Okay - thanks for the great info @Seattle1 - so you think they will have another case opened with the new charges on the Jackson County court site? I just have to keep looking, eh?

I'm adding Michigan together with New Jersey as my least favorite states for case info!!

I looked up all three defendants and it seems that only charge 1 of 4 was dismissed and the remaining charges for gang membership, firearm, and providing material support are all bound over for Trial in Dist Court for each so I don't know why the status is shown as closed. I don't know what other court they would be in but District 12. Sorry, @Niner.

maybe @JerseyGirl - you seem to find recent articles - was wondering about ALL of them except for Garbin. I have him for sentencing on 7/8/21.

Last hearing I have for Fox, Franks, Harris & Caserta is 2/17/21 with trial on 10/23/21. Croft's last hearing was 10/13/20.

Antrim County - I have Fox, both Nulls & Fix last hearing on 4/14/21. And Higgins' last hearing 11/19/20.

I looked up the Jackson County guys - Bellar, Musico & Morrison - no new case has been opened for them. Last hearing was 3/29/21 a preliminary hearing when the cases were dismissed. But there are new charges - right?

A Michigan judge on Monday ordered three men to stand trial in a plot to kidnap Democratic Michigan Gov. Gretchen Whitmer over her coronavirus restrictions.

Jackson County District Court Judge Michael Klaeren ruled there was enough evidence and bound over Paul Bellar, Joe Morrison and Pete Musico to circuit court to stand trial.

“The defendants are joined at the hip here,” Klaeren said before announcing his ruling. “The prosecution did a good job in establishing who knew what and when.”

The three men are accused of aiding six others who are charged in federal court with conspiring to kidnap Whitmer. Five more people are also charged in state courts.

Klareen said there was enough evidence for trial on charges of [1] providing material support for terrorist acts, [2]gang membership and [3]using a firearm during a felony. Klaeren dismissed a charge of threat of terrorism against Musico and Morrison. Bellar didn’t face that charge.

Michigan man turns on militia, agrees to cooperate in Gov. Whitmer kidnapping plot prosecution

In exchange for leniency, a Michigan man has agreed to help prosecutors in their efforts to convict fellow members of a militia group accused of plotting to kidnap Gov. Gretchen Whitmer.

Maxwell Wyckoff, 22, of Clarkston, a Wolverine Watchmen militia member whose associates are accused in the kidnap plot, is charged with converting a semiautomatic weapon to an automatic weapon, a felony punishable by up to four years in prison; and possessing a muffler or silencer device, a felony punishable by up to five years in prison.

Judge Michael Klaeren of 12th District Court in Jackson dismissed the charge against Morrison & Musico & declined a request by prosecutors to add it to the charges against Bellar. Klaeren also on Monday ordered Bellar, Morrison & Musico to stand trial on three remaining charges, gang membership & providing material support for terrorism, both punishable by up to 20 years in prison, as well as felony firearm, punishable by up to 2 years in prison. In a statement, Attorney General Dana Nessel said the state would "explore all options for reconsideration of the charge moving forward." Klaeren cited two other alleged plotters who are charged in federal cases in his ruling on Monday: Adam Fox & Barry Croft & referred to "the material support (Morrison & Musico) provided to the terrorist Adam Fox" as a reason to bind them over for trial. 4/6/21 Update: Court case is closed. It likely the Attorney General /Prosecutor probably dropped the remaining charges when they lost the terrorism threat, and the material support charge was weak. Attorney General Dana Nessel said the state would "explore all options for reconsideration of the charge moving forward." The gang membership charge and the felony firearms charge were dependent on the material support for terrorism charge, [Judge] Klaeren said. But just as the secret nature of the group's communications is why the terrorism threat charge was tossed, Klaeren used it as a reason why the gang membership charge could not be dismissed without examining the material support charge.

Adam Dean Fox, Barry Croft, Kaleb James Franks, Daniel Joseph Harris, Brandon Caserta & Gerard Garbin plead guilty on 1/27/21 & will be sentence on 7/8/21. All charged with Federal crimes; trial to start on 10/12/21.

I have Garbin (Federal) for sentencing on 7/8/21.

