitor’s GPS tether in place. No further dates stated.
4/27/22 Update: Fix, Molitor, Higgins, Michael & William Null - are awaiting a preliminary exam in Antrim County. That hearing is set for 8/29/22 in the 86th District Court.

4/27/22 Update: The Hull bros. will continue to be monitored by GPS tethers while on bond, 86th District Judge Michael Stepka said Wednesday, April 14, 2021. The judge, however, lifted a house-arrest provision for Michael Null of Plainwell * William Null of Shelbyville so that they could work late & meet with attorneys – or have dinner with families at restaurants. The judge, who earlier ruled that the brothers could be released by posting 10 percent of $250K bonds, said they would continue to be monitored by tether. Fix, Molitor, Higgins, Michael & William Null - are awaiting a preliminary exam in Antrim County. That hearing is set for 8/29/22 in the 86th District Court.

The reason for the delay is the recent increase in COVID-19 cases across northern Michigan. Twin brothers accused in the plot to kidnap Governor Gretchen Whitmer have been released from house arrest. Maxwell Wyckoff, 22, of Clarkston, a Wolverine Watchmen militia member whose associates are accused in the kidnap plot, is charged with converting a semiautomatic weapon to an automatic weapon, a felony punishable by up to four years in prison; and possessing a muffler or silencer device, a felony punishable by up to five years in prison.
4/27/22 Update: The Hull bros. will continue to be monitored by GPS tethers while on bond, 86th District Judge Michael Stepka said Wednesday, April 14, 2021. The judge, however, lifted a house-arrest provision for Michael Null of Plainwell * William Null of Shelbyville so that they could work late & meet with attorneys – or have dinner with families at restaurants. The judge, who earlier ruled that the brothers could be released by posting 10 percent of $250K bonds, said they would continue to be monitored by tether. Fix, Molitor, Higgins, Michael & William Null - are awaiting a preliminary exam in Antrim County. That hearing is set for 8/29/22 in the 86th District Court.
*Shawn Michael Fix (38/now 39) of Belleville arrested & charged (10/7/20) & arraigned (10/9/20) with providing material support for terrorist acts & carrying or possessing a firearm during the commission of a felony. Plead not guilty. $250K cash/surety bond. Bond out on 11/10/20.

11/18/20 Update: Higgins is planning to challenge his extradition to Michigan, his lawyer said Wednesday. Michigan’s extradition paperwork for Higgins of Wisconsin Dells, Wisconsin, is improper because it was signed by Whitmer, the target of the alleged plot, Higgins’ lawyer argued in a court filing in advance of Wednesday's status conference in Columbia County Circuit Court in Wisconsin. “To put it more bluntly, the requisition was signed in an official capacity by someone with a clear, undeniable conflict of interest in the case against Higgins: the Michigan (governor), who as the named alleged victim has a direct and utterly undeniable personal interest in this matter,” Higgins’ attorney, Christopher Van Wagner, wrote in the filing. Despite Higgins’ objections to his extradition, he was to be processed after Wednesday's hearing by the Columbia County Sheriff’s Office & held in custody until a bond hearing on Thursday, 11/19/20.

4/15/21 Update: New court documents indicate that Higgins voluntarily decided to dismiss his appeal with advice of his legal counsel, which will allow the Columbia County Sheriff’s Office to give Michigan agents custody of Higgins to transport him to Michigan once accepted by the court. He has been in the Columbia County Jail since November as court proceedings continued & remained in Columbia County custody as of Friday afternoon, according to online records. Court proceedings began moving forward in Michigan Monday.

