The six charged in federal court are:

Prosecutors requested a 40-day extension, until Dec. 16, to seek an indictment against the men, who face up to life in prison if convicted of the conspiracy charge. The request is unopposed by defense lawyers, according to the court filing.

It does look like LE dove deep here, and I agree with you about a hard prosecution but I think this evidence is going to be so strong, they will crawl for plea deals. Even ole Barry. :D

I am also glad to see that the case does not appear to rest heavily on the future testimony of paid informants. Likewise, though informants were present, they do not appear to have been recruiters or leaders.

Rather, the evidence seems to be primarily based on what actions the defendants took independently, including leadership roles, or what they independently discussed.

In the past, over reliance on mercenary (paid) informants in leadership roles in extremism trials involving far right, extreme left and Islamic defendants has led to defensive counters.

These counters have included that paid informants repeatedly badgered reluctant defendants, used romantic advances, plied the defendants with alcohol or marijuana, used psychological pressures- including eliminating raised excuses from participating, or repeatedly showing unenthused defendants "get angry" videos. Other counters included that informants used false pretenses to get a defendant to handle incriminating evidence.

Though some of these counters were rejected, some were accepted by juries, judges or appellate courts. This has led to distrust of paid informants- especially if the case is heavily reliant on them.

10/7/20 Update: His arraignment is pending in Antrim County. 10/9/20 Update: Arraigned Friday morning via Zoom in Antrim County. A not guilty plea was entered for Fix. He is being held in lieu of $250,000 bail, cash/surety & will have to wear a GPS tether & remain under home arrest if bond is posted. He cannot leave the state of Michigan or possess weapons. Fix isn’t allowed to have any contact with Whitmer or anyone related to her, or to go within 500 yards of her workplace and residences. “You’ll have no contact, in any manner whatsoever, with any member of the group known currently as Wolverine Watchmen, or any other member of any terrorist, militia, or other similar group,” 86th District Court Magistrate Tammy Rodgers said. A probable cause conference will be scheduled on or before Oct. 21, and a preliminary examination is scheduled for 1:30pm on Oct. 28. 10/21/20 Update: Next preliminary exam hearing on 10/28/20.
*Brian Higgins (51) of Wisconsin Dells, WI. arrested & charged (10/15/20) with material support of an act of terrorism. Will be extradited to Antrim County. Wisconsin: Bail $10K Cash (10/19/20 paid cash-released).
10/15/20 Update: Brian Higgins (51) of Wisconsin Dells was arrested in Wisconsin on Thursday (10/15/20) & will be extradited to northern Michigan's Antrim County, where 3 of the other 13 suspects in the alleged kidnapping plot have been arraigned. Higgins participated in surveillance of Whitmer’s vacation home. He also provided night-vision goggles & used a dash camera in his vehicle to record footage of the surveillance. Higgins faces up to 20 years in prison and/or a $20K fine, has been charged with material support of an act of terrorism.
10/19/20 Update: Higgins appeared via video Monday in Columbia County court. Columbia County District Attorney Brenda Yaskal requested a $1 million bail for Brian Higgins, but Judge Todd Hepler set the lower amount of $10K. 10/19/20 paid cash bail-released. Higgins is due back in Columbia County court on Nov. 18. He has been ordered to surrender his passport & not to leave Wisconsin. He also can’t have any contact with others charged in the case.

Four men accused of taking part in a plot to kidnap and execute Gov. Gretchen Whitmer won’t see a courtroom until December. The delay means the men’s joint preliminary exam, originally set for Tuesday in an Antrim County courtroom, won’t offer a first glimpse of case facts and testimony for weeks to come.

Lawyers for the men charged — Michael Null, William Null, Eric Molitor and Shawn Fix — needed more time to review case materials. Fix and the Null brothers were each held on $250,000 cash bonds, and Molitor was given a $250,000, 10 percent bond. They remain in police custody, records show.

A fifth man to be charged in Antrim County, 51-year-old Wisconsin resident Brian Higgins, has yet to be arraigned. Higgins, who remains in Wisconsin awaiting extradition, has been released on bond.

Fix, the Nulls and Molitor return to court on Dec. 16.

A probable cause conference is set for Dec. 2.

I’m seeing on wistv.com (local to Columbia SC) where one of these suspects had written of taking the SC governor “into custody” also. Local state LE (SLED) complains that the feds didn’t let them know of it.