10/9/20 Update: First appearance for detention hearing in court on Tuesday, 10/13/20 at 9:30am in front of U.S. Magistrate Judge Sally Berens in federal court in Grand Rapids for Fox, Garbin, Franks, Harris & Caserta. Croft has detention hearing in Delaware on 10/13/20 @ 2:45pm. 10/13/20 Update: During the brief hearing in Wilmington, Delaware, Croft waived his right to a detention hearing there but reserved his right to one in Michigan. An order to transport Croft from Delaware to Michigan was issued 10/13/20. He did not appear in federal court along with his co-defendants last week & no bond hearing has been held or scheduled.
11/2/20 Update: Croft has not appeared in the district,’’ Judge Berens wrote. “Indeed, defendants do not oppose this motion.’’ Croft lives in Delaware. The others are from Michigan. Under the Oct. 30 order, the government has until Dec. 16 to obtain an indictment.
4/5/21 Update: A document filed in federal court lists over 200 items attorneys are looking to seize from locations where several men suspected to be involved in a plot to kidnap Gov. Gretchen Whitmer met & trained. The Bill of Particulars for Forfeiture of Property span 18 pages, filed in US District Court of Western Michigan’s Southern Division & Hon. Robert J. Jonker against Adam Fox, Barry Croft, Ty Garbin, Kaleb Franks, Daniel Harris & Brandon Caserta. The prosecution also reserves the right to seek the forfeiture of later-identified assets pursuant to the notice provided. The Forfeiture Allegation filed on Tuesday [3/30/21] provided notice to the defendants that upon conviction, the U.S. would seek forfeiture of any firearms & ammunition involved in the commission of the crime.
6/1/21 Update: Federal prosecutors do not oppose public release of exhibits in the alleged plot to kidnap Gov. Gretchen Whitmer. The government had previously released exhibits that were offered as evidence against five co-defendants in October but Croft’s transfer from the Philadelphia Federal Detention Center to Michigan was delayed. Buzzfeed’s attorney, Joseph Richotte, said the government in January offered nine exhibits – including photos, decrypted text messages & audio & video recordings – in support of Croft being held until trial. U.S. District Court in Grand Rapids provided live audio of the hearing but recordings -- and photographs -- are prohibited in federal court. Assistant U.S. Attorney Nils Kessler said that court records are presumed to be accessible to the public but access is not an absolute right. He noted that Croft’s attorney objected to release of the exhibits while attorneys for the others did not. He said the exhibits in both proceedings were similar. U.S. Magistrate Judge Sally Berens in Grand Rapids set a June 16 hearing to consider the motion for Croft only. In late April, the U.S. Attorney’s Office filed new charges against Croft, Fox and Harris for conspiracy to use a weapon of mass destruction for the alleged plot to blow up the bridge near the governor’s vacation home. Croft and Harris are also facing new charges of knowingly possessing a destructive device.

Judge weighs bid to release Whitmer kidnapping evidence to news groups

Lawyers for several news outlets are seeking access to the exhibits, arguing the public has the right to review them to understand why Delaware resident Barry Croft was ordered held without bond pending trial this fall.

They made their arguments, contending that access to the exhibits used at Croft's bond hearing will not automatically taint a jury pool and that both parties in the case have the opportunity to screen potential jurors.

Croft is one of five people awaiting trial on a kidnapping conspiracy charge that could send them to federal prison for life. A sixth man, Hartland Township resident Ty Garbin, has pleaded guilty and is cooperating with the government.

Bond conditions loosened for man accused in Whitmer kidnap plot

Eric Molitor, of Cadillac, went before Antrim County’s 86th District Court to ask for his bail restrictions to be lifted.

The pretrial hearing for the men was originally set for December last year, but it's been postponed several times due to attorneys needing more time to prepare, and now to wait until the court can meet again in person.

*Sentencing Hearing (Federal case) (@ am CT) - MI – Plot to kidnap Michigan Governor Gretchen Whitmer - only for *Ty Gerard Garbin (24) (born 1995) of Hartland arrested & charged (10/8/20) & indicted (12/17/20) with conspiracy to commit kidnapping. All charged with a federal crime. All are being held without bond. All plead not guilty (12/17/20).
2/11/21 Update: A federal judge Wednesday delayed the trial of five men accused of plotting to kidnap Gov. Gretchen Whitmer by almost seven months to give defense lawyers more time to prepare. The move by U.S. District Judge Robert Jonker to reschedule the trial from March 23 to Oct. 12 in federal court in Grand Rapids follows a request from defendant Brandon Caserta who cited voluminous evidence amassed during the FBI investigation. The trial is scheduled to start Oct. 12 in federal court in Grand Rapids. Ty Garbin, who plead guilty will be sentenced on July 8.

*Adam Dean Fox (37) (born 1983) of Grand Rapids, *Barry Gordon Croft, Jr. (44) (no birth date given) from Bear, Delaware (waiting to be extradited to MI), *Kaleb James Franks (26) (born 1994) of Wexford, *Daniel Joseph Harris (23) (born 1997) of Lake Orion & *Brandon Michael-Ray Caserta (32) (born 1988) of Canton arrested & charged (10/8/20) & indicted (12/17/20) with conspiracy to commit kidnapping. All charged with a federal crime. All are being held without bond. All plead not guilty (12/17/20).
Trial set to begin on 10/12/21. (expected to last 3 weeks) for Fox, Croft, Franks, Harris & Caseta.

4/5/21 Update: A document filed in federal court lists over 200 items attorneys are looking to seize from locations where several men suspected to be involved in a plot to kidnap Gov. Gretchen Whitmer met & trained. The Bill of Particulars for Forfeiture of Property span 18 pages, filed in US District Court of Western Michigan’s Southern Division & Hon. Robert J. Jonker against Adam Fox, Barry Croft, Ty Garbin, Kaleb Franks, Daniel Harris & Brandon Caserta. The prosecution also reserves the right to seek the forfeiture of later-identified assets pursuant to the notice provided. The Forfeiture Allegation filed on Tuesday [3/30/21] provided notice to the defendants that upon conviction, the U.S. would seek forfeiture of any firearms & ammunition involved in the commission of the crime.

And.... Jackson County guys - are okay - I have them for a hearing on 7/23/21.