8/4/21 Update: Higgins was initially imprisoned in Columbia County, but his case has since been extradited to Michigan despite an appeal. As conditions of his release, Higgins has to wear a GPS tracking device & surrender his passport to authorities & other restrictions. 12/1/21 Update: Competency hearing. Defendant appeared with attorney M. Naughton & AG S. Doddamani present; all parties appeared via video/Zoom. Competency hearing not held. Parties stipulated to finding of competency on report. 6/29/21 Update: Eric Molitor went before Antrim County’s 86th District Court to ask for his bail restrictions to be lifted. Molitor is one of five men being charged in the Antrim County court because of their connection to a surveillance trip to Gov. Whitmer’s vacation home in Elk Rapids. He was charged with providing material assistance to a terrorist organization & a felony firearm offense. Molitor has been on house arrest for five months since making bail on January 14. His lawyer asked the court to change the conditions so that he could work a job early in the morning, before his curfew allowed. Furthering his support of limited restrictions, Molitor’s lawyer argued that his client was not a willing participant. He admitted Molitor went on the surveillance trip but was scared of his companions, who had come armed. He added that Molitor was not a threat to the public & that other men alleged to have committed similar crimes have had their bail conditions relaxed. Prosecutors supported changing the curfew conditions if Molitor was provided a job offer, but asked for continued GPS monitoring. They argue Molitor was more than willing to participate in the surveillance. In court filings, prosecutors said he was close with Wolverine Watchmen ring-leader Adam Fox. They allege Molitor took photos & video of the governor’s home using Fox’s phone & tracked the distance to nearby police departments. The judge eliminated the curfew requirement but kept Molitor’s GPS tether in place. No further dates stated.

He argued the twins never left a Walmart parking lot in Cadillac. An assistant attorney general argued the brothers were being driven to do surveillance on Whitmer's summer home, and that they didn't want to turn back & did leave the parking lot. Preliminary hearing was rescheduled to 2/17/21 & if necessary on 2/18/21.

11/18/20 Update: Higgins is planning to challenge his extradition to Michigan, his lawyer said Wednesday. Michigan’s extradition paperwork for Higgins of Wisconsin Dells, Wisconsin, is improper because it was signed by Whitmer, the target of the alleged plot, Higgins’ lawyer argued in a court filing in advance of Wednesday's status conference in Columbia County Circuit Court in Wisconsin. “To put it more bluntly, the requisition was signed in an official capacity by someone with a clear, undeniable conflict of interest in the case against Higgins: the Michigan (governor), who as the named alleged victim has a direct and utterly undeniable personal interest in this matter,” Higgins’ attorney, Christopher Van Wagner, wrote in the filing. Despite Higgins’ objections to his extradition, he was to be processed after Wednesday's hearing by the Columbia County Sheriff’s Office & held in custody until a bond hearing on Thursday, 11/19/20.
2/18/21 Update: Antrim County – Fix of Belleville, Molitor of Cadillac, M. Null of Plainwell & W. Null of Shelbyville were recently granted a 60-day adjournment with new preliminary examination dates pending. Defense attorneys said they needed more time to review evidence that’s yet to be turned over by the Attorney General’s Office. The awaited information was expected to be turned over to the defense within two weeks (around 3/11/21). Brian Higgins is another suspect charged in Antrim County, but he is currently fighting extradition from his home in Wisconsin Dells, Wisconsin.
4/15/21 Update: New court documents indicate that Higgins voluntarily decided to dismiss his appeal with advice of his legal counsel, which will allow the Columbia County Sheriff’s Office to give Michigan agents custody of Higgins to transport him to Michigan once accepted by the court. He has been in the Columbia County Jail since November as court proceedings continued & remained in Columbia County custody as of Friday afternoon, according to online records. Court proceedings began moving forward in Michigan Monday.
5/19/21 Update: In exchange for leniency, a Michigan man has agreed to help prosecutors in their efforts to convict fellow members of a militia group accused of plotting to kidnap Gov. Gretchen Whitmer. Maxwell Wyckoff, 22, of Clarkston, a Wolverine Watchmen militia member whose associates are accused in the kidnap plot, is charged with converting a semiautomatic weapon to an automatic weapon, a felony punishable by up to four years in prison; and possessing a muffler or silencer device, a felony punishable by up to five years in prison.
8/4/21 Update: Higgins was initially imprisoned in Columbia County, but his case has since been extradited to Michigan despite an appeal. As conditions of his release, Higgins has to wear a GPS tracking device & surrender his passport to authorities & other restrictions. 12/1/21 Update: Competency hearing. Defendant appeared with attorney M. Naughton & AG S. Doddamani present; all parties appeared via video/Zoom. Competency hearing not held. Parties stipulated to finding of competency on report. AG to provide order. Case to be set for preliminary hear per Judge Stepka. Hold pending next hearing.