FBI Special Agent Richard Traskalso said they also talked about "taking out" a second politician, Virginia Gov. Ralph Northam. The bond hearing provided new details about how investigators infiltrated the alleged conspiracy with informants and undercover agents. And testimony portrayed members of the alleged conspiracy as security-conscious schemers who were caught despite using encrypted chat applications & foul-mouthed code names for each other. The three defendants are: Kaleb James Franks, 26, of Wexford, known as "Red Hot". Daniel Joseph Harris, 23, of Lake Orion, known as "Beaker". FBI Special Agent Richard Trask discussed the roots of the investigation and motivation of six men charged in federal court with conspiring to kidnap Whitmer. U.S. Magistrate Judge Sally Berens ordered the 5 men to stand trial on a conspiracy to commit kidnapping charge that is punishable by up to life in federal prison. For: Adam Fox, Ty Garbin, Kaleb Franks, Daniel Harris & Brandon Caserta. Adam Fox, who prosecutors say headed an alleged conspiracy to kidnap Gov. Gretchen Whitmer waived his detention hearing & will remain in jail pending trial in federal court. Fox is jailed without bond in Newaygo County. Next status conference hearing on 11/4/20. Garbin is jailed without bond in Newaygo County. Next status conference hearing on 11/4/20. Magistrate Berens denied bond for Franks. Franks is currently jailed under federal custody in Newaygo County. Harris, deemed a “serious risk” to the community, is jailed in Newaygo County in federal custody pending trial. U.S. Magistrate Sally J. Berens ordered Caserta to remain jailed without bond pending trial. He’s currently jailed under federal custody in Newaygo County. An order to transport Croft from Delaware to Michigan was issued 10/13/20. He did not appear in federal court along with his co-defendants last week & no bond hearing has been held or scheduled.
10/27/20 Update: Federal agents recently found "explosive device components" while investigating six men accused of plotting to kidnap Gov. Gretchen Whitmer ^ need more time to consider seeking federal terrorism charges, according to a court filing Monday. The disclosure was included in a filing by federal prosecutors who asked a federal judge to give the government more time to seek an indictment against the six men who are being held without bond. Prosecutors also need more time to sift through evidence collected during the investigation. That evidence includes hundreds of hours of undercover audio recordings & more than 13,000 pages of encrypted text messages. "The evidence also included potentially illegal firearms & explosives evidence, which must be examined by FBI & ATF experts to determine whether additional federal charges are appropriate," Assistant U.S. Attorney Nils Kessler wrote. Prosecutors requested a 40-day extension, until Dec. 16, to seek an indictment against the men, who face up to life in prison if convicted of the conspiracy charge. The request is unopposed by defense lawyers, according to the court filing.

10/23/20 Update: Jackson County Judge Michael Klaeren slashed bond from $10 million to $100,000. A defense attorney argued that Musico actually was kicked out of the group because he was too “soft” & wouldn't commit to violence. If he posts bond he must wear a GPS tether. The judge noted that Musico has a job, ties to the community and “20-plus years of law-abiding conduct.” Next Probable cause hearing on 12/4/20.

11/18/20 Update: Higgins is planning to challenge his extradition to Michigan, his lawyer said Wednesday. Michigan’s extradition paperwork for Higgins of Wisconsin Dells, Wisconsin, is improper because it was signed by Whitmer, the target of the alleged plot, Higgins’ lawyer argued in a court filing in advance of Wednesday's status conference in Columbia County Circuit Court in Wisconsin. “To put it more bluntly, the requisition was signed in an official capacity by someone with a clear, undeniable conflict of interest in the case against Higgins: the Michigan (governor), who as the named alleged victim has a direct and utterly undeniable personal interest in this matter,” Higgins’ attorney, Christopher Van Wagner, wrote in the filing. Despite Higgins’ objections to his extradition, he was to be processed after Wednesday's hearing by the Columbia County Sheriff’s Office & held in custody until a bond hearing on Thursday, 11/19/20.

LANSING, Mich. – The men accused of attempting to kidnap and possibly kill Gov. Gretchen Whitmer also had two other plots to kill Michigan politicians involving public executions and mass murder in the ongoing case, according to newly discovered court filings in a Michigan district court.

According to the recent filings, members of the group had a Plan B which was initially Plan A. The group wanted to storm the capitol with 200 men, “take hostages, execute tyrants and have it televised...” The plan they said would take roughly one week adding “no one is coming out alive.”

The original Plan B was less complicated. The group would storm the capitol while the legislature was in session, lock the doors and burn the capitol to the ground. One associate had allegedly attempted to take “selfies” to document entrances and exits at the capitol at a recent rally...
